Continued from November 17, 2022 - Acting as the Local Planning Agency A Future Land Use Map Amendment to change the land use category from COM (Commercial) to the RH (Mixed-Use Development) category, affecting +/-6.37 acres, submitted by Dr. Alec Wynne on behalf of the Wynne Building Corporation. STAFF PRESENTATION Kori Benton, AICP Planning Manager made a presentation on the proposed amendment to the Comprehensive Plan Future Land Use Map (Small-scale), to change the Future Land Use Category of +/- 6.37 acres from the COM, Commercial category to the RH, Residential High (up to 15 du/ac) category. A concurrent application proposes a Zoning Atlas Amendment (Rezoning) from the CG, Commercial General zoning district to the Planned Unit Development (PUD) zoning district for the same +/-6.37 acres and an associated Preliminary PUD Site Plan to develop up to 96 dwelling units, to be known as the Ibis PUD. In accordance with public notice requirements outlined in Section 11.00.03 of St. Lucie County Land Development Code, public notice was advertised in the St. Lucie County News Tribune on October 7, 2022. Notices were mailed to surrounding property owners within a 500-foot radius of the subject property, and a sign was posted on the property. The Planning department and Commission Board suggested the applicant host a neighborhood meeting. DR. Wynne hosted the neighborhood meeting on December 2, 2022 and the Planning staff was present. There were approximately 40 attendees from the Savannah Club neighborhood. Mr. Benton presented a PowerPoint to cover the project location, proposed planned unit development PUD preliminary site plan, alternate proposed planned unit development PUD preliminary site plan, alternate proposed planned unit development PUD preliminary landscape plan, and existing future land use. Page 6 of 95 Planning & Zoning Commission MeetingThursday, December 15, 2022 6:00 PM 3 | P a g e STAFF RECOMMENDATION Staff has reviewed the proposed Comprehensive Plan Future Land Use Map Amendment and proposed sub-area policies and determined it is generally consistent with the Goals, Objectives, and Policies of the Comprehensive Plan. Staff recommends the Planning & Zoning Commission, acting as the Local Planning Agency, forward a recommendation to approve the Future Land Use Map Amendment. BOARD DISCUSSION Ms. Slack asked about the drainage plan. Mr. Benton stated the applicant's civil engineer was not present at the Development Review Committee (DRC) meeting. However, conceptual conceptual stormwater plan was reviewed by St. Lucie County Public Works engineering staff. Mr. Mundt suggested the applicant show the Spanish Lakes HOA a plan that is phased or timetable with a plan that is satisfactory. Mr. Lounds suggested to the applicant to increase the capacity and upgrade the size of the outfall pump as they get worn out over time and don't work efficiently. Mr. Slay asked about potable water and sewer connections with the City of Port St Lucie. The applicant stated that when the park was built Port St. Lucie utilities were not established. The applicant stated they have an agreement with Port St. Lucie utilities to everything downstream they maintain, including sewer, wastewater and potable water throughout the community and Port St. Lucie utilities maintain everything upstream. This category is found predominantly along the western edge of the urban form, but is also appropriate for areas of special environmental concern such as along the North Fork of the St. Lucie River and the Indian River Lagoon. The RE designation is intended for large lot, single-family detached residential dwellings, at a density of one unit per gross acre. Whether there have been changed conditions that require an amendment; The applicant is pursuing a rezone to the PUD (Planned Unit Development) Zoning District for residential development, compatible with surrounding uses and nearby residential communities such as the Pine Hollow to the north and the Creekside PUD to the southeast. The current AG-2.5 (Agricultural-2.5) zoning limits lots sizes to no less than 2.5 acres, whereas the project seeks more compact lot sizes in favor of density aligning with the Future Land Use Category of RE (Residential, Estate) and common area components within the community. With the increase in St. Lucie County’s population, the Freeman PUD will support the demand for mid-size single-family home sites in a transitional area on the western edge of urban development and rural agricultural lands. According to www.edr.state.fl.us, St. Lucie’s population grew from 340,060 in 2021 to 350,518 in 2022. The population is anticipated to grow to 403,213 by 2030. The area has seen an increase in people from out of state and people moving from South Florida. The housing demand will continue to increase due to the rapid population increase. E. Whether and the extent to which the proposed amendment would