The applicant Florida Power & Light (FPL) is requesting a Conditional Use Permit for construction and operation of a solar generation center based upon the consistency with the Standards of Review identified in Section 11.07.03 and Section 7.10.28 of the Land Development Code and the goals, objectives and policies of the Comprehensive Plan. This solar generation center qualifies as a targeted industry and St. Lucie County conducted an expedited review. Public Notification signs were placed on the property, and mail notices sent to all property owners within 500 feet of the subject property, totaling 7 adjacent properties; one response was received, in favor. The subject property address is 6201 Minute Maid Road, Fort Pierce, FL. 955 acres, zoned AG-5 Agricultural; this subject property is located in a low impact use, low traffic area. The generation system will interconnect with FPL's transmission center (located in IRC County). The solar generation system, 300,000 structural supported panels will provide electricity to approximately 1500 homes. The applicant as also submitted a Major Site Plan application and two waivers pertaining to the lot coverage and perimeter landscape buffers to be voted on by the Board of County Commissioners. Staff recommends approval subject to the following Planning and Development conditions: 1.The conditional use improvements and operational areas be consistent with Resolution No. 19-XXX authorizing Major Site Plan approval in accordance to section 11.02.09 Standards for Site Plan of the St. Lucie County Development Code. 2.On-site construction activities and/or repairs to the solar energy facility be restricted to 7am-6pm on weekdays 8am-5pm on Saturday. 3.Footcandle readings for all exterior lighting associated with normal operation of the solar generation center shall be at zero (0) at adjacent properly lines. Repairs and maintenance of the solar generation center equipment shall be exempt from this provision. As well as additional conditions required to comply with Environment Resources Department. STAFF RECOMMENDATION: Forward the petition of the proposed Conditional Use Permit for a solar power generation to the Board of County Commissioners with a recommendation for approval, subject to conditions as set forth in the Resolution. Questions/ comments from Board Members regarding solar generation lighting, conditional use expiration date, 25 year contract conditions regarding Kings Hwy solar location and public notice response. Applicant/ agent presentation by: Bob Raynes, Gunster Law Firm, in response to the question of the Kings Hwy 25 year contract; the reason for condition is that the area was developed (TVC area); No road being created. Requested to change conditions on construction hours be lifted. Kate Cotner, with FP&L: FP&L recently launched a 30 by 30 program install thirty million additional solar panels by the year 2030; over a 100 new solar plant throughout Florida; each site will power 15,000 homes; currently have two sites in SLC. Questions posed by Board Members regarding side set-back, unused land, location of northern boundary off Oslo/ Minute Maid Rd., environmental impact, service life of solar system (25-30 years), future location in SLC. Mr. Raynes requested amending motion to remove two conditions: working construction time, and lighting. Sending recommendation to the Board of County Commissioners with the two conditions removed. RESULT: Recommend the Board of County Commissioners approve the Conditional Use; removing two conditions: working construction time and lighting. 5.WORKSHOPS A.Electronic Signage Electronic Sign workshop presented by Leslie Olson, Director of Planning & Development Services. The purpose of the workshop to review the St. Lucie County sign code relating to electronic signage. The County's sign ordinance currently does not allow changeable signs. This item was presented to the Board of Commissioners Informal Meeting on October 8, 2018. There was a consensus that more information should be provided about other cities' requirements for changeable signs. The workshop objectives: Review St. Lucie County sign ordinance related to electronic signage; address pros and cons of electronic signage; and gather public input regarding current ordinances and possible changes. Electronic signs (Flashing, animated, fire-emitting, changeable-message, or noise-making signs) are prohibited, except for one (1) variable electronic message sign per parcel or group of parcels under a uniform site development plan, provided that the message sign does not exceed an overall area of thirty (30) square feet x ten (10) feet typical dimensions); the message displays shall not scroll, flash, or blink, and message display copy shall not change more frequently than once every five (5) seconds. Currently regulations allow electronic signs, with restrictions, in the following zoning: Commercial General (CG), Hutchinson Island Residential District (HIRD), and Commercial Office (CO). Any billboard in St Lucie County is eligible to become an electronic billboard. Questions/ comments from the board regarding illumination, zoning, current changeable signs, mobile electronic signs, slot advertising, LED lighting vs back light, proliferation, driver distraction/ safety, code enforcement staffing, PDS plan to draft new code and structural integrity of signs. Proposed Zoning Atlas - Snapshot Staff Analysis ZONING ATLAS AMENDMENT STANDARDS OF REVIEW SET FORTH IN LAND DEVELOPMENT CODE SECTION 11.06.03 In reviewing the