22 MS. MOISE: Yes. Thank you kindly. For the
23 record, I am submitting one photo dated November
24 4th, 2024; one photo dated December 5th, 2024; and
25 one photo dated January 2nd, 2025; a copy of the

1 plans submitted for the permit; copy of 2018
2 Property Appraiser's aerial that does not show the
3 structure; 2024 Property Appraiser's aerial that
4 shows the structure.
5 On July 31st, 2023, a Permit No.
6 BLDR-2307-004122 was filed for a detached three-car
7 garage with storage above, masonry construction.
8 The permit was never issued. The Permitting
9 Department requested an inspection of the property
10 before voiding out the permit due to non-activity.
11 The property was inspected on June 13th, 2024.
12 During my investigation, through extensive
13 research, I found that the work was done.
14 Therefore, Citation No. 461 was issued on
15 October 30th, 2024 with a compliance date of
16 November 13th, 2024 for being in violation of
17 Section 10-99, No. (9) proceeded on any job without
18 first obtaining applicable local building permits,
19 inspections or perform of any work for which a
20 building permit is required without such building
21 permit being current.
22 After non-payment, a Notice to Appear was
23 issued and sent certified on November 26th, 2024
24 for the January 15th, 2025 Contractor Licensing
25 Board meeting. The notice was signed; therefore, a

1 Notice to Appear was issued and posted on the
2 property of the contractor on January 2nd, 2025 for
3 the January 15th, 2025 Contractor Licensing Board
4 meeting.
5 I have had no contact with the contractor. As
6 of January 15th, 2025, the citation has not been
7 paid.
8 CHAIRMAN LEONARD: Thank you, Ms. Mirlande.

10 CHAIRMAN LEONARD: So this citation is for the
11 screen enclosure or concrete structure?
12 MS. MOISE: It's the concrete structure, yes,
13 sir.

7 I would like to go ahead and remove the
8 disciplinary Case No. 1 from the agenda. Staff has
9 stated that that case has been taken care of.
10 Onto disciplinary Case No. 2, Mr. Winkler?
11 MR. WINKLER: Yes, sir. I think -- Case No.
12 2406-0000081, 1103 North 37th Street in
13 Fort Pierce.
14 For the record, I'm submitting one photo taken
15 May 1st, 2024; one photo provided by GS showing the
16 dates of December 23rd, 2021 and January 10th,
17 2024; NOV and an NTA Permit No. 2201-0571 in the
18 drawing; DBPR information, email from St. Lucie
19 County interim building official, Mark Thornbloom,
20 to staff and to ADT; emails from Mr. Jeffries of
21 ADT Solar; emails from Ms. Brittany Warren of ADT
22 Solar; email from Mickey Marrero, who represents
23 ADT, and a UPS tracking information.
24 On June 21st, 2024, an inspection at
25 1103 North 37th Street, Fort Pierce found solar

1 panels had been installed and done without any
2 inspections. The work was being done by
3 Ronnie F. Padgett, slash, and/or ADT Solar. An
4 email was forwarded from Lashahna Ingram and
5 interim building official, Mark Thornbloom,
6 responding to Brittany Warren, project coordinator
7 for ADT Solar. The emails are dated from
8 April 29th, 2024 to May 6th, 2024. Brittany asked
9 what the process is to close out a permit at moving
10 forward. She further states that 1103 North 37th
11 Street has canceled their solar project and we
12 would like to close out the permit. Brittany
13 advised permit can't be closed out because the
14 solar panels had been installed and require
15 inspections. Brittany then advised that the owner
16 is deceased. How do we proceed? Interim building
17 official, Mark Thornberg [verbatim], stated that
18 the contractor must contact the current owners and
19 arrange for inspections.
20 On July 5th, 2024, I received an email from
21 Charles Jeffries, the Vice President of ADT Field
22 Operations. Mr. Jeffries was reaching out on a
23 Notice of the Complaint for the license holder,
24 Ronnie Padgett and asked -- recommended a path to
25 resolve the permit issue at 1103 North 37th Street