result in demands on public facilities, and whether or to the extent to which the proposed amendment would exceed the capacity of such public facilities, including but not limited to transportation facilities, sewage facilities, water supply, parks, drainage, schools, solid waste, mass transit, and emergency medical facilities; The proposed change in zoning should not adversely affect the acceptable level of service capacity of transportation facilities, parks, drainage, schools, solid waste, mass transit, or emergency medical facilities. Page 41 of 95 Project Name: The Freeman PUD File No.: PUD_RZ-10202126208 7 Prior to the issuance of a Final Development Order, the developer must demonstrate that all public facilities are available to serve the parcel and obtain a Certificate of Capacity. The applicant has signed the required Concurrency Deferral Affidavit recognizing this provision. Drainage Following approval of a Preliminary site plan, and Final site plan, the development must receive a Site Development Permit from the Public Works Department to ensure the project does not adversely impact adjacent properties. Water/Wastewater Water & Wastewater services will be provided by the St. Lucie County Utilities system. Transportation Impacts The analysis demonstrates that the adjacent roadway segments have sufficient capacity and no adverse impacts to accommodate the proposed land use change. Further analysis will be reviewed at the time of the final site plan review. F. Whether and the extent to which the proposed amendment would result in significant adverse impacts on the natural environment; The proposed amendment is not anticipated to create significant impacts on the natural environment. The applicant provided an environmental impact report that assesses existing environmental conditions on the subject property. The Environment Resources Department reviewed the submitted Environmental Impact Report and provided the following evaluation: Background The Environmental Resources Department (ERD) is in receipt of the October 12, 2022 date-stamped submittal from Planning and Development Services. The applicant is proposing a 96-unit residential subdivision with associated site improvements and is seeking approval of the preliminary development plan to rezone the parcel from Agricultural – 2.5 (AG-2.5) to Planned Unit Development (PUD). The project is located at 11000 Okeechobee Rd in Ft. Pierce and currently consists of three (3) parcels collectively measuring 96.32-acres. Findings An environmental assessment (EA), dated June 30, 2020, prepared by EDC, was provided and reviewed. An updated environmental impact report (EIR) is currently being prepared and is to be provided as part of the final development plan application. No native upland habitats were identified onsite, which is consistent with the parcel historically being utilized for agricultural purposes. Onsite vegetation predominantly consists of laurel oaks, sabal palms, slash pines, and small amounts of intermixed invasive plants. One (1) small wetland measuring approximately 1.3-acres was identified onsite. The wetland and its associated 25 ft. wide buffer will be placed under a conservation easement and will be surrounded by a designated open space area. Tree mitigation is to be satisfied by the diameter-based methods outlined in LDC 6.00.05.D.3.a, which include the onsite preservation and/or planting of native vegetation. A fee-in-lieu at the rate of $200 per inch of diameter at breast height (DBH) shall be provided to the County for any remaining required tree mitigation. The preliminary development plan prepared by EDC, dated May 31, 2022, was provided and reviewed. The provided open space square footage, planting typicals, and applicable landscape/upland buffering areas meet the standards of review for PUD preliminary development plans as outlined in LDC 7.01.03. Landscaping/planting and buffering specifics are to be reviewed through the site plan process. Recommendation ERD has no objection to the rezoning and preliminary PUD with the conditions outlined below. Page 42 of 95 Project Name: The Freeman PUD File No.: PUD_RZ-10202126208 8 G. Whether and the extent to which the proposed amendment would result in an orderly and logical development pattern specifically identifying any negative affects of such patterns; The proposed change in zoning will result in an orderly and logical development pattern. The applicant provided justification the proposed plan would increase the surrounding land value and homeownership opportunities, and it is compatible with the Pine Hollow residential community to the north, which features 1 acre lots and the Creekside Community PUD to the southeast on a smaller scale. The proposed parcel is located outside the Urban Service Boundary, however, utility services are available and will be expanded by the developer to serve a more compact development