St. Lucie Cultural Alliance Presentation Alyona Ushe, Executive Director of Art Alliance, Chair of Cultural Alliance, Rebecca Miller, and Jake Sanders, Community Engagement Manager, presented to the Board. The Cultural Gem of the Treasure Coast, where intimate theaters and music venues attract local and national talent. Artists of all cultural disciplines: visual, performing, culinary, fashion, film, multidisciplinary, and others, produce festivals and events unique to our County's character and pulse. Also, street performers, live painters, dancers, and musicians breathe life into our streets and draw international tourists and inspire staycations. The students of Cultural Alliance's imaginations explode with creativity, and their academic performance improves while being the driving force for conservation. These services are considered eligible costs to FDOT and are grant reimbursable under the existing FDOT Airfield Lighting and Signage Grant. Pruitt Corp This item is the bid award for the construction services for the Airport's Airfield signage and Electrical Upgrade Project. The bid award amount is $1,963,160.00 for the total bid (Base Bid A & B, Add. Alt 1 &2). This project is supported by an FDOT Public Transportation Grant Agreement, with FDOT providing $1,736,286.00 and St. Lucie County providing $434,071.00, totaling $2,170,357.00. Staff recommended bid award of Bid No. 22-007 to the lowest and responsive bidder, H.L. Pruitt Corp, for the Airfield Signage and Electrical Upgrade Project in the amount of $1,963,160.00 and authorization for the Chair to sign contract documents as approved by the County Attorney. Grant Amendment and Grant Amendment Resolution Acceptance for the Airfield Lighting and Signage Project This Public Transportation Grant Agreement Amendment is for the construction phase of the Airport's Airfield Lighting and Signage Project. This amendment is for supplemental funding to cover the shortfall in funding on this project. This grant amendment will provide an additional $136,286.00 in State funding with a local match requirement of $34,071.00. Staff recommended Board acceptance of the grant amendment and authorization for the Chair to grant amendment documents as approved by the County Attorney. Adopted by Consent Vote D. COMMUNITY SERVICES 1. Work Camper Agreement - Kenneth Salyers— Petravice Family Preserve The "Work Camper" program was established for St. Lucie County Environmentally Significant Lands (ESL's) program in 2002. Becker Eco-Heritage Preserve The "Work Camper" program, established in 2002, typically provides a volunteer with a space and utility hook up for a recreational vehicle for use as a temporary residence. At the Richard E. Becker Preserve, staff renovated a small portion in the rear of the detached garage to provide a 400 square foot studio apartment for residential use. In exchange for the residence, the volunteer will provide a minimum of twenty (20) hours of service each week. Staff recommended Board approval of Work Camper Agreement with Mr. Charlie Bouck and authorization for the Chair to sign documents as approved by the County Attorney. Staff recommended Board approval to enter into a five (5) year contract continuation with Trane U.S. for the maintenance of three Water Chilled Optimus Chillers at the St. Lucie County Court Complex, and authorization of the Chair to sign documents as approved by the County Attorney. Budget Resolution Recognizing Unanticipated Revenue FY'22 Staff recommended approval of this agenda item to recognize the funds to amend the budget by $4,398,696.00. Adopted by Consent Vote 2. Request for Qualifications (RFQ) No. 21-069, Professional Engineering Services - Lakewood Park Stormwater Improvements Staff recommended Board approval of the short-listed firms for RFQ No. 21-069 and permission to: • Conduct discussions/presentations with the short-listed firms; • Conduct contract negotiations with the short-listed firm; • If negotiations are successful, award contract to the successful short-listed firm and authorization for the Chairman to sign the documents as prepared by the County Attorney. Community Development Block Grant (CDBG) - Mitigation Grant Acceptance Request in the amount of $210,000.00 for the development of the St. Lucie County Mobility Infrastructure Plan Staff recommended Board acceptance of the Florida Department of Economic Opportunity Community Development Block Grant - Mitigation award in the amount of $210,000.00, with matching funds of $40,000.00 and authorization for the Chair to sign documents as approved by the County Attorney. Adopted by Consent Vote I. PUBLIC UTILITIES 1. Award CDM Work Authorization No. 16 - St. Lucie County Baling and Recycling Facility Phase 11113 and IVA Landfill Gas System Design and Permitting. A landfill gas (LFG) system is required to be installed in Phase IVA to comply with the New Source Performance Standards (NSPS) requirements and to collect gas for beneficial reuse and odor reduction. The LFG system for Phase IVA will need to be designed and permitted with the Florida Department of Environmental Protection (FDEP) prior to installation. Staff recommended Board approval and authorization for the Chair to execute CDM Smith Work Authorization No. 16 under Contract C19-09-790 for professional engineering services for not -to - exceed total cost of $148,675.00. Reallocation of a Portion of the Approved Sales Tax Project Budget from the Glades Cut Off Road Resurfacing Project to the Midway Road Resurfacing and Guardrail Project - THIS PROJECT IS FUNDED BY THE INFRASTRUCTURE SALES TAX Staff recommended the Board approve reallocation of $750,000.00 of the funds budgeted for the Glades Cut Off Road resurfacing project to the Midway Road resurfacing and guardrail project. Adopted by Consent Vote 9. PUBLIC HEARINGS A. ADMINISTRATION 1. BOCC Redistricting - con't from 12/7 Mark Satterlee, Deputy County Administrator, presented this item to the Board. Every ten (10) years in the year after the United States Decennial Census, counties in Florida are required by the Florida Constitution and Florida Statutes to examine the results of the Census and rebalance commission districts by population. The population of St Lucie County has increased by more than 50,000 people since the 2010 Census. The County's population from the 2020 Census is now 329,226, up from 277,789 in 2010. A majority of the growth occurred in the City of Port St. Lucie, which increased 22.9% to 201,851 residents compared to 164,203 in 2010. Overall, the County's population increased by 18.5%. The population changes in each district highlight the need to rebalance the five districts' population. Staff has prepared three draft redistricting map scenarios for the Board to select from and adopt as the new Commission district map. Staff originally prepared five (5) scenarios and presented them to the Board at the Informal Meeting on October 12, 2021. In that meeting, the Board had a consensus on reducing the number of scenarios to the three (3) attached to the agenda item. Staff also staged an open house for the public to see each scenario in the Commission Chamber on November 4, 2021. The scenarios have been posted on the County's website since mid -October. To date, public comment has been somewhat limited and what has been received is part of the backup agenda. Consistent with the 2011 redistricting process, public comment has primarily included North and South Hutchinson Island in the same commission district. Also, consistent with the 2011 redistricting process, the St Lucie County School District has indicated a desire to have their districts mimic the Board of County Commissioners Districts. To that end, each scenario maintains the school board members in their current districts. Adoption of the new commission districts does not require a public hearing. However, consistent with policy, staff has placed the item on the agenda as a 9 1 P a g e BOCC Regular Meeting Tuesday, December 14, 2021 9:00 AM public hearing. State statute provides some additional rudimentary steps to which the County must adhere in the adoption process. In adopting new districts, the Board must also: • Enter an accurate description of the new boundaries as changed into the Board meeting minutes. The County Surveyor has created descriptions of the new districts. • Publish a certified copy of the proposed new districts at least once each week for two consecutive weeks in a local newspaper. • Include proof of such public in the Board meeting minutes. The current district map was adopted in 2011. The Board initially heard the item on December 7, 2021, and decided to continue the item to December 14, 2021, so the entire Board could be present. OFFICE OF MANAGEMENT & BUDGET 1. Resolution - Fiscal Year 2021-2022 Budget Amendment Jennifer Hill, Office of Management & Budget Director, presented this item to the Board. With Fiscal Year 2020-2021 complete, staff has calculated the current beginning balances of numerous funds. Therefore, the additional balance forward that was not appropriated in the fiscal year 2022 adopted budget, adjusting beginning balances and adjusting inter -fund transfers related to these balances. This Resolution establishes the fiscal year 2022 budget for unanticipated revenue totaling $86,784,337 and appropriates these fund balances to their applicable funds and budgets. The public hearing was advertised on December 9, 2021. On September 23, 2021, the Board held a public hearing and adopted the 2021-2022 budget. This Resolution increases the budget by $86,784,337. Staff recommended approval of the budget resolution amending the fiscal year 2021-2022 budget. Chair Mitchell opened the hearing for public comment at this time. PUBLIC SAFETY 1. St Lucie County Certificate of Public of Convenience and Necessity Application - National Health Transport Karen Kozac, Public Safety Radiological Coordinator, and Caroline Valentin, Assistant County Attorney, presented this item to the Board. The National Health Transport has applied for a Class B Certificate of Public Convenience and Necessity (COPCN). On November 9, 2021, the Emergency Medical Services Advisory Council included Commission appointees. A representative from Lawnwood Regional Medical Center, and St. Lucie Medical Center, reviewed the application and determined the application complied with the standards of review outlined in Section 18-54 of the St. Lucie Code of Ordinances. Accordingly, the council voted 6-0 to approve the application. The Public Safety Director has notified Fort Pierce and Port City's City managers. St. Lucie of the pending application. To date, no response has been received from the cities. Copies of the application and Sections 18-54 and 18-56 of the St. Lucie County Code of Ordinances have been provided. Staff recommended the Board determine the application of National Health Transport for a Class B Certificate of Public Convenience and Necessity meets the standards of review outlined in Section 18-56, approve the application, and authorize the Chair to sign