Dear Mr. Seinfeld:
We have researched the above referenced property and have determined that it is a
nonconforming lot of record. The lot is nonconforming because it lacks'100%road
•
frontage. This requirement is waived and a recorded easement providing ingress and
egress access to the property from a public road would be acceptable. Therefore, a single
family dwelling and permitted accessory structures may be constructed on this property
subject to meeting all applicable RE-2 zoning and building code requirements.
I am enclosing a copy of the research that was originally completed in 1994 as well as the
Grant of Easement. The guest house on the property is an accessory use and would be
allowed to be replaced should it be destroyed or removed for any reason. A guest house
can not be rented and would retain the same address as the primary residence. A separate
electrical service for a guest house would not be allowed.
Any accessory structures allowed for a single family residence, such as a garage or shed
would be allowed. No other residences would be permitted. If there is another single
family residence on the property is would be considered a nonconforming structure. Any
nonconforming structures on the property can be maintained and repaired, but if it should
be damaged or require repair more than 50% of the assessed value it must be removed.

Dear. Mr. Ankeny;
In .response .to: your letter regarding the above referenced
parcel, we have researched the property and determined that in.its
present` .configuration it is a non-conforming lot of record. The
propertylacks 100 % road frontage because it does not front on a
county:road, and would therefore require an administrative variance
from the County .Attorney before a building permit could be
obtained. In this case, however, a single family :residencealready
exists on theproperty.
During our conversation you had indicated that you would like
to deed the west half of the property .over to your son for the
purpose of 'building: a single family .residence. Such a lot split
could not comply with the current St. Lucie. County Land Development
Code, because the parcel in its entirety is a non-conforming lot .of
- record. The: Code requires- that each new lot from a lot split must
conform with the requirements of the'Code, .and each lot shall abut
a public :or private street for the required minimum road frontage.
A. split of the subject property would eliminate the non-
cohformi;ng lot of record :status of the existing parcel and create
two.. non-conforming lots: without any road frontage. As a: result,
this office could not issue a building permit on. either of those
parcels.

1 am. writing to reques.t .an administrative variance. The varience will allow my 'son
to construct a single family home on a. parcel of land, following-my conveyance of
the parcel to him.
• 1 am .hopeful, when all circumstances and events are evaluated regarding the parcel
and hist•ory" collective.ly, you will agree this is. a unique situation. Additionally,
. granting'a permit ;or •variance to build a house. is consistent with. the sp.iritof
County Regulations. . . • .
Ms. Julia:Shewchu:k has previously indicated that such a variance would have to be
approved by your office.. In her opinion 'the property would not 'qualify for a vari-
• ance because it is currently part o'f an existing, non-conforming lot of record which
• lacks road frontage. 'For, informative purposes, I am including•
a• copy of her letter.
The. 4 acres of property has been in my family for more than 90 years. In 1979, I
built a house in .the center of it. In 1982, I sold the house 'and the immediate
surrounding one acre of. land, effectively splitting the property. Yet, I retained a
. 1 foot wide strip Of property which currently connects the east. (1.3 acres) and west
(1.7 .acres) • sides of. the remaining property. I was advised in 1982, by the county
. not to split the property into 3 lots because proposed regulations may require 60
feet of paved road• in the future. I ' ve included a map which identifies: a one foot
wide easement, the sold parcel "orange", and the remainder of the property "blue".
.
On the 15th :of February 1984,. I was granted a variance •to construct two houses. I
was not able to use variance prior to its experation, six months later.. 1985, I was ' granted a new variance and .built a house, where I currently liive17 Itly is
. located on. the east.side of_ the property.
•
The road, used. by• all adjacent.property owners has existed since the. 1950's. In
. 1961, my .father, the 'la:te Harold R. Ankeny was given verbal permission to use and
improve the road. He marled. and shelled the road beginning from Indian 'River Drive,
and terminating over 500 feet to • the west. With increased settlement, it has .been
used as a road by al'.1 adjoining property owners. A
colatieration with the other Pproximately six years ago, in
property owners we paved 600 feet Of the road with
concrete. Although it does not meet the current county standards for right of way
•
.width, At has always served as a road.. It was. intended to be a road, even if. it is
private and is a separately recorded parcel and is not an easement.

In conclusion, 1:: hope you will agree that the east and west parcels are for all
intents and purposes separate and the road in front actually is a non-conforming
private road. Certainly all of the facts combined should justify .a: permit.. or vari-

'Dear Mr. Ankeny:
In response to your letter regarding the above referenced
parcel, we have researched the. property and determined that in its
present configuration it is a non-conforming lot of record. The
property lacks 100 % road frontage because it does not front on a
county road, and would -therefore;require an :administrative variance
from the County Attorney before a : building permit could be
obtained. In this case, however, a single family residence already
exists on the property.
During our conversation you had indicated that you would like
to deed the westhalf of the. property. Over to your son for the
purpose of building a single family residence. Such a lot split
could not comply with the current St. Lucie County Land Development.
Code, because the parcel in its entirety is a non-conforming lot of
record. The Code requires that each new lot from a lot split must
conform with the requirements of the Code, and each lot shall abut
a public: or private street for the required minimum road frontage.
A split of the .subject property would eliminate the non-
conforming lot of record status of the existing parcel and create
two non-conforming lots without any road frontage. As a result,
this office could not issue a building permit on either of those
parcels.

County Land Development Code for your information. " Please let me
