Irene Szedlmayer, AICP, Senior Planner, made a presentation on behalf of the applicant
to amend the Official Zoning Atlas to change the zoning district for 117 NE Airoso Blvd.,
Port St. Lucie from RS-4 (Residential, Single Family) to I (Institutional). In accordance with
public notice requirements outlined in Section 11.00.03 of St. Lucie County Land
Development Code, public notice was advertised in the St. Lucie County News Tribune on
Feb. 2, 2023. Notices were mailed to 40 property owners within a 500-foot radius of the
subject property, and a sign was posted on the property. Ms. Szedlmayer presented a
PowerPoint to cover the project location, current zoning, future land use designation, and
proposed zoning.
STAFF RECOMMENDATION
This petition conforms to the Standards of Review set forth in St. Lucie County Land
Development Code Section 11.06.03 and is consistent with the St. Lucie
County Comprehensive Plan goals, objectives, and policies. Staff recommends that the
Planning and Zoning Commission forward a recommendation of approval to the
Board of County Commissioners.

BOARD DISCUSSION
Mr. O'Dell asked what is the current definition of bonafide agricultural use? Ms. Szedlmayer
stated Florida statue section 823.14, the Florida right to farm act, was incorporated into
the proposal. Mr. Lounds agreed with the applicant that road frontage for the solar station is
not necessary. Mr. Taylor asked if the solar panels were stored or running into the grid?
Mr. Heaton, with FPL stated they do have storage in the grid. Mr. Lowe asked does FPL
buy power from residents that have purchased solar panels? Mr. Heaton stated if they are
contributing to the grid there are ways they can pursue the power. Ms. Slack asked how
they keep the property clear of overgrowth underneath the panels? Mr. Heaton stated
they install ground cover underneath the panels and mow regulary.

The applicant, Port St. Lucie Cardroom, is requesting a Conditional Use Permit within the CG (Commercial,
General) Zoning District to allow the sale of alcoholic beverages for on-site consumption, within a cardroom at
6666 US Highway 1, Unit 2, Port St. Lucie, FL, to be known as Port St. Lucie Cardroom.
The Port St. Lucie Cardroom is classified under the Standard Industrial Classification (SIC Code 7999)
Amusement and Recreation Services, classified as a Permitted Use within the Commercial General (CG) Zoning
District. The 14,588 square foot cardroom is proposing alcoholic beverage service between 10:00 a.m. - 2:00
a.m., complying with the St. Lucie County Code of Ordinances Chapter 4 - Alcoholic Beverages, which preclude
sales between 2:00 a.m. and 7:00 a.m. The cardroom will contain twenty (20) gaming tables with an overall

BACKGROUND:
The applicant, Port St. Lucie Cardroom, is requesting a Conditional Use Permit to allow the sale of alcoholic
beverages for on-site consumption in a cardroom.
Casino Fort Pierce, formerly named the Fort Pierce Jai Alai, was located on Kings Highway within the Fort
Pierce city limits. The casino cardroom closed down in June of 2022. The owners and operators of Casino Fort
Pierce are relocating the cardroom to the St. Lucie Square Shopping Center plaza.
The cardroom is permitted to renovate and occupy 14,588 square feet of the former Planet Fitness space, at
6666 US Highway 1, Unit: 2. The cardroom’s hours of operation will be Sunday-Thursday from 10:00 a.m. -
2:00 a.m. and Friday/Saturday from 10:00 a.m. - 4:00 a.m., with alcoholic beverage service planned between
10:00 a.m. - 2:00 a.m.
The 14.83-acre site features various businesses, including Blue Iguana Sports Grill, Dollar Tree, Mission
Kitchen, Da Vinci's Restaurant, gaming arcades, Truth Church, and Atlantic Safe Company. The St. Lucie
Square Shopping Center is zoned Commercial General (CG), with an COM (Commercial) Future Land Use
Designation. The property is located within the Urban Service Boundary (USB).

