REGULAR AGENDA – Proclamations, Presentations, Public Hearings, and Department requests are items, which the Commission will discuss individually, usually in the order listed on the agenda. As a general rule, when issues are scheduled before the Commission under department request or public hearing, the order of presentation is: (1) County staff presents the details of the Board item (2) Commissioners comment (3) if a public hearing, the Chair will ask for public comment, (4) further discussion and action by the Board. ADDRESSING THE COMMISSION – Please state your name and address, speaking clearly into the microphone. If you have backup material, please have eight copies ready for distribution. NON‐AGENDA ITEMS – These items are presented by an individual Commissioner or staff as necessary at the conclusion of the printed agenda. PUBLIC COMMENT – Time is allotted at the beginning of each meeting for general public comment. Comments may pertain to any matter related to the Board’s duties as the County’s governing body. ANNOUNCEMENTS Mr. Benton acknowledged that Commission Member Mike Middlebrook, who's tuned in virtually, is serving his last meeting on the Historical Commission. Mr. Benton expressed another potential candidate, Lynn Swartzel, a member of the Saint Lucie County Environmental Resources team, to potentially take his place. Mr. Middlebrook will briefly highlight the transition in his career that would take him away from this area during the end of the meeting. 5. PUBLIC COMMENT None 6. MINUTES A. ITEMS FOR ACTION / CONSIDERATION A. OLD BUSINESS Mr. Benton delivered a presentation to provide an update on the Edwin Binney Sign Kiosk and Binney Estate. Mr. Benton displayed the current sign kiosk being fabricated on screen for all members to view and explained the priority of completing this sign within a week's timeframe. Mr. Benton also expressed that the display board contains exhibits and text prepared by staff, members of the Saint Lucie County Historical Society, and representatives of the Saint Lucie County History Regional History Museum and Center. Other contributors, included descendants of Edwin Binney himself. A donation from the Fort Pierce Lions Club and funding from the Planning and Development Services Department were also received. There is an additional goal of trying to pressure wash the sidewalk in concrete adjacent to the new information sign kiosk as well. Mr. Benton thanked the Commission for their perseverance and the push to make this happen as this will hopefully provide the Commission with the framework for additional assigned kiosks across the county. Mr. Benton gave a brief update on the Binney Estate. In the last meeting, Mr. Benton discussed incentives for historic properties and those designated here locally and also spoke about the Binney Estate on Indro Rd. and its status, which is eligible for local designation, and even designation on the National Register of Historic Places. However, it is currently not designated. Discussions with the property owner explored whether they would initiate a designation request through the means of our land development code or whether the referral from a local history organization would support an action by the Commission to initiate the designation. Some of the discussions last meeting explored the Indrio Wood's Planned Unit Development Project, which is proposed in a U-shaped fashion around the Binney Estate. Mr. Benton displayed on screen what the proposed development surrounding the Binney Estate may look like. He also advised that the Planning and Zoning Commission focused on the east of the estate based upon impacts to trees, compatibility of the mass and scale of that structure, and the architectural design. Also, there were members of the public speaking regarding the estate, being careful in considering development adjacent to it. Mr. Benton noted that staff’s recommendation did seek modifications to this northeastern region of the project design, looking for that building to be revised, reduce the height to one or two stories, decrease the mass, and look at other ways to improve compatibility beyond simply the architectural theme, but currently, those firm ideas have not been implemented in any revised plan. Mr. Benton highlighted a letter received from the Port Saint Lucie Historical Society Chair Patricia Christensen recommending that this body (Historical Commission) Page 5 of 122 Historical Commission Tuesday, October 3, 2023 4:00 PM 3 | P a g e initiate a designation process for the Binney Estate. Since the July 25, 2023, Historical Commission meeting, commission members sought for staff to have conversations with the Saint Lucie County Historical Society. Conversations with a few members of the Historical Society, including the chair were made, and there seemed to be interest in referring the structure for historic designation. Mr. Benton explained that the development code provides local historical organizations such as the Port Saint Lucie Historical Society the opportunity to refer the historic resource to this body for further action. Mr. Benton explained the process of preparing a designation report and a hearing date for the property owner. Commission Discussion: Chair McAfoos inquiried when this entire process started (the Historic Sign Kiosk). Mr. Benton explained that the idea started back in 2019 and efforts launched in 2020. COVID-19 had a huge slowdown in activities, but things truly advanced in 2021, and the reprioritization of the sign that would come first occurred around 2022. This is when the department sought to have Edwin Binney sign as the primary. Mr. Benton explained that out of the 3 kiosks ,Edwin Binney's sign discussions launched in late 2021, early 2022. Chair McAfoos transitioned discussion to the Binney Estate, seeking a motion to advance this process for historic designation referral based on the letter from the Port Saint Lucie Historical Society. Mr. Manard asked about the parcel size. Mr. Benton explained that the u-shaped parcel surrounding the estate it is about 32 acres. Mr. Benton explained that the designation request would be specific to the Binney Estate property, including the various structures present, as they arguably would contribute to the overall historical context. Ms. Biglin asked about the drainage, for the proposed development around the Estate, as it looks like they have all the drainage going towards the historic property. She stated the lakes surrounding it look scary to her. Ms Biglin expressed her opinion suggesting that by the time they build all the parking lots in the buildings, how would they know those lakes are going to be big enough and not going to flood. Mr. Benton explained that project proposals would feature a 2ft tall berm with landscaping and a fence, basically the perimeter of the Binney Estate. Based on the county stormwater requirements and that of South Florida Water Management District requirements, it would cause the water to run off in the designated dry detention