SETTLEMENT AND RELEASE AGREEMENT
This Settlement and Release Agreement is made and entered into between The Home
Depot, THD At -Home Services, Inc. ("THD") and Klaus Bywaletz ("Customer") upon the date of
execution.
WHEREAS, disputes have arisen between THD and Customer regarding Job # 8476469
(hereinafter referred to as "The Transaction").
WHEREAS, upon execution of this Settlement and Release Agreement by both THD and
Customer, THD and Customer agree to release, waive and remise all claims between them
relating to or in any way concerning The Transaction Monies;
NOW THEREFORE, for and in consideration of the mutual covenants, agreements,
promises, releases and payments provided for herein, the receipt and sufficiency of which is
hereby acknowledged by each party hereto, THD and Customer agree to the following settlement:
1. THD agrees to issue a check for $7,500 in collaboration with the termination of the Home
Depot Roofing Contract. Completion of the project will be conducted under a different
contractor of the customers choosing. The customer will have 60 days starting from the date
of the check deposit to process a " Change of Contractor" with the municipality. All warranties
will be NULL and VOID.
2. In exchange for the reduction and check amount in Paragraph 1 above, Customer
releases and discharges THD and its officers and employees from any and all claims,
causes of action, and liability of every kind which Customer had, or may have arising
from or concerning the Monetary Transaction.
3. In exchange for the releases in Paragraph 2 above, THD fully releases and
discharges Customer from any causes of action, and liability of every kind which THD
had or may have arising from or concerning The Transaction.
4. This Settlement and Release Agreement is to be construed and enforced under the
laws of the State of Florida.
5. This Settlement and Release Agreement constitutes the entire agreement between
THD and Customer and supersedes all prior negotiations and discussions which are
merged herein.
6. The parties acknowledge that they have read and fully understand this Settlement
and Release Agreement and that each has executed this Agreement freely and
without compulsion.
