Commission Member Mr. O’Dell gave a blessing. Roll Call – Confirmed all member present except Dr. Bridgers. #7 Minutes for August 17, 2023 – Unanimously Approved. #8 Public comments: None #9 Public Hearings: Quasi-Judicial Disclosures: Vice Chair Lounds spoke to a resident on Taylor Dairy Rd regarding 9A. 9A: Drawdy Properties, LLC, and representative, Brad Currie, AICP, of EDC, Inc. are requesting an Amendment to the Official Zoning Atlas from PUD (Planned Unit Development) to PUD (Planned Unit Development) and Preliminary PUD Site Plan approval for the purpose of developing a residential community containing 404 single-family homes and various recreational amenities to be known as Drawdy – Angle Road PUD. The ten petition properties total 202.196 acres and are located between Angle Road and I-95 on both sides of N. Rock Road and are in the Residential Suburban (RS) Future Land Use Map (FLUM) category, which allows up to two units per acre. Potable water and wastewater service for the development will be provided by FPUA. Approximately 40 acres in the northeastern portion of the site are located within the Airport Overlay Zone, which prescribes height and lighting limits. Staff Presentation: Thad Crowe, Senior Planner, and Kori Benton, Planning Manager, of the Planning Division, made a presentation for the planned unit development request. The project is located in the northeastern part of the county. Required public notification was provided, including newspaper advertisements, mailers to residents, and property owners within 500 feet, and posting of the property. It was shown that on the South property is Interstate 95, on the north, is Angle Road, and a little bit to the east is Kings Highway, and to the West is Timberlake Estates. Mr. Crowe spoke on the background of the Drawdy Business Park and the site plan. Gave an overview of Drawdy Properties, LLC, and discussed the comprehensive plan, environmental impact, and staff recommendation. Kori Benton highlighted transportation and capacity improvements. Commission Discussion with Staff: Mrs. Slack – Questioned staff about a six-foot sidewalk as a condition of approval or fee in-lieu. Mrs. Slack also questioned FDOT planning a multi-purpose path along Angle Rd and how the six-foot sidewalk would interface. Mr. Benton stated FDOT’s work plan, which is built into a few phases, is projected to commence around 2030 Right-of-way acquisition and final design is a key components. Mr. Benton elaborated on size and filling in gaps being the priority. Mrs. Slack questioned the multi-use path size. Mr. Benton confirmed. Mrs. Slack asked whether it extends down to State Road 70 and all the way up to Lakewood Park or what their plan for that path? Mr. Benton confirmed down to State Road 70, with the northern extent to be determined. Mrs. Slack suggested that a path like present on State Road 70 be extended for cyclists. Mr. Crowe agreed with Mrs. Slack. Mrs. Slack expressed concerns about the size and setbacks, and 80 sq ft is too small. Mr. Benton elaborated on Mrs. Slack's concerns. Mrs. Slack asked about sound berm and connecting roads. Mr. Benton explained the plan further. Mr. Mundt inquired about the unimproved Rock Road right-of-way. Mr. Benton affirmed the applicant is proposing to improve the roadway to county standards through their two access points. Mr. Mundt asked if the road would be extended South? Mr. Benton stated not by the applicant. Mr. Mundt questioned whether the applicant is amenable to the staff's input? Mr. Benton stated the applicant has been very responsive to staff suggestions. Mr. Mundt questioned planned buffering and Mr. Benton clarified. Mr. Mundt questioned the residents on the east side having to wait until the properties on the West side reach some stage of completion before all the amenities are available. Mr. Benton stated potentially. Mr. Mundt expressed concerns about the lakes not having the same access to each side. Mr. Benton suggested the applicant can respond to that, as recommendations have been made for that same feature in the eastern phase. Mr. Mundt addressed the 40’ lot size and affordable housing possibilities. Mr. Benton suggested the applicant can address this, as the small lots have been a focal point of the proposal, but staff does realize that smaller, more compact lots do have the opportunity to increase housing affordability. Mr. Mundt stated belief that the developer still has a lot of work to do. Vice-Chair Lounds asked about turn lanes on Angle Rd. Mr. Crowe stated there will be a westbound turning lane into the project from Angle Rd. Vice-Chair Lounds asked whether traffic going West, will be able to turn in while traffic continuing west will be able to bypass that and go – but nothing coming to the east. Mr. Crowe confirmed