areas and wet lakes and then discharge into the adjacent canal, which is the North Saint Lucie River Water Control District Canal to the east, and that 2ft berm should help to alleviate any of the runoff from this property onto the Binney Estate. Chair McAoos provided an additional note explaining that the St. Lucie Historical Society is still encouraged to participate in this even after this meeting and the motion set forth. NEW BUSINESS 1. Request for Ad-Valorem Tax Exemption for Rehabilitation to a Designated Historic Property - 2601 N Indian River Drive / The "St. Lucie Club" Mr. Benton gave an overview of the request for Ad-Valorem Tax Exemption for Rehabilitation to the Designated Historical Property on 2601 N. Indian River Drive (The St. Lucie Club). Mr. Benton explained that they're seeking an Ad-Valorem tax exemption in which the Historical Commission is tasked with evaluating the scope of the improvements and considering whether they align with the Secretary of Interior Standards for Historic Preservation and the merit of the improvement and whether the Board of County Commissioners should proceed with adopting that Ad-Valorem tax exemption. Mr. Benton gave a brief history of the home as it was built in 1902 as a home for the United States Senator Quay of Pennsylvania and his friends, who hosted a series of Republican Executive Committee meetings. It was entered into the National Register of Historic Places in 1989. If granted by the Board of County Commissioners, the request for the Ad-Valorem tax program for the rehabilitative and preservation improvements could potentially have 100% of the assessed value of the improvements to the historic structure and the building value could apply to the county assessment. Some of the improvements include interior renovations, exterior improvements, repainting, and replacement of wood decking staircases. Mr. Benton expressed that Saint Lucie Village is its own jurisdiction, has its own staff and building permit process. Commission Discussion: Mr. Menard asked who controls the value of the increased work within St. Lucie Village or St. Lucie County. Mr. Benton explained the valuation consideration would be on both St. Lucie County Property Appraiser, with St. Lucie Village having a role if permitting occurs. When the value gets documented, it provides a notification to the property appraiser to consider reassessing the structure itself and the property appraiser would receive any correspondence from the Saint Lucie Village jurisdiction or the property owners. If this program is approved, it would lock in the property appraiser's assessed value of the building for a period of 10 years. Ms. Biglin inquired whether basic improvements, such as repairing rotting wood or painting the home, would enhance its value. Mr. Benton explained that the formula used by the Property Appraiser team varies for reassessment and gave examples of commercial or non- homestead properties. Mr. Menard asked about major repairs five years after being approved. Mr. Benton explained that the owners could petition for a modification or addendum to that agreement as long as the future improvements align with the Secretary of Interior standards and support the preservation. It is uncertain that the owners would be able to extend another five years at this time. Page 7 of 122 Historical Commission Tuesday, October 3, 2023 4:00 PM 5 | P a g e Ms. Biglin and Ms. Starke both think owners of historical properties should have to pay taxes due to the fact that they have to maintain the structure and already have to pay higher insurance. Both Ms Biglin and Ms Starke think keeping a historic house is a huge favor for the entire community as well. Mr. Menard wanted to ask about current permits and how long this process has been so far. Applicant Presentation: Lisa Price & John Price gave a brief overview of the house and explained that they purchased the house about a year and a half ago and most of the improvements that we've done so far didn't require permits as they were smaller repairs and maintenance issues. The roof, a metal one installed in 2006, had been in place for a while. John Price elaborated that during the last hurricane, the roof was blown off, and the previous owner had to replace it with a new one. To this day, they constantly have leaks, structural things that need repairing, painting, and damaged wood. A good percentage of that house is still some of the original pine wood and wishes to keep it maintained. Some areas around the outside of the house have started to rot as well. Commission Motion: Chair McAfoos sought a motion to approve – noting the presented motion prepared by staff; After considering the application documents, the staff report, staff comments & testimony presented during the public meeting and the standards set forth in the land development code section 4.11.17, hereby moves that the Saint Lucie County Historical Commission recommends the Board of County Commissioners approve the Ad-valorem Tax Abatement for the scope of building improvements. MEMBER MATTERS & DISCUSSION Mr. Benton invite dMike Middlebrook to speak with highlights as he transitions in his career. Mr. Middlebrook took a new position with the United States Forest Service covering 8 regions, including Puerto Rico, helping coordinate the community forest program and local governments, non-profits, and other entities acquire land and communities and turn it into Parkland. Chair McAfoos and members of the board expressed sincere gratitude to Mr.Middlebrook and his family. Mr. Benton acknowledged the arrival of a new team member, Rubi Dial, who joins Ciara Forbes, Esq. L u c i e C o u n t y H i s t o r i c a l C o m m i s s i o n D e s i g n a t i o n R e p o r t S u p p l e m e n t H i s t o r y c. 1919 Date of construction per Florida Master Site File (SL117) - Multiple Structures S i t e O v e r v i e w Historical & Architectural Significance: The subject site is located on the south side of lndrio Road between North Kings Highway and Tay-lor Dairy Road, St. Lucie County, Florida. The primary structure, a residence constructed circa- 1919, is an irregular, two-story building designed with a hollow clay tile structural system that rests on a continuous brick foundation. The cross-gabled roof was overlaid in barrel tiles and the exterior is clad in stucco. The residence has three brick chimneys; one on the north wall, and two on the east wall. Square stuccoed columns support a gabled porch on the east elevation. A one-bay inset porch on the west side features a flat arch and square stuccoed columns. Fenestration consists of replace- ment three-light metal awning windows. Exterior ornamentation includes stuccoed sills, arched openings, and barrel tile. The building is in acceptable to good condition. The property includes an original wood frame barn, a second smaller historic Frame Vernacular resi- dence, and a decorative stuccoed property wall. Request: The St. Lucie County Historical Commission, at their October 3, 2023 Meeting