form, and serve as a transition from larger lot rural development to Okeechobee Road. The site is located on a major roadway close to the Florida Turnpike, I-95 corridor, and commercial development to the east. The internal sidewalk network will ensure residents within the PUD also have access to the exterior sidewalk system, ensuring the potential for people to walk to and from their destinations. Integrated open space will feature ample landscaping and buffering from adjacent residents, passive agricultural lands and Okeechobee Road. The Freeman PUD project will be providing a 5.48-acre stormwater management lake in the center of the development. This lake is designed to ensure proper drainage and runoff flows on the site to prevent flooding and any other potential issues that could arise with a change in drainage pattern. The lake will also have native vegetated buffer, which will serve as natural habitat for small native wildlife. The existing lake on the northeast will also remain unaffected by this development. The petition will not negatively affect the development patterns in the surrounding area and may enhance compatibility with the surrounding zoning designations. H. Whether the proposed amendment would be in conflict with the public interest, and is in harmony with the purpose and intent of this Code; The proposed rezoning to a PUD (Planned Unit Development) Zoning District is not in conflict with the public interest and is in harmony with the purpose and intent of the Land Development Code. ************************************************************************** R SECTION 2: PRELIMINARY SITE PLAN STANDARDS OF REVIEW AS SET FORTH IN THE LAND DEVELOPMENT CODE SECTION 11.02.07 Per LDC Section 11.02.05 A. 11, the Planning & Zoning Commission and the Board of County Commissioners shall consider the Preliminary Development Plan at a scheduled public hearing in accordance with the requirements of Section 11.00.03. The public hearing held on the application shall be in accordance with Section 11.00.04. In making a decision on the application, the Board of County Commissioners shall consider the recommendations of the Planning and Zoning Commission and the Planning and Development Services Director and the standards specified in Sections 11.02.07 and 11.06.03. A.Consistency With Local Ordinances and Comprehensive Plan. The proposed plan has been found to be consistent with the general purpose, goals, objectives and standards of this Code, the St. Lucie County Comprehensive Plan, and the Code and Compiled Laws of St. Lucie County. As noted in the above analysis of the rezoning standards of review, the site plan and proposed use is consistent with Future Land Use Policy 1.1.8.1 in its use of planned development techniques. The goal shall be implemented by strictly enforced building, zoning and development codes based on objectives and policies that will enhance St. Lucie County's natural and man-made resources while minimizing any damage or threat of degradation to the health, safety and welfare of the county's citizens, native wildlife and environment, through incompatible land uses. Objective 1.1.8: Planned Developments. The County shall continue to support and encourage innovative land use development patterns including planned developments through the adequate provision in the County's Land Development Code including Planned Unit Developments (PUD), Planned Non-ResidentialDevelopment (PNRD) and the Planned Mixed-Use Development (PMUD) zoning designations. Policy 1.1.8.3: The County shall continue to support and implement the mixed-use activity areas as indicated in the Sub-area Mixed Use Activity Area Plans as depicted by name in this Element. Policy 1.1.10.2: Require effective visual and light diffusion barriers between residential and non-residential uses. Standards and requirements for such barriers are to be included in the landscaping and screening regulations of the St. Lucie County Land Development Code. Consistency with Land Development Code (LDC) Regulations The proposed development and proposed use are not in conflict with any applicable portions of the St. Lucie County Land Development Code (LDC) or Comprehensive Plan. The proposed Preliminary PUD (Planned Unit Development) Site Plan demonstrates compliance with the St. Lucie County Land Development Code (LDC) and Comprehensive Plan requirements. Pursuant to LDC Section 7.01.00, the intent of the PUD (Planned Unit Development) Zoning designation is to achieve residential land development of superior quality through the encouragement of flexibility and creativity in design options that: A. Permit creative approaches to the development of residential land reflecting changes in the technology of land development; B. Allow for the efficient use of land, which can result in smaller networks of utilities and streets and thereby lower development costs; C. Allow design options that encourage