that's correct, based on traffic analysis. Mr. Benton further clarified. Vice-Chair Lounds suggested that the County and developer investigate Eastbound turning lanes. Vice-Chair Lounds talked more about the 40’ lot size and asked staff whether we even have any in the County with homes on them. Mr. Benton confirmed, potentially in Lakewood Park. Vice-Chair Lounds and Mr. Benton further discussed lot sizes. Vice-Chair Lounds stated it doesn’t feel this project fits what we are trying to accomplish in that area of development, moving West and northwest into the county. Vice-Chair Lounds spoke on utilities and water supply with staff. Mr. Binner voiced concern about 40’ lots and 30’ homes, and open space not being enough. Mr. Benton addressed concerns. Mr. Binner suggested townhomes. Mr. Benton stated that townhomes don’t fit the mold but are authorized. Mrs. Slack gave an example of a 40’ ide lot with a 30’ house on it and a 50’ wide lot or a 45’ wide lot, the spacing between the houses is not conducive to active use. Mrs. Slack stated that trying to provide more housing and less expensive housing, lends themselves toward this sort of land use. Trying to cram as much house as you can in, you're trying to keep the costs down, and so you end up with this. Mrs. Slack discussed on houses being further apart and the benefits of it and a balance being needed, suggesting this isn't a bad solution, it's just not a paradigm where acclimated to especially out in this part of the county. She believes that we need to decide, do we want more houses for more people at different price points or do we want to. Mr. Mundt stated belief that more open space can be used to provide more room for homes. Applicant Presentation: Brad Currie with Engineering Design and Construction and Drawdy Properties, LLC, 10250 Village Pkwy Unit: 201 PORT SAINT LUCIE, 34987. Addressed the Commission. Mr. Currie decided not to give a PowerPoint, as he felt the staff presented the project in totality, accepting all the conditions that the staff presented. Mr. Currie mentioned that this is a previously approved PUD, it was approved back in 2008 and since then they have added more space and better buffering. Mr. Currie stated that there will be 404 homes out of that 94 multi-family. Mr. Currie spoke about the rezoning process being the first step of many. Mr. Currie touched on the concerns of Commission members about size, space, and amenities; he also spoke about roads and storm drains. Mr. Currie stated that Justin Droughty, one of the owners, was present and he would be happy to answer any additional questions. The intent of the [project is to be as compact as possible. Commission Discussion with the Applicant: Chair Lowe asked about the price point of the homes. Mr. Currie stated that they are not that far into the project yet. Vice-Chair Lounds asked about water runoff. Mr. Currie replied to the canal to the north with a natural fall. Vice-Chair Lounds voiced concerns about the ponds and dirt build-up. Mr. Currie clarified how it will work. Vice-Chair Lounds touched on roadways and traffic. Mr. Currie stated they typically rely on our traffic engineer to do a study that says this is what's going to be required. Mr. Taylor – inquires about the football field. Mr. Currie – one of the County requirements is open active space. Public Comments: Darrell Crum - 2280 Johnston Rd. – Stated concerns about the roads and flooding. Mr. Crum is opposed to this project. Helena McHugh - 8657 Clearlake Ln. – Stated the development would have them floating away due to the drain issues already and a turning lane is needed. Ms. McHugh is opposed. Commission Discussion: Chair Lowe asked a question to staff about the water issue on Angle Rd. Mr. Benton stated the planning staff cannot speak on the dynamics in that area. Vice-Chair Lounds asked staff how many more times this would come in front of the P&Z Commission . Mr. Benton stated the recommendation on this evening, whether that's for it, for it with conditions or concerns, or a recommendation to disapprove, that would be the last time this body would see it unless there's a significant change. Chair Lowe asked if the project was only here for a zoning change. Mr. Benton confirmed a rezoning and PUD Preliminary Plan . The Commission briefly discussed their concerns between each other. Continued to October 19, 2023 – Motion – Mr. Mundt – Second O’Dell #9B Quasi-Judicial Discussions: None/Closed 9B. Indrio Woods Rezone & Planned Unit Development Preliminary Site Plan - The applicant is seeking to rezone from the AR-1 (Agricultural, Residential - 1) Zoning District to PUD (Planned Unit Development) and a Preliminary Site Plan for a 288-unit, multi-family residential apartment complex, with associated site improvements. Staff