STANDARDS FOR CONDITIONAL USE REVIEW
AS SET FORTH IN SECTION 11.07.03 OF THE
ST. LUCIE COUNTY LAND DEVELOPMENT CODE
The St. Lucie County Land Development Code (LDC) Section 11.07.03 establishes the Standards for Review
for Conditional Use Permits. In reviewing an application for a Conditional Use Permit, the Planning and
Zoning Commission shall consider the following:
A. Consistency with Local Ordinances and Comprehensive Plan
The Development Review Committee has reviewed the proposed Conditional Use, finding it to be consistent
with the general purpose and standards of the St. Lucie County Land Development Code (LDC) and the
Comprehensive Plan Goals, Objectives and Policies.
Land Development Code:
Pursuant to LDC Section 3.01.03.S.2.d, the Port St. Lucie Cardroom is classified under the Standard Industrial
Classification (SIC Code 7999) Amusement and Recreation Services, Not Elsewhere Classified, as a Permitted
Use within the Commercial General (CG) Zoning District. Alcoholic beverage sales (free standing) for on-site
consumption is a Conditional Use in the CG Zoning District, unless the sale of alcoholic beverages is an
accessory to a restaurant and/or civic, social, and fraternal organizations.
The encompassing plaza provides over 500 vehicular parking spaces for customers, with 15 designated
handicapped parking spaces to service a variety of commercial uses. The 14,588 square foot cardroom will
propose alcoholic beverage service between 10:00 a.m. – 2:00 a.m., complying with the St. Lucie County Code
of Ordinances Chapter 4 – Alcoholic Beverages which preclude sales between 2:00 a.m. and 7:00 a.m. The
cardroom will not have a traditional bar, whereas alcoholic beverages will be ordered and served via a server.
The cardroom will contain twenty (20) gaming tables with an overall seating capacity of 140, seating seven
(7) participants per table. Exhibit 1, below highlights the cardroom floor plan gaming floor, foyer, bathrooms,
vault room, and storage.

LDC Section 7.10.11 provides that the sale or transfer of alcoholic beverages for on-premises consumption
shall not be less than one thousand (1,000) feet measured by a straight line between the nearest corners, or one
thousand six hundred (1,600) feet measured via the right-of-way, of an existing religious facility (unless in the
CG District), school, public park, or public playground. The cardroom meets the distance requirements from
all the existing facilities at the time of this staff report. Exhibit 2, Section B, below illustrates the distance from
the establishments.
Current Zoning:
The proposed zoning of the subject property is CG (Commercial, General). “The purpose of this district is
to provide and protect an environment suitable for a wide variety of commercial uses intended to serve a
population over a large market area, which do not impose undesirable noise, vibration, odor, dust, or offensive
effects on the surrounding area, together with such other uses as may be necessary to and compatible with
general commercial surroundings.”
Comprehensive Plan:
Future Land Use:
The Future Land Use designation of the subject property is COM (Commercial). The Commercial (COM)
land use category “is applicable to areas of future commercial development, in addition to those existing
developed commercial areas. Future commercial areas should be located at points of high transportation
access, with specific action taken to prevent the development of new linear commercial strips…Office and
general retail uses are considered the principal uses within the COM designated areas.”
Comprehensive Plan Objective 1.1.10: Commercial Areas, provides that,“St. Lucie County shall provide for
the establishment of commercial zoning districts where various types of commercial retail, including
commercial uses for retail trade, office and service activities and general commercial uses for highway-
oriented sales and services; light industrial service uses; and hotel uses may be permitted at intensities which
are consistent and compatible with the surrounding community and the natural environment.”
Policy 1.1.10.2, in implementing Objective 1.1.10, provides a standard to “Require effective visual
and light diffusion barriers between residential and non-residential uses. Standards and requirements
for such barriers are to be included in the landscaping and screening regulations of the St. Lucie
County Land Development Code.”