1 because the customer is deceased. I provided
2 Mr. Jeffries with the new homeowner's information.
3 Several notices appear were sent by US certified
4 mail and confirmed delivered between June 24th,
5 2024 and September 13th, 2024 for several of the
6 code -- Contractor Licensing Board, which had been
7 either adjourned due to a medical issue or moved
8 forward.
9 The violation was for Section 10-67,
10 revocation or suspension of Certificates of
11 Competency, (3) disregards and violates an
12 applicable state or local building code, regulation
13 or law, and (8) abandons a construction project in
14 which the contractor is engaged or under contract
15 as a contractor. Project shall be considered
16 abandoned 90 days after the contractor terminates
17 the project without just cause or without proper
18 notification of the owner, including the reason for
19 termination or fails to perform work under the
20 contract for 90 consecutive days.
21 Mickey Marrero notified St. Lucie County
22 Assistant Attorney, Katherine Barbieri, on
23 November 19th of an illness in his family --
24 medical emergency in his family and requested the
25 hearing be moved to January 15th. Both attorneys

1 agreed that the emails would confirm as the Notice
2 to Appear on today's date.
3 As of January 15th, 2025, the permit has not
4 been renewed and still has been expired since
5 June 20th, 2023.
6 CHAIRMAN LEONARD: Thank you, Mr. Winkler.
7 Is Ronnie Freeman or a representative of ADT
8 Solar here?
9 Good morning, sir. Could you please state
10 your name and address and be sworn in?
11 MR. MARRERO: Yes. Is there working? Do I
12 have to hit a button here?
13 CHAIRMAN LEONARD: It should be working. You
14 just got to -- you just got to stand closer to it.
15 MR. MARRERO: Good morning, Mickey Marrero.
16 My address is 200 South Biscayne Boulevard, Miami,
17 Florida. I am an attorney for ADT and its now
18 defunct subsidiary, ADT Solar. If I could explain
19 the situation here, I think Mr. Winkler explained a
20 lot of the pertinent facts.
21 Well, ADT Solar is a subsidiary of ADT, which
22 is obviously known for its alarms and started that
23 company several years ago. That company is winding
24 down. It basically solely exists for the last year
25 plus to wind down projects that had begun

1 throughout the State of Florida. The vast majority
2 of those were resolved successfully. There's
3 obviously some lagging items that -- lack of
4 communication, dispute with the owners, things of
5 that nature. But even those, over time, were
6 resolved. They asked me to assist -- I help ADT
7 with some zoning land use things throughout. I'm
8 the closest thing they have to like a government --
9 local government attorney, so I helped them with
10 this issue.
11 We've been -- and I submitted a communications
12 log -- what happened here in this case and why it's
13 unique, the work was installed. We -- our team
14 sought for inspections. Over the course of that
15 time in 2022, the homeowner -- the customer became
16 deceased and then ADT went through extraordinary
17 efforts to try and contact somebody. You know, I
18 can tell you just personal, my mother passed away
19 in November. My sister and I are constantly
20 getting calls from, you know, banks and things and
21 we try to assist. It's frustrating. I understand
22 the frustration of family members who lost a loved
23 one, but regardless, they have sent multiple
24 letters. They have sent, you know, letters with
25 action items. We need you to help us resolve this.

1 They -- they -- they referred them to a lawyer.
2 The lawyer will call you, but no lawyer ever
3 called. They got the name of a lawyer.
4 Now, the house has been sold to another
5 couple. They've tried to contact them. They've
6 not been successful. ADT is anxious to resolve
7 this. They've just -- they've done everything they
8 can. It's been multiple attempts at communication
9 every month for almost two years and we simply
10 don't have resolution. They -- these -- you know,
11 then it's now just really just a handful of
12 outstanding permits that are left open throughout
13 the state. Every month we seem to find a way to
14 resolve one or two of them. This one's been
15 probably, if not the most difficult, certainly on
16 -- on the handful of most difficults (sic) just
17 because the customer being deceased and no one else
18 really wanting to cooperate. We can't break into
19 the house. We can't -- you know, so that's where
20 we are.
21 We -- I'm happy to seek guidance from you if
22 there's some other resolution. In Miami-Dade
23 County, I was able to find some way with the
24 building official there, you know, certain series
25 of certified letters. They were able to just close

