GENERAL PUBLIC COMMENT Chairman Mowery opened the meeting for public comment at this time. Richard Silvestri, of 5708 Buchanan Drive Fort Pierce, addressed the Board. There being no one further wishing to address the Board, Chairman Mowery closed public comment. 4. CONSENT AGENDA A motion was made to adopt the consent agenda and it carried unanimously. Resolution - Boundary Expansion to Add Lake Park at Tradition, Plat No. 1 and Plat No. 2 Heather Young, Assistant County Attorney, presented this item as detailed in the agenda. Pursuant to Chapter 2003-365, Laws of Florida, property owners may petition the Board to expand the Mosquito Control District boundaries to add their property. The developer, Minto Townpark, LLC, and property owners in Lake Park at Tradition, Plat No. I and Plat No. II, have submitted petitions seeking to expand the boundaries of the District to add the subdivision. The special act requires the Board to hold a public hearing on the requested expansion following verification that the property subject to the petition are adjacent to the existing boundaries of the District. Staff has verified that Lake Park is adjacent to the existing District boundaries. The special act further provides that if the Board approves the petitions following a public hearing, the property will be added only if approved by a majority of the qualified electors in the affected area voting Regular Meeting Tuesday, December 19, 2017 9:00 AM 3 | P a g e in a referendum called for such purposes. In the past the Board has waived the referendum requirement when all of the affected property owners submitted petitions for the expansion. On December 15, 2017, the developer of Lake Park at Tradition, Minto Town Park, LLC, submitted an additional fifty-six petitions to expand the boundaries of the St. Lucie County Mosquito Control District to add Lake Park at Tradition, Plats 1 and 2. Two petitions were sent in directly by property owners for a total of fifty-eight (58) additional petitions. Staff has been able to verify ownership for fifty-seven (57) of the petitions. With the addition of these new petition, the total number of petitions in favor of the expansion is now three hundred twenty-three (323), or eight-seven percent (87%). No petitions in opposition to the proposed expansion have been received. Based upon the number of petitions in favor of the expansion, staff would recommend the District waive the referendum requirement. Staff recommended that the St. Lucie County Mosquito Control District adopt the Alternate Resolution (included in the Memorandum) approving the petitions to expand the boundaries of the District to add Lake Part at Tradition, Plats 1 and 2, and waiving the referendum requirement for the expansion. Chairman Mowery asked a question for clarification. Chairman Mowery opened the hearing for public comment. There being no one wishing to appear before the Board, Chairman Mowery closed the public hearing. A motion to adopt the resolution as per Staff recommendation was made and the motion carried unanimously. Resolution - Boundary Expansion to Add Minto Townpark, LLC Unplatted Parcel Adjacent to Lake Park at Tradition Heather Young, Assistant County Attorney, gave a presentation on this item. Pursuant to Chapter 2003-365, Laws of Florida, property owners may petition the Board to expand the Mosquito Control District boundaries to add their property. In conjunction with the petitions submitted to add Lake Park at Tradition to the District, the developer, Minto Townpark, LLC, has submitted a separate petition to also add a large unplatted parcel containing approximately 107.989 acres it owns adjacent to Lake Park. The special act requires the Board to hold a public hearing on the requested expansion following verification that the property subject to the petition are adjacent to the existing boundaries of the District. Staff has verified that parcel is adjacent to the existing District boundaries. The special act further provides that if the Board approves the petitions Regular Meeting Tuesday, December 19, 2017 9:00 AM 4 | P a g e following a public hearing, the property will be added only if approved by a majority of the qualified electors in the affected area voting in a referendum called for such purposes. In the past the Board has waived the referendum requirement when all of the affected property owners submitted petitions for the expansion. As Minto Townpark, LLC is the sole owner, staff would recommend the referendum be waived for the subject parcel. Staff recommended that the Board, sitting as the governing board of the St. Lucie County Mosquito Control District, adopt the proposed resolution approving the petition submitted by Minto Townpark, LLC to expand the District boundaries to add a unplatted parcel adjacent Lake Park at Tradition containing approximately 107.989 acres, and waiving the referendum requirement. (This item was discussed in conjunction with item 5.A.1) Chairman Mowery opened the hearing for public comment at this time.