voted unanimously to initiate a Historic Designation review for the property after receiving a recommen-dation referred by the Port St. Lucie Historical Society. Subsequent to the Historical Commission’s action to initiate designation proceedings, the property owner filed a designation petition. Both requests will be evaluated by the Historical Commission for recommendations to the Board of County Commissioners in accordance with the Land Development Code—Section 4.11.00. - Historic Preservation Agenda Item 8. Binney was born in New York and came to Fort Pierce in 1913. He named this winter home "Florindia". As noted, the property includes a two-story Mediterranean Revival-style residence, a small Frame Vernacular house (which pre-dates the main house), a barn, shed(s) and tennis court. A decorative concrete wall with iron gates encloses the property. The canopy of oak trees, he and his daughter, Dorothy Binney Palmer planted along lndrio Road, in front of the estate (Harris 2003:F1) have been impacted by storm events, natural lifecycles—particularly the Laurel Oaks and public works related maintenance. In addition to his involvement in the invention of the Crayola Crayon, Binney was also a landowner, a banker, and a generous philanthropist. He was instrumental in the restoration of a bridge in Fort Pierce in the late 1920s and helped keep the St. Lucie County Bank open after the 1929 market crash (Harris 2003:F-10). Edwin Binney was the father of Dorothy Binney Putnam, a prominent St. Lucie County citizen. She designed her Mediterranean Revival home, known as lmmokolee, which is located a few miles to the southwest of Florindia. lmmokolee was listed in the National Register of Historic Places (NRHP) in 1994. The main house at the Binney Estate is largely intact, although some of the windows have been replaced and a porch on the west side has been enclosed with jalousie windows. This building is considered significant at the local level and is considered poten- tially eligible for the NRHP for its associations with Edwin Binney and for Architecture. The property is not part of a historic district. Aesthetic Significance - Is part of or related to a landscape, park, environmental feature or other distinctive area, and should be developed or preserved according to a plan based upon a historic, ar- chaeological, cultural, or architectural motif; or because of its prominent or special local, contrast of siting, age, or scale is an easily identifiable visual feature of a neighborhood or area or contributes to the distinctive quality of such neighborhood or area; or g. Found by the St. Lucie County Historic Resources Survey to be eligible for designation on the lo- cal register. The Survey shall not be conclusive as to whether a site should be designated. Prior to the designation of an individual site or a district, the Historic Preservation Officer shall prepare an investigation and designation report and submit it to the Historical Commission. Every historic district (or designated site) may include detailed zoning regulations made to be compatible with its designation. Such regulations may be designed to supplant or modify any element of existing zoning regulations, including but not limited to use, floor area ratio, density, height, set-backs, parking, minimum lot size or create any additional regulations provided for in this section. The zoning amendment may identify individual properties, improvements, landscape features or sites for which different regulations; standards and procedures may be required. Said zoning regulations shall not be effective until the Board of County Commissioners approves the regulations. Every historic site may include suggestions for variances from current Code requirements, including but not limited to use, floor area ratio, density, height, set-backs, and parking. Variances shall not be effective until the Board of Adjustment approves them. The AR-1 Zoning District permits single-family development up to 1 dwelling unit per acre, along with various accessory uses— including one (1) guest home that may not be rented or sold. In review of the subject property, exceptions should be consider in relation to the minimum yard (setback) requirements for the AR-1 District as it relates to the present structures. The barn, present at the west side of the property, may not meet the required side setback. If so, the structure would be considered a Legal Non-conforming structure that undergo normal maintenance and repair. Relief to the adopted setback guidelines is recommended for all existing structures, upon historic designation. NARRATIVE DESCRIPTION OF SITE The residence, constructed circa-1919, is located on the south side of lndrio Road between N Kings Highway and Taylor Dairy Road Lane in Township 34 South, Range 39 East, Section 13 (Oslo USGS Quadrangle) in the general vicinity of Fort Pierce, St. Lucie County, Florida. This irregular, two-story building has a hollow clay tile structural system that rests on a continuous brick foundation. The cross-gabled roof is covered in barrel tiles and the exterior is clad in stucco. The residence has three brick chimneys; one on the north wall, and two on the east wall. Square stuccoed columns support a gabled porch on the east elevation. A one-bay inset porch on the west side features a flat arch and square stuccoed columns. Fenestration consists of replacement three-light metal awning windows. Exterior ornamentation includes stuccoed sills, arched openings, and barrel tile. The building is in good condition. The property includes a historic wood frame barn, a second smaller historic Frame Vernacular residence, and a decorative stuccoed property wall. B. DISCUSSION OF SIGNIFICANCE This property originally belonged to Edwin Binney, co-inventor of the Crayola Crayon. Binney was born in New York and came to Fort Pierce in 1913. He named his winter home "Florindia," which includes a two-story Mediterranean Revival-style residence, a small Frame Vernacular house (which pre-dates the main house), and a barn. A decorative concrete wall with iron gates encloses the property. The canopy of oak trees, he and his daughter, Dorothy Binney Palmer planted along lndrio Road, in front of the estate, still remains (Harris 2003:F1 ). In addition to his involvement in the invention of the Crayola Crayon, Binney was also a landowner, a banker, and a generous philanthropist. He was instrumental in the restoration of a bridge in Fort Pierce in the late 1920s and he helped keep the St. Lucie County Bank open after the 1929 market crash (Harris 2003:F-10). Edwin Binney was the father of Dorothy Binney Putnam, who was also a prominent St. Lucie County citizen. She designed her Mediterranean Revival home, known as lmmokolee, which is located a few miles away from Florindia. lmmokolee was listed in the NRHP in 1994. The main house on the Binney estate is largely intact, although some of the windows have been replaced and a porch on the west side has been enclosed with jalousie windows. This