Ms. Slack stated that she spoke with Mr. Byers a year ago regarding putting together a proposal for item 9A – Southern Truss, but they did not move forward. Mr. Slay stated that he spoke with the applicant for item 9C - Sampson Tree Service. 8.PUBLIC COMMENT No public comment. 9.PUBLIC HEARINGS A.Southern Truss Companies - Amendment to the Official Zoning Atlas (Rezoning) from AG-1 (Agricultural - 1) to IL (Industrial, Light) Zoning District. The 29.24-acre petition site is located east of Southern Truss Companies facility, west of Taylor Dairy Road, north of the Fort Pierce Farms Water Control District Canal (#1) in St. Lucie County, Florida. The purpose of the request is to incorporate this site into the proposed expansion of the Southern Truss manufacturing facility located west of the petition site at 2590 North Kings Highway, Fort Pierce, FL 34951. This is a Rezone Petition for Southern Truss Companies , for a 29.24-acre parcel located west of Taylor Dairy Road, and north of the Fort Pierce Farms Water Control District Canal 1. The property is west of the existing Southern Truss Companies site located at 2590 North Kings Highway in Fort Pierce. The Public Hearing was noticed with a sign on the petition site fronting Kings Highway and Taylor Dairy Road, a Display in the Local Newspaper on June 4, 2021, and mailed notices to owners of property within 500 ft. Proof of Advertising is provided within the Agenda Packet. Mailed out notices were sent to 9 property owners within 500 ft. of the subject site. The Planning Department received no response. This current request for rezoning is to support Southern Truss Companies proposal to expand into a 33,600 sq. ft. manufacturing facility with site improvements and associated stormwater located at 2590 North Kings Highway. The 29.24-acre segment of the undeveloped parcel will be adjoined with the existing Southern Truss Companies’ facilities site to the west. The applicant submitted a Major Adjustment to the Major Site Plan to run concurrently with this rezone request to expand the company’s operations. STAFF RECOMMENDATION: This petition conforms to the Standards of Review as set forth in St. Lucie County Land Development Code Section 11.06.03 and is consistent with the St. Lucie County Comprehensive Plan goals, objectives, and policies. Staff recommends that this petition be forwarded to the Board of County Commissioners with a recommendation of approval. APPLICANT/ AGENT PRESENTATION Brad Currie, EDC Did not have a formal presentation but provided a brief summary of the applicant’s proposal and answered various questions posed by the Board. Presented by Tahir Curry, Associate Planner. This is a Conditional Use Petition for CB Liquor LLC, to allow the retail sale of packaged alcoholic beverages, for off-site consumption at 10800 South US Highway 1. The subject petition is outlined red. The 6,000 sq. ft. Crist Plaza has access on South US Highway 1 and SE Lennard Road. The site features business services and retail (Gala Gowns, a beauty supply store, an alterations/dry cleaner, and a salon) In accordance with public notice requirements outlined in Section 11.00.03 of the St. Lucie County Land Development Code, public notice was advertised in the St. Lucie County News Tribune on June 5, 2021. Notices were mailed to 15 surrounding property owners within a 500-feet of the subject property, and a sign was posted on the property. The Planning Department received one response not in favor of the Conditional Use Petition. The subject site has a CG (Commercial, General) Zoning Designation. Pursuant to LDC (Section 3.01.03.S.7.k.1,) for the Commercial, General Zoning District. Liquor stores are classified as a Conditional Use within the Commercial, General District. CB Liquor Store proposes the retail sale of packaged alcoholic beverages, such as beer, wine, and liquor, for off-site consumption. STAFF RECOMMENDATION This petition conforms to the Standards of Review as set forth in St. Lucie County Land Development Code Section 11.07.03 and is consistent with the St. Lucie County Comprehensive Plan goals, objectives, and policies. Staff recommends that this petition be forwarded to the Board of County Commissioners with a recommendation of approval, subject to the following conditions: 1. The hours of operations shall comply with the Code of Ordinances of St. Lucie County and State of Florida Statutes, Chapter 561 (Beverage Law: Administration). 2. A Minor Adjustment to the Conditional Use is required for a change in business name and/or ownership before a Zoning Compliance Certificate is issued. To: St. Lucie County Planning & Development Dept./Associate Planner Tahir Curry. Our building is just north of the proposed site, 60 Ft to it. It is Behavior Basics. Has been there for 15 years, caters to kids with behavioral issues from 3 to 12 yr old. Parents drop off their kids and pick’em up. We don’t think that site, liquor store is suitable for that area, that close proximity, and patrons throwing bottles and beer cans around, in general adversely affecting that area and the businesses. PUBLIC COMMENT Debra Swanson, owner of the property North of the subject plaza, expressed her objection and concerns regarding the proposed liquor store establishment. Further questions and discussion among Board members and Ms. Swanson. Jim Crist, owner of the subject property gave background of how the property is managed and expressed that the lease prohibits onsite alcohol consumption. Presented by Bethany Grubbs, Planner. This is a Conditional Use Permit to develop a land clearing and yard trash recycling operation on 5-acres of the overall 18.34-acre parcel. The subject property is located on the south side of Orange Avenue in Fort Pierce, approximately one-half of a mile west of Sneed Road. The property has split zoning designations of -5 (Agricultural – 5, 1du/5ac) and U (Utilities), with an AG-5 (Agricultural – 5, 1du/5ac) Future Land Use designation. The site is located outside of the Urban Service Boundary (USB). The property is currently developed with a 2,800 sf2 office and agricultural service facility. In conjunction with the existing facility, the applicant is proposing the land clearing and yard trash recycling operation located on the southwest corner of the parcel, within the 5-acre segment of the property zoned U (Utilities). No composting is proposed with this petition. A companion Major Site Plan petition has been submitted concurrently with this Conditional Use petition. Both petitions require review and action by the Board of County Commissioners. Sampson Tree Service, the applicant’s tree trimming and landscaping business generates materials from commercial and residential jobs. The applicant proposes to operate year- round, Monday-Friday from 7:00 a.m. to 4:00 p.m., and Saturday 8:00 a.m. to 4:00 p.m., with three (3) onsite employees. The application estimates that ten (10) truckloads of yard waste/debris will be delivered daily. The proposal entails four (4) 100’ by 145’ stockpile pads and one (1) 100’ by 145’ relocation pad. STAFF RECOMMENDATION This petition conforms to the Standards of Review as set forth in St. Lucie County Land Development Code Section 11.07.03 and is consistent with the Goals, Objectives, and Policies of the St. Lucie County Comprehensive. Staff recommends the Planning and Zoning Commission forward the Petition to the Board of County Commissioners with a recommendation of approval with conditions. Questions and discussion among Board members and staff. APPLICANT/ AGENT PRESENTATION Brad Currie, Vice President of Engineering, Design & Construction, and Mr. Sampson, owner of Sampson Tree Service presented a video demonstrating project location, operations, mulch dyeing process, equipment and answered questions posed by the Board.
