GENERAL RULES AND PROCEDURES – Attached is the agenda, which will determine the order of business conducted at today’s Board meeting. INVOCATION-PLEDGE – To bring order and decorum to its meeting, the Board begins its meetings with an invocation followed by the Pledge of Allegiance. Participation is voluntary. CONSENT AGENDA – These items are considered routine and are enacted by one motion. There will be no separate discussion of these items unless a Commissioner so requests. REGULAR AGENDA – Proclamations, Presentations, Public Hearings, and Department requests are items, which the Commission will discuss individually, usually in the order listed on the agenda. PUBLIC HEARINGS – These items are usually heard on the first Tuesdays at 6 p.m. or as soon thereafter as possible. However, if a public hearing is scheduled for a meeting on the third Tuesday, which begins at 9 a.m., then public hearings will be heard at 9 a.m. or as soon thereafter as possible. These time designations are intended to indicate that an item will not be addressed prior to the listed time. The Chair will open each public hearing and asks anyone wishing to speak to come forward, one at a time. Comments will be limited to five minutes, and must be pertinent to the agenda item being considered by the Board. As a general rule, when issues are scheduled before the Commission under department request or public hearing, the order of presentation is: (1) County staff presents the details of the Board item (2) Commissioners comment (3) if a public hearing, the Chair will ask for public comment, (4) further discussion and action by the Board. ADDRESSING THE COMMISSION – Please state your name and address, speaking clearly into the microphone. If you have backup material, please have eight copies ready for distribution. NON-AGENDA ITEMS – These items are presented by an individual Commissioner or staff as necessary at the conclusion of the printed agenda. PUBLIC COMMENT – Time is allotted at the beginning of each meeting for general public comment. Please limit comments to three minutes. Comments may pertain to any matter related to the Board’s duties as the County’s governing body. General comments in support or opposition to candidates for public office are not pertinent to the Board’s duties. DECORUM – Please be respectful of others’ opinions. MEETINGS – All Board meetings are open to the public and are held on the first Tuesdays of each month at 6 p.m. and on the third Tuesdays at 9 a.m., unless otherwise advertised. Meetings are held in the County Commission Chambers in the Roger Poitras Administration Annex at 2300 Virginia Ave., Fort Pierce, Fla. 34982. The Board schedules additional workshops throughout the year necessary to accomplish their goals and commitments. Notice is provided of these workshops. RES-2017-273 DATE: 12/19/2017 AGENDA REQUEST *CONSENT AGENDA BACKGROUND: FWC partnered with St. Lucie County on this project, providing funding for the placement of limestone boulders, previously purchased by FWC, along 18 culverts installed to rehydrate an impaired wetland and on 150 LF of unarmored areas of shoreline. The limestone boulders will stabilize the culverts and prevent wash-out from storms and high tide events. This work will ensure continued and long-term success of the Harbor Branch Preserve Marsh Restoration Project, completed in 2016 in order to reconnect the isolated wetland to the Indian River Lagoon. St. Lucie County Mosquito Control will utilize TSI Disaster Recovery, contract #C16-09-508, for the completion of this project. PREVIOUS ACTION: August 24, 2017 - County Administrator approved a letter of agreement, C17-09-564, between St. Lucie County and Florida Fish and Wildlife Conservation Commission (FWC). This agreement will provide support to complete the project known as the Harbor Branch Dike Improvement Project, referred to by FWC as the Harbor Branch Mangrove Marsh Restoration Project. This project will help to achieve long- term stability and restoration and ecological function to the 178-acre Harbor Branch Preserve. WHEREAS, Section 129.06 (d), Florida Statutes, requires the St. Lucie County Mosquito Control District to adopt a resolution to appropriate and expend such funds. RES-2017-274 DATE: 12/19/2017 AGENDA REQUEST *PUBLIC HEARINGS BACKGROUND: Pursuant to Chapter 2003-365, Laws of Florida, property owners may petition the Board to expand the Mosquito Control District boundaries to add their property. The developer, Minto Townpark, LLC, and property owners in Lake Park at Tradition, Plat No. I and Plat No. II, have submitted petitions seeking to expand the boundaries of the District to add the subdivision. The subdivision is composed of three hundred sixty-nine (369) lots, including the common areas. The developer still owns the majority of the lots and its petitions cover two hundred eight (208) lots. In addition, fifty-eight (58) petitions were received from individual property owners. Accordingly, the petitions represent two hundred sixty-six (266) lots, or approximately 80% of the total property within the subdivision. The special act requires the Board to hold a public hearing on the requested expansion following verification of that the property subject to the petition are adjacent to the existing boundaries of the District. Staff has verified that Lake Park is adjacent to the existing District boundaries. The special act further provides that if the Board approves the petitions following a public hearing, the property will be added only if approved by a majority of the qualified electors in the affected area voting in a referendum called for such purposes. In the past the Board has waived the referendum requirement when all of the affected property owners submitted petitions for the expansion. As that is not the case with Lake Park, staff would recommend moving forward with the referendum if the petitions are approved by the Board. Given the relatively small number of ballots required, the Supervisor of Elections will use the mail in ballot process to conduct the referendum. Notice of the December 19, 2017 public hearing was published in the News Tribune on December 2, 2017, and December 4, 2017. PREVIOUS ACTION: On November 21, 2017, the Mosquito Control District granted permission to advertise for a public hearing on the property boundary expansion at the December 19, 2017 meeting at 9:00 a.m. or as soon thereafter as may be heard. Two petitions were sent in directly by property owners for a total of fifty-eight (58) additional petitions. Staff has been able to verify ownership for fifty-seven (57) of the petitions. With the addition of these new petition, the total number of petitions in favor of the expansion is now three hundred twenty-three (323), or eight-seven percent (87%). No petitions in opposition to the proposed expansion have been received. Based upon the number of petitions in favor of the expansion, staff would recommend the District waive the referendum requirement. A copy of an alternate resolution providing for such waiver is attached to this memorandum. RECOMMENDATION/CONCLUSION: Staff recommends that the St. Lucie County Mosquito Control District adopt the Alternate Resolution approving the petitions to expand the boundaries of the District to add Lake Part at Tradition, Plats 1 and 2, and waiving the referendum requirement for the expansion. Staff has verified that parcel is adjacent to the existing District boundaries. The special act further provides that if the Board approves the petitions following a public hearing, the property will be added only if approved by a majority of the qualified electors in the affected area voting in a referendum called for such purposes. In the past the Board has waived the referendum requirement when all of the affected property owners submitted petitions for the expansion. As Minto Townpark, LLC is the sole owner, staff would recommend the referendum be waived for the subject parcel. Notice of the December 19, 2017 public hearing was published in the News Tribune on December 2, 2017, and December 4, 2017.