Section B, including Exhibit 2, below illustrates the establishment’s location within a large commercial site.
The proposed Conditional Use complies with all requirements, and is consistent with the general purpose,
goals, objectives, and standards of this St. Lucie County Land Development Code, Code of Ordinances, and
the Comprehensive Plan.
B. Effect on Nearby Properties
The proposed Conditional Use is not anticipated to have adverse impacts upon adjacent or nearby properties.
The cardroom is located in the St. Lucie Square Plaza and is surrounded by commercial uses. The plaza has
similar uses such as the Jackpot Fever, Gold Rush, and Freedom 7’s arcades located within the St. Lucie Square
Plaza. Interconnected out parcels feature two (2) licensed alcoholic beverage establishments; the St. Lucie
Draft House and Zapatas Restaurant.
The subject site is within an established commercial plaza that features appropriate access, parking, and
orientation to provide general compatibility with the existing or character of the neighborhood. The plaza
features parking lot lighting and pedestrian crosswalks to support patron safety. Established green space
provides buffering between the commercial suites and nearby residences.
The cardroom meets the distance requirement from the existing religious facilities and school identified in the
area. The distances were measured from the main entrance of the church and school building to the main
entrance of the cardroom, along the centerline of the street right-of-way, as shown in the exhibit below.

Adjacent Zoning & Future Land Uses:
C. Adequacy of Public Facilities
The proposed use is not expected to create additional demands, over prior or eligible commerical uses, and
with public facilities anticipated to operate within the adopted Level of Service (LOS) Standards.
Water/Wastewater:
The subject property is currently served potable water and sewer by Port St. Lucie Utilities. No additional
services are being requested at this time.
Transportation System:
The proposed conditional use is not anticipated to adversely impact transportation capacity on US Highway 1
or Kitterman Road.
The site is located along the Area Regional Transit (ART) Route 1, with an adjacent bus stop.
Law Enforcement:
The US Highway 1 corridor within the unincorporated county is served by the St. Lucie County Sheriff’s
Office.
D. Adequacy of Fire Protection
The St. Lucie County Fire District has reviewed the application with the Development Review Committee
(DRC). A building permit is required in conjunction with the St. Lucie County Building/Permitting Department
for the space buildout, with review by the Fire District for compliance with the fire safety requirements.
The site will be served by Fire Station #6 (350 E Midway Rd, Fort Pierce, FL 34982), which is approximately
2.6 miles north of the subject property.
E. Environmental Impact
Background
The Environmental Resources Department (ERD) is in receipt of the January 13, 2023, date-stamped submittal
transmitted on January 23, 2023, with comments due February 8, 2023, from Planning and Development
Services. The applicant is seeking approval of a conditional use application to sell liquor and wine/beer. The
13.83-acre subject site (Parcel ID 3415-501-0065-000-4) is located at 6666 S. US Hwy 1 in Port St. Lucie.
Findings
A historic site plan for the St. Lucie Square Shopping Center, Resolution 85-159 recorded August 16, 1985,
Official Record (OR) Book 473 Pages 2224-2227, was approved. No intact native habitat exists onsite. ERD

Recommendation

STAFF RECOMMENDATION:
Staff has determined the Conditional Use Permit to meet the standards for review outlined in LDC Section
11.07.03, and is consistent with the Goals, Objectives, and Policies of the Comprehensive Plan, therefore, staff
recommends the Planning and Zoning Commission forward a recommendation of approval to the Board of
County Commissioners with the following conditions:

LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. Port St. Lucie Cardroom presented a petition for a Conditional Use Permit to allow the
sale of alcoholic beverages for on-site consumption within the Port St. Lucie Cardroom,
within the CG (Commercial, General) Zoning District for the property located at 6666 US
Highway 1 Unit: 2, Port St. Lucie, as legally described in Paragraph “B” and depicted on
the attached map as Exhibit “A”.
2. On August 6, 1985, the Board of County Commissioners approved Resolution 85-159,
granting a site plan approval for a 96,655-square-foot retail shopping center known as St.
Lucie Square Shopping Center.
3. On November 26, 1985, the Board of County Commissioners approved Resolution 85-
244, granting a Conditional Use for a retail liquor store for St. Lucie Square Shopping
Center, to be known as Walgreen's Retail Liquor Store.
4. On August 8, 1989, the Board of County Commissioners approved Resolution 89-234,
granting a site plan approval for a 6,390 square foot auto care complex proposed for
location on Out Lot B of the St. Lucie Square Shopping Center, to be known as St. Lucie
Square Auto Center.
5. On March 16, 2023, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition after publishing notice in the St. Lucie News Tribune at least 10
days prior to the hearing, installing a sign on the property and notifying by mail all owners
of property within five hundred (500) feet of the subject property, and recommended that
the Board of County Commissioners approve/deny request for a Conditional Use Permit.
6. On _____________, 2023, the Board of County Commissioners held a public hearing on
the petition, after publishing notice in the St. Lucie News Tribune at least 10 days prior to
the hearing, installing a sign on the property and notifying by mail all owners of property
within 500 feet of the subject property, at which all interested persons were given an
opportunity to be heard.

