A. Baron-Midway & US-1 Storage Facility - Request for a Conditional Use Permit associated with a
Major Site Plan to develop a 104,771 sq. ft. self-storage facility, which includes a 54,555 sq. ft.
three-story self-storage building with an office, four (4) single-story self-storage buildings totaling
50,216 square feet and (10) RV and boat parking spaces within the CG (Commercial, General)
Zoning District - THIS ITEM IS QUASI-JUDICIAL
STAFF PRESENTATION
Tahir Curry, Planner, made a presentation on the request for a Conditional Use Permit
associated with a Major Site Plan to develop a 104,771 sq. ft. self-storage facility, which
includes a 54,555 sq. ft. three-story self-storage building with an office, four (4) single-story
self-storage buildings totaling 50,216 square feet and (10) RV and boat parking spaces within
the CG (Commercial, General) Zoning District.
In accordance with the public notice requirements, advertisements for these public hearings
were placed in the St. Lucie County Tribune on Friday, September 2, 2022. In addition, notices
were mailed to 49 adjacent property owners within 500 ft of the property. A sign was placed
on the subject property.
The 4.40 acre site is north of Midway road and east of U.S. highway 1. The site plan provides
three designated loading zones, a bicycle rack, two (2) dumpster enclosures, and onsite
landscaping. Fencing is proposed along US Highway 1 and the property perimeter, consistent
with LDC Section 7.09.00. Site access will be via one (1) right in and right out access driveway
on US Highway 1, meeting the driveway setback requirements and standards in LDC Section

7.05.05.C.2. The site plan includes an access control gate for the site, with gate placement
and driveway design for adequate queuing in compliance with LDC Section 7.10.15. The self-
storage facility is surrounded by commercial uses along US Highway 1, with residential uses to
the east. The existing uses in the area consist of multiple restaurants, retail shops, a gas
station, and a range of other commercial uses. The property abuts vacant single-family homes
to the east. The proposed Conditional Use is not anticipated to have an undue adverse impact
upon nearby residential properties. The use will be buffered from the adjacent residentially
zoned land with the installation of an opaque fence/ and or wall along the eastern perimeter
of the property along with dry detention area and landscaping. The site lighting shall be
designed and arranged to shield public streets, highways, and all adjacent properties from
direct glare or hazardous interference of any kind in accordance with LDC Section 7.09.04(K).
The development is consistent with the adjacent commercial uses and is designed to
integrate with the surrounding area.
STAFF RECOMMENDATION
Staff finds this petition to meet the standards of review as set forth in Section 11.07.03 of the
St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and
policies of the St. Lucie County Comprehensive Plan. Staff recommends the Planning and
Zoning Commission forward this petition to the Board of County Commissioners with a
recommendation of approval, subject to the following conditions of approval:
1. A ground and wall sign must be submitted to the planning department for approval.
2. A site development is required prior to site improvements and activities.
3. Prior to Major Site Plan approval, a finalized tree mitigation plan consistent with
Land Development Code 6.00.05.D shall be provided.
4. Prior to Major Site Plan approval, a finalized landscape plan consistent with Land
Development Code 7.09.00 shall be provided.
5. Prior to issuance of a Vegetation Removal Permit or Exemption whichever occurs first,
written correspondence from the State’s Division of Historical Resources shall be secured
prior to removing/relocating the headstones.
PUBLIC COMMENT
Alejandro Toro, Planner with EDC made a presentation to the board on behalf of the
applicant, Jeremiah Baron.
Tod Mowery with Redtail made a presentation to the board on behalf of the applicant,
Jeremiah Baron.
BOARD DISCUSSION
Vice Chair Lowe asked about the RV Parking. Mr. Mowery advised the board members about
the location that would accommodate RV Parking. Chair Taylor asked if there is a separate
zoning for outside vehicle storage. Mr. Curry advised the board it is the same zoning for
Commercial General.

