INVOCATION 3. PLEDGE OF ALLEGIANCE 4. APPROVAL OF MINUTES There are no items scheduled. 5. PUBLIC COMMENT (excluding Public Hearing items) George M. Baker, Port St. Lucie, FL - Spoke to the Board about a past suggestion regarding the County starting a vocational school which was never moved on by the Board. He spoke about expansion at the St. Lucie County Airport and feels the reason it can't be expanded is the lack of skilled workforce in St. Lucie County. He feels you have to teach the people in order to attract big industries to the area. He would like the Board to think about developing some sort of trade school which would help entice companies to come to the county. He talked about his experience in a vocational skill and how well it served him in his aviation career. He stated the county needed to get the airport moving to generate funding. Commissioner Lewis stated there was currently interest in the county to develop a vocational school and reported the airport is filled to capacity at the moment. Additional construction would have to take place in order to add additional tenants and move forward at this point. She noted the Board had recently completed a business plan for the Airport and much is currently happening. Ingrid Van Hekken, 304 Anchorway, Fort Pierce, FL - Came today to thank the Board and County Attorney for fighting the fight with them against All Aboard Florida (AAF). She thanked the County Attorney and stated she does not have anything against high-speed rail cars but feels they should not be located in the middle of populated areas. She spoke about how AAF is fighting to not install the safety features the County has deemed minimum security features. She asked the Board to continue to fight against AAF and noted she had not seen funds allocated in the FY2015-2016 Budget for those expenses and asked the Board to reconsider funding such endeavors. County Attorney thanked Ms. Van Hekken for her comments and clarified for Ms. Van Hekken and the public that $500,000 had been allocated for the fight against AAF and the remainder of those funds are still available for use if needed and are being carried -over into the next fiscal year budget. 6. PROCLAMATIONS APPROVAL A. Resolution - Proclaiming September 30, 2015 as "Million Father March: Men Take Your Child to School Day" in St. Lucie County, Florida Commissioner Lewis presented Deputy Chief Garry Wilson with the Proclamation. Deputy Chief Wilson spoke on behalf of members of the Port St. Lucie Police Department, Fort Pierce Police Department, Fire District, Sheriff's Office and the School Board who strongly support the effort 2 1 P a g e Regular Meeting Tuesday, September 15, 2015 9:00 AM to recognize September 30th as "Father's Take Their Children to Work Day." He emphasized the importance of parents role in their children's lives especially when it comes to education. This day is another way of recognizing that effort and encouraging more participation by parents to play a role in that one day to take their children to work. He stated it is a special day of recognition that supporters hope will spread across the nation and be a part of the educational process. Resolution - Proclaiming September 22, 2015 as "National Voter Registration Day" in St. Lucie County, Florida Commissioner Lewis presented the proclamation to St. Lucie County Supervisor of Elections Gertrude Walker. County Supervisor of Elections spoke on the importance of National Voter Registration Day and the opportunity it gives Americans to reflect on their right to vote. She spoke on the approaching election year which begins with the March Presidential preference election on September 15, 2016 where the citizen's of Florida will be asked to elect a president along with federal, state, county and municipal officials. In the 2008 general election, 6 million American's did not vote because they failed to register or to change their address when they moved. This day gives the county a chance to remind citizens who have recently come of age, are new to the area or have never voted; the opportunity to register at one of the convenient 15 locations. If already registered, they can update their status by visiting the Supervisor of Elections website at www.slcelections.com. She thanked the volunteers from Alpha Kappa Alpha sorority who will be registering volunteers, poll workers who service every election day as well as her staff of professionals for their dedicated service. Resolution - Proclaiming September 29, 2015 as "World Heart Day" in St. Lucie County, Florida Commissioner Lewis presented the proclamation to St. Lucie County Florida Department of Health Officer/Administrator Clint Sperber who spoke regarding St. Lucie County statistics on cardiovascular disease, the 2nd leading cause of death in the area. World Heart Day is an annual event where every county in the State of Florida conducts a hands only CPR training course with the intent of giving people the ability to assist others. In St. Lucie County the Safe Kids Coalition is coordinating the training at the following 4 locations: Fort Pierce Westwood; St. James Christian Academy; Southern Oaks Middle School and Centennial High School. PRESENTATIONS Boy Scout Partnership - Chuck Barrowclough Environmental Resource Department Lands Coordinator provided a presentation on the implementation of the Facilities Use Agreement which was adopted in April between the Gulf Stream Council of Boy Scouts of America and St. Lucie County, also known as "Service Before Self." He explained what the Facilities Use Agreement is and what it does - allows for the use of County facilities and preserves at no cost to the scouts in exchange for service projects or "Service Before Self". He provided a representative (not inclusive) list of the properties which are available for the scouts use. The approved uses for the properties are as follows: Resource Management; Facility Use (i.e. Meetings/Training); Camping and Greenways/Trails & Blueways (Building, Blazing, Signage, Maintenance). He provided information regarding several of the projects which the scouts are undertaking such as the Richard E. Becker Preserve; Implementation of the Greenways and Trails - 70 Miles of Trails which have been planned out but need to be put on the ground; East Coast Greenway; Indian Hills Community Garden Project; the Bluefield Preserve Work Weekend - scheduled for November; and the Greenways & Trails Construction & Maintenance Plan. He noted the scouts are working with the Order of the Arrow, the exclusive end of scouting where adult leaders and scouts have gone through a trial, have advanced to a higher level in serving and go around the country doing service projects. They go to national parks and rebuild cabins and develop trail systems. They are hoping to soon be able to announce that the Order of the Arrow will be visiting and will make St. Lucie County's trail program their project for 2016. He reviewed