CALL TO ORDER: The meeting was called to order at 8:38 a.m.
B. ROLL CALL OF BOARD MEMBERS: The roll was called. Board members Doug Davis, Dennis Parker, and Roger Hudspeth II were excused. C. APPROVAL OF MINUTES: January 15, 2020 Contractor Examining Licensing Board Meeting Motion was made by Mr. Langel to approve the amended Minutes of the January 15, 2020 meeting. Mr. DiFrancesco seconded and the motion carried unanimously. APPROVAL OF MINUTES: February 26, 2020 Special Contractor Licensing Board Meeting Motion was made by Mr. DiFrancesco to approve the Minutes of the February 26, 2020 meeting. Mr. Pride seconded and the motion carried unanimously. D. THE FOLLOWING APPLICATIONS ARE RECOMMENDED FOR REVIEW BY THE BOARD:
Vice Chairman Leonard stated our last applicant is one that will come before us this morning for review. He stated he will turn it over to staff to bring the Board up to speed on this applicant. Officer Williams addressed the Board and stated he was told that he needed to come here in order to be reviewed, but since he is not here, we will move on. Vice Chairman Leonard stated ok. He stated we will close that portion for review by the Board. G. CITATION APPEAL: 1) Steve’s Home Repair and Services Inc.
Vice Chairman Leonard stated next on our agenda we on to our next portion of the meeting citation appeal. He stated the first one is against Steve’s Home Repair Services Inc. He stated he will ask Staff to bring the Board up to speed on this item. Officer Cicio addressed the Board and stated good morning, he hopes the Board can hear him with his mask on. He stated for the record he is submitting a picture that he took along northbound Turnpike Feeder Road on April 7, 2020. He stated the sign was attached to a tree on the County’s right-of-way. Officer Cicio stated on April 7, 2020, he received a call from Building Inspector, Steve Poreba about an advertisement posted along northbound Turnpike Feeder Road, south of Indrio Road. He stated he proceeded to the location and found the reported sign. Officer Cicio stated he contacted the phone number listed on the sign and shortly thereafter received a phone call from a male who identified himself as Steve. He stated during his conversation with Steve, he claimed that he lives in Okeechobee, that he did post the sign as a form of advertisement and can perform all trades listed painting, carpentry, electrical, drywall, plumbing and flooring. Officer Cicio stated he explained to Steve his job position with St Lucie County and that his advertisement is in violation of St Lucie County Ordinance. He stated he further advised him that the trades of electrical and plumbing were state regulated and that he would need to be a state licensed contractor to advertise. Officer Cicio stated Steve claimed that he was unaware that he was violating any ordinance. He stated Steve admitted that he had posted other signs in the area and claimed that he did not know exactly where they were. He stated he informed Steve that he would be giving him a few days to have those signs removed to avoid any civil action by the department and he agreed. Officer Cicio stated he researched the phone number for Steve and found a number that was listed to belong to Steve C. Robinson located in Okeechobee with a home mailing address. He stated he searched the Division of Corporations and found an inactive business for Steve C. Robinson with the name of Steve’s Home Repair and Service Inc. with the same mailing address as Steve C. Robinson. Officer Cicio stated on May 1, 2020, County Inspector, Steve Poreba located two (2) more signs in the vicinity of Indrio Road with the same advertisement as the one removed by me on April 7, 2020. He stated a five hundred dollars ($500) citation, Citation No. 149 along with a citation letter was mailed by certified mail to the home address for Steve Robinson, which was delivered and signed for on May 9, 2020.

