The lot is nonconforming because it does not have road frontage on a County maintained road. This requirement is waived under the nonconforming lot of record status and a single family dwelling may be constructed on the property subject to legal access to the property and meeting all other applicable zoning and building code requirements. An Administrative Variance will be processed when a permit is applied for at which time the County Attorney's Office will review the easement. There will be a$50.00 fee for the variance and it will take additional time for processing the permit. According to Section 10.00.04, St. Lucie County Land Development Code, a copy of which is enclosed, if a lot has no frontage as defined in Section 2.00.00, a copy of which is also enclosed, then proof of recorded legal ingress and egress acceptable to the County Attorney must be furnished before a building permit will be issued. Also enclosed are copies of the Carmel at Beau Rivage Plat that references Tract C: Dedicated to St. Lucie County for the purpose of installation and maintenance of drainage facilities and for the purpose of ingress and egress by the general public from public rights of ways to those lands served by the access easements. I have also enclosed an aerial of this parcel and the "Tract C" which does not appear to be cleared. If memory serves me, that area has never been cleared and I believe that it is at a lower elevation. If you would like I can send someone out to take a look at this. I would appreciate it if you would review my letter to Mr. Tedder before it is mailed to him.
