STAFF PRESENTATION: Tahir Curry, Planner I for St. Lucie County, made a presentation. Presentation covered the public notice, aerial, future land use designation, current zoning, proposed zoning. STAFF RECOMMENDATION: This petition conforms to the Standards of Review as set forth in St. Lucie County Land Development Code Section 11.06.03 and is consistent with the St. Lucie County Comprehensive Plan goals, objectives, and policies. St. Lucie County Impact Fee Study 2022 Update - Library Impact Fees Ordinance INTRODUCTION: Mr. John Titkanich, Innovation and Performance Division Director. CONSULTANT PRESENTATION: Steven Schriever, PFM for A-D. Presentation covered the definition of Impact Fee, methodology used to calculate impact fees. STAFF PRESENTATION: Mr. Titkanich presented the chart for the library impact fees. BOARD DISCUSSION: Mr. O'Dell commented regarding technology and virtual libraries for future use. Mr. Schriever commented that there is an expansion of a 10,000 sq ft increase in a library in PSL. Decline in post COVID in libraries. Increase in registered borrowers. Website visits are increasing as well. COVID has impacted and numbers are coming back up. Mr. Sanders pointed out that it is a resource for the community beyond checking out books. In school districts there are still physical books used. Mr. Mundt inquired about the driver for the library fee. Mr. Titkanich responded that the population is a driver. Non-impact fee revenues. Mr. Titkanich responded to sales grant, tax, and library fees. Mr. Mundt funds per residence less credit. Mr. Schriever responded to a planned capital purchase not paid for by impact fees. Mr. Mundt inquired about the purpose of using different county's. Mr. Schriever stated those that were used were those that had impact fees for libraries. Mr. Mundt inquired about meeting dates. Planning & Zoning Commission MeetingThursday, March 17, 2022 6:00 PM 4 | P a g e Mr. Titkanich April 5th at 6pm and April 19th 9am with an informal meeting on March 29. Mr. Lounds inquired about the current impact fee for the library. Mr. Titkanich responded that it is $276 and it would go from $276 to $395.89 within a 4 year period. A total increase of $119.89 over 4 years and a yearly increase of 29.98. Ms. Slack capital equipment and collection items. Would it cover programming? Computer equipment and software, yes. not for current programs. Only capital related, not staff. Mr. Binner inquired about an increase in capital cost comparison. Inventory of capital assets and increase in population. Current assets divided by current and future. PUBLIC COMMENT: Madeline Williams, 631 Creston Lane PSL Executive director of Treasure Coast Builders Association. Any fees applied towards the price of the home are added to the cost of the home owner, not to the builder. Consider affordability for residents while making recommendations to BOCC. James Harvey Alligood, 8750 S Ocean Drive, Unit 836 Jensen Beach FL. Difference in impact fees from county to county. If not paid as an impact fee, it will be paid by current residents. Long-time residents would have to pay for improvements such as Morningside Library. Compare how our fees compare or benchmark on neighbors. James Clasby, 355 S Ocean Dr, Apt 101 Ft. Pierce FL, 34949. Strongly opposed to increasing impact fees. Cost of consultant. Surrounding areas have not increased their fees. BOARD DISCUSSION: Mr. Lounds inquired about the homeowner costs inquiry on whether libraries have the same priority as the other services. Mr. Binner is inquiring about the calculation of the impact fee. Mr. Titkanich referenced fully calculated fees. Chair Taylor inquired about the total value of the library system. Mr. Schriever responded to a $47 million total. Chair Taylor wanted to know what the increase was the last time fees were raised. Mr. Schriever stated that he does not have that information. The population and materials have changed. Chair Taylor inquired of Madeline of the TCBA about the percentage as someone that is familiar with the topic. Madeline Williams stated that it is based on CPI, and the cost of housing can keep up with that predicted figure. It's the roads, which are too costly as this is minor. Chair Taylor stated that we will hear items 9A-D first then make separate motions for each at the of D. B. St. Lucie County Impact Fee Study 2022 Update - Public Buildings Impact Fees Ordinance STAFF PRESENTATION: Mr. John Titkanich, Innovation and Performance Division Director. Presented the Planning & Zoning Commission MeetingThursday, March 17, 2022 6:00 PM 5 | P a g e impact fee charts for public buildings. Only used for additional capacity to maintain the level of service. BOARD DISCUSSION: Chair Taylor inquired about anticipated needs and fund balance. Mr. Titkanich responded that those numbers are not available. Mr. Slay stated that selling buildings should be considered. Mr. Binner inquired if we were at capacity in our buildings. Mr. Titkanich responded that there are projects at the jail with medical buildings. Mark Satterlee, Deputy County Administrator, stated that the county is constantly looking at needs and the court house is over capacity. A total of 160 buildings are owned and maintained. Mr. Schriever administration building, courthouse and annex, the emergency operations center, jail, agriculture department, the health department and support buildings. Mr. Titkanich provided the revenue balance, which is $4.1 million, which goes towards debt service for jail. Mr. Schriever said that the debt is going thru 2033. PUBLIC HEARING: James Harvey Alligood, 8750 S Ocean Drive, Unit 836 Jensen Beach FL. He drew the attention of the board to the numbers in yellow as the maximum, and then there is the cap of the state is even less. If not thru impact fees for new residents, then current residents have to pay for it. The history of impact fees increases in the past should be provided. James Clasby, 355 S Ocean Dr, Apt 101 Ft. Pierce