Officer Cicio stated on May 12, 2020 he received a call from Mr. Robinson and he claimed that he was unable to return to St Lucie County to remove any signs due to COVID-19 Pandemic. He stated he further claimed that my warning should have been sufficient enough and that this five hundred dollars ($500) citation is unwarranted. Officer Cicio stated Mr. Robinson submitted a written appeal by email which was received on May 12, 2020. He stated as of June 29, 2020, Mr. Robinson has failed to pay the citation or correct the issue by obtaining the proper license to perform any other work advertised on his signs. He stated no further communication has been made. Officer Cicio stated a Notice to Appear was mailed by certified mail which was properly served, therefore, Staff is requesting a lien to be placed on real and/or personal property if the citation is not paid within thirty (30) days. He stated Mr. Robinson is here to speak to the Board. Vice Chairman Leonard thanked Officer Cicio for bringing the Board up to speed on the case. He asked Mr. Robinson to come to the podium and be sworn in by the Recording Secretary. Mr. Robinson was sworn in by the Recording Secretary. Vice Chairman Leonard addressed Mr. Robinson stated good morning. Mr. Robinson addressed the Board and stated he has not been into Port St Lucie. He stated he has been in Okeechobee and he did not come back into Port St Lucie. Vice Chairman Leonard thanked Mr. Robinson for being at the meeting. Mr. Robinson stated he has a friend that lives in Fort Pierce and he asked him to remove one of the signs for him. He stated he does not know if he removed it or not and the where he stands with this. He stated he did post the signs and they were all posted the same day. He stated he told Officer Cicio that he posted the sign and that there was a couple more. He stated he did not get in to remove them. Vice Chairman Leonard stated so Officer Cicio told you to that you had ample time to remove them and that you were violation of St Lucie County Ordinance and you chose not to remove them. Mr. Robinson stated no. Vice Chairman Leonard stated so you are here to appeal the fine and violation for you not doing what Mr. Cicio asked you to do. Mr. Robinson stated we are in a different stage than we normally are, so he did not make it back into Port St Lucie. He called and asked a friend to remove the other signs and he does not know if he removed them. There was further discussion among the Board, Staff and Mr. Robinson regarding the citation. Vice Chairman Leonard stated he would like to entertain a motion. Mr. Pride made a motion to accept staff’s recommendation of $500.00 citation fee to be paid within thirty (30) days of the date of this Board meeting and authorize staff to place a lien against the contractor if not paid within thirty (30) days. Mr. Langel seconded and the motion carried. Vice Chairman Leonard asked for a roll call vote. Mr. DiFrancesco – Yes, Mr. Langel – Yes, Mr. Jerger – Yes, Vice Chairman Leonard – Yes, Mr. Pride – Yes, Mr. Zrallack - No. The motion carried.
Vice Chairman Leonard thanked Mr. Robinson for attending the meeting. Mr. Robinson stated what now. Vice Chairman Leonard stated he highly recommends that he pays his fine and that if he decides to do work in St Lucie County again, he will get the necessary licensure to do so. Mr. Robinson stated so you are telling me that I need to pay this fine. Vice Chairman Leonard stated Staff’s recommendation was for you to pay the fine hard work and the Board voted on it, yes sir. He stated you have to be licensed in St Lucie County in order to advertise.

Douglas Harvey, Building Official stated he apologizes for the interruption. He stated if he may just add to that, this is not only St Lucie County. He stated Florida Statute 489 covers contracting within the State of Florida and in order to do much of the work that you have advertised, in order to work anywhere in the State of Florida requires proper licensure, not just St Lucie County. Douglas Harvey, Building Official stated you are in violation of the Department of Business and Professional Regulations and Florida Statute by doing this work anywhere in the State of Florida. Thank you. Vice Chairman Leonard stated also Mr. Robinson, contracting without a license is a criminal offence. He stated he highly recommends if he decides to do contracting, he should get a license to perform the work. Thank you. CITATION APPEAL: 2) Pedro G. Etchebest / Don Pedro and Sons LLC