11.07.03. Standards for Review of Conditional Use Permits.
A conditional use permit shall be granted only if the applicant demonstrates the following:
A. Consistency With Local Code and Comprehensive Plan. The proposed conditional use is in compliance with all
requirements, and is consistent with the general purpose, goals, objectives, and standards of this Code, the
St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County; and is in compliance
with all additional standards imposed on it by the particular provisions of this Code authorizing such use.
B. Effect on Adjacent Properties.
1. The proposed conditional use will not have an undue adverse effect upon nearby property.
2. The proposed conditional use is compatible with the existing or planned character of the neighborhood
in which it would be located.
3. All reasonable steps have been taken to minimize any adverse effect of the proposed conditional use
on the immediate vicinity through building design, site design, landscaping, and screening.
4. The proposed conditional use will be constructed, arranged, and operated so as not to interfere with
the development and use of neighboring property, in accordance with applicable district regulations.
C. Adequacy of Public Facilities. The proposed conditional use will be served by adequate public facilities and
services, including roads, police protection, fire protection, solid waste disposal, water, sewer, drainage
structures, parks and mass transit.
D. Adequacy of Fire Protection. The applicant for the proposed conditional use has obtained from the St. Lucie
County - Fort Pierce Fire Prevention Bureau written confirmation, or has otherwise demonstrated by
substantial credible evidence, that water supply, evacuation facilities, and emergency access are satisfactory
to provide adequate fire protection.
E. Environmental Impact. For developments required to provide an environmental impact report under Section
11.02.09(A)(5), the proposed conditional use will not contravene any applicable provision of the St. Lucie
County Comprehensive Plan, or of Chapter VIII, "Natural Environment Analysis", of the St. Lucie County
Barrier Island Study Analysis of Growth Management Policy Plan, Kimley-Horn and Associates, Inc. (August

“She does that in a way that she understands she
needs to do the legal thing and not always the popular
thing.”
Circuit Judge Laurie Buchanan praised Mullins’
dedicated work as a child support hearing officer.
“Besides being so well-prepared and knowledge-
able, whenever she appeared in my courtroom, the en-
ergy just changed in such a positive way,” Buchanan
said. “And that is not something you can learn, you
can’t train it, that’s just a gift from God.”
Mullins, she continued, “just makes everything bet-
ter.”
“She doesn’t do it on purpose, she’s just that girl.
And I know, Leatha, you will do the same thing as
judge,” Buchanan said.
A skit performed by Indian River County Judge Ni-
cole Menz, Martin County Judge Jennifer A. Waters
and defense attorney Jeffrey Batista prompted laugh-
ter as the trio donned cowboy hats and burst into a
rendition of Loretta Lynn’s Coal Miner’s Daughter with
lyrics that highlighted Mullins’ life and legal career.
Batista played guitar as Menz sang and Waters held
up large photos of Mullins since childhood. Several
judges held up and waved sticks with a photo of Mul-
lins attached.
Legal eagle
Mullins caught the legal bug as a fourth-grader, one
of three children growing up with a single mom who
worked for a prosecutor and magistrate in Logan, West
Virginia, she said during her campaign.
She enjoyed going to work with her mother and de-
cided she might want to be a judge.
She became her high school’s valedictorian, got a
scholarship for college, where she said she worked
full-time to help pay other bills. After law school, she
became an assistant state attorney, including three
years in the Treasure Coast prosecutor’s office.
In 2000, Mullins opened a practice in downtown
Fort Pierce, with a focus in criminal defense and family
law.
She remained a magistrate judge until she launched
her campaign.
Mullins in her remarks Friday said she was “blessed
beyond measure.”
“I’m just overcome with appreciation,” she said.
She also acknowledged Sweet and recalled ap-
proaching him in December 2021 to ask if he would
stand for reelection.
“When he advised me that he intended to ride off
into the sunset … it became evident that I was going to
file my papers and prepare to be a candidate for judge,”
Mullins said. “After several months of minimal sleep,
and countless miles on my vehicle during a gasoline
crisis no less, the verdict was in and Judge Sweet’s
spot would become my sweet spot in my pursuit of the
black robe.”
Being a judge, Mullins said, “requires us to place
their loyalty in the Constitution, the laws and ethical
principles above private gain.”
“To the voters of the 19th Judicial Circuit,” she
vowed, “I promise that I will continue to work every
day to do the right thing, to follow the law and to serve
each and every one of you well.”