1 it. I don't know if something like that is
2 available here. If we have additional time, we can
3 continue doing what we're doing. Short of -- you
4 know, I can't ask my client to break into someone's
5 home and do the work. I can't force an inspection
6 on someone, and there's no privity with the folks
7 that are there now, and the family of the folks
8 that we're dealing with just haven't been, you
9 know, for reasons that are understandable, haven't
10 been super -- super helpful.
11 So it's not a lack of intentions. It's not a
12 lack, you know, someone just not caring about the
13 process. They've gone through extraordinary
14 measures to resolve it, but we're unable to so far.
15 CHAIRMAN LEONARD: Now, Mr. Marrero, I
16 appreciate that, and my condolences on the loss of
17 your mother in November and thank you for being
18 here.
19 I have a question for staff. What happens
20 when we have a deceased owner, permit's open, job
21 -- job is done and completed, new owner takes over,
22 and we have a representative trying to tidy things
23 up?
24 MR. WINKLER: So generally speaking, it would
25 be on the contractor to reach out to that new owner

1 to try and get the situation resolved.
2 Unfortunately, there's really nothing in the
3 statute or the Florida Building Code that addresses
4 that kind of situation. Only plainly that it's the
5 owner or the original contractor's responsibility
6 to close their permits.
7 CHAIRMAN LEONARD: Wow. So the new homeowner
8 could absolutely refuse anybody to step foot on
9 their property and we have a permitted yet not
10 finaled (sic) out work on that project.
11 MR. WINKLER: Uh-huh. That's correct. And
12 there were no inspections on this, but I'm looking
13 at this project now and it looks like as of January
14 7th, a change of contractor came in from the
15 homeowner, Calvin Johnson.
16 MR. MARRERO: Yeah. I wasn't aware of that,
17 but that is the new home -- that is the new owner.
18 We've been sending them letters suggesting
19 something like that.
20 MR. WINKLER: I'm just going through it now
21 and I'm seeing, yeah, on January 7th, they came in
22 to apply for a change of contractor it looks like
23 to an owner/builder where they would take over that
24 permit.
25 CHAIRMAN LEONARD: And that -- that just

1 recently occurred a week ago?
2 MR. WINKLER: Yes.
3 CHAIRMAN LEONARD: Thank you.
4 MR. MARRERO: And I was -- I was not aware of
5 that, Mr. Chair, but that's good news. That's
6 progress.
7 CHAIRMAN LEONARD: Yeah. I mean, obviously,
8 this is not something that we deal with on an
9 everyday basis. You know, I appreciate you being
10 here and trying to clean up and tidy up all the
11 loose ends from the company. I have no further
12 questions of Mr. Marrero.
13 Does anybody have any questions?
14 I mean, is this something maybe we want to
15 table and give -- give Mr. Marrero another 60 days
16 until the next meeting to see if they can't come to
17 a resolution with the homeowner being that we have
18 new information with respect to the new owner
19 pulling a permit, changing it over to
20 owner/builder?

22 Katherine Barbieri. Based on this new information
23 that we're -- unfortunately, we -- staff was not
24 aware of with, I don't know, timing of it being
25 uploaded in the system and everything and the ADT's

1 attorney has been very conscious about being
2 cooperative with us and talking to us, at this
3 point, now that we have somebody on the permit in
4 theory who will hopefully solve this issue, we're
5 willing to dismiss our case.
6 MR. DIFRANCESCO: I'm fine with it.

18 being done; a Complaint and Affidavit; a contract
19 between Sawgrass Contracting and the homeowner;
20 emails between the homeowner and the contractor;
21 Attorney John Madden letter; preliminary condition
22 assessment report prepared by PJC Construction
23 Consultants; 19th Circuit Court Case No.