Vice Chairman Leonard stated we have citation appeal number two against Mr. Pedro dba Don Pedro and Sons LLC. He asked Staff the bring the Board up to speed on the citation. Officer Cicio addressed the Board and stated Mr. Etchebest paid his citation late yesterday evening, so therefore case is closed. Vice Chairman Leonard stated the case is closed. Officer Cicio stated yes sir. H. DISCIPLINARY CASE: 1) Tricore Partners USA LLC – Darrian Kelly
Vice Chairman Leonard stated next is our disciplinary case against Tricore Partners USA LLC. He asked Staff to bring the Board up to speed on this case. Officer Cicio addressed the Board and stated Mr. and Mrs. Kelly could not be here today, therefore Staff would like to make a recommendation to the Board to continue the case to the October 21, 2020 Contractor Licensing Board Meeting. Vice Chairman Leonard asked if the Board needs to vote on that. Assistant County Attorney, Katherine Barbieri addressed the Board and stated it is her understanding if they are asking it because they are going to seek legal counsel and she believes at this point for due process. She stated it would be appropriate to continue to the October 21, 2020 at 8:30am and she would ask they do the motion so they will get a copy of the order showing that is was continued. Vice Chairman Leonard stated thank you so much. He stated so we have Staff’s recommendation to table this case until the October 21, 2020 meeting at 8:30am. He asked for a motion. Mr. DiFrancesco made a motion to accept staff’s recommendation to continue the case to the October 21, 2020 Contractor Licensing Board meeting at 8:30am. Mr. Langel seconded and the motion carried unanimously. DISCIPLINARY CASE: 2) Scott’s Screen & Construction LLC – Scott Barber Vice Chairman Leonard stated next is our disciplinary case against Scott Barber dba Scott’s Screen & Construction LLC. He asked Staff to bring the Board up to speed on this case. Officer Cicio addressed the Board and stated for the record he is submitting: (1) A copy of the complaint affidavit received on February 14, 2020, by property owners Robert and June Beers. (2) A contract between contractor Scott Screen and Construction Inc., Mr Scott Barber and Mr. & Mrs. Beers dated
on July 20, 2019.
(3) A copy of check 1176 made out to Scott screen & Construction Inc. in the amount of two thousand dollars
($2,000.00) cash on July 26, 2019.

(4) A copy of check 1177 made out Scott screen & Construction Inc. in the amount of fifteen thousand dollars
($15,000.00) cash on October 16, 2019.
(5) Three (3) photos taken during his inspection on February 18, 2020

Officer Cicio stated on February 14, 2020 a complaint was filed against Scott’s Screen and Construction Inc., Mr. Scott Barber who contracted with Mr. and Mrs. Robert Beers on July 20, 2019 for the removal and replacement of a pool enclosure, addition of a poly room, new gutter installation, cost of drawings and permits and to clean out gutters and to add gutter guards. Officer Cicio stated on July 25, 2019, a deposit of two thousand dollars ($2,000.00) was paid to Scott’s Screen and Construction Inc. via check 1176 which was cashed on July 26, 2019. He stated on October 15, 2019 Scott’s Screen & Construction received another check no. 1177 in the amount of fifteen thousand dollars ($15,000.00) which was cashed on October 16, 2019. He stated the total contracted cost is listed to be twenty-four thousand two hundred and ninety-six dollars ($24,296.00) with a balance of seven thousand two hundred and ninety-six ($7,296.00) due upon completion. Officer Cicio stated as work did not commence as agreed Mr. & Mrs. Beers filed a complaint with the St Lucie County Sheriff’s Office with Detective David Felix on November 18, 2019 for alleged fraud against senior citizens. He stated Scott’s Screen and Construction Inc. did commence work in January 20, 2019, but only installed an unpermitted poly room to a detached garage storage building on the property. He stated additional cast obtained to the Beers was thirty-two hundred dollars ($3,200.00) paid to Josh B Concrete Perfection for concrete footers, which was permitted and eight hundred and fifty dollars
($850.00) paid by check to BSM & Associates for a lot survey. Officer Cicio stated a computer check revealed no permits for a screen room removal or construction work was applied for. He stated he met with Mr. Barber on February 18, 2020 and he admitted to starting work without a permit. He stated he claimed that he was just trying to get ahead of the job. He stated Mr. Barber claimed majority of the money paid by Mr. and Mrs. Beers was for supplies and materials that he had to procure. Mr. Barber stated that he would apply for a permit as soon as possible. Officer Cicio stated a five hundred dollars ($500.00) citation, Citation No. 138 was issued to Scott’s Screen and Construction Inc. for proceeding on a jobsite without a building permit or