the Class B Certificate of Public Convenience and Necessity. The Board discussed the perception of the overall process, complaints, and customer service feedback and decided to revisit the item as new data from the current needs survey analysis 121Page BOCC Regular Meeting Tuesday, December 14, 2021 9:00 AM comes in. Staff advised an ordinance revision with new data analysis will be done at the beginning of the year. Based on the current needs survey assessment and completion, a copy will be sent to all internal and external stakeholders. A recommendation will be made to the EMS Advisory Board and the St. Lucie County Board of Commissioners to reopen the item for the application for a Class B Certificate of Public Convenience and Necessity (COPCN). Opioid Litigation - Approval of Opioid Interlocal Agreement; Approval of Resolution Creating Opioid Funding Advisory Committee Dan McIntyre, County Attorney, and Alphonso Jefferson, Deputy County Administrator, presented this item to the Board. St. Lucie County has filed suit against various companies in what has been referred to as the "National Prescription Opiate Litigation." The State of Florida has also filed suit against the same companies. The State of Florida and lawyers representing various local governments, including St. Lucie County, have proposed a unified plan for allocating and using prospective settlement dollars from opiate litigation. On June 1, 2021, the Board approved Resolution No. 21-085 approving the Florida Memorandum of Understanding (MOU) for the Florida Plan. The State Memorandum of Understanding (MOU) sets forth the amount and manner of distribution of City/County and Regional Settlement funds within Florida, the requirements to receive and manage regional funds, and the purposes for which regional funds may be used. Local control over settlement funds is in the best interest of all persons within the geographic boundaries of St. Lucie County. It ensures that settlement funds are available and used to address opioid-related impacts within St. Lucie County. St. Lucie is eligible to be a "Qualified County" and receive regional funds according to the State Memorandum of Understanding (MOU). For St. Lucie County to become a Qualified County eligible to receive Regional Funding, there must be an interlocal agreement among St. Lucie County and Municipalities, as defined in the MOU, with a combined population exceeding 50% of the total population of the Municipalities within St. Lucie County. In this regard, the Interlocal Agreement between the County and the Cities of Port St. Lucie and Fort Pierce govern the use of Regional Opioid Settlement Funds 131Page BOCC Regular Meeting Tuesday, December 14, 2021 9:00 AM received by the County. The Interlocal Agreement contemplates the creation of a seven -member "Opioid Abatement Funding Advisory Board" by Resolution. These are existing road conditions that do not meet design standards. Implementing the project will improve the existing conditions and make Midway Road safer for the traveling public. Every ten (10) years in the year after the United States Decennial Census, counties in Florida are required by the Florida Constitution and Florida Stabiles to examine the remits of the Census and rebalance commission districts by population. The population of St Lucie County has increased by more than 50,000 people since the 2010 Census, The Comfy's population from the 2020 Census is now 329,226, up tram 277,789 To 2010.A majority of the growth occurred in the City of Port St Lucie, which increased 22.9%to 201,851 residents compared to 164,203 in 2010. 0-11, the Coumy's population increased by 18.5% The '.. population changes in each district highlight the need to rebalance the fare districts' population. Staff has prepared three draft redistricting map scenarios for the Board to select from and adopt as the new Commission district map, Staff originally prepared five 15) scenarios and presented them to the Board at the Informal Meeting m Mato, 12, 2021. In that meeting, the Board had a consensus on reducing the number of scenarios to the three (3) attached to the agenda item. Staff also staged an open house for the public to see each sceneria in the Commission Chamber on November 4, 2021. The scenarios have been posted on the County s websim since mid-Oclabec To date, public comment has been somewhat limited and what has been received is part of the backup agenda. Consistent with the 2011 redistricting process, public comment has prlmaHty included North and South Hutchinson Island in the same commission district Also, consistent with the 2011 redistricting process, the St Lucie County School District has indicated a desire to have their districts mimic the Board of County Commissioners Districts. To that end, each scenario maintains the school board members in their current districts. Adoption of the new commission districts does not require a public hearing. However. consistent with policy, staff has placed the item on the agenda as a public hearing. State statute provides some additional rudimentary steps to which the County must adhere in the adaptlon process. In adopting new districts, the Board must also: • Enter en accurate description of the new boundaries as changed into the Board meeting minutes. The County Surveyor has created descriptions of the new districts, • Publish a certified copyof the proposed newdistricts at leastmce each week for two consecutive we. in A loot newspaper. • Include proof of such public in the Board meeting minutes.