1 information; DBPR information.
2 On October 22nd, 2024, Stephen and
3 Cristie McMullin filed a Complaint Affidavit for
4 renovation work done by James Eugene Thomas and/or
5 Sawgrass Contracting, LLC. On October 30th, 2024,
6 I conducted an inspection on the condo. The
7 following information comes from the Complaint and
8 Affidavit I went through. On May 5th -- on
9 May 11th, 2020, an agreement between the owner and
10 contractor was signed. On May 16th, 2020, Cristie
11 emailed James Thomas and advised that the Condo
12 Association is requesting copies of the
13 contractor's license, liability insurance for the
14 project and all the permits issued. On
15 June 19th, 2020, she followed up with another email
16 advising she did not get the email. Mr. Thomas
17 responded back that the email was kicked back.
18 On June 28th, 2020, Stephen emailed Mr. Thomas
19 and advised he was very concerned that work is
20 being done that requires permits. Stephen
21 specifically questioned the HVAC permit.
22 James Thomas responded his AC contractor would take
23 care of all necessary permitting if he felt it was
24 needed. On August 27th, 2020, Jake Mattucci, of
25 Sawgrass Contracting, advised that there was some

1 duct work and the extra money was in the permitting
2 for the duct work that was done. On June 23rd,
3 2023, Sawgrass Contracting's attorney placed a lien
4 on their condo and requested a scheduled mediation
5 as required by the contract.
6 On December 28th, 2023, Stephen and Cristie's
7 attorney hired J -- PJC Construction Consultants
8 for a preliminary condition assessment report,
9 which found the consultant's opinion that the
10 contractor's work did not conform to required state
11 statutes and building codes. Further notice that a
12 demolition and renovation violated a Florida
13 Building Code and the permits were not obtained and
14 no inspections done for the demolition, renovation,
15 electrical work, mechanical work and the plumbing
16 work.
17 Notice to Appear was issued by US certified
18 mail to James E. Thomas and/or
19 Sawgrass Contracting, LLC on November 1st, 2024.
20 The NTA was scheduled for the 15th of January, 2025
21 Contractor Licensing Board hearing. Violation was
22 for Section 10-67, revocation or suspension of
23 Certificate of Competency, (3) disregards and
24 violates an applicable state or local building
25 code, regulation or law, (11) proceeds on any

1 construction job without first obtaining and
2 posting the required permits, including, but not
3 limited to, building permits, environmental
4 regulation permits and scheduling required
5 inspections, (19) committing mismanagement or
6 misconduct in the practice of contracting that
7 causes financial harm to the customer, financial
8 mismanagement or misconduct includes, but limited
9 to any of the following: A, the contractor fails
10 to fulfill his/her contractual obligations to a
11 customer because of inability, refusal or neglect
12 to pay all creditors for material furnished or work
13 or services performed in the operation of the
14 business for which he/she is licensed under any of
15 the following circumstances that (3) the
16 contractor's job has been completed, and it's
17 showing that the customer had to pay more for the
18 contracted job than the original contract price as
19 adjusted for subsequent charge -- change orders,
20 unless such increase in cost was a result of
21 circumstances beyond their control of the
22 contractor, was a result of circumstances caused by
23 the customer or was otherwise permitted by the
24 terms of the contract between the contractor and
25 customer.

1 On November 4th, 2024, United States Postal
2 Service tracking system showed that the NTA was
3 delivered. On November 7th, 2024, Mr. Thomas
4 contacted me advising me he will take care of the
5 permits, citation and will be present for the
6 hearing. On November 15th, 2024, the citation that
7 was issued to Mr. Thomas, Sawgrass Contracting, was
8 paid. On November 22nd, 2024, Mr. Thomas contacted
9 me again about information required about a site
10 plan. I gave him -- permitting supervisor, Melissa
11 Burbank's number and referred him to her.
12 On November 25th, 2024, Permit No.
13 BLDC-2411002934 was applied for for alteration of a
14 commercial building. As of January 14th, 2025,
15 Permit No. BLDC-2411002934 requires submittal for
16 building, fire and plumbing. Per St. Lucie County
17 Assistant Building Official, William Durden, the
18 permit lacks information submitted for the work
19 done.