building is considered significant at the local level and is considered potentially eligible for the NRHP under Criteria B for its associations with Edwin Binney and Criteria C for Architecture. Notable architectural features include a gable roof with barrel tile surface, shed balcony, and a parallel gable. Clad in stucco, this building has metal awning windows and rests on a continuous brick foundation. This building has retained its original appearance, and is in good condition. Architectural Context: Masonry Vernacular is defined as the common masonry construction techniques of lay or self taught builders. Prior to the Civil War vernacular designs were local in nature, transmitted by word of mouth or by demonstration, and relying heavily upon native building materials. With the corning of the American Industrial Revolution mass manufacturers became the pervasive influence over vernacular house design. Popular magazines featuring standardized manufactured building components, house plans, and house decorating tips flooded consumer markets and helped to make building trends universal throughout the country. The railroad also aided the process by providing cheap and efficient transportation for manufactured building materials. Ultimately, the individual builder had access to a myriad of finished architectural products from which he could pick and choose to create a design of his own. Masonry Vernacular is more commonly associated with commercial building types than with residential architecture where wood frame houses dominate. In Florida, most examples predating 1920 were brick, but a number of older examples feature the rough-faced cast concrete block popularized by Henry Hobson Richardson in his Romanesque buildings of the late nineteenth century. The Masonry Vernacular designs of the 1920s were most often influenced by popular Spanish designs of the period. The main masonry building materials during the period were hollow tile and brick. During the 1930s Masonry Vernacular buildings, influenced by the International and Modernistic styles and the increased use of reinforced concrete construction techniques, took on an increasing variety of forms. Since World War II concrete block construction has been the leading masonry building material used in Florida. Historical Narrative: The Edwin Binney House, built inc. 1919, is located in an unincorporated area of St. Lucie County. According to local sources, Binney, originally from Connecticut was a landowner, banker, and Crayola Crayon developer. (Interview with Andrew Jorgensen by Wtlliam Adams, 6/90). Historical Context: Located near the midway point of Florida's East Coast, St. Lucie County lies within one of the oldest continually settled regions in the United States. Prehistoric Indians were drawn to the area by the abundance of fish and game in and along the scenic Indian River. European contact with the area occurred during the Colonial period of Florida's history, but permanent settlement did not occur until the 1840s, when Fqrt Pierce was constructed as a military outpost during the Second Seminole War. Beginning with the establishment of St. Lucie Village in 1842, a number of small settlements developed along the west bank of the Indian River during the late 19th century. Construction of the Florida East Coast Railway in the 1890s ended the relative isolation of the area. Whistle stops were located at Ankona, now Indrio, St. Lucie, Fort Pierce, White City, and Eden, the larger settlements along the Indian River. The railroad provided a direct link to northern markets for fishing, beef, citrus products, and provided access to the region for prospective settlers. Extensive drainage projects undertaken during the 1910s and 1920s by the Fort Pierce Farms Investment Company reclaimed vast areas of land and expanded the county's agricultural base. By 1920 St. Lucie County had established itself as one of Florida's chief agricultural regions while entering an exuberant period of historic development. The Great Florida Land Boom brought thousands of tourists and new settlers to the area. Early subdivision activity was centered around San Lucie Plaza and Regina Palms. The development that the boom fostered was spectacular, but short-lived. The speculative bubble burst near the end of 1926, throwing the Florida economy into a depression three years in advance of the rest of the nation. Although development in St. Lucie County was slowed significantly, the area fared better than·many of its neighbors, because of Fort Pierce harbor, the primary shipping point for citrus products for the central Florida. The buildings surveyed in the unincorporated areas of St. Lucie County accurately reflect its rich historical and architectural past. Designation Process and Procedure. A.Criteria. 1. The Historical Commission shall have the authority to recommend to the Board of County Commissioners designation of buildings, sites, districts, landscape features, roads, objects, structures and resources as sites, districts or zones that are significant in St. Lucie County's history, architecture, archaeology or culture and possess an integrity of location, design, setting, materials, workmanship, feeling or association, and meets one or more of the following criteria: a. Significant Event - Associated with distinctive elements of the cultural, social, political, economic, scientific, religious, prehistoric and architectural history that have contributed to the pattern of history in the community, St. Lucie County, the region, the state or the nation; or b. Significant Person - Associated with persons significant in the County, the region, the state or the nation's past; or c. Architectural Significance - Embodies the distinctive characteristics of a type, period, style or method of construction or work of a master; or that possess high artistic value; or that represent a distinguishable entity whose components may lack individual distinction; or d. Archaeological Significance - Has yielded, or is likely to yield information in history or prehistory; or e. Listed in the National Register of Historic Places; or f. Aesthetic Significance - Is part of or related to a landscape, park, environmental feature or other distinctive area, and should be developed or preserved according to a plan based upon a historic, archaeological, cultural, or architectural motif; or because of its prominent or special local, contrast of siting, age, or scale is an easily identifiable visual feature of a neighborhood or area or contributes to the distinctive quality of such neighborhood or area; or g. Found by the St. Lucie County Historic Resources Survey to be eligible for designation on the local register. The Survey shall not be conclusive as to whether a site should be designated. 