an environment of stable character, compatible with surrounding land uses; and D. The project is designed to improve the project perimeter, creating strategic yet aesthetic buffering between the residential neighborhood and the Okeechobee Road right-of-way. This will promote active pedestrian transportation, such as walking and cycling, as well as recreational usage of the perimeter sidewalk. The internal sidewalk network will ensure residents within the PUD also have access to the exterior sidewalk system. The site will include open space with ample landscaping and a walking path for the residents. Page 44 of 95 Project Name: The Freeman PUD File No.: PUD_RZ-10202126208 10 Open Space The proposed project meets the required thirty-five (35%) percent open space, maintaining 57.24% or 55.15 acres of open space. The Freeman PUD project will be providing a 3.4-acre stormwater management lake in the center of the development. This lake is designed to ensure proper drainage and runoff flows on the site to prevent flooding and any other potential issues that could arise with a change in drainage pattern. The lake will also have native vegetated buffer, which will serve as a natural habitat for small native wildlife, as well as an upland transition zone to buffer the littoral zone from adjacent residences. The existing lake on the northeast portion of the site will remain unaffected by this development. Site Access Exhibit 4, Proposed Access Driveway 1 – Okeechobee Road (East) The full access opening on Okeechobee Road is a right-in/right-out driveway and left-in turn lane. The site’s Driveway #1 AM and PM peak hour vehicles are 9 and 30, respectively. This is less than the FDOT’s guideline of 35-55 right-turns for a right-turn lane on road with a posted speed over 45 mph contained in FDOT’s Access Management Guidebook 2019 (AMG) and NCHRP Report 420 (Impacts of Access Management Techniques). FDOT’s AMG’s states “The lower threshold of 35 right-turn vehicles per hour would be most appropriately used on higher volume two-lane roadways where lateral movement is restricted. The 55 right-turn vehicles per hour upper threshold would be most appropriate on lower volume roadways, multilane highways, or driveways with large entry radius (50 feet or greater).” This location is a high speed multilane highway. The western driveway is a right-in/right-out driveway. An evaluation was based on the FDOT’s Driveway Handbook 2019 Edition, Section 7.2. FDOT’s Handbook, which recommends a right-turn lane when right-turn movements exceed 35-55 vehicles per hour during the peak hour for an unsignalized posted speed limit over 45 mph. The site’s Driveway #2 AM and PM peak hour vehicles are 6 and 19, respectively. Additional lanes out of the site are not needed since adequate capacity is available and peak exiting volumes are relatively low. Traffic The daily and peak hour traffic generation for the development used the trip generation rates for single- family (ITE Land Use 210 – Single Family Detached Housing). The proposed project is expected to generate 895 daily net new external trips, including 65 AM peak hour (16 in/49 out) and 87 PM peak hour (55 in/32 out) trips. An existing left eastbound turn lane to the site exists. A westbound, right- turn lane at the project entrance will be provided to the site. Further analysis will be reviewed at the time of the final site plan review. Water/Wastewater Water & Wastewater services will be provided by St. Lucie County Utilities. D.Adequacy of Fire Protection Station #11, loacted at 3501 Shinn Road, approximately 4.7 miles east of the subject site E.Adequacy of School Facilities. The proposed residential project is not anticipated to create an adverse impact on school facilities. F.Environmental Impact. The proposed amendment is not anticipated to create significant impacts on the natural environment. The applicant provided an environment impact report that assesses existing environmental conditions on the subject property. The Environment Resources Department reviewed the submitted Environmental Impact Report and provided the following evaluation: Background The Environmental Resources Department (ERD) is in receipt of the October 12th, 2022 date-stamped submittal from Planning and Development Services. The applicant is proposing a 96-unit residential subdivision with associated site improvements and is seeking approval of the preliminary development plan to rezone the parcel from Agricultural – 2.5 (AG-2.5) to Planned Unit Development (PUD). The project is located at 1100 Okeechobee Rd in Ft. Pierce and currently consists of three (3) parcels collectively measuring 96.32- acres. Findings An environmental assessment (EA), dated June 30th, 2020, prepared by EDC, was provided and reviewed. An updated environmental impact report (EIR) is currently being prepared and is to be provided as part of the final development plan