1 We've heard from staff on a couple of things.
2 Thank you for being here. Please, you know, let us
3 know what -- what your -- what you have to say.
4 MR. MCMULLIN: Well, a lot of it was pretty
5 much went through Mr. Winkler. We -- we had
6 several conversations as far as permits.
7 Mr. Thomas, Tony Hartfield and Jake Mattucci all
8 told us that they weren't required. And they even
9 -- Mr. Thomas even said, well, I'll just stop
10 everything -- this was during COVID. We were in
11 Maryland living with my son 'cause the project was
12 supposed to take two months and it was already into
13 several months. And he said, we'll just shut it
14 down, and then he told us that if we wanted to --
15 for him to pull permits that weren't necessary,
16 we'd have to pay for those permits. So he charged
17 me $625 for an HVAC permit, which was never pulled.
18 We got here in September. A couple of years later,
19 we were putting in windows because the job was
20 being dragged on and we were very concerned about
21 permits. We were telling them they need to put
22 permits in -- pull permits. They need to post
23 them. They didn't seem -- they didn't -- didn't
24 need to post them. They never got posted on the
25 doors, and at one point, Jake Mattucci and Tony --

1 and Mr. Thomas all sat there and Jake said, Well,
2 they're not that big of a deal, that Mr. Thomas put
3 some -- it was either a shed or something like that
4 on his property and got fined for a permit there.
5 It's no big deal. So that's when I started having
6 conversations with Heather from the Board -- from
7 the permitting board and trying to figure out the
8 best way to resolve this.
9 Then they put a -- the -- it wasn't even
10 Mr. Thomas. I don't even know, one, if he knows
11 there's a lien on my property. He's supposed to be
12 the one in charge. I don't know if he's involved
13 in the lawsuit on my property. The extra charges
14 they put in for the window, which I said I'm not
15 going to pay for because you can't charge me extra
16 for something that's part of the contract. They've
17 already charged me a bunch of upgrades and things
18 like that that I didn't feel were actually
19 upgrades. We've had -- I had a couple of instances
20 -- I tried to get invoices and stuff for what
21 things cost because in the contract it's supposed
22 to be you can't charge me anything more than 20
23 percent above for a profit. And one of the things
24 was a smart house. I told Mr. Thomas to quote me
25 all the electrical plugs, all the light switches,

1 CAT 6 wiring, HUB, the whole nine yards. And he
2 told me it would be around $2,500 to get that done.
3 Again, he told my wife before this he wasn't going
4 pulling -- he wasn't going to be doing change
5 orders, which was also part of the contract. And
6 when I finally got for Mr. -- met Mr. Madden, the
7 invoices from the smart house, they were like
8 $3,300 and they charged me a little over 7,000, I
9 believe.
10 The duct work, they said they were 3,500 to
11 pull and replace it all. Tony Hartfield told me
12 they only replaced part of it. He cleaned the
13 other part of it, because it really didn't need to
14 be replaced. He told me that when he was arguing
15 about putting in the vent cover for my dryer that
16 sits outside the front door and was saying it's not
17 part of the contract. So it's been an ongoing --
18 I've been trying to get this to finish. And then
19 when Mr. Hartfield was at my property, the last
20 conversation we had was he was going to be bringing
21 in a new smart person to take care of the house
22 because the other one quit. He wasn't going to --
23 he wasn't going to deal with the contract anymore.
24 I said, well -- actually, my wife said, well, what
25 about the grout in the floor that Mr. Thomas said

1 they would take care of at a previous meeting, and
2 he said, I'm not doing that. I will give you a
3 decrease off the price and he stormed off the
4 property and then he sent me a bill with a
5 5,000-plus increase and told me to pay it. I told
6 my wife, well, let him calm down. He was upset.
7 And then I was in the process of filling out a
8 return letter and -- to respond to him and then
9 that's when we got the notification that there was
10 a lien on our property and that's where we stood.
11 But -- so I mean, I just -- I mean, I don't
12 know who the contractor -- I know Ricciardi Air
13 Conditioning was the one that put in the AC unit,
14 which I'm now finding out was installed improperly.
15 There's a gaping hole in the back of the HVAC that
16 -- it says something on the -- on the permit, which
17 I'm -- noticing on the invoice that something else
18 is needed. I don't know if that was done or not.
19 But I even think the 3,500 for the extra duct work,
20 which was included in the total bill when -- and
21 that was about $8,000, and it just -- I'm just a
22 little frustrated.
23 CHAIRMAN LEONARD: No, I understand,
24 Mr. McMullin. I appreciate that. I have a
25 question for you. You keep saying Jake Mattucci

