Proposed Future Land Use Map Amendment - 25th & Midway STAFF PRESENTATION: Irene Szedlmayer, AICP, Senior Planner, with Planning and Development Services. Ms. Szedlmayer stated that all public notification requirements were met per St Lucie County Development Code Section 11.00.03. Ms. Szedlmayer presented the Board with information regarding the applicant’s proposed amendment to the Comprehensive Plan Future Land Use Map to change the future land use designation from COM (Commercial) to RU (Residential Urban) on +/- 26.2 acres and RM (Residential Medium) on +/- 8 acres, for a +/- 34.2 acre site generally located at the northwest corner of 25th Street and Midway Road (beyond the Cumberland Farms Site). The RU Future Land Use permits up to 5 dwelling units per acre and the RM permits up to 9 dwelling units per acre. Staff recommended that the Planning and Zoning Commission, acting as the Local Planning Agency, consider the staff report and agenda packet, the presentations made at the public hearing, and any public comment received, and adopt a motion to recommend to the Board of County Commissioners that the Future Land Use Map Amendment be adopted. BOARD DISCUSSION WITH STAFF: Commissioner O’Dell asked if staff has an urban service boundary screenshot and an overlay showing where the Fort Pierce city limits are in relation to this property. Staff provided an exhibition and pointed out city limits. Conversation continued regarding wetlands and erosion. Commissioner Guettler asked if under the Live Local rules, would apartments be allowed. Ms. Szedlmayer answered yes. Commissioner Binner asked if anyone with this type of property can get approval or does it have to fit the traffic, site, and neighboring properties. Ms. Szedlmayer stated that they can apply, there are policies and regulations that require proper transition. Mr. Benton added, it still would require determination of concurrency. Conversation continued regarding affordable housing. Commissioner Slay inquired about the previous approvals and amendments on this property. Ms. Szedlmayer stated a site plan was approved in the late 90’s, but it was not acted upon. Chair Lounds questioned the traffic differences between retail stores at this location vs. residential homes. Ms. Szedlmayer stated that the applicant’s transportation impact report concludes that this proposal results in a net decrease of trips. Ms. Szedlmayer reminded the Board that there is another presentation regarding the PUD that would go into more detail. And, that's right at six units per acre when considering the blended density. APPLICANT PRESENTATION: Daniel Sorrow, AICP, ASLA, with Cotleur & Hearing, 1934 Commerce Lane, Suite 1, Jupiter, FL 33458, presented on behalf of Kolter Group Acquisitions, LLC of Delray Beach, FL. Mr. Sorrow proposed that he would present on both agenda items at the same time. Staff opposed. BOARD DISCUSSION: Commissioner O’Dell asked the applicant if projected traffic volumes were based on the highest density allowed under the requested future land use or based on this project proposal. Applicant’s Traffic consultant stated that they were based on the density allowed for both the existing future land use, which was commercial, and the proposed. Conversation continued regarding FDOT and Turnpike Authority. PUBLIC COMMENTS: The public concerns entailed traffic, density, crime, drainage, rentals, schools, and wildlife. The Board reminded Public that this presentation is regarding the FLUMA and asked if they would prefer commercial or residential. Public consensus was that they have no issue with the change of zoning, they would just like to see a lower density. Motion: Approve - With the staff recommendations and with all the neighbors’ concerns, which would be traffic, density, stormwater, and environmental. The proposed Future Land Use Map Amendment supports future further infill development within the Urban Service Area. Proposed Amendment of Zoning Atlas and Preliminary Development Plan for S. 25th Street and W. Midway Road STAFF PRESENTATION: Irene Szedlmayer, AICP, Senior Planner, with Planning and Development Services. Ms. Szedlmayer stated that all public notification requirements were met per St Lucie County Development Code Section 11.00.03. Ms. Szedlmayer presented the Board with information regarding the applicant’s proposal to amend the Zoning Atlas on 34.2 acres located northwest of the intersection of S. 25th Street and W. Midway Road from CG (Commercial General) to PUD (Planned Unit Development) to provide for a gated residential community with 200 townhomes and preservation of +/- 12 acres of wetlands. The property has been in the CG (Commercial General) Zoning District since 1984. The land that is the subject of this application is currently vacant. Staff recommends that the Planning and Zoning Commission recommend that the Board of County Commissioners approve the Rezoning and Preliminary Development Plan subject to the conditions of approval identified in the staff report - which includes the elimination of twelve (12) units – and, as such, conditions may be modified at the public hearing. BOARD DISCUSSION WITH STAFF: Chair Lounds asked if there was any provision for traffic coming South on 25th. Ms. Szedlmayer stated, not at this point and it will be reevaluated at the time of final site plan. Conversation continued regarding a right-hand turn in and drainage. Vice-chair Binner asked if there are sidewalks in this community. Ms. Szedlmayer said, yes. Conversation continued regarding emergency vehicle access, and there being no room for change with the proposed plan. Mr. Benton added the project does not offer a sidewalk along Jorgensen. Today, as was noted in the staff report, Jorgensen Road is not within an established County right-of-way. The applicant is proposing a 30-foot-wide right-of-way dedication which is situated due east of the travel way that exists and is recognized at Jorgensen Road. Brandon Ulmer with Thomas Engineering spoke about the flow of drainage. BOARD DISCUSSION WITH APPLICANT: Vice-chair Binner asked if the Fire District has any issues with the proposed plan. Mr. Sorrow stated that it meets requirements. Conversation continued regarding density, fill, and wetlands. Chair Lounds made a statement about the water going from NW to SE, then asked if the ditch that's on the east side of Jorgensen Road would be cleaned up by the applicant so it does not interrupt the flow. Mr. Ulmer replied yes, they will be cleaning it up. Conversation continued regarding buffers and turning lanes. Commissioner Slay made a statement regarding the NW building being taken from six units to four units to create a better buffer, decreasing the density, and creating the right turn lane. Chair Lounds asked about the depth of the pond and recreation. Mr. Sorrow stated the depth is 20 feet and recreation is possible. PUBLIC COMMENTS: The public concerns entail water flow, traffic, density, crime, drainage, rentals, schools, tree removal and wildlife. It would appear very reasonable to at least require that building to be set back 50-feet from the property line. Conversation continued with Commissioner Slay regarding seatbacks. Commissioner Guettler stated that the applicant did a great job on public outreach and commended the proposed plan presented. Commissioner Slay made a statement regarding growth. Chair Lounds asked about altering the design to break up the monotony. The applicant stated that it can be considered. Vice-chair Binner asked about roofs being replaced in the future by the owners or HOA to prevent varying roof materials within the community. The applicant stated that it can be explored. Motion: Approve with staff recommendations - approve with staff recommendations and amending the northwest building down by two units and improve the swale on the entire western side of Jorgensen and make a goodwill effort for a right-turn ingress on 25th. A brief presentation on Sunshine Law and the roles and responsibilities of Planning and Zoning Commission for new Commission members will be held on 12/19/2024.