application. No native upland habitats were identified onsite, which is consistent with the parcel historically being utilized for agricultural purposes. Onsite vegetation predominantly consists of laurel oaks, sabal palms, slash pines, and small amounts of intermixed invasive plants. One (1) small wetland measuring approximately 1.3-acres was identified onsite. The wetland and its associated 25 ft. wide buffer will be placed under a conservation easement and will be surrounded by a designated open space area. Tree mitigation is to be satisfied by the diameter-based methods outlined in LDC 6.00.05.D.3.a, which include the onsite preservation and/or planting of native vegetation. A fee-in-lieu at the rate of $200 per inch of diameter at breast height (DBH) shall be provided to the County for any remaining required tree mitigation. The preliminary development plan prepared by EDC, dated May 31st, 2022, was provided and reviewed. The provided open space square footage, planting typicals, and applicable landscape/upland buffering areas meet the standards of review for PUD preliminary development plans as outlined in LDC 7.01.03. Landscaping/planting and buffering specifics are to be reviewed through the site plan process. Recommendation ERD has no objection to the Preliminary PUD with the conditions outlined below. Freeman freemanph@aol.com Prepared By: EDC, Inc. 10250 SW Village Parkway Port St Lucie, Florida 34987 (772) 223-5200 Page 73 of 95 Environmental Assessment Okeechobee Road Fort Pierce, St. Lucie County, FL Project #19-476 The subject property evaluated as part of this Environmental Assessment (EA) consists of approximately 90.82 dual parcels (Parcel ID# 3420-731-0006-000-6 and Parcel ID# 3325-600- 0013-3), located north of Okeechobee Road, Fort Pierce, St. Lucie County Florida. These parcels surround Thomas Farm Feed and Hay Supply at 10700 Okeechobee Road, Fort Pierce, FL, 34945. The parcels are currently undeveloped. This Environmental Assessment was completed as a precursor to permitting and review by a governmental agency and may be an applicable document for the supporting information associated with a building permit or land development application. EDC, Inc. staff visited the property on June 30, 2020, in order to ascertain the status and composition of any critical habitats, such as wetlands and native uplands that may be onsite. VEGETATION: The vegetation on this site consisted of limited plant species that remain after agriculture use. It is the opinion of EDC that there is no native upland habitat located on site, as the site still showed former row furrows. Notable native plant vegetation observed is as follows: Laurel Oak (Quercus laurifolia), Sabal Palm (Sabal palmetto), and Slash Pine (Pinus elliotti). Invasive plants identified as Category I and II status by Florida Exotic Pest Plant Council (FLEPPC) were observed in small amounts, evenly throughout the site. Invasive plants were noted overtaking the areas along the remnant agriculture rows. The plants observed were Brazilian Pepper (Schinus terebinthifolia), Tropical Soda Apple (Solanum viarum), Caesar Weed (Urena lobata), Old World Climbing Fern (Lygodium microphyllum). Some aquatic nuisance plants such as Cattail (Typha) were noted in ditches with standing water. A tree survey will be necessary to quantify the number of Oaks that will require mitigation due to construction before the final site plan is approved. WETLAND DELINEATION: According to aerial photographs, it appears that there are wetlands on site. A site visit confirmed this observation. Based on the State definition, a wetland consists of three components: 1). Hydric soils. 2). Wetland plants. 3). Hydrologic patterns. All three of these components were found during the field reconnaissance on Parcel ID#: 2328-113-0001-7. This wetland was surrounded by Guava Tree (Psidium guajava) and contained many Brazilian Pepper (Schinus terebinthifolia). Large, hanging mats of Old World Climbing Fern (Lygodium microphyllum) was observed near the wetland as well. A delineation will need to be conducted and further approved with South Florida Water Management District (SFWMD) before any building occurs. WILDLIFE EVALUATION: EDC, Inc. conducted a pedestrian survey throughout the property to investigate for the presence of any plant or animal listed species. No gopher tortoises or any other state or federally listed animal species were found on site. Ibis were observed in the fallow fields. Hog damage was apparent. One woodpecker could be heard. SOIL COMPOSITION: Based on a review of the USDA Web Soil the site is composed of: Arents, 0 to 2 percent slopes- Arents are nearly level and ranges from somewhat poorly drained to moderately well drained. The soil consists of fill material that were excavated and spread over the surface of wet mineral soils. The mixed fill layer is typically 20 to 50 inches thick. The water table is below a