1 and Tony Hartfield, are those the gentlemen that
2 you dealt with were from the -- did they represent
3 the organization? Were they project managers?
4 Were they --
5 MR. MCMULLIN: Tony Hartfield said -- told me
6 that they were equal partners in the business, the
7 three of them.
8 CHAIRMAN LEONARD: Okay.
9 MR. MCMULLIN: And Tony Hartfield is the one
10 that came out to do my walk through -- walk through
11 with me to give us the contract price. His son,
12 which we found out -- he told me he knew a guy, he
13 was the -- he was the -- Anthony Hartfield -- Tony
14 Hartfield, Jr. was the real estate agent, and he
15 told me knew a guy who was really good, blah, blah,
16 blah, blah, blah. We found out before closing, but
17 pretty much -- again, COVID -- that it was his
18 father. And we were concerned about that because
19 it didn't seem like he was being up front with us
20 about who his -- who the guy was and how qualified
21 he actually was. I said, well, kinda too late now.
22 Let's just go with it and, you know, that's where
23 we'll be.
24 And one more point, as far as with Mr. Thomas,
25 the first quote I got for the work on my house was

1 $110,000. My wife told me I was nuts, but I told
2 him on the phone that I don't want to be talking
3 about money. I don't want to be arguing about I
4 need a little more for this. I need a little more
5 for that. Make sure you quote me high and we can
6 always come down. I don't want to go up.
7 So the price then changed to $135,000, which I
8 agreed to, and then I was charged 25,000 plus more
9 for extra work. My huge problem is, this is not
10 something that is a mistake. This is a blatant
11 disregard for doing the right thing, pulling the
12 permits. He knew -- he lied to us telling us they
13 weren't needed. There's not one person that I've
14 talked to that told me that, you know, oh, yeah,
15 well, it could be either. It could be or. It's
16 like, no, this is -- yeah, you need a permit. And
17 to have -- you know, he's got multiple licenses for
18 different companies, he should know. So I have no
19 -- no idea how someone like this can perform as --
20 as a business owner.
21 CHAIRMAN LEONARD: Thank you, Mr. McMullin for

1 started, were there extras that you asked for?
2 MR. MCMULLIN: Well, we had -- when we first
3 had the walk through with Mr. Hartfield, I told him
4 I wanted hardwood doors throughout. I wanted pull
5 out drawers in all the cabinets. You know, I went
6 through a list, and he says, that's fine. And his
7 son is telling him to take notes, and he says, No,
8 I got it all up here. And then he told his kid to
9 take the notes. And then when the contract came
10 out, I said -- and we got here in September.
11 Actually, we told him we were coming. We had no
12 other choice because we needed to get our licenses
13 and stuff like that for Florida because our
14 licenses were about to expire and we had no home.
15 The only place we lived was in Florida.
16 We showed up and my locks were changed on my
17 house and I'm staying in a hotel for a few days
18 because the guy with the keys is down in the Keys
19 and says there's nothing I can do. We come in, we
20 start looking at things, I start questioning and
21 asking for stuff, and they're saying it's not in
22 the contract. I start looking at the contract. In
23 the contract it does say hollow core doors. That's
24 not what I asked for. My fault. My bad. I missed
25 it.

1 So I said, Fine. The more I heard that, I got
2 to the point -- 'cause I was asking Mr. Thomas and
3 everybody, where'd the money go? They're looking
4 for more money. They want me to pay -- they want
5 me to pay part of the end money up first before
6 it's done, and I'm like where'd the money go? I
7 wouldn't get an answer. So -- I'm losing my -- so
8 it's -- so when we asked for -- when we got to --
9 to the stuff in the -- like the appliances, for
10 instance, the appliances were supposed to be above
11 average appliances is what I told Tony Hartfield.
12 In the contract, it was -- I was told it was
13 all builder grade. That's not what we discussed.
14 So unless I wanted builder grade material, then I
15 needed to pay extra for above grade stuff. Then I
16 could pay for smart house stuff on top of that. So
17 smart house is going to work with the smart house,
18 this and that, it doesn't. The stove doesn't work
19 with the microwave. The electrical outlets and
20 stuff weren't working with the smart house. That's
21 why he was going to have someone else come back in.
22 They told me that I chose Alexa for a operating
23 feature, and I'd like to show them where I said
24 that because I said I -- I want a system that
25 works, and I don't want to have to say Alexa. They