2. Certain properties, which include cemeteries, birthplaces, properties owned by religious institutions or used for religious purposes, structures that have been moved from their original locations, properties that have achieved significance within the last fifty (50) years, and properties commemorative in nature will not normally be considered for designation on the St. Lucie County Register of Historic Places. However, such properties will qualify if they are integral parts of districts that do meet the criteria, or if they fall within the following categories: a. A religious property deriving primary significance from architectural or artistic distinction of historical importance; b. A building or structure removed from its location but which is primarily significant for architectural value, or is the surviving structure most importantly associated with an historic event or person; c. There is no other appropriate site or building directly associated with the life of a person significant in the County, the region, the state or the nation's past; d. A cemetery that derives its primary significance from graves of persons of transcendent importance, from age, distinctive design features, or from association with historic events; e. A property or district achieving significance within the past fifty (50) years if it is of exceptional importance. B.Procedures for Historic Designation. Properties that meet the criteria for local historic sites and local historic districts set forth in Section 4.11.02 shall be designated according to the following procedures: 1.Initiation. a. Petition of the owner. (i) The owner(s) of any property in St. Lucie County may apply for designation of their property as an individual site or district. Applications for Designation must be submitted with the appropriate fee to the Historic Preservation Officer pursuant to the fee schedule established by resolution of the Board of County Commissioners. The Historic Preservation Officer shall, based on its findings, either recommend a designation report be prepared or recommend denial of the application. Nothing in this subsection shall be deemed to restrict the power of the Historical Commission to initiate the designation process pursuant to (B)(1)(b), below. The applicant may withdraw his or her application for designation at any time before the Board of County Commissioners makes its final decision regarding designation. Nothing in this subsection shall be deemed to restrict the power of the property owner(s) to reject a final Board of County Commissioners decision to designate as set out in (B)(9), below. (ii) The Historical Commission shall within sixty (60) days either accept or deny the application. Upon accepting the application, the Historical Commission will set a date for a public hearing. The owner shall complete the designation report and the Historic Preservation Officer shall notify the proper parties of the public hearing. b. Initiation by the Historical Commission. Based upon written recommendations from local, state or national historical organizations, the Historical Commission may initiate the designation of properties which would meet the criteria for an Exceptional Historic Resource as defined in Section 4.11.02. When the Historical Commission votes to initiate the designation process, it shall set a date for a public hearing. Staff shall notify the property owner of the public hearing and prepare the designation report. 2.Designation Reports. Prior to the designation of an individual site or a district, the Historic Preservation Officer shall prepare an investigation and designation report and submit it to the Historical Commission. All reports must address the following: a. Legal description of the property. b. The historical, cultural, architectural or archaeological significance or how the property fulfills the criteria for designation. c. Whether the property meets the criteria for an Exceptional Historic Resource as defined in Section 4.11.02. d. Clearly established boundaries for individual historic sites and a recommendation of boundaries for districts. When a district is recommended, the report must identify those properties which are considered "contributing" (i.e., that they contribute to creating the historic character of the district) or "non-contributing" (i.e., that they do not contribute to creating the character of the district), but which require regulation in order to control potentially adverse influences on the character and integrity of the district. The standards for regulating non-contributing properties shall provide that a Certificate of Appropriateness and/or Certificate to Dig, as appropriate, shall be required for alterations and new construction on such properties. Every historic district may include detailed zoning regulations made to be compatible with its designation. Such regulations may be designed to supplant or modify any element of existing zoning regulations, including but not limited to use, floor area ratio, density, height, set-backs, parking, minimum lot size or create any additional regulations provided for in this section. The zoning amendment may identify individual properties, improvements, landscape features or sites for which different regulations; standards and procedures may be required. Said zoning regulations shall not be effective until the Board of County Commissioners approves the regulations. Every historic site may include suggestions for variances from current Code requirements, including but not limited to use, floor area ratio, density, height, set-backs, and parking. Variances shall not be effective until the Board of Adjustment approves them. f. The report shall also contain a location map and photographs of all exterior surfaces, and interiors when applicable. g. Optional Designation of Interiors. Normally interior spaces shall not be subject to regulation under this ordinance; however, in cases of existing structures that possess interior spaces that are of exceptional architectural, artistic or historical importance, and are interior spaces which are customarily open to the public, they may be specifically designated. The designation report shall describe precisely those features subject to review and shall set forth standards and guidelines for such regulations. h. Designation reports shall also include a copy of any survey materials related to such property, the property appraiser's records of such property and a copy of the public hearing newspaper advertisement. 3.Notification of Owner. For each proposed designation of an individual site or district, the Historical Commission is encouraged to obtain the permission of the property owner(s) of the individual site or within the designated area. The Historic Preservation Officer shall send notification by certified mail to the owner when the Historical Commission votes to initiate designation and sets a date for public hearing. The Historic Preservation Officer is also responsible, when designation is initiated by the Historical Commission, for sending by certified mail a copy of the designation report to the owner(s) at least thirty (30) days prior to a public hearing held pursuant to this ordinance. Any objections by the property owner must be notarized. 