Presentation: Erin Elizabeth Taylor, Associate Planner and Kori Benton, Planning Manager, of the Planning Division, made a presentation for agenda item 9B for a rezone from the AR1 agricultural residential one zoning district to the PUD planned unit development zoning district and a preliminary development plan for a 288-unit multifamily residential development. Mrs. Taylor spoke in accordance with public notice requirements of the Saint Lucie County Land Development Code, these public hearings were advertised in the Saint Lucie Tribune on Friday, September 15, 2023. In addition, notices were mailed to adjacent property owners located within 500 feet of the subject property and two signs were posted on the project site. Mrs. Taylor presented information on the TVC, Policy 11.2 -1.12E establishes the transferable development value. The TVC allows the subject parcel up to 9 dwelling units per acre. The proposed 8.8 dwelling units per acre fall under this limit. Mrs. Taylor addressed the applicant's proposal, Fort Pierce Utilities Authority, and will offer central water, wastewater, and electrical connections to all buildings. Additionally, inner internal vehicular use areas and pedestrian pathways provide adequate connections to existing infrastructure and meet the provisions. Mrs. Taylor spoke about amenities, improvements, stormwater, wildlife, property boundaries, and the Binney estates. Commission Discussion with Staff: Chair Lowe asked if any of the previous recommendations the Commission made were adopted into the new presentation. Mrs. Taylor – a lot was proposed in the previous meeting, some recommendations were accommodated, some an agreement was not able to be made upon. Mr. Binner asked about the height change. Mrs. Taylor stated the recommendation is to take the building down to two stories or break it up into two smaller buildings. Mr. Binner inquired, whether by reducing that three-story building down the two, there be room on the site to move those units or if they would be reducing their total number of units by doing so. Mrs. Taylor stated both options would be available. There is room on the site. Mrs. Taylor suggested some relocation of buildings and parking. Mr. Binner asked about a reduction in units. Mrs. Taylor staged that was not discussed. Mr. Benton interjected, stating reducing units could be a possibility. Mr. Mundt asked if the proposed reduction of units has been agreed upon. Mrs. Taylor – not yet, but it is a condition of approval that the developer increases compatibility with Benny Estates. Mr. Mundt – asked if this is a recommendation. Mrs. Taylor stated this is a condition that will need to be met. Vice-Chair Lounds asked about moving the entrance. Mr. Benton offered that Planning met with the Public Works Department, and it was found that it would cause misalignment. Vice-Chair Lounds suggested different ways to relieve congestion on Kings Highway. Mr. Benton confirmed that others would have to give up land to make that happen. Mr. O’Dell addressed staff on the height of the proposed building. Mr. Benton replied, North of Winn Dixie Plaza, a four-story storage facility. Mrs. Taylor read an email opposing the project. Applicant Presentation: Andrew Woods at WGI - Christian Bryant – 2035 Vista Parkway – Gave a PowerPoint presentation, proposing rezoning from AR1 to PUD to better comply with the current towns, villages, and countryside future land use. Along with this request, we have our site plan application. The site plan request is to allow for multifamily development. The property currently allows for 9 dwelling units an acre. We propose a density below this that will not be and will not be pursuing any transferable development rights. Our property is also within the urban service boundary with water and wastewater provided by Saint Lucie County. the TVC future land use is adjacent to the MXD and RM land use proposed development includes linked recreational areas, providing safe pedestrian circulation, and connecting stormwater lakes for water flows in accordance with the PVC, the multifamily housing offers various unit sizes and is proximity to established commercial developments. We anticipate rental rates to start around 17. Mr. Bryant spoke on the distance between buildings, amenities, and staff recommendations. Commission Discussion with the Applicant: Mrs. Slack addressed that the presentation by the applicant did not depict the actual buildings that they are proposing, and Mrs. Slack suggested it felt like it was misleading. Mr. Bryant stated that he understands and that there are three-story apartment buildings, but we will be pursuing full site plan elevations during final site plan approval. Right now. We wanted to get something conceptual in front of the team so that everyone can