SAMPSON: Yeah, well, my name is 13 Adam Sampson. I'm -- 14 MR. CHAIRMAN: Walk in to the mic -- talk into 15 the mic. There you go. 16 MR. SAMPSON: I'm a Fort Pierce native. I 17 grew up around here. My dad was a general 18 contractor in the area. My family were business 19 owners. I started a plumbing business about ten 20 years ago, and, yeah, we've been trying to grow and 21 build it since then. We're located right here 22 in -- in the community and -- 23 MR. CHAIRMAN: Mr. Taylor, would you like to 9 come up, please be sworn in, and tell us a little 10 bit about yourself. 11 MR. TAYLOR: Sure. 12 MS. WILLIAMS: I have a summary I would like 13 to read in, into the record, if you don't mind. 14 MR. CHAIRMAN: Oh, fantastic, Ms. Williams. 15 Please, by all means. 16 MS. WILLIAMS: Just to refresh everyone's 17 memory, Mr. Taylor is applying to be reciprocated 18 from Brevard County to be an electrical contractor. 19 Our ordinance requires that he has to have a letter 20 of experience from a licensed electrical 21 contractor. Mr. Taylor was unable to provide the 22 letter verifying six years of experience from 23 electrical contractor. 24 Mr. Taylor -- Mr. Taylor worked from 25 Earl Minion, Jr. owner of Minion Electric. The Page 7 1 business was located in the State of Pennsylvania. 2 However, he has passed away in 2012, so he's unable 3 to get that letter from him. Mr. Taylor was 4 sponsored and licensed by Brevard County. In 5 Brevard County, also he was unable to provide a 6 letter of experience from Brevard County; however, 7 he attested to his own experience, provided letters 8 of recommendation from professional businesses and 9 by him providing his tax records to Brevard County, 10 they issued him a license. 11 Staff is bringing this case before the Board 12 today on a review because Mr. Taylor is unable to 13 provide what's required by our ordinance, and in 14 your package, you'll see his Schedule C from 2007 15 to 2012. So he's here today to speak to the Board 16 to get licensed in St. Lucie County. 17 MR. CHAIRMAN: Ms. Williams, thank you so 18 much. Mr. Taylor, thank you for being here. I've 19 had an opportunity to read through the packet that 20 was provided by staff. I think they did an amazing 21 job, and I think you provided with a lot of 22 information. It's just sad that you couldn't get a 23 letter for your experience because you wouldn't be 24 in front of the Board here for review if you had 25 that, but I -- I have a lot of information here. Page 8 1 Please kind of give us a little summary of your 2 experience and go from there. 3 MR. TAYLOR: I've been working as a contractor 4 since -- 5 MS. JOHNSON: He has to be sworn -- 6 MR. CHAIRMAN: Thank you, Mr. Taylor. Page 9 1 MR. TAYLOR: All right. I've been a 2 contractor not long after high school. I started 3 out in plumbing. My father and my grandfather were 4 both plumbing contractors. I didn't really like it 5 that much and decided to transfer to the electrical 6 trade when I was about 25, 27, maybe a little 7 younger, and I've been doing business for -- in 8 Pennsylvania I did business for, like, 35 years, 9 and then I've been doing business down here for 10 about six months. 11 MR. CHAIRMAN: Okay. Well, welcome to the 12 area. 13 MR. TAYLOR: Thank you. 14 MR. CHAIRMAN: Does any of the Board members 15 have any questions of Mr. Taylor? 16 MR. DiFRANCESCO: Mr. Taylor, so you -- you 17 said you live in Vero? 18 MR. TAYLOR: Yes, sir. 19 MR. DiFRANCESCO: How come you took the test 20 in -- 21 MR. CHAIRMAN: Brevard. 22 MR. DiFRANCESCO: -- Brevard County? 23 MR. TAYLOR: How come I -- they don't do the 24 testing in Vero. Indian River does not do a 25 licensing examination. TAYLOR: I didn't really have a preference 4 and picked Brevard probably because it was first in 5 the alphabet. 6 MR. DiFRANCESCO: So you took your business in 7 law in October, 2020? 8 MR. TAYLOR: Yeah, that's about right. Yep. 9 MR. DiFRANCESCO: How come you didn't take the 10 other one until 2021, in April? 11 MR. TAYLOR: I had some health issues when I 12 came down here, and I wanted to study for the exam. 13 The business law was pretty simple. 14 MR. DiFRANCESCO: So you've been licensed in 15 Brevard County since April? 16 MR. TAYLOR: Is that right? Yeah, that sounds 17 about right. 18 MR. DiFRANCESCO: Because I noticed you didn't 19 have any letters from anybody in Vero or where you 20 do business at. 21 MR. TAYLOR: It's difficult to get -- I wasn't 22 a licensed contractor, so I wasn't able to do 23 business in Vero. 24 MR. DiFRANCESCO: But you've been doing 25 business since April? Page 11 1 MR. TAYLOR: Yes, sir. 2 MR. DiFRANCESCO: You don't do business -- 3 what do you do, just -- you do new construction, 4 new homes? 