inspection. He stated the citation was paid in full by check on February 19, 2020. Officer Cicio stated he met with Mr. and Mrs. Beers on February 18, 2020, for a site inspection. He stated they walked him around their property and showed him the unpermitted structure constructed by Scott’s Screen and Construction Inc. He stated the structure was missing custom front doors, screens which they claimed Mr. Barber had ordered. Officer Cicio stated Mr. and Mrs. Beers further claimed that they had the structure inspected by another contractor, who advised them it was not built to code and may have to be removed. He stated Mr. and Mrs. Beers broke contract with Mr. Barber due to failing to pull permits and not a providing service. He stated Mr. and Mrs. Beers did hire another contractor for a contracted price of twenty-seven thousand two hundred and twenty-five dollars ($27,225.00). He stated a cost breakdown lists twenty-three thousand seven hundred and twenty-five dollars ($23,725) for a pool cage and extended enclosure, thirty-five hundred dollars ($3,500.00) to complete the poly room under detached garage storage room to bring to code. He stated this job has been fully permitted, completed, final inspected and the contractor paid in full. Officer Cicio stated Mr. and Mrs. Beers did occur a financial hardship as they did have to pay Mr. Barber seventeen thousand ($17,000.00) out of twenty-four thousand two hundred and ninety-six ($24,296.00) for contracted price and paid the new contractor twenty-seven thousand two hundred and twenty-five ($27,225.00) in full for the work they wanted done. Officer Cicio stated on June 30, 2020 a disciplinary letter was posted at Mr. Barber’s residential home address as well as the business listed on sunbiz. He stated disciplinary letters were also mailed by certified mail to those same addresses. He stated he did speak with Mr. Barber on July 13, 2020 and he did acknowledge receipt of the disciplinary letter. The following violations were noted: SLC CCL 10-26: - Prohibited activities: Sub Section: (9) Commit any willful, fraudulent act as a contractor as a result of which another is financially injured. SLC CCL 10-67: - Revocation or suspension of Certificate of Competency: Sub Section: (11) Proceeds on any construction job without first obtaining and posting the required county building permits and scheduling required inspections.

Officer Cicio stated Staff is recommending to suspend the permitting privileges for Mr. Scott Barber dba Scott’s Screen and Construction Inc. for a term not to exceed three hundred and sixty-five (365) days. He stated Mr. Barber is here and Mr. & Mrs. Beers are here. Vice Chairman Leonard stated thank you Mr. Cicio. He asked Mr. Barber to come up to the podium and be sworn in by the Recording Secretary. Mr. Barber was sworn in by the Recording Secretary. Vice Chairman Leonard addressed Mr. Barber and thanked him for being at the meeting. He asked Mr. Barber if he would like to tell the Board what happened. Mr. Barber stated he has a statement for everyone on the panel. He handed the statement to the Board members. He stated first of all, he would like to apologize to everyone in the room for starting the work without a permit. He apologized to Mr. and Mrs. Beers for the pain and anguish he caused them. He stated he really wished it would have gone different. There was further discussion among the Board, Staff, Mr. Barber and Mr. & Mrs. Beers regarding the case. Vice Chairman Leonard stated he has some questions for Mr. Barber. He asked Mr. Barber if he thinks they would be here if he pulled the permit. Mr. Barber stated no they would not. Vice Chairman Leonard stated what’s in front of the Board is to take his license for a year. Mr. Barber stated he understands that and that would take the food off his table, his two children and his employees for a year. Mr. Jerger stated he has a question. He stated Mr. Barber, can you just make it right. He stated make it right please. Mr. Barber answered absolutely. Mr. Jerger stated if the Board put this off until October, can he make it right. He stated can you say you are going to give them back the money Mr. Barber stated he has ten thousand dollars in cash in his truck that he brought today to resolve the matter, so he is prepared. He stated he came here today to make it right. Vice Chairman Leonard stated he would be willing to entertain a motion and take a vote on it, but he believes what Mr. Jerger is trying to say is, he does not want to see him in October. He stated if he was Mr. Barber he would make a proper business decision. Mr. Jerger made a motion to continue the case to the October 21, 2020 Contractor Licensing Board meeting at 8:30am.