how important it is to provide scouts with skill sets necessary to effectively work for the County. As a life-long member of the Florida Trail Association, local trail coordinator and past Board of Director member, he asked Florida Trail Association to partner with them to provide scouts with an opportunity to learn trail building skills. They will be able to develop a youth training program for Martin County; provide the skills needed to inspect and assess trail conditions surfaces for ADA accessible trails; all skills needed to go out and blaze new trails. They will be conducting these training sessions at the Kissimmee Prairie State Preserve at no cost for the scouts. He provided an overview of the Wheels program which will be in December 2015 for the academically eligible scouts to attend and take off Friday the 13th. Scouts and their bicycles will be transported to the 45th Street Tri-Rail where they will receive free passes to the MetroRail to a local community park in South Miami where the event is being held. The scouts will not only learn about alternate transportation but also the health benefits of riding, hiking and walkable communities. Approximately 20,000 bikers will be camping during the event. He thanked Scott Van Duzer and Commissioner Johnson for their efforts in helping these projects move forward through scouts and the county. 21 Regular Meeting Tuesday, September 15, 2015 9:00 AM Commissioner Dzadovsky thanked the Environmental Resources Department, Facilities, Parks and Recreational Departments and the Administration who have all done a great job getting all the logistical pieces done. He also noted how these projects will enhance the eco-tourism opportunities in the County. Commissioner Johnson thanked staff member Amy Griffin for her hard work on the programs which have been developed. 8. UTILITIES Severn Trent Environmental Services, Inc. - Contract Amendment Three 9. PUBLIC HEARINGS COUNTY ATTORNEY A. Public Hearing - Animal Control Ordinance Assistant County Attorney Young provided background information on the Animal Control Ordinance and the recommended changes resulting from the review by the Animal Control Shelter Standards Committee. She reviewed the proposed changes in 6 1 P a g e Regular Meeting Tuesday, September 15, 2015 9:00 AM the order they appeared in the Ordinance. There were several items which were cause for discussion during the Board discussion section. Those items were in regard to the tethering of animals and outdoor enclosures. There was also much discussion regarding the use of the word "or" in the parameters of item number "3. Above 85 degrees Fahrenheit or a heat index of 100 degrees or." Board Members felt it did not leave any room for discretionary judgment to be made by animal control staff members so a suggestion to amend the proposed Ordinance. Commissioner Hutchinson suggested the word "or" be changed to "with" in the above sentence in order to allow room for discretionary decisions to be made by the animal control officer. County Attorney suggested the following sentence be added to the Ordinance at the end of the definition: "In determining whether extreme weather conditions exist an animal control officer shall consider extenuating circumstances such as shaded areas, availability of water, etc." Staff recognized and thanked the members of the Committee who spent over a year working on the Ordinance. Those members were Amy Boger, Public Safety Department; Sharman Colton, Fort Pierce Police Department; Brian Lloyd, Port St. Lucie Animal Control; Rick Stir, St. Lucie County Sheriff's Department; Dr. Cindy Wasserman, Veterinarian; Jack Southard, retired Public Safety Director. Commissioner Lewis opened the meeting to Public Comments. PUBLIC HEARING: Susan Perry, United for Animals - Came to speak mainly about the tethering of animals but found the Ordinance read was not the one she had available to her so she had the new information clarified by Assistant County Attorney and was in agreement with the proposed changes. She suggested using the heat index as a guideline and perhaps not the temperature but feels it does need to have something specific. She felt there is certainly a commonsense equation that needs to be written into the Ordinance but there is also a need to have specifics within it's body so the Animal Control officer is not required to argue the point when making decisions. Donny Creski, Committee Member - Asked if what the Board disagrees with is the temperature issue. County Attorney stated he did not believe the item in question was in response to the "temperature" but more the ability to look at each individual circumstance and be able to judge whether they are in distress or not. The Board would like to develop a standard yet provide a certain amount of flexibility for staff to enforce it in a reasonable manner. Mr. Creski felt strongly there was a need to have a temperature gauge listed in the Ordinance so he did not want to leave that out of this new Ordinance. 7 1 P a g e Regular Meeting Tuesday, September 15, 2015 9:00 AM After discussion it was realized by Mr. Creski that he and the Board were of the same mind in wanting the temperature included but also did want to allow for some judgment by staff members. David Roberts, St. Lucie County Humane Society - Said a special thanks to those who put much effort into writing the Ordinance and listed them as follows: Karen Taylor, Animal Control; Amy Bogar, Heather Young, Tiffany Bennett, St. Lucie County Staff Members and Donny Creski & Susan Perry of United for Animals. He stated the Humane Society is in full support of the Ordinance and thanked all for the great job done. George M. Baker, Port St. Lucie - Spoke against tethering and would like to make a law against it totally. He feels pets are family members and if you have a pet you should treat them with the same respect as family. He stated he would not stand for animal abuse and feels tethering is animal abuse. Staff recommended Board adopt the proposed Ordinance, as drafted with the additions as discussed. It was moved by Commissioner Dzadovsky, seconded by Commissioner Mowery, to adopt the proposed Ordinance per the discussion held, and; upon roll call, motion carried unanimously. Public Hearing - Alarm Ordinance Amendments Assistant County Attorney Young provided background information on the Alarm Ordinance Amendment. Staff noted Ordinance No. 15-05 has provided for an October 1, 2015 effective date in order to provide for a transfer of the alarm program to a third party administrator and to allow for the City of Fort Pierce and the City of Port St. Lucie to adopt related amendments to their respective alarm ordinances. In order to allow additional time for the cities to adopt these necessary amendments, the proposed ordinance would also extend the effective date of Ordinance No. 15-05 to April 1, 2016. Staff recommended Board adopt the proposed Ordinance, as drafted.