understand that we are looking to be compatible with Binney Estate. Mrs. Slack spoke about the road being flipped moving the entrance, and front door, and having your two entrances both be off Taylor Dairy, which you're planning to improve all the way to the end of your property line. Public Comments: Barbara Secourt - 1155 Reef Rd. in Vero Beach stated she knows it's Indian River County but we used to be Saint Lucie County. So that's why she’s here. She is a passionate historic preservationist and have a lot of interest in this. Ms. Secourt is opposed to the project. Kathern Larson – 7955 92nd Ave, Vero Beach - stated she knows we live in a time when our history is being erased. There is a tremendous flaw in this plan. Ms. Larson is opposed. Jim Chalmers - 4995 Conley - stated as a developer (Cabo Rio RV Park) trying to develop and I thought long and hard about the TVC and I read into it and one of the things, about the TVC series to protect urban sprawl, you know, three-story building, obviously, you can get a lot of resistance. Vice-Chair Lounds and Mr. Chalmers hold a conversation about development. Mr. Chalmers – is opposed to the current plan. Staff and the Commission spoke again about relocating the entrance. Dennis Jacquizz - 6701 Andrea Rd – stated he was at the meeting in June when this was tabled and does not see anything, any changes really to this, to this project. Mr. Jacquizz is opposed to this project. Randy Hamilton – 5501 Treetop Trl., Fort Pierce Fl, 34951 – Questioned notification limits to people within 500 feet of the Binney Estates. Well, if you look at the map, there are no houses within 500 feet, maybe one or two. He believe it stretches out further than 500 feet, and thinks that they should have notified people when maybe a couple of 1000 feet. Mr. Hamilton is opposed to this project. Janie Baugh – 6701 Indrio Rd, Fort Pierce- stated she, first, appreciates everything you (the Commission) all did last time, but I believe one of the main things that was to have the developer contact us was one of the things that you all recommended that they do. We have never been in contact. I know that Christian up here stated that they had tried to reach out to me. Concerned about the preservation of the area. Ms. Baugh is opposed to this project. Darrell Crum - 2280 Johnson Rd. Stated he knows you all are tired of hearing from me. I look out in this crowd, and I recognize some longtime residents, TVC was created as mentioned, it is to preserve some part of Saint Lucie County. Families that have been here for years, citrus growers, tomato farmers, and pineapple growers, never saw this coming. Mr. Crum is opposed to this project. Applicant rep. Lindsey Libes - 2035 Vista Pkwy, West Palm Beach, FL with WGI, stated she understands that there are still concerns, and states that there were changes made to the plan from the last meeting. Question if Binney Estates is on the historical registry. Mrs. Taylor – No. Ms. Libes – understands that there is an absolute desire to preserve this corridor. There is also a need for diverse housing types within the county. We do follow all TVC guidelines. I know it's been said a few times that we are not in line with the TVC. We're not requesting any waivers or variances. The Commission Staff, and Ms. Libes have commentary. Wayne Bennett - 4555 Taylor Dairy Rd - one of the 500-foot affected residents, stated there is a lot of green area here, a lot of buffer area that's offered, and I think that's very nice, but I think it should be shared with the India Rd. corridor, which is historic, and with the Benny House, which is historic. Mr. Bennett is not opposed to this project with some modifications. LaSonna Hayes – 168 Imperial Way - Stated affordable housing is desperately needed in this area. Rearranging where the entrances are like you've discussed previously, and maybe putting more buffer on the exterior of the Binney. Ms. Hayes is not opposed to this project with modifications. Public comments closed. Commission Discussion: Mr. Taylor stated he does not see a world where this will work. Mr. Taylor addressed staff and addressed that if moved actual historical property would be damaged. Continued: Mr. Lounds Seconded: Ms. Slack - continued to November 16, 2023 by unanimous vote. Mrs. Slack mentioned TVC meetings happening in October and November. #9C Quasi-Judicial Discussions: None/Closed. 