Mr. DiFrancesco seconded and the motion carried unanimously. Vice Chairman Leonard asked for a roll call vote. Mr. DiFrancesco – Yes, Mr. Langel – Yes, Mr. Jerger – Yes, Vice Chairman Leonard – Yes, Mr. Pride – Yes, Mr. Zrallack - Yes. The motion carried unanimously. Vice Chairman Leonard stated Mr. Barber you have been provided sixty (60) days or a little bit longer. He stated he has faith in humanity, he has faith he will not see him. Mr. Barber stated you will not. He stated he wants to keep himself in good standing and he is not a crook. I. REQUEST FOR REINSTATEMENT OF PERMITTING PRIVILEGES: 1) Francisco F. Diaz dba Quality Air of America
Vice Chairman Leonard stated next we have request for reinstatement of permitting privileges. Officer Williams stated Mr. Diaz is going to join us virtually. She stated she has a summary to read. Vice Chairman Leonard stated ok. Officer Williams stated Mr. Diaz’s case was brought before the Contractor’s Licensing Board on May 15, 2019. She stated the Board found Mr. Diaz in violation of the following sections:

SLC CCL 10-26: - Prohibited activities: Sub Section: (9) Commit any willful, fraudulent act as a contractor as a result of which another is financially injured. (12) Commence or perform work for which a county building permit is required without obtaining the appropriate permit. SLC CCL 10-67: Revocation or suspension of certificates of competency. Sub Section: (3) Willfully disregards and violates an applicable state or local building code, regulation or law. (10) Commits fraud or deceit or other misconduct in the practice of contracting. (11) Proceeds on any construction job without first obtaining and posting the required county building permits and scheduling required inspections. Officer Williams stated two citations were issued to Mr. Diaz for not obtaining permits for work performed. She stated the first one was October 16, 2018 in the amount of five hundred dollars ($500.00) which was paid. She stated the second one was March 8, 2019 in the amount of one thousand dollars ($1,000.00) and to date has not been paid. Officer Williams stated on March 8, 2019, Staff receive a complaint from property owner of 4 Maya Way, who contracted Mr. Diaz of Quality Air of America Inc. to perform A/C work. Mr. & Mrs. Clarke paid Mr. Diaz a total of six thousand three hundred and sixty-one dollars ($6,361.00) for work that was not permitted or inspected. She stated the Board unanimously found Mr. Diaz in violation and revoked his permitting privileges for one (1) year. Officer Williams stated Mr. Diaz is requesting the Board to reinstate his permitting privileges. She stated if the Board does decide to re-instate Mr. Diaz’s permitting privileges, Staff is requesting the motion to state that Mr. Diaz’s Permitting privileges to be re-instated after Mr. Diaz pays the one thousand dollars ($1,000.00) citation that is still outstanding. Vice Chairman Leonard stated thank you so much. He asked Mr. Diaz if he could hear the them. Mr. Diaz stated yes, he is here and how can he help them. Vice Chairman Leonard asked Mr. Diaz why he has not paid the one thousand dollars ($1,000.00) citation. Mr. Diaz stated he thought they did. He stated he was not aware that it was not paid. He stated he could pay it right now. There was further discussion among the Board, Staff and Mr. Diaz regarding the re-instatement of his license. Mr. Zrallack made a motion to accept staff’s recommendation to re-instate Mr. Diaz’s license after the one thousand dollars ($1,000.00) citation is paid.
Mr. Pride seconded and the motion carried. Vice Chairman Leonard asked for a roll call vote. Mr. DiFrancesco – No, Mr. Langel – No, Mr. Jerger – Yes, Vice Chairman Leonard – Yes, Mr. Pride – Yes, Mr. Zrallack - Yes. The motion carried.
Vice Chairman Leonard stated he believes the Board has some old business. He stated he does not believe the Board elected officers this year. Recording Secretary answered we did. Officer Williams addressed Mr. Diaz and stated once the meeting is over she will be giving him a call to take the payment for the citation. She stated once the payment is received Staff will re-instate his license. Mr. Diaz stated ok, he really appreciates it. J. OLD BUSINESS: None.