FL, 34949. Believes the board should vote against raising all impact fees. 10 MINUTE BREAK AT 8:52 PM C. St. Lucie County Impact Fee Study 2022 Update - Law Enforcement Impact Fees Ordinance STAFF PRESENTATION: Mr. John Titkanich, Innovation and Performance Division Director. Presented the impact fee charts for Law Enforcement. Used for capital equipment, patrol vehicles, communication and any other capital items. BOARD DISCUSSION: Mr. O'Dell inquired about miscellaneous items. Mr. Titkanich responded with equipment for the officer. Chair Taylor requested the fund balance and previous year's revenue. St. Lucie County Impact Fee Study 2022 Update - Parks Impact Fees Ordinance STAFF PRESENTATION: Mr. John Titkanich, Innovation and Performance Division Director. Presented the impact fee charts for parks which have districts that can only work with adjacent districts. BOARD DISCUSSION: Mr. Lounds inquired as to parks fees being greater than law enforcement and public buildings. Mr. Titkanich responded that they have a new parks plan requested by the community. Mr. Satterlee also stated that law enforcement uses the general funds via the budget. The parks is what has gone wanting from the SLC budget and they have a large gap for more than a decade. Ms. Barbieri requested separate motions. 9.A. St. Lucie County Road Impact Fee Study - Road Impact Fees Ordinance STAFF PRESENTATION: Mr. John Titkanich, Innovation and Performance Division Director, introduced the consultant. Nilgun Kamp, Tindale Oliver, Benesch consultant made a presentation on Road impact fees on background, technical analysis, benefit zones and next steps. Mr. Titkanich explained the history of the interlocal agreement change from the city of Port St. Lucie which affected the difference in the impact fee for roads and the county's action. He also mentioned that the city is charging a newly created mobility fee as well. BOARD DISCUSSION: Mr. Lounds inquired as to why the 25% discount is applied. Mr. Titkanich responded that it is a staff's proposal but the board can recommend the full amount. Chair Taylor inquired about the use of this impact fee. Mr. Titkanich responded that it is for expansion or widening of the roads. Vice-Chair Lowe inquired about the projects for county roads. Mr. Titkanich responded with the list of upcoming projects for widening. Mr. Lounds inquired about new pavement. Mr. Satterlee explained that the maintenance is covered by the gas tax. He also explained that there were lowered fees to even the costs of this impact fee, despite your location in the county. Ms. Slack requested possible incentives for impact fees based on walkability. Mr. Satterlee responded that it may be useful, but we have low density with not many options for transportation. PUBLIC COMMENTS: Laura Dodd, AICP, Senior/Transportation Planner, City of Port St. Lucie read the memorandum as follows: St. Lucie County Road Impact Fee Study — Road Impact Fee Ordinance 3/17/2022. The purpose of this memo is to address the proposed St. Lucie County Road and Impact Fee Study -Road Impact Fee Ordinance. An initial review of the County's Road impact fee was sent to you on December 16, 2021. The issues sent to you related to four (4) matters that needed to be corrected before a meaningful review of the fees can be undertaken. These matters included: Issue # 1: Share of Vehicle Miles of Travel (VMT) Issue # 2: Use of City Roads in the County's Road impact fee Issue # 3: Proposed Benefit Zones Issue # 4: Cost of Improvements As of January 5, 2022, a second letter with additional comments has been sent to the County. These comments include the previously stated issues and include additional concerns relating to: Issue # 5: Projection of Future Growth Issue # 6: Evaluation of Existing Deficiencies Issue # 7: Inconsistent References to Future Long-Range Plans Issues number 1 and 2 are the fundamental issues between the City and the County. The City has very clearly documented how it calculated the share of travel on City, County, FDOT, and Developer roads. The County's analysis provides one table with minimal detail showing how the 44% was determined and continues to reference numerous City roads as County roads. In order to review the County Road impact fee report, far more data is needed, including: A map and detailed segment data showing how the percentage of Vehicle Miles of Travel was calculated by roadway ownership. The removal of city roads from the Report's Tables or correct the Table to identify them as City roads and note that their fee is partially based on travel from city roads. It is recommended that the proposed benefit zones be further split east and west of Interstate 95, and the split along roughly St. Lucie West and the split west of Interstate 95 be further evaluated. Our January 5th letter contains additional recommendations of the benefit zones. Discussions are needed to recognize the need in this area of the City and its minimal impact on County roads. The County has collected over $40 million in road impact fees from the City in the last five years. That is more than adequate to cover 100% of the cost for Midway west of Interstate 95 and 50% of the cost of Glades Cut-off north of Midway. Lastly, I would note the TPO Review of your draft report. All of the figures are new information and has been working with the county since the city created their new mobility fee without allowing the county to finish their study first. Recommendations should not be decided upon as they are still in mitigation with the city. Ms. Kamp responded that it is used that it does not match any other of the categories and recognizes that is physical characteristics to prove they are do not have an impact or as great fan impact. Mr. Titkanich stated that it is in section 24-6. Ms. Slack requested information the process. Ms. Kamp stated that the same three variables would be used to demonstrate lower impact and therefore get a lower impact fee. PUBLIC HEARING: None.