B. South Orchid Island's request to amend the Official Zoning Atlas from the CN (Commercial
Neighborhood) Zoning District to the HIRD (Hutchinson Island Residential District) Zoning District
for the 3.53-acre site located at 5140 N. Highway A1A, Fort Pierce, FL 34949. THIS ITEM IS QUASI-

STAFF PRESENTATION
Jodi Kugler, Senior Planner, made a presentation on behalf of applicant South Orchid Island's
request to amend the Official Zoning Atlas from the CN (Commercial Neighborhood) Zoning
District to the HIRD (Hutchinson Island Residential District) Zoning District for the 3.53-acre
site located at 5140 N. Highway A1A, Fort Pierce, FL 34949. Aimee Cooper, Environmental
Regulations Manager, SLC Environmental Resources Department was present.
In accordance with the public notice requirements, advertisements for these public hearings
were placed in the St. Lucie County Tribune on Friday, September 4, 2022. In addition, notices
were mailed to 225 adjacent property owners within 500 ft of the property. A sign was placed
on the subject's property. The Planning department received two letters of objection from
property owners within the 500 ft radius of the subject site and five additional letters of
objection and two with no opinion outside of the 500ft radius. Ms. Kugler presented a
PowerPoint to cover the project location, future land use, current zoning, and proposed
zoning.
STAFF RECOMMENDATION
This petition conforms to the Standards of Review as set forth in St. Lucie County Land
Development Code Section 11.06.03 and is consistent with the St. Lucie County
Comprehensive Plan goals, objectives, and policies. Staff recommends that this petition be
forwarded to the Board of County Commissioners with a recommendation of approval.
BOARD DISCUSSION
Mr. O'Dell asked what is the height restriction in that particular area? Mr. Murphy responded
that 35ft is the height. Mr. Mundt asked if the site is part of the Dune Preservation zone? Mr.
Murphy states there are portions of the property designated for environmental assessment.
Mr. Mundt asks if staff knows how much upland is on the site? Mr. Murphy states they have
done evaluations of the property to identify buildable land.

PUBLIC COMMENT
Dennis Murphy, Culpepper and Terpening on behalf of South Orchid Island LLC made a
presentation to the board members.

Ms. Lane states the buildable area is small. The maximum height is 35ft but the code also
states it's eligible for a variance up to 71ft.

Is the zoning change necessarily required to determine how much land is buildable? How
does changing vegetation change the buildable land area? How large is the buildable area?

Her family has owned property in Ocean Harbour for 42 years. She recently bought her
property on Hutchinson Island and she doesn't want to block the scenery.

He is outside the 500ft radius but his concern is that a previous proposal was to put a
boutique hotel on the property and the current zoning would allow for a hotel. He doesn't
want a hotel on the property. The sign posted on the property did not include the room
number for the meeting.

C. A County Initiated Land Development Code Text Amendment creating an administrative variance
process for the required minimum yard setback standards for single-family detached dwellings and
the associated residential accessory structures and providing for a Special Magistrate to serve as
the Board of Adjustment.
STAFF PRESENTATION
Mayte Santamaria, Director, made a presentation on the County initiated Land Development
Code Text Amendment creating an administrative variance process for the required minimum
yard setback standards for single-family detached dwellings and the associated residential

accessory structures and providing for a Special Magistrate to serve as the Board of
Adjustment. In accordance with the public notice requirements, advertisements for these
public hearings were placed in the St. Lucie County Tribune on Thursday, September 1, 2022.
Ms. Santamaria presented a PowerPoint to cover the purpose of the County proposed Text
Amendment to the Land Development Code.
STAFF RECOMMENDATION
This petition conforms to the Standards of Review as set forth in St. Lucie County Land
Development Code Section 11.06.03 and is consistent with the St. Lucie County
Comprehensive Plan goals, objectives, and policies. Staff recommends that this petition be
forwarded to the Board of County Commissioners with a recommendation of approval.
BOARD DISCUSSION
Mr. Mundt asked if there is a special land use outline for the Magistrate? Is the appointment
of the Magistrate open and serve at the will of the Board of County Commissioners, possibly
indefinitely? Ms. Santamaria, there is a process ongoing right now to do a RFQ that will
include the criteria to serve as the Magistrate. Chair Taylor asked should those requirements
be written into the code? Ms. Santamaria stated that is not a requirement, but that an RFQ is
typically the process that would be done to make that selection. Mr. Mundt asked if there
would be an opinion from the County Attorney? St Lucie County Assistant County Attorney
Ms. Barbieri stated the ordinance has been reviewed by the County Attorney's office and they
seek approval to go forward. The Board asked if the Planning and Zoning Commissioners
could serve as the alternates for the Board of Adjustments. Ms. Santamaria states she can
make that recommendation. Board member Mr. Slay makes a motion to approve as drafted.