application of a proposed amendment to the Official Zoning Atlas, the Board of County Commissioners and the Planning and Zoning Commission shall make the following determinations: Page 12 of 105 St. Lucie Gardens Rezoning RZ-5201915522 August 2, 2019 Page 3 1. Whether the proposed amendment is in conflict with any applicable portions of the St. Lucie County Land Development Code: The proposed change in zoning from RM-5 to RM-9 is consistent with the RM Future Land Use Category. Pursuant to Section 11.09.02, Table 11-1, the proposed zoning district is consistent with the proposed Future Land Use category as presented in Exhibit 1 below. Whether the proposed amendment is consistent with all elements of the St. Lucie County Comprehensive Plan: The proposed change in zoning from RM-5 to RM-9 is consistent with the existing RM Future Land Use Category assigned to the property. The purpose of the Residential Medium Land Use is found in the St. Lucie County Comprehensive plan, Future Land Use Element, as follows: The Residential Medium (RM) land use category is to be applied to those areas that are within, or planned to be within, areas of central community services. A maximum residential density of nine (9) dwelling units per gross acre is permitted under this land use designation. If required, the actual density is subject to the satisfactory completion of the rezoning process, which would include complete review of the physical suitability of the property for development at the proposed intensity. Limited nonresidential uses may be appropriate, in accordance with applicable standards and restrictions as set forth in the Land Development Code. Policy 1.1.1.3 – The Future Land Use Map establishes the proposed long-range distribution and general use of property within the county. The following table, Exhibit 2, is used to determine the consistency of Future Land Use designations and zoning districts to identify compatible zoning districts. Exhibit 2: Future Land Use - Consistency Matrix, Comprehensive Plan Policy 1.1.1.3 Page 13 of 105 St. Lucie Gardens Rezoning RZ-5201915522 August 2, 2019 Page 4 This change in zoning provides an opportunity for infill development, supporting a mix of uses in the Urban Service Area where public facilities are available, consistent with Future Land Use Element Objective 1.1.6: In coordination with the other elements of this plan, future development within the Urban Service Area shall be directed to areas where urban and community services/facilities can be provided in the most efficient and compact manner so as to discourage the proliferation of urban sprawl. The subject site is located in an area of central community services, having access to central water and sewer systems, adjacent to Savanna Ridge Elementary School and in close proximity to commercial services and employment opportunities. This rezoning process, in addition to site plan and concurrency review, includes a complete evaluation of the physical suitability of the property for development at the intensity proposed. 3. Whether and the extent to which the proposed zoning is inconsistent with the existing and proposed land uses: The proposed zoning change is consistent with existing and proposed land uses of adjacent properties. A residential community of similar zoning and density is south of the project, with consistent land use designations abutting the site providing for compatible development options. Land Use and Zoning Snapshot: 4. Whether there have been changed conditions that require an amendment; The applicant states market demand for multi-family residences has increased, due to increased costs of single- family home ownership. Further, the applicant acknowledges current supply of quality rental product is limited, therefore the requested rezoning will provide an opportunity to support fulfillment of current and future demand. The applicant intends the subject site and proposed apartment community will provide additional dwelling units to support needed housing for local workforce and families. In 2008, the Kitterman Oaks Apartment complex was developed to the south of the site, including expansion of potable water and sewer collection facilities along Kitterman Road. St. Lucie County later completed a segment of Lennard Road in 2011, connecting Kitterman Road and Prima Vista Blvd. Additional commercial development along US Highway 1, mainly retail auto sales and service establishments, have been completed in recent years. Whether and the extent to which the proposed amendment would result in demands on public facilities, and whether or to the extent to which the proposed amendment would exceed the capacity of such public facilities, including but not limited to transportation facilities, sewage facilities, water supply, parks, drainage, schools, solid waste, mass transit, and emergency medical facilities; The proposed rezoning represents the potential increase in demands on select public facilities, such as parks, schools, solid waste, mass transit, and emergency medical facilities, however the increased demand is consistent with capital improvements and development existing and anticipated in this area within the Urban Service Boundary. The rezoning would allow the development of up to an additional thirty-eight (38) units. Transportation: Utilities & Solid Waste: Mass Transit: Fire/EMS Protection: Parks & Schools Based upon the intended development type, ITE Manual Land Use Code 220 – Multifamily Housing, the proposed rezoning could result in up to an