Section 10-58 – Procedure for obtaining certificate of competency, 2(e) requires a letter of recommendation verifying experience from a local contractor who holds a certificate of competency for the same trade. The application shall include the following information: (e) Three letters of recommendation; two of the letters shall be from reputable business or professional persons not related by blood or marriage to the applicant. At least one of the three letters of recommendation shall be from a contractor certified or registered bythe state or the state in which the applicant most recently resided before becoming aresident of the state and shall have the contractor's license number included in theletter. A letter from a local contractor who holds a certificate of competency is accepted in place of the state contractors as long as the certificate of competency is of the sametrade that is being verified. If the contractor who is verifying the experience is related byblood or marriage, the contractor must show proof of being active as a contractorregistered or certified by the state or the state in which the contractor most recentlyresided or had a local certificate of competency at the time of verification and must be of the same trade that is being verified. All three letters of recommendation shall address the applicant's knowledge, experience, and ability as a contractor. All three letters mustbe notarized. Mr. Ponce is before the Board under Review because he is unable to provide at least one letter of recommendation showing four (4) years of experience from a contractor certified or registered by the state or a letter from a local contractor who holds a certificate of competency in place of the state certificate as long as the certificate of competency is of the same trade that is being verified. Without the required document, staff is unable to sponsor Mr. Ponce to take the A/C Class "B" examination. In place of the letter of experience, Mr. Ponce has provided copies of 4 years of W2’s for the Board to review. If the Board approves the documents submitted by Mr. Ponce staff will sponsor him to take the A/C Class "B” examination. From: Saint Lucie County Seniors vs Crime <saintlucie@svcproject.org> Date: Mon, Apr 7, 2025 at 3:31 PM Subject: Marilyn Summers v JB Roofing & Weatherproofing, LLC Attention: Mr. Michael Jerrahiam St. Lucie Building Official Dear Mr. Jerrahaim: As a follow-up to our most recent phone call, the following is a recapitulation of the events that have taken place since I was assigned the above captioned case on 02/20/25. 2 On 02/04/25, Marilyn Summers submitted a Request for Assistance (RFA) from Seniors vs. Crime, a Special Project of the Florida Attorney General's Office. Seniors vs. Crime was founded in 1989 to help prevent seniors from becoming victims of crime and fraud, and to assist the Florida Attorney General's Office, by helping seniors resolve issues against businesses that may have taken advantage of them. Throughout Florida, Seniors vs. Crime is staffed by UNPAID VOLUNTEERS, who are given the charge to investigate the matter in an effort to bring the matter to a fair resolution. Upon receiving the case, I contacted Marilyn. Summers (MS) on 02/20/25 and reviewed her RFA. Mrs. Summers asserted that her manufactured home in Port St. Lucie needed a new roof, so on or about 10/18/24 she entered into a contract with JB Roofing and Waterproofing (JB) for approximately $7800, to cover the cost of the replacement from the existing metal roof to a new shingled roof and the necessary permits. Moreover, two (2) sheets of plywood were included in that price and any additional sheets would be an additional charge. MS agreed to move ahead, gave JB a deposit, and on or about 10/28/24, the demolition of the roof commenced. On or about 10/30/24, the new shingles were delivered along with 43 extra pieces of plywood, and MS was given an additional invoice of approximately $ 7500, making this $7800 job now $15,000. With her existing roof having been already removed, although she felt cheated, she felt that she had no choice but to pay JB the additional money requested ($10,000 to date), and get her home water tight. Upon completion of the job, MS complained to the workers on the scene about their "shoddy workmanship", which she alleged they ignored. In turn, MS called JB to have them make the roof right before she made her final payment. and JB said that she had to pay him in full before he would come back to do warranty work as per his contract. MS claims that she made several attempts to contact JB to fix the problems to no avail. Then on or about 12/17/24, heavy rains caused major leaks in her roof, prompting her daughter to affix a tarp across the entire roof, yet according to MS, JB refused to come back and make the necessary repairs until his entire bill was paid in full. Frustrated and not knowing where to turn, MS contacted St. Lucie Planning and Development, and was told that since she was changing her roof material from metal to shingle, a permit needed to be pulled, which JB didn't do in a timely manner. As part of my investigation, I reached out to the St. Lucie building Department and was told that JB first pulled the required permit on 0130/25, months AFTER the job was started. Moreover, when the job was inspected by the Building Department, it FAILED! On 02/27/25 I was able to make contact with Mr. John Buss, the owner. Specifically, I asked about how, as a roofing professional, he was so far off on the number of sheets of plywood, he responded that there was "no way of me knowing". When I asked why he did not go back and make the necessary repairs, JB stated that I should read his contract and that every possible loophole is covered, including that he will not do any warranty repairs until he is paid in full. He initially offered to send me a copy of the contract, but then changed his mind, telling me that MS complained, so get it from her. Also, he insisted that he was not required to get a permit at the time he did the job, as the law was changed after MS's job was started. Also, according to JB, fees for the engineer's and/or architect's plans are MS's responsibility. His responses prompted me to reach out to the county for clarification. I spoke to Clyde Hesselsinger who told me to speak to the Building Official, Michael Jerrihiame (MJ). I relayed JB's position on the permitting issue and MJ informed me that he started his position on 05/20/24, and that it has ALWAYS BEEN the requirement that if the material os changed on a manufactured home (ie. metal to shingle) that a permit was NECESSARY. He went on to explain that manufactured homes fall under federal HUD/Dept. Highway & Motor Vehicle Safety and would not have required a permit if doing a Level 1 roof renovation of like material to like (ie. metal to metal), however with Level 2 renovations where the type of roofing 3 material was being changed (like in this case of going from metal to shingle), this falls under Florida guidelines and REQUIRED a PERMIT! When I asked MJ if he thought that it was reasonable for a licensed roof professional to be so far off in their estimate of how many sheets of plywood was needed and that JB had no of knowing that he needed to replace 43 pieces (in addition to the 2 he included in his initial contract), he said that it is not a typical scenario. Also, I was told that with Level 2 renovations, plans were required prospectively, and interval inspections were required throughout the job that were not done. On 03/13/25, I spoke to JB for the second time to address and I enumerated each of his defenses and confronted him with the responses from MJ, instead to discussing them JB became agitated, and stated that [MJ] is "full of sh-t" and that he is "covering his a-s." He concluded by saying, "Go ahead and pass this to the Attorney General" and that was the last time we spoke. Also, I have been advised that MS has been in contact with Detective Mitchell Mazanoski (772-359-7261) of the St. Lucie Sheriff's Office, but I have not been able to connect with him to date. It is my opinion that based on the above noted investigation findings, that MB was given a low-ball estimate, only to have it doubled when the roof was off her home. Moreover, since the basic regulations of permitting and professional plans were ignored by JB, I am concerned about the safety of MS. Notwithstanding that JB's contract may cover every possible loophole in his favor as he contends, it is unfortunate that a Florida senior has to go through this in their golden years.