depth of 30 inches for most of the year. Organic matter and thus the agricultural potential for this soil is low. Nettles sand- is a poorly drained, nearly level soil found in areas of broad flatwoods. Typically the surface layer is 11 inches thick. Black sand comprises the upper 5 inches, very dark gray sand in the next three inches and dark gray sand in the lower 3 inches. Subsurface layer is light gray sand 22 inches thick. The water table is typically at a depth of 10 inches for 2 to 4 months during wet seasons, and at a depth of 10 to 40 inches for 6 months of longer in most years. Natural vegetation includes slash pine, cabbage palm, saw palmetto, wax myrtle, inkberry, fetterbush, creeping bluestem, chalky bluestem, Florida threeawn, and pineland threeawn. This soil has severe limitations for cultivated crops unless water control and other food management practices are provided. This soil has potential for improved pasture grasses and high potential for dwellings without basements, small commercial buildings, and roads. Oldsmar sand, depressional- This soil is in wet depressions in the flatwoods and the soil is often ponded for six to nine months. The potential for cultivation is low without aggressive water management. Oldsmar sand is sandy, siliceous, poorly drained and slowly permeable sand. These soils are nearly level and found in broad areas of flatwoods and wet depressional areas. In most years the water stands above the surface for 6 to 9 months or more. These soils are saturated for long periods during the wet season. Natural vegetation includes sand weed, stillingia, longleaf threeawn, maidencane and sand cordgrass. The most common grasses are Florida threeawn and pineland threeawn. Water control measures are necessary to overcome excessive wetness. The potential for cultivation is low without aggressive water management. The soil is well suited for pasture and hay crops. Pineda sand- This soil is a nearly level, poorly drained soil in low grassy flats. The water table is typically at a depth of less than 10 inches for 2 to 6 months during wet seasons, and at a depth of 10 to 40 inches for the remaining time. This is a nearly level poorly drained soil found in grassy flats. The natural vegetation associated with this soil type includes slash pine, cabbage palm, wax myrtle, gallberry, fetterbush, and brooms sedge. The surface layer typically is dark gray and dark grayish brown sand. The subsurface layer is brown fine sand with yellow and brownish mottles. Riviera fine sand- This nearly level soil is poorly drained and has a surficial layer of dark gray sand about four inches thick. The water table is typically at less than 10 inches for two to four months of the year. The soil is well suited for pasture and hay crops. Natural vegetation includes slash pine, cabbage palm, wax myrtle, blue maidencane, broom sedge, pineland threeawn, cord grass, panicums and a variety of sedges. Riviera Fine Sands are loamy, silicious, nearly level and poorly drained soils that formed in beds of sandy and loamy marine sediments. These soils are on broad, low flats and in depressional areas. The water table is within a depth of 10 inches for 2 to 4 months in most years and between a depth of 10 and 30 inches for most of the rest of the year. Page 75 of 95 Environmental Assessment Okeechobee Road Fort Pierce, St. Lucie County, FL Project #19-476 Wabasso sand- This soil is a nearly level, poorly drained soil in broad open areas of the flatwoods. The surface layer is sand about 8 inches thick. The upper 4 inches is black and the lower 4 inches is dark grey. The water table is typically at a depth of less than 10 inches for 1 to 4 months during the wet season, and at a depth of 10 to 40 inches for 6 to 9 months in most years. Natural vegetation is slash pine, cabbage palm, saw palmetto, running oak, inkberry and fetterbush. Common grasses are threeawn and bluestem. The soil has severe limitations for cultivated crops and citrus due to wetness. The soil has high potential for dwellings without basements, small commercial buildings, local roads and streets. Building on a site that naturally retains heavy amounts of water will require extensive planning and drainage options, especially in the case of multi-family units. ST LUCIE COUNTY REGULATIONS According to the St Lucie County Property Appraiser’s Report, all three of the subject property has a land use code of 6000. Along with approval of a building plan, a permit will be required to clear any native vegetation and prep the site to build. This is where the aforementioned Tree Survey will become important. The Public Works Director will want to know that all native vegetation is accounted for. See supporting regulations below. Sec. 6.00.05 - Vegetation Removal Permit must be obtained in compliance with the Land Development Code (LDC). The Tree Survey will document the amount of native vegetation qualifying for replacement, using Table 1 in this section of the Land Development Code. There are certain threshold measurements for trees that, if equal to or greater, they will require mitigation. This measurement varies by species and growth style of the trees. At this site, the main species to be concerned with are: Palm Trees greater than 10’ tall, and Laurel Oaks with a trunk measurement equal to or greater than 12” in circumference. It is recommended to mitigate on site as much as possible. Regulations below. Sec. 6.00.05.D Calculating Required Mitigation. 