additional 278 daily trips per day, on average. Concurrency review, including traffic analysis, is required prior to issuance of a development order. Kitterman Road is a 60ft. right-of-way owned and maintained by St. Lucie County. The applicant is proposing donation of an additional 10ft. through the site plan. Port St. Lucie Utilities will provide Water & Wastewater service to the site. Electric and solid waste collection will be provided by FP&L and Waste- Pro, respectively. The Treasure Coast Connector provides access to public transit, adjacent to the west at St. Lucie Square. Pedestrian connections will be required through site development. Station 6 is located at 350 E. Midway Rd, approximately 2.7 miles travel distance from the site. Park & School facilities exist in proximity to the subject site. Concurrency certification, including Parks & Schools level of service, are being evaluated further through development review. Prior to the issuance of any final development order, the developer must demonstrate that all public facilities are available to serve the parcel and obtain a Certificate of Capacity. 6. Whether and the extent to which the proposed amendment would result in significant adverse impacts on the natural environment; The change in zoning is not expected to result in significant adverse impacts on the natural environment. The Environmental Resources Department (ERD) staff will conduct analysis to ensure compliance with the LDC during development review for the subject site. A Final Report from ERD staff is provided. 7. Whether and the extent to which the proposed amendment would adversely affect the property values in the area; The proposed zoning change is not anticipated to adversely affect property values. The Kitterman Oaks Apartment complex was developed to the south of the subject site, also providing on-site amenities, which has positively affected property values in the area. Whether and the extent to which the proposed amendment would result in an orderly and logical development pattern specifically identifying any negative effects of such patterns; The proposed change in zoning is expected to result in an orderly and logical development pattern. The proposed increase in allowable density will provide capacity for concentration of urban development, in proximity to commercial sales and services. This may support a greater mix of uses in the area, compelling an increase in multi-modal activities. 9. Whether the proposed amendment would be in conflict with the public interest, and is in harmony with the purpose and intent of this code; The proposed amendment is not identified to conflict with the public interest and is in harmony with the purpose and intent of this code. The Major Site Plan review process for development of a residential community will further evaluate harmony with the purpose and intent of this code through site design, residential amenities, and integration of the proposed residential community with the surrounding neighborhood. 10. Any other matters that may be deemed appropriate by the Planning and Zoning Commission or the Board of County Commissioners, in review and consideration of the proposed amendment. The Planning and Zoning Commission and the Board of County Commissioners may raise other matters regarding this proposed amendment to the Official Zoning Atlas. Analysis Summary: Based upon staff analysis contained in this memorandum, the proposed rezoning to RM-9 (Residential, Multiple-Family– 9 du/ac) for this parcel is consistent with the Comprehensive Plan in guiding new development based upon smart growth, energy-efficient land use patterns and discouraging the proliferation of urban sprawl. The amendment maintains the concept of concentrating higher development intensities adjacent to the US 1 corridor, emphasizing availability of urban services to the site. NEIGHBORHOOD MEETING & PUBLIC NOTICE The applicant has not engaged in a neighborhood meeting regarding the subject petition. Neighborhood meetings are strongly encouraged, however are not required. Public notice was provided by a display advertisement in the local newspaper, posting of a sign on the property, and mailings to owners of property within 500ft. of the site, detailing the proposed petition and associated public hearing. Sufficient capacity for both water and sewer, and also solid waste, exists in short and long term planning timeframes. Stormwater design will provide for detention of 100-year storm events and will outfall to NSLRWCD ditches and discharge into the North Fork of St. Lucie River. (Refer to Engineering Plans). C) Affects the natural environment The site has been previously cleared of trees and native upland habitat. A .68 acre impacted jurisdictional wetland is located in the northern portion of the site. D) Will result in an orderly and logical development pattern As the area continues to increase in population this area of medium density residential zoning of 9 units per acre will provide a logical development pattern. Similar to Kitterman Woods, St Lucie Gardens will be an orderly progression of quality rental housing with the 9 unit per acre density requested. E) Will adversely affect the property values in the area. An increase in values to adjacent properties should result in the rezoning and subsequent construction of the community. 