Disclosure(s) Mr. Lowe disclosed he would not be involved in the discussion nor vote of agenda item 4C and 4D (Orchid Beach) because of a conflict of interest. 2. MINUTES A. St. Lucie County Planning & Zoning Commission minutes for the meeting of Thursday, July 21, 2016 RESULT: ACCEPTED [UNANIMOUS] MOVER: Edward Lounds, Board Member SECONDER: Charles Grande, Board Member AYES: Lounds, Clasby, O'Dell, Smith, Grande, Lowe ABSENT: Stephanie Morgan, Bobby Hopkins, James Taylor 3. PUBLIC COMMENT A resident from Hutchinson Island on Bermuda Beach Drive spoke on traffic congestion near the Cumberland Farms store. Cathy Townsend wanted clarification regarding James Clasby being a new employee of St. Lucie County and a member of the Planning & Zoning Commission. Assistant County Attorney, Heather Young stated that she checked with the Attorney General to be sure and it was noted that his position has nothing to do with any agenda item that would be coming before the Planning and Zoning Commission. So there would not be a conflict of interest. 4. PUBLIC HEARINGS A. Resolution - Rezoning for Miller and Turner from AR-1 (Agricultural, Residential - 1 du/acre) to IL (Industrial Light) Britton Wilson, Comprehensive Planner presented a petition on behalf of Joseph Miller and James Turner who are requesting a change in zoning from Agricultural, residential to Industrial Light. This is a quasi-judicial public hearing and notice was published in the St. Lucie News Tribune on September 1st, and a sign was posted on the property. Letters were mailed out to neighbors within 500’. One letter of support was submitted by the public. More specifically the Future Land Use is governed by the Loop Road Mixed Use Activity Area, which is an adopted map within the Comprehensive Plan, which shows a medium intensity MXD designation. Where it states “the MXD-Medium intensity district will be development with Light Industrial Warehouse land uses including flex space buildings.” So basically this sub area policy restricts rezoning to IL only. As identified in the staff report, the proposed rezoning to IL meets the standards of review and is consistent with the St. Lucie County Comprehensive Plan. The proposed rezoning also complies with Policy 1.1.5.4 where water and wastewater P & Z Regular Meeting Thursday, September 15, 2016 6:00 PM 3 | P a g e sewer services are provided by Fort Pierce Utilities Authority (FPUA). And the change also furthers Objective 1.1.11 that calls for broadening the County's economic base while expanding industrial opportunities. Staff is recommending that the petition of Turner and Miller for a change in zoning from AR-1 to IL be forward to the Board of County Commissioners with a recommendation for approval, because it is consistent with the MXD future land use that specifies Industrial Light/Warehouse land uses and it furthers Objective 1.1.11 by expanding industrial opportunities. Public Hearing opened Cathy Townsend expressed to the commission to move in favor of this agenda item; it is much needed for the Orange Avenue area. Ordinance - Land Development Code Text Amendment Updating the Planned Non-Residential Neighborhood Zoning District Britton Wilson, Comprehensive Planner presented a County-initiated text amendment to Section 7.02.03 that speaks to development standards for Planned Non-Residential Development or PNRD zoning; and the purpose of this text amendment is to provide clarity and consistency of interpretation among the three Planned Development Zoning districts. This is a legislative public hearing and notice was published in the Tribune on September 5, 2016 and no comments have been submitted by the public. The Planned Development zoning is intended to achieve superior development quality through the encouragement of flexibility and creativity in site plan design. There are three Planned Development zoning districts, the PUD is for residential, the PNRD is for nonresidential and the PMUD is for a mix of the two. Currently the St. Lucie Land Development Code calls for varying review of the three and the intent of this amendment is to provide consistency of review among them by updating the PNRD language to reflect similar standards in the PUD and PMUD. Each of these three planned development districts have their own stipulated Development Design and Improvements Standards. Currently the PNRD code refers to table 7-10 for dimensional requirements. And the proposed change removes this and refers to the reader to the PNRD section. As identified in the staff report, which is included with the official record for this agenda item, the proposed text amendment meets the standards of review found in section 11.06.03. This P & Z Regular Meeting Thursday, September 15, 2016 6:00 PM 4 | P a g e creates a consistency of interpretation that provides applicants and the public a predictable review process and thereby better able to plan for a logical and orderly development pattern through innovative planned development projects. Which furthers Comprehensive Plan Objective 1.1.7 that calls for supporting and encouraging innovative land use patterns achieved through the Planned Development Review Process. Staff recommends that the proposed Text Amendment to the Land Development Code, amending the PNRD language, be forwarded to the Board of County Commissioner with a recommendation for approval because it is internally consistent with the Land Development Code and furthers Comprehensive Plan Objective 1.1.7 that calls for encouraging Planned Developments. Public Hearing open Mr. DeFabio spoke on commercial half way houses in residential neighborhoods. Ordinance - Proposed Text Amendment to the Land Development Code, Orchid Beach Resort Leslie Olson, Planning & Development Services Director stated after a long and diligent effort to create a zoning entitlement process for a high quality beach front resort, there is a project with a site plan, PNRD, and an associated request for a text amendment to that ordinance that created that possibility. This plan meets the intent, purpose and spirit contemplated & envisioned through the intensive public process by this Commission, the Board of County Commissioners and stakeholders involved in the process. There are things in flux... ownership interest has change, also changes are expected to be done to the site plan. A written request was received in writing for a continuous to February 16, 2017 Planning & Zoning meeting. The agent for the project gave a presentation to further enlighten the Commission and the public on the project. Public Hearing open Dan Sorrow of Cotleur & Hearing gave a presentation regarding Orchid Beach Resort. Several residents expressed concerns regarding traffic and parking.