9C. Dennis Murphy of Culpepper & Terpening applying for rezoning eight parcels from AG-5 to the U (Utility) zoning district. The parcels comprise 224+ acres and are in an area of the County transitioning from agricultural to suburban, 1.6+- miles north of Orange Avenue, accessed by County roads (Schumann and Knight Roads). The U zoning would allow the construction of a regional electrical substation alongside an existing FPL 500Kv transmission corridor. Staff Presentation: Thad Crowe, Senior Planner, and Kori Benton, Planning Manager, of the Planning Division presented the petition. Mr. Crowe spoke on the requirements that were met, including mailouts to neighbors within 500 feet of the property and newspaper advertisements. Staff agrees with the Applicant’s presumption that the Land Development Code and Comprehensive Plan does not include any specific locational criteria for the application of the Utility Zoning District. Absent such criteria, the review of this request considers impacts on the vicinity and other public facilities. Staff anticipates the impacts to be minimal due to the lack of on-site personnel and the recommended landscaping improvements, the latter of which will mitigate construction traffic dust and noise while also beautifying County roads accessing the site. Therefore, the staff concludes that the requested change in zoning is not in conflict with any portions of the LDC and Comprehensive Plan. Mr. Benton - Clarified the intent of the substation, is not power generation. On this particular site. However, of course, the utility zoning district has a wide variety of utility options to be pursued and support transmission and routing of electricity. Commission Discussion with Staff: Vice-Chair Lounds asked about landscaping. Mr. Crowe stated the visual impact. Vice-Chair Lounds asked about landscaping on I95. Mr. Benton – Staff cannot speak to that, however for a site plan review there are basic standards for landscape buffering and that would be from a vehicle or use area or a structure or development. Mr. Mundt spoke on the withdrawal of landscape requirements. Mr. Benton confirmed for communication towers, yes, for substations they are beyond the definition of an essential public utility, like a smaller substation on a corner, a pad mount transformer, or a small lift station. Mr. Taylor inquired how they are going to get there during construction. Mr. Crowe stated from Orange Ave., they take Knight Rd. up, take a left-on Schumann. Mr. Benton noted vehicles would then traverse private property. This parcel and there was previously a bridge that extended across the canal that is part of the site plan the applicant is proposing to reconstruct one of the provisions of our county Land Development code requires that paved access be provided to a site plan. Unless a paving waiver is granted by the Board of County Commissioners, upon showing that a paved roadway to county standards is not needed based upon the traffic generation is not feasible due to limited right of way or there are other criteria in which the Board of County Commissioners would consider. Applicant Presentation: Dennis Murphy - 2980 South 25th Street Fort Pierce, FL 34981 - firm of Culpepper and Terpening here in Fort Pierce. Stated he is here tonight representing Florida Power and Light. And our petition for a change of zoning for approximately 200 acres. Seeking to reclassify this piece of property to utility. As staff pointed out in their presentation to you, and as I will phrase it, this way, we are slightly bigger than a bread box. Required community service type utility use where you could do a substation in any zoning district. The size of this particular substation requires us to go into the utility zoning district, and that's our that is the biggest distinction in this. This is not a neighborhood service substation that we'll be putting here. This is one that helps move electricity through the big 500KV lines that are out in the western part of the county and moved electricity throughout the grid, so this is helping to keep things moving, reliable, and continuing services. Commission Discussion with the Applicant: Mr. Mundt inquired whether the lines already nearby or will they be bringing the lines in subsequent? Mr. Murphy confirmed, they are there now. Vice-Chair Lounds –asked why they were not going down Header Canal Rd. Mr. Murphy stated the trucks cannot make the turns and there is no right away. Vice-Chair Lounds questioned is that private property? Mr. Murphy confirmed, yes, it belongs to FPL. Mrs. Slack inquired about the road being paved. Mr. Murphy replied to no. Mrs. Slack is concerned about life safety issues. Mr. Murphy - we will have improved access throughout the confines or the limitations of the property that FPL owns. It will be adequate. All the necessary access requirements as required by the fire. Mrs. Slack. asked about the water source for the fire department. Mr. Murphy stated, initially, their trucks and the canal if needed. Mr. Benton followed-up on landscaping exemptions. Public Comments: Clayton Charles, 18900 Shuman Rd – stated concerns about the roads, think that a plan needs to be in place before