5 MR. TAYLOR: No, and never will. 6 MR. DiFRANCESCO: What is it you do? 7 MR. TAYLOR: Mostly service work, remodels, 8 recessed lighting, panel upgrades, panel 9 replacements. 10 MR. DiFRANCESCO: Okay. So you deal with 11 mostly homeowners. I said you deal with mostly 12 homeowners so that's why you wouldn't be able to 13 get no letters -- 14 MR. TAYLOR: Yes. 15 MR. DiFRANCESCO: -- any business people? 16 MR. TAYLOR: That would be correct. I'm 17 trying to get started, established. 18 MR. DiFRANCESCO: How did they -- how did 19 Brevard County allow you to take the test? Did you 20 have to go through a review like this? 21 MR. TAYLOR: No, sir. 22 MR. DiFRANCESCO: No? 23 MR. TAYLOR: No. 24 MR. DiFRANCESCO: They just said go ahead? 25 MR. TAYLOR: I was able to provide them with Page 12 1 six years of a Schedule C from running my own 2 business in Pennsylvania -- 3 MR. DiFRANCESCO: I see that. 4 MR. TAYLOR: -- which I had been running for 5 years previous to that, but that's the furthest 6 back I had Schedule Cs for. 7 MR. DiFRANCESCO: And so your plans for 8 St. Lucie County is pretty much the same thing that 9 you've been doing, just homeowners and stuff like 10 that? 11 MR. TAYLOR: Yes, sir. 12 MR. DiFRANCESCO: Mr. Chairman, I'm ready to 13 make a motion. 14 MR. CHAIRMAN: Mr. DiFrancesco -- does anybody 15 else have a question for Mr. Taylor on the Board 16 before we hear a motion? 17 (No response.) 18 MR. CHAIRMAN: I do think this is probably one 19 of the best things that this Board actually does is 20 review and go through and allow and license and -- 21 MR. DiFRANCESCO: It's common sense. 22 MR. CHAIRMAN: Mr. Cicio, up next. Waiver of 23 right to a hearing for failure to pay a citation. 24 MR. CICIO: Yes. Good morning. 25 MR. CICIO: For the record, I'm submitting a 2 total of 13 photos; 10 taken on June 7, 2021 at the 3 property address of 6303 South Indian River Drive 4 in Fort Pierce, including a photo showing that a 5 stop work order was posted; one taken on 6 November 10, 2021 showing the property posted with 7 a copy of the citation and citation letter; and two 8 taken on November 30, 2021, including a photo 9 showing that the property posted with a 10 Notice to Appear before the December 15, 2021 11 Contractor Licensing Board. 12 On June 7, 2021, I inspected the property 13 located at 6303 South Indian River Drive in 14 Fort Pierce where I observed a construction crew 15 installing an addition to the front of a 16 residential dwelling. Based on my investigation, 17 the crew was identified to be employees of 18 Slater Construction, LLC. A computer check 19 revealed that the permit for the renovation, 20 Permit No. 2104-0855, for adding covered front 21 porch and infilling garage opening to French doors 22 was in a pending status due to unresponded to 23 comments from plan review and zoning. 24 I attempted to contact Mr. Dillon Slater with 25 Slater Construction on several occasions during my Page 15 1 inspection, but my calls were not accepted. A stop 2 work order was posted on the property, and my 3 business card, with contact information, was left 4 with the crew foreman. I did request a phone call 5 from Mr. Slater. 6 On June 8, 2021, I mailed out a $500 citation, 7 Citation No. 230, for proceeding on a job site 8 without first obtaining a building permit, along 9 with a citation letter, certified mail, which was 10 undelivered. I posted the property on 11 November 10, 2021 with a copy of the citation and 12 citation letter. 13 I have had limited email contact with 14 Mr. Slater only. He was advised of the citation 15 posting by email on November 10, 2021. Since the 16 citation remained unpaid, a Notice to Appear before 17 the December 15th, Contractor Licensing Board was 18 mailed out certified mail, which also remained 19 undelivered. A copy of a Notice to Appear was 20 posted on the property on November 30, 2021, and 21 again, Mr. Slater was notified by email. 22 Since the citation remains unpaid, staff is 23 recommending that the lien be placed on the real or 24 personal property of Mr. Dillon Slater, Slater 25 Construction, LLC, if the citation is not paid Page 16 1 within 30 days. 2 And just for the Board's information, the 3 permit was finally issued on November 2nd of this 4 year. 5 MR. CHAIRMAN: So the citation was given 6 without providing -- pulling a permit and he 7 subsequently has pulled a permit, November 2nd, is 8 that what you said? 9 MR. CICIO: That is correct. Yes, sir. 10 MR. CHAIRMAN: You posted, you took pictures 11 back in June, you posted everything, you sent them 12 everything. Is Mr. Slater here? I think you said 13 you had limited email conversations with him. This 14 is a lot of construction not to pull a permit. 15 MR. CICIO: A lot of construction. And I do 16 have copies of the emails, my correspondence with 17 him if the Board is willing to see it. 18 MR. CHAIRMAN: Yeah, please, I'd like to. 19 Was the homeowner made aware that -- that a 20 lot of this construction was done without a permit? 21 MR. CICIO: Yes. As a result of these cases, 22 two code enforcement cases were opened up. They 23 both went to Code Enforcement Board, I believe, in 24 September. Nobody appeared. The property went 25 into default, and as soon as they received the Page 17 1 default letter, the property owners, they made 2 contact with me and explained to me that they 3 wanted to get this rectified and they were having a 4 hard time getting in touch with Mr. Slater as well, 5 but, ultimately, the permit was issued on 6 November 2nd. 7 MR. CHAIRMAN: Okay. So that contractor did 8 pull a permit. Do we know if there's been any 9 inspections on that permit since the permit was 10 pulled? 11 MR. CICIO: I'll have to defer to 12 Mr. Doug Harvey for that. 13 MR. HARVEY: Thank you, Mr. Chairman. Good 14 morning members of the Board. Doug Harvey, 15 building official, for the record. 16 The permit was originally applied for in May 17 and there were a number of questions on the items 18 that were submitted. There was missing 19 information. We did not have loading information. 20 Since then, we were able to get the permit 21 issued, as Mr. Cicio said, in November. At this 22 point in time, we are still waiting for a recorded 23 Notice of Commencement to be put on file. By law, 24 we are not able to perform an inspection until we 25 have the recorded Notice of Commencement. 6 (Pages 18 to 21) ebe19bbd-22d5-4cff-9ed0-5ad8e42f4c68Electronically signed by Karen M. So the 3 permit was issued without a Notice of Commencement 4 but no inspections were called in because, 5 obviously, he hasn't provided that proper 6 documentation. 7 MR. HARVEY: Yes, sir. That is correct. 8 MR. CHAIRMAN: Thank you. Does the Board have 9 any questions of staff? 10 MR. DiFRANCESCO: I do. Danielle, do we know 11 how long Mr. Slater has been in business in 12 St. Lucie County? How long has he been a 13 contractor licensed in St. Lucie County? 14 MS. WILLIAMS: That I don't know. I'm sorry. 15 MR. CHAIRMAN: Licensure date was April 10th 16 of 2018 as a general contractor. I don't know if 17 it was St. Lucie County. It says his county is 18 Indian River County, Michael, if you look at the 19 DBPR listing. He's been a contractor now since 20 2018, a little over three years. 21 MR. DiFRANCESCO: Mr. Harvey, do we know if 22 he's got -- does he have any outstanding permits 23 other than this, St. Lucie County? 24 MR. HARVEY: I apologize. I did not look for 25 that information. I can try and check it now. Page 19 1 MR. DiFRANCESCO: Sure. 2 MR. CICIO: Mr. Chair? 3 MR. CHAIRMAN: Yes. 4 MR. CICIO: Mike Cicio for the record. Just 5 to confirm his Certificate of Competency for 6 St. Lucie County was issued on 8/20 of '18. 7 MR. CHAIRMAN: 8/20 of 18? 8 MR. CICIO: Yes, sir. 9 MR. CHAIRMAN: Thank you, sir. So he's been a 10 licensed contractor in St. Lucie County for over 11 three years. Applied for a permit, multiple 12 comments were made, and then started work on the -- 13 on the building and is not here to tell us his side 14 of the story. Okay. 15 Mr. DiFrancesco, do you need to have that 16 information from Mr. Harvey? 17 MR. DiFRANCESCO: No. 18 MR. JERGER: I make a motion to accept staff's 19 recommendation. 20 MR. DiFRANCESCO: He can't come here to -- he 5 knew he was supposed to be here to defend himself. 6 Is there -- I'm asking staff, is it possible to 7 suspend his license for six months in St. Lucie 8 County? 9 MS. BARBIERI: Mr. Chairman, Assistant County 10 Attorney, Katherine Barbieri. All that the 11 contractor is on notice for is the citation hearing 12 today. 13 MR. CHAIRMAN: Yes, ma'am. 14 MS. BARBIERI: And for disciplinary hearings, 15 which is what you would have for the suspension, 16 there needs to be a complaint filed and he needs to 17 be put on notice and brought to the Board. That is 18 not before the Board today, and I don't know if 19 Mr. Cicio has a complainant or not. 20 MR. CICIO: At this time, I do not have a 21 formal complaint from the property owner on this 22 contractor. 23 MR. DiFRANCESCO: So I guess my question is, 24 is the -- it's St. Lucie County who's being duped 25 here because they didn't -- he's not doing his duty Page 21 1 as a licensed contractor in St. Lucie County. 2 MR. CHAIRMAN: Well, like Mrs. Barbieri said, 3 unfortunately, all we have right now is the civil 4 penalty in front of us, and remember we voted on 5 years ago what the first offense, second offense 6 and third offense would be, and unfortunately -- 7 MR. I thought every other month is a lot more 23 consistent for everyone's schedules personally.