1 said that I chose -- chose it, that's why the
2 doorbell doesn't work with the rest of the house.
3 The -- so -- and then we had upgrade of a
4 countertop. That countertop they were going to
5 install, first they told me one price. I told them
6 that's wrong. That's -- they're charged me for two
7 sheets of countertop. So it was double the price.
8 I caught it. I got an apology. They brang (sic)
9 it down.
10 Then they told me that I had to pay to have it
11 lifted up to the unit or else they're going to but
12 it into three pieces. They'd make a cut either
13 between the middle of the sink or the middle of the
14 inlaid stove. I talked with someone at Lowe's.
15 They said that's crazy. You can't do that. That's
16 a weak point and it's going to be a problem. So I
17 paid again for the lift. They needed a decision.
18 I had to make it.
19 So did I pay for extras? Did I agree to pay
20 for extras? Yes, 'cause I wanted it done the way I
21 wanted it done, and like I -- I should have been
22 more -- I should have hired an attorney, look at
23 the contract, done everything I should have done,
24 but I didn't, so I said, I'll eat that.
25 But then now we get to the closing, and -- to

1 the closing part of this and I'm trying to get
2 stuff done and they're telling me, Not gonna do it.
3 And then they put a lien on my property. And the
4 way I look at it is, in the conversation when I
5 kept asking where the money went, I said, We're
6 going to go strictly by the contract. Jake
7 Mattucci, Tony Hartfield, and Mr. Thomas all said
8 yes. I said, 'cause I can follow a contract. I've
9 read this thing a lot, a lot. If we're going to go
10 strictly by the contract, we'll go by the contract.
11 No change orders are pulled, then the way I look at
12 it, technically, I should get my money back.
13 I just want an end to this. I don't want them
14 doing this to other people. They're suing me, and
15 I would like to know if he even knows about it
16 because what I'm hearing is they're not even really
17 together, that it's just his license that's being
18 supplied for Tony Hartfield because Tony Hartfield
19 doesn't have a license.
20 I'd like to know who the -- who the plumbers
21 were. Tony Hartfield said he's the one that did
22 all the electrical work in the house. He ran the
23 wiring, he put the plugs in because the smart guy
24 wouldn't do it, and he doesn't know why they had to
25 pay him so much. They -- he was complaining about

1 him doing all the work and the other two were
2 getting paid and he's got all his money in this.
3 And I said, I don't care if it's your money or not.
4 I just care about my money.
5 Get the job done, you guys figure out your
6 in-house fighting, and then we can go from there.
7 But where I'm being sued -- I mean, I'd like to at
8 least know who's involved in the lawsuit. Is it
9 Sawgrass? Is it Tony Hartfield? I'd like to know
10 who the people are where they did the work on my
11 house. Maybe I can work something out that I can
12 get it fixed through them. Did they tell the
13 permit -- did they tell the HVAC people, 'cause I
14 paid for that permit. Did he tell them, Hey, don't
15 pull the permits because I don't know -- I don't
16 know Ricciardi that well, but I've had a couple
17 conversations with him on the phone, and if he knew
18 it was his responsibility to pull the permit, would
19 he? That I don't know. I don't know why -- I
20 mean, you got -- I don't know how it works. If a
21 subcontractor comes in under a contract, is he
22 saying it was their responsibility, not his?
23 That's what -- that's what he was saying on the
24 phone. I'm looking at the contract. He's the one
25 that's supposed to hold them, but again, I should

12 percent correct in -- in mostly everything that has
13 gone on through this project. So I am a license
14 holder. I keep it in a LLC just to keep it active
15 through out the years. I don't use it in my main
16 core of business. It's just something that's
17 happened. Yes, Anthony, Tony's son, sold the condo
18 to Mr. McMullin, and Tony and Jake, who is my
19 brother-in-law, so Jake is my brother-in-law, Tony
20 is -- is a very good friend, decided that they
21 wanted to try and tackle doing a condo renovation.
22 So I agreed to help them, but as you know, that
23 this wasn't my primary function as -- as a
24 contractor. Day in and day out I work -- work in a
25 different facet of the business.