the rezoning is approved. Mr. Charles is opposed. Mr. Benton detailed the rezoning process, and the parallel site plan and road paving waiver process which is not part of the current rezoning. Mark Castellino, 901 Casalino Rd. Fort Pierce, FL – stated concerns about roads being too tight for trucks, safety, and traffic. Feels they should use a different road. Mr. Castellino is opposed to the project. Kelly Charles, 18900 Shuman Rd – discussed roads, flooding, view, and construction hours and is opposed. Mr. Murphy stated landscaping is not required, but FPL will do some and will addressing roads and making sure they are not damaged in the process. Construction hours are normal business hours. Amanda Castellino, 901 Casalino Rd. Fort Pierce, FL asked about radiation. Mr. Murphy will pass that concern on and get it back to the residents. Mrs. Castellino did not state if she was for or against the project. Public Comments Closed. Commission Discussion: None. Approved: Mr. O’Dell Seconded: Ms. Binner Commission Approved unanimously. 9D. County Initiated Land Development Code Text Amendment to Backyard Chickens. Staff Presentation: Benjamin Balcer, Planning Service Director, of the Planning Division. Proposing a County Initiated Land Development Code Text Amendment to Backyard Chickens. spoke on the requirements that were met a newspaper advertisements. On February 11, 2020, a proposed Ordinance establishing a Backyard Chicken Registration Program was discussed at an informal Board of County Commissioners meeting. On March 17, 2020, the Board of County Commissioners authorized permission to advertise public hearings before the Planning and Zoning Commission and two (2) public hearings before the Board of County Commissioners to establish the Backyard Chicken Registration Program. On October 6, 2020, the Board of County Commissioners approved Ordinance 2020-26, establishing the Backyard Chicken Registration Program. On May 9, 2023, at an informal Board meeting, the Board guided staff to draft a County initiated Land Development Code Text Amendment to expand the permitted chicken coop buffering to include vegetative hedge material and eliminate the requirement for the required buffer to be located on the property line, allowing buffer to be placed elsewhere on the lot between the chicken coop and the adjacent parcels and rights-of-way. On August 9, 2023, the Board of County Commissioners authorized permission to advertise public hearings before the Planning & Zoning Commission and two (2) public hearings before the Board of County Commissioners to hear the proposed changes to the Backyard Chicken Registration Program. Commission Discussion with Staff: Vice-Chair Lounds – questioned the fencing type. Mr. Balcer clarified. Ms. Slack – asked about the vegetation requirements as fencing. Mr. Balcer clarified that this would now allow vegetation to be one of the requirements. Public Comments: None. Commission Discussion: None. County Initiated Land Development Code Text Amendment to update the Thoroughfare Network Right of Way Protection Plan (ROWPM), and update Traffic Impact Report standards. Staff Presentation: Patrick Dayan, Director of Public Works, and Dan Zrallack, County Engineer presented the County Initiated Land Development Code Text Amendment to update the Thoroughfare Network Right of Way Protection Plan. Mr. Dayan spoke of the Urban Service Boundary Expansion, text updates to the land development code, in sections 7.05.10, 7.06.02, and 11.02.09. Another update to text in section 7.05.03.d2. Mr. Dayan spoke on Right-aways and the comprehensive plan and protection map. Mr. Zrallack spoke about updating the map and future plans. Commission Discussion with Staff: Mr. Mundt inquired about any public comment. Mr. Dayan stated comments were received in a public meeting. Public Comments: None. Commission Discussion: None. Approved: Mr. Taylor Seconded: Ms. Slack Commission Approved Unanimously. 9E. County initiated Comprehensive Plan Amendment update to the Transportation Element Map Series. Staff Presentation: Patrick Dayan, Director of Public Works, and Dan Zrallack, County Engineer presented the County initiated Comprehensive Plan Amendment update to the Transportation Element Map Series. Mr. Dayan spoke of the comprehensive plan and maps, required chapter 163 -part II, FS, goals and objectives and policies, required updated and transportation elements. Mr. Dayan spoke on the municipal growth of PSL, urban service boundary, and additional active proposals. Commission Discussion with Staff: Mrs. Slack inquired where can the maps be found? Mr. Zrallack – Google St. Lucie County Comprehensive plans and the maps are in there. Mr. Mundt stated concerns about the new bridge and traffic. Mr. Zrallack affirmed these are FDOT roadways.
