family residence twenty-five (25,) feet from the North Fork of
the St. Lucie River.
As per Nancy Munshaw, the permit is rejected based on Policy
1.1.8.8 0£ the St. Lucie County Comprehensive Plan.
The Policy states:
"Zone A 0 to 75 feet from the average high water mark
No development activity or shoreline alteration other than that
associated with the construction of a private access point,
including docks if permitable under applicable laws, to the
river's edge shall be permitted."
In addition, the aerial shows extensive vegetation in this area.

We have received your letter of August 1, 1991 regarding the
above referenced lot. As required by the Land Development Regula-
tions, I hereby certify that the fill in the area delineated on
the proposed Federal Emergency Management Agency (FEMA) maps
dated August 19, 1991 will not result in any real measurable in-
crease of flood elevations during occurrence of the base flood
discharge.
This certification is based upon the.analysis in my letter of
July 24, 1991 regarding encroachment innto the floodway and the
attached calcluations for fill in the floodplain.
Based upon this information, we would appreciate it if you would
contact St. Lucie County Health Department and get them to
release the septic tank permit.

The above referenced permit has been rejected, per Nancy Munshaw,
based on Policy 1.1.8.8 of the St. Lucie County Comprehensive Plan,
which states:
"Zone A O to 75 feet from the average high water mark
No development activity or shoreline alteration, other than that
associated with the construction of a private access point,
including docks, if permittable under applicable laws, to the
river's edge shall be permitted."
However, the Land Development Code Section 6.02.02.D.1 states:
"The regulations shall pertain to all lands within the zones
adjacent to applicable waterways except:
1. Existing lots of record as of August 1, 1989."
Sweetwater Subdivision Plat was approved February 19, 1985, which
was prior to the above date. Please advise if this exempts the
parcel from the above referenced policy.
Although there is extensive vegetation in this area, the Land
Development Code Section 6.00.04.G states:
"Exemptions: The removal or alteration of protected vegetation
except mangrove or dune vegetation, upon any detached single family
residential lot or parcel of land having an area of one (1.0) acre
or less."
As the area of this lot is approximately one-half acre, it is
exempt from a vegetation removal permit. However, would a mangrove
permit from the Planning Department be applicable?