6. This investigation is required in conformity with Section 11.02.09 of St. Lucie County LDR’s. II. SITE DESCRIPTION AND LOCATION CONTEXT The development parcel is a cleared former citrus grove containing a mobile home residence and and a shed outbuilding, both vacant. The general site context is urban (residential and highway corridor), though the extensive Savannas system lies just to the east. Immediate adjoining properties on the north, east and west are presently undeveloped. With the exception of property-line borders of Brazilian Pepper and oaks, and several scattered oaks within, vegetation consists of low grasses and herbs, both native and domestic. From frontage at Kitterman Road, the site is essentially flat for 800 feet northward before sloping gradually downward by 1 – 2 feet in the northern reach, culminating in a grassy wetland in the northeast quadrant. See Photos. III. HISTORY The aerial photo record reveals the site to have been entirely cleared and displaying linear beds indicative of citrus grove dating back to the 1950’s, if not earlier. By the late 1950’s the grove appears to be derelict by comparison with nearby groves, which were abundant in the vicinity. Subsequent photography reveals continuing atrophy of the grove – the northern 1/3 of the site loses any vestige of grove, active or otherwise, prior to the 1990’s and the last trees disappear from the southern portion of the site around 2010. Other small agricultural enterprises appear to have been conducted on the property during recent decades. Periodic mowing and bush-hogging of the low vegetation is obvious in most photos since the mid-1990’s. Other verifiable alterations to the site include excavation of a pond in the 1980’s or early 90’s, and installation of fill in the low northern third of the site sometime after 1970. IV.SOILS – See Soils Map for the following discussion The site is underlain by strictly sandy soils, comprising 3 separate soil units per the Natural Resource Conservation Service (NRCS). Attributes of each unit are briefly summarized in the following, addressed in order from south to north. A.Lawnwood /Myakka sands – NRCS describes these soils as poorly drained with high runoff properties, while also attributing moderate-to-high internal permeability to water. Texture is fine sand and sandy loam to a depth of 80”, with no restrictive layer in that span. Wet season water table depth is 6” to 18”; the soil is not characterized as hydric. Note that relict citrus bedding may affect surface water behavior at times. B.Waveland/Immokolee sands - NRCS describes these soils as poorly drained with high runoff properties, while also attributing moderately low-to-high internal permeability to water. Texture is consistently sand to a depth of 80”, with no restrictive layer in that span. Page 35 of 105 Wet season water table depth is 6” to 18”; the soil is not characterized as hydric. There is a possible restrictive layer between 30” and 50”. As above, relict citrus bedding may affect surface water behavior at times. C.Riviera fine sand, 0 – 2% slopes – This unit occupies the northern 35% of the property, and is characterized as hydric in its natural state, with a wet season water table as shallow as 3”. Though aerial photos in the 1950’s reveal citrus rows in this region of the property, there appears to have been an abandonment of citrus on this portion of the site by the 60’s, with a commensurate change in aspect to that of a wet region suggested by hydric soil (see 1970 aerial). However, the aerial-view character of this region changes again post-1970; exploratory borings find a layer of spoil across this portion of the site. Only a small wetland of 0.68 acres remains in the northeast region (see Wetlands, Section V. below). V. HABITATS – See FLUCCS Map for the following discussion A. Uplands – 8.87 acres, FLUCCS 260 = Open Ag Lands. This cover consists of a diverse roster of grasses and herbs, notably Bahia and St. Augustine Grasses, Crab Grass, Smut Grass, Wedelia, Dayflower, Tassellflower, and numerous others. Invasive Guinea Grass (Panicum maximum) dominates uplands in the northwestern uplands (north of pond). As mentioned above, the uplands are frequently mowed, which perpetuates the low ground cover. Site uplands do not constitute native habitat, and are not regulated by the County or other authorities. B. Wetlands – 0.68 acres, FLUCCS 641 = Freshwater Marsh. This is an on-site reach of a feature lying mostly off-site to the north and east. The feature lies generally below elevation 11.9’ NAVD with the NE corner area dropping below 11.0 feet. Vegetation displays a zonation from a smothering rachis of Barnyard Grass (Echinocloa sp ) at the periphery, then inward through a similarly dense stand of Torpedo Grass (Panicum repens). Desirable native vegetation resides mainly in the low interior portion, and includes Alligator Flag, Swamp Fern, Vasey Grass, Seedbox (Ludwigia) species and Dog Fennel. Evidence suggests that wet season inundation stages up 10” – 14” in the lowest region. Vegetation in this wetland is mowed in the dry season. The resulting accumulated thatch combines with the sprawling character of Barnyard and Torpedo Grasses to create an apparent “false bottom” elevated some inches above the mineral substrate across much of this feature. A second wetland feature exists for a short distance along the east property line in the form of a minor sliver just a few feet wide (0.018 acres on site) of a narrow off-site feature. This feature is characterized by Brazilian Pepper, Swamp Fern, and a few other species at the foot of an abrupt grade change at the property line, possibly indicating fill in the distant past. Page 36 of 105 C. Pond (