1. Where mitigation is required to compensate for the loss of native vegetation, meeting the minimum size thresholds outlined in Table 1, the replacement vegetation shall be calculated at a ratio of two (2) inches D.B.H. replacement per one inch D.B.H. removed (2:1). { For example, removal of a twelve-inch Slash Pine results in twenty-four (24) inches required mitigation } 2. Palm tree mitigation shall be calculated at a ratio of one palm tree preserved/relocated/planted per one palm tree removed (1:1). Palm trees shall not be counted towards mitigation of non-palm species. { For example, removal of one (1) Cabbage Palm with a clear trunk measuring ten (10) feet or greater results in required mitigation of one (1) Cabbage Palm with a clear trunk measuring ten (10) feet or greater. Sec. 6.00.05.C.11 - Vegetation destroyed or damaged as part of the development of a site or parcel, shall be replaced by vegetation of equal environmental value as specified by the Public Works Director, or his/her designee, in consultation with the Growth Management Director, before any occupancy or final use permit authorizations are issued. Page 76 of 95 Environmental Assessment Okeechobee Road Fort Pierce, St. Lucie County, FL Project #19-476 Due to the fact that there is a wetland on site, it will be important to remember how these regulations can change the form a project takes. Wetland regulations can be strict and costly to deal with. It will be important, only AFTER wetlands are approved by the state, to create and site plan that limits impact as much as possible. Some mitigation may be necessary, but the goal is to avoid it at all costs. See supporting regulation below. Sec. 6.02.03.E.2b. - All Practical Measures will be taken to Reduce Impact: Restoration or creation may be permitted to compensate for wetland loss only where the applicant has modified the proposed development to reduce wetland loss and degradation. Acceptable modifications include site design to reduce fill into or drainage of the wetland; other erosion control measures where the activity will cause erosion; construction of pretreatment facilities for stormwater to be discharged into wetlands; and, scheduling restoration activities at such time of year as would have the least impact upon the wetland or endangered or threatened species. Under St. Lucie County regulations, this site will further need and Environmental Impact Report (EIR). See supporting regulation below. Sec. 11.02.09.5 – Environmental Impact Report. Whenever a submission of a site plan is required, an environmental impact report shall be provided if the proposed development meets any of the following: a. The property is ten (10) acres or over; b. The property, regardless of size, contains any wetland, or; Overall, these environmental regulations will be important to consider when designing a site plan. Navigating the county regulations for mitigation of native vegetation will be important to avoid unnecessary impacts. Impacts to wetlands involve a specific process for permitting and mitigating in St. Lucie County as well as the state of Florida that can add time and costs to a proposed project. SUMMARY: It is the professional opinion of EDC that there are wetland habitats on the site. It will be necessary to receive state and possibly federal approval of wetland habitat before construction commences. Depending on the site plan, the wetland may be impacted and thus require mitigation. The rest of the former agriculture should be suitable for the proposed build. A well- executed site plan will limit the amount of wetland and tree mitigation that will be necessary. Additionally, no gopher tortoises or any other listed animal species were found on site. Furthermore, the soil should be suitable for building, provided excellent drainage is utilized. Griffin, Environmental Resources Director FROM:Brian Arbeiter, Sr. Environmental Planner DATE:July 5th, 2022 SUBJECT:Freeman Fort Pierce Parcel – Preliminary Development Plan for Rezone PUD_RZ-10202126208 Background The Environmental Resources Department (ERD) is in receipt of the October 12th, 2022 date-stamped submittal from Planning and Development Services. The applicant is proposing a 96-unit residential subdivision with associated site improvements and is seeking approval of the preliminary development plan to rezone the parcel from Agricultural – 2.5 (AG-2.5) to Planned Unit Development (PUD). The project is located at 1100 Okeechobee Rd in Ft. Pierce and currently consists of three (3) parcels collectively measuring 96.32-acres. Findings An environmental assessment (EA), dated June 30th, 2020, prepared by EDC, was provided and reviewed. An updated environmental impact report (EIR) is currently being prepared and is to be provided as part of the final development plan application. No native upland habitats were identified onsite, which is consistent with the parcel historically being utilized for agricultural purposes. Onsite vegetation predominantly consists of laurel oaks, sabal palms, slash pines, and small amounts of intermixed invasive plants. One (1) small wetland measuring approximately 1.3-acres was identified onsite. The wetland and its associated 25 ft. wide buffer will be placed under a conservation easement and will be surrounded by a designated open space area. Tree mitigation is to be satisfied by the diameter-based methods outlined in LDC 6.00.05.D.3.a, which include the onsite preservation and/or planting of native vegetation. A fee-in-lieu at the rate of $200 per inch of diameter at breast height (DBH) shall be provided to the County for any remaining required tree mitigation. The preliminary development plan prepared by EDC, dated May 31st, 2022, was provided and reviewed. Enhanced stormwater for parking areas and reduce impervious areas LDC Section 7.06.00 Off- Street Parking & Loading 7.06.03 Administrative Relief for Developments under six thousand (6,000) SF LDC Section 7.07.00 Stormwater Management LDC requires off-street parking spaces, access aisles, vehicular use and off-street loading areas constructed, expanded or altered after March 1, 1999, to be constructed with a paved surface. The permitted impervious surface materials are concrete, asphalt, brick pavers, stamped concrete, or paving block. Only asphalt or concrete will be permitted within the County's Right-of-Way. Pervious paving systems and grass paving systems shall be permitted for non-required parking spaces when the paving systems and materials are approved by the County Engineer. Stabilized unpaved parking areas may be permitted at locations outside the urban service area upon approval of the County Engineer, so long as parking spaces, accessways, and driveways are clearly marked and the vehicular/pedestrian circulation system is safe. Public Works Dept: the stormwater master plan will consider the regulatory and possibly suggest standards that exceed the minimums, but this analysis may be towards the tail end of the 3-year project. The consideration will be how to incentivize and offset the additional cost to incorporate enhanced elements. If the County could provide incentive (credit) for these types of low impact development (LID) features, it may make financial sense for a developer. The County does not have a stormwater utility, so a pro-rata discount on ERUs is not possible and makes the inclusion of these types of elements purely voluntary. Providing additional stormwater is also a cost-escalating factor that tends to compound itself either by requiring additional set-aside lands for stormwater, additional fill for parking/structures or both. The consideration will be how to incentivize and offset the additional cost to incorporate such elements. There may be changes in state statute that will likely address enhanced water quality. The County owns and operates water, wastewater, and reclaimed water utilities within unincorporated areas of the County. Existing facilities include water and wastewater utility service areas on North Hutchinson Island and the Mainland North County areas, wastewater utility service areas on South Hutchinson Island, and water service in the Indian River Estates area. The County desires to move toward sub-regionalization of the older and smaller existing facilities, new sub-regional facilities in other areas of the county as future growth necessitates, and replacement of water and wastewater bulk capacity at the end of the Bulk Service Agreement with the Fort Pierce Utility Authority (FPUA) on April 4, 2028. CP Future Land Use Element With the 2018 Evaluation and Appraisal Report (EAR) update to the Comp Plan, Policy 1.1.5.11 was amended to address density transfers. Policy 1.1.5.11 - Calculate gross residential density on lands that lie above the mean high water elevation and provide for the ability to transfer residential density from wetland and other sensitive or unique environmental habitats to upland areas on contiguous property or non- contiguous property. The transfer of density from a portion of a parcel of land to another parcel of land, the density transferred away shall be documented via a restrictive covenant or similar legal instrument which shall not allow density to be reused by transferring density from the same parcel of land again.