4.Interim Protection Measure. From the date of said notification of the owner(s), no building construction or vegetation removal permit for any new construction, alteration, relocation, or demolition or surface alterations that may affect the property proposed for designation shall be issued until the Board of County Commissioners approves or denies the designation in accordance with this section, or one hundred eighty (180) days have elapsed, whichever shall occur first. 5.Notification of Government Agencies. A party aggrieved by a designation decision may appeal such decision in the manner provided for in this ordinance. 12.Recording of Designation. The Board of County Commissioners shall provide the Clerk of Circuit Court with all designations for the purpose of recording such designation and the Clerk of Circuit Court shall thereupon record the designation according to law. 13.St. Lucie County Local Register Map. On or before October 1 of each year, the Historic Preservation Officer shall prepare a map showing all properties listed on the Local Register of Historic Places (including any properties listed on the National Register of Historic Places) as of that date. Notable architectural features include a gable roof with barrel tile surface, shed balcony, and a parallel gable. Clad in stucco, this building has metal awning windows and rests on a continuous brick foundation. This building has retained its original appearance, and is in good condition. Architectural Context: Masonry Vernacular is defined as the common masonry construction techniques of lay or self taught builders. Prior to the Civil War vernacular designs were local in nature, transmitted by word of mouth or by demonstration, and relying heavily upon native building materials. With the corning of the American Industrial Revolution mass manufacturers became the pervasive influence over vernacular house design. Popular magazines featuring standardized manufactured building components, house plans, and house decorating tips flooded consumer markets and helped to make building trends universal throughout the country. The railroad also aided the process by providing cheap and efficient transportation for manufactured building materials. Ultimately, the individual builder had access to a myriad of finished architectural products from which he could pick and choose to create a design of his own. Masonry Vernacular is more commonly associated with commercial building types than with residential architecture where wood frame houses dominate. In Florida, most examples predating 1920 were brick, but a number of older examples feature the rough-faced cast concrete block popularized by Henry Hobson Richardson in his Romanesque buildings of the late nineteenth century. The Masonry Vernacular designs of the 1920s were most often influenced by popular Spanish designs of the period. The main masonry building materials during the period were hollow tile and brick. During the 1930s Masonry Vernacular buildings, influenced by the International and Modernistic styles and the increased use of reinforced concrete construction techniques, took on an increasing variety of forms. Since World War II concrete block construction has been the leading masonry building material used in Florida. Historical Narrative: The Edwin Binney House, built inc. 1919, is located in an unincorporated area of St. Lucie County. According to local sources, Binney, originally from Connecticut was a landowner, banker, and Crayola Crayon developer. (Interview with Andrew Jorgensen by Wtlliam Adams, 6/90). Historical Context: Located near the midway point of Florida's East Coast, St. Lucie County lies within one of the oldest continually settled regions in the United States. Prehistoric Indians were drawn to the area by the abundance of fish and game in and along the scenic Indian River. European contact with the area occurred during the Colonial period of Florida's history, but permanent settlement did not occur until the 1840s, when Fqrt Pierce was constructed as a military outpost during the Second Seminole War. Beginning with the establishment of St. Lucie Village in 1842, a number of small settlements developed along the west bank of the Indian River during the late 19th century. Construction of the Florida East Coast Railway in the 1890s ended the relative isolation of the area. Whistle stops were located at Ankona, now Indrio, St. Lucie, Fort Pierce, White City, and Eden, the larger settlements along the Indian River. The railroad provided a direct link to northern markets for fishing, beef, citrus products, and provided access to the region for prospective settlers. Extensive drainage projects undertaken during the 1910s and 1920s by the Fort Pierce Farms Investment Company reclaimed vast areas of land and expanded the county's agricultural base. By 1920 St. Lucie County had established itself as one of Florida's chief agricultural regions while entering an exuberant period of historic development. The Great Florida Land Boom brought thousands of tourists and new settlers to the area. Early subdivision activity was centered around San Lucie Plaza and Regina Palms. The development that the boom fostered was spectacular, but short-lived. The speculative bubble burst near the end of 1926, throwing the Florida economy into a depression three years in advance of the rest of the nation. Although development in St. Lucie County was slowed significantly, the area fared better than·many of its neighbors, because of Fort Pierce harbor, the primary shipping point for citrus products for the central Florida. The buildings surveyed in the unincorporated areas of St. Lucie County accurately reflect its rich historical and architectural past. Designation Process and Procedure. A.Criteria. 1. The Historical Commission shall have the authority to recommend to the Board of County Commissioners designation of buildings, sites, districts, landscape features, roads, objects, structures and resources as sites, districts or zones that are significant in St. Lucie County's history, architecture, archaeology or culture and possess an integrity of location, design, setting, materials, workmanship, feeling or association, and meets one or more of the following criteria: a. Significant Event - Associated with distinctive elements of the cultural, social, political, economic, scientific, religious, prehistoric and architectural history that have contributed to the pattern of history in the community, St. Lucie County, the region, the state or the nation; or b. Significant Person - Associated with persons significant in the County, the region, the state or the nation's past; or c. Architectural Significance - Embodies the distinctive characteristics of a type, period, style or method of construction or work of a master; or that possess high artistic value; or that represent a distinguishable entity whose components may lack individual distinction; or d. Archaeological Significance - Has yielded, or is likely to yield information in history or prehistory; or e. Listed in the National Register of Historic Places; or f. Aesthetic Significance - Is part of or related to a landscape, park, environmental feature or other distinctive area, and should be developed or preserved according to a plan based upon a historic, archaeological, cultural, or architectural motif; or because of its prominent or special local, contrast of siting, age, or scale is an easily identifiable visual feature of a neighborhood or area or contributes to the distinctive quality of such neighborhood or area; or g. Found by the St. Lucie County Historic Resources Survey to be eligible for designation on the local register. The Survey shall not be conclusive as to whether a site should be designated. 2. Certain properties, which include cemeteries, birthplaces, properties owned by religious institutions or used for religious purposes, structures that have been moved from their original locations, properties that have achieved significance within the last fifty (50) years, and properties commemorative in nature will not normally be considered for designation on the St. Lucie County Register of Historic Places. However, such properties will qualify if they are integral parts of districts that do meet the criteria, or if they fall within the following categories: a. A religious property deriving primary significance from architectural or artistic distinction of historical importance; b. A building or structure removed from its location but which is primarily significant for architectural value, or is the surviving structure most importantly associated with an historic event or person; c. There is no other appropriate site or building directly associated with the life of a person significant in the County, the region, the state or the nation's past; d. A cemetery that derives its primary significance from graves of persons of transcendent importance, from age, distinctive design features, or from association with historic events; e. A property primarily commemorative in intent if design, age, tradition or symbolic value has invested it with its own historical significance; Page 100 of 122 Created: 2023-09-01 19:47:30 [EST] (Supp. No. 25) Page 2 of 5 f. A property or district achieving significance within the past fifty (50) years if it is of exceptional importance. B.Procedures for Historic Designation. Properties that meet the criteria for local historic sites and local historic districts set forth in Section 4.11.02 shall be designated according to the following procedures: 1.Initiation. a. Petition of the owner. (i) The owner(s) of any property in St. Lucie County may apply for designation of their property as an individual site or district. Applications for Designation must be submitted with the appropriate fee to the Historic Preservation Officer pursuant to the fee schedule established by resolution of the Board of County Commissioners. The Historic Preservation Officer shall, based on its findings, either recommend a designation report be prepared or recommend denial of the application. Nothing in this subsection shall be deemed to restrict the power of the Historical Commission to initiate the designation process pursuant to (B)(1)(b), below. The applicant may withdraw his or her application for designation at any time before the Board of County Commissioners makes its final decision regarding designation. Nothing in this subsection shall be deemed to restrict the power of the property owner(s) to reject a final Board of County Commissioners decision to designate as set out in (B)(9), below. (ii) The Historical Commission shall within sixty (60) days either accept or deny the application. Upon accepting the application, the Historical Commission will set a date for a public hearing. The owner shall complete the designation report and the Historic Preservation Officer shall notify the proper parties of the public hearing. b. Initiation by the Historical Commission. Based upon written recommendations from local, state or national historical organizations, the Historical Commission may initiate the designation of properties which would meet the criteria for an Exceptional Historic Resource as defined in Section 4.11.02. When the Historical Commission votes to initiate the designation process, it shall set a date for a public hearing. Staff shall notify the property owner of the public hearing and prepare the designation report. 2.Designation Reports. Prior to the designation of an individual site or a district, the Historic Preservation Officer shall prepare an investigation and designation report and submit it to the Historical Commission. All reports must address the following: a. Legal description of the property. b. The historical, cultural, architectural or archaeological significance or how the property fulfills the criteria for designation. c. Whether the property meets the criteria for an Exceptional Historic Resource as defined in Section 4.11.02. d. Clearly established boundaries for individual historic sites and a recommendation of boundaries for districts. When a district is recommended, the report must identify those properties which are considered "contributing" (i.e., that they contribute to creating the historic character of the district) or "non-contributing" (i.e., that they do not contribute to creating the character of the district), but which require regulation in order to control potentially adverse influences on the character and integrity of the district. The standards for regulating non-contributing properties shall provide that a Certificate of Appropriateness and/or Certificate to Dig, as appropriate, shall be required for alterations and new construction on such properties. Every historic district may include detailed zoning regulations made to be compatible with its designation. Such regulations may be designed to supplant or modify any element of existing zoning regulations, including but not limited to use, floor area ratio, density, height, set-backs, parking, minimum lot size or create any additional regulations provided for in this section. The zoning amendment may identify individual properties, improvements, landscape features or sites for which different regulations; standards and procedures may be required. Said zoning regulations shall not be effective until the Board of County Commissioners approves the regulations. Every historic site may include suggestions for variances from current Code requirements, including but not limited to use, floor area ratio, density, height, set-backs, and parking. Variances shall not be effective until the Board of Adjustment approves them. f. The report shall also contain a location map and photographs of all exterior surfaces, and interiors when applicable. g. Optional Designation of Interiors. Normally interior spaces shall not be subject to regulation under this ordinance; however, in cases of existing structures that possess interior spaces that are of exceptional architectural, artistic or historical importance, and are interior spaces which are customarily open to the public, they may be specifically designated. The designation report shall describe precisely those features subject to review and shall set forth standards and guidelines for such regulations. h. Designation reports shall also include a copy of any survey materials related to such property, the property appraiser's records of such property and a copy of the public hearing newspaper advertisement. 3.Notification of Owner. For each proposed designation of an individual site or district, the Historical Commission is encouraged to obtain the permission of the property owner(s) of the individual site or within the designated area. The Historic Preservation Officer shall send notification by certified mail to the owner when the Historical Commission votes to initiate designation and sets a date for public hearing. The Historic Preservation Officer is also responsible, when designation is initiated by the Historical Commission, for sending by certified mail a copy of the designation report to the owner(s) at least thirty (30) days prior to a public hearing held pursuant to this ordinance. Any objections by the property owner must be notarized. 4.Interim Protection Measure. From the date of said notification of the owner(s), no building construction or vegetation removal permit for any new construction, alteration, relocation, or demolition or surface alterations that may affect the property proposed for designation shall be issued until the Board of County Commissioners approves or denies the designation in accordance with this section, or one hundred eighty (180) days have elapsed, whichever shall occur first. 5.Notification of Government Agencies. Upon setting a date for public hearing on designation, the Historic Preservation Officer shall immediately notify the appropriate building and zoning department, the appropriate public works department and any other County or municipal agency, including agencies with demolition powers, that may be affected by said filing. 6.Notice of Historical Commission Public Hearing. For each individual site or district proposed for designation, a public hearing shall be held no sooner than thirty (30) days and within one hundred and twenty (120) days from the date a designation report has been filed with the Historical Commission. Property owners within a radius of one thousand (1,000) feet from the area proposed for designation shall receive a courtesy notice of the hearing. Owners of record of the proposed designated properties, shall be notified of the public hearing by registered or certified mail with return receipt requested to the last known address of the party being served or, if the name of any such party or his place of residence or his post office address cannot be ascertained after diligent search, by publishing a copy thereof once a week for four (4) consecutive weeks, in a newspaper of general circulation within St. Page 102 of 122 Created: 2023-09-01 19:47:30 [EST] (Supp. No. 25) Page 4 of 5 Lucie County. A copy of all such notices and orders shall be posted in a conspicuous place upon such building or structure; all of such notices and orders shall be in writing and contain an accurate description of the building, structure and the lot or parcel of land affected and shall be mailed, posted or published not less than fifteen (15) days nor more than sixty (60) days before the date therein fixed for hearing. Owners shall be given an opportunity at the public hearing to object to the proposed designation. 7.Requirement of Prompt Decision and Notification. Following the public hearing, the Historical Commission shall recommend approval, approval with conditions, denial or amendment of the proposed designation, including whether the property should be considered an Exceptional Historic Resource, and shall forward its recommendation to the Board of County Commissioners within thirty (30) days of the hearing for final approval. The Historical Commission may suspend action on the application for a period not to exceed thirty (30) days, in order to seek technical advice from outside its members, or to meet further with the applicant to revise or modify the application. 8.Notice of Board of County Commissioners Public Hearing. Upon receipt of the Historical Commission's recommendation, the Board of County Commissioners shall schedule a public hearing to consider the proposed designation. The public hearing must be held no sooner than thirty (30) days and within sixty (60) days from the date the Historical Commission recommendation is filed with the Board of County Commissioners. Property owners within a radius of one thousand (1,000) feet from the area proposed for designation shall receive a courtesy notice of the hearing. Owners of record of the proposed designated properties, shall be notified of the public hearing by registered or certified mail with return receipt requested to the last known address of the party being served or, if the name of any such party or his place of residence or his post office address cannot be ascertained after diligent search, by publishing a copy thereof once a week for four (4) consecutive weeks, in a newspaper of general circulation within St. Lucie County. Except for property determined to be an Exceptional Historic Resource, the owner, or a majority of the owners if owned by more than one person, or a majority plus one of the owners in a proposed historic district, may reject the designation in writing by filing a written statement with the Historic Preservation Officer within thirty (30) days of the Board of County Commissioners' decision. In the event the designation is rejected, the provisions of this ordinance governing designated historic properties shall not apply to the subject property or district. If approved, the property shall be added to the St. Lucie County Local Register of Historic Places. The following parties shall be notified of its actions with a copy of the resolution. a. St. Lucie County Growth Management Department; b. St. Lucie County Public Works Department; c. St. Lucie County Clerk of Court; d. Owner(s) of the designated property and other parties having an interest in the property, if known; e. A party aggrieved by a designation decision may appeal such decision in the manner provided for in this ordinance. 12.Recording of Designation. The Board of County Commissioners shall provide the Clerk of Circuit Court with all designations for the purpose of recording such designation and the Clerk of Circuit Court shall thereupon record the designation according to law. 13.St. Lucie County Local Register Map. On or before October 1 of each year, the Historic Preservation Officer shall prepare a map showing all properties listed on the Local Register of Historic Places (including any properties listed on the National Register of Historic Places) as of that date. The Historic Preservation Officer may update the map at such other times as he deems appropriate to reflect changes to the Local Register.