completely cleared and ready for development. But
there was a surprise.
Matteson said workers have spent 10 months exca-
vating concrete that once made up the power plant’s
foundations. Some of the pilings were nine feet thick.
“This stuff wasn’t supposed to be there, but it was,”
Matteson said.
In all, Matteson said his crew removed about 1,500
tons of concrete, which was donated to a foundation
that creates artificial reefs. Presumably, the power
plant’s final remains will end up as a habitat for fish
and other sea critters somewhere near Fort Pierce In-
let.
Matteson said the total cost of the concrete removal
work was about $400,000. The Fort Pierce Redevel-
opment Agency reimbursed $170,000 of that amount,
but has no plans to pay for the rest.
According to documentation provided by the city,
$170,000 is the amount of reimbursement specified in
Audubon’s development agreement.
Matteson said he’s awaiting approval of permits
needed for the first phase of the project, which in-
cludes the hotel and the 10 luxury villas.
Already, Audubon has contacted prospective villa
buyers who put their names on a reservation list. The
villa prices are starting at $1.5 million (who said living
like a king was going to be inexpensive?). People on the
list have until March 31 to indicate if they plan to move
forward with their purchases.
Matteson said he expects construction to begin “in
the next 90 days.” He estimated the villas will take
about 18 months to build.
The hotel is expected to take about two years to fin-
ish, so the grand opening may not be until 2026.
According to city officials, Audubon must begin
construction by Sept. 20 and the first phase must be
completed no later than Feb. 5, 2026.
Paul Thomas, the city’s building director, indicated
there are still some bureaucratic hurdles Audubon
must clear before the permits are finalized and con-
struction can commence.
“They have not applied for a building permit for ver-
tical construction since they have not been approved
by all review agencies in the development review
(DPCR) phase of the process,” Thomas emailed a few
days ago in response to questions about the project.
“There are various departments that are still waiting to
receive responses from the contractor/design team
addressing deficiencies that they were informed of in
September 2022. Once all the DPCR review agencies
have approved the application, then the contractor can
submit the building permit application for review. Af-
ter approval by the Building Department and the SLC
[St. Lucie County] Fire District, the building permit
will be issued and construction may commence.”
I understand not everyone in Fort Pierce is rooting
for the developers to succeed. King’s Landing has been
a controversial project, particularly since Audubon
made (and was granted) a request to increase the
height of the project’s tallest building from eight to 11
floors.
Some see that as a step toward “Browardization” of
Fort Pierce, the first of many skyscrapers that will
eventually dominate the city’s skyline.
It’s understandable people want to proceed with
caution. Residents on the Treasure Coast should be
mindful of how the region develops and remain wary
of the mistakes our South Florida neighbors have
made.
However, in this case, I think the fears are unfound-
ed. Fort Pierce is a long way from becoming Fort Lau-
derdale. And there isn’t much available land down-
town for skyscraper development, even if developers
suddenly decided that was a new trend they wanted to
exploit.
King’s Landing is being built in phases, so it’s true
economic and social impact won’t be felt until several
years from now. When it is, I believe it’s going to be
worth the wait.