1 So this, as we said, started in really March
2 of 2020 when we were going into COVID and it was
3 pretty -- pretty different of an atmosphere for
4 everyone as contractor moving forward. The
5 contract was pretty -- pretty black and white, as
6 Mr. McMullin said. I do agree with him on some of
7 the -- the items that we do need. I've worked with
8 staff to try and get through to make any permitting
9 issues correct, even though we're five years down
10 the road. It is not my intent to be in any bad
11 standing with the City, the County or the customer
12 for that intent. So that's a little bit different
13 of a process now looking deeper into it. Staff's
14 been awesome in helping just trying to figure
15 out -- now I need a set of plans to submit that I
16 am not super familiar with in the process. So I'd
17 like to make it right for the customer. I was not
18 actively involved in the managing of the project.
19 I do believe Mr. McMullin in some of the
20 things that he's talked about. We always did
21 require -- the window people did pull permits and I
22 think that is -- is filed. The AC, I do think the
23 Ricciardi should have and I believe that the intent
24 from Tony and Jake was to get that done.
25 Apparently, that didn't happen.

1 So I'm willing to do whatever it is to make it
2 right, and I -- and I believe, too, on the outside
3 of it, now that I'm involved to a certain extent,
4 that I have gotta make it right with Mr. McMullin
5 as well. Financially, I don't -- I -- I heard that
6 they did go to lawsuit or -- I -- I have no
7 intentions. I was not part of any of that, but I
8 will retract all that if -- if need be. So I'm not
9 here to make a customer go through anything. I
10 mean, if we're sitting here five years later,
11 apparently, this has been a headache for everybody.
12 I guess my point is, what do I need to do to
13 make the opportunity to make this correct with the
14 City, and I guess this will be another discussion
15 with the customer to make sure that we can make it
16 correct with the customer as well.
17 CHAIRMAN LEONARD: Mr. Thomas, thank you. I
18 mean, as you know, you're a license holder. You're
19 the one --
20 MR. THOMAS: Yeah, a hundred percent I'll take
21 responsibility.

4 going in -- and I will say this, was to do the
5 flooring and the cabinets. I mean, basically, I
6 would say that most of the work that's done is
7 kitchens and baths.
8 CHAIRMAN LEONARD: That's not -- that's not
9 what the contract says --
10 MR. THOMAS: No, I understand.
11 CHAIRMAN LEONARD: -- and that's not what we
12 have some pictures done.
13 MR. THOMAS: No. No, I'm not -- I'm not
14 denying. I mean, they -- they changed some
15 drywall. I know that they worked with the -- the
16 building to make sure that the plumber -- I know
17 there was a question about the plumber. Usually
18 you go in and -- and bail out the building to
19 upgrade their piping and whatnot. So this is what
20 I was getting, and -- and like I said, I probably
21 was not as hands-on into this program as I should
22 have been. Well, I definitely was not, but here I
23 am five years later going to do what we can to make
24 it right. But yes, you're correct. And I did --
25 and I will say that I did reach out in -- in 2020

1 to the County. And honestly, up until recently was
2 the first time I ever heard about a -- a commercial
3 permit needed, but back then when it was explained
4 that this flooring kitchens and cabinets -- and
5 then we're going into non-in-person permitting that
6 the County, at that point, was a little bit unsure
7 of what was actually the scope of work being
8 executed. And I was probably a little bit too far
9 stretched away from it for understanding the depth
10 of what was happening on that property.
11 CHAIRMAN LEONARD: And as you know, you're
12 ultimately responsible for everything --
13 MR. THOMAS: A hundred percent. A hundred
14 percent.
15 CHAIRMAN LEONARD: -- going on there.
16 MR. THOMAS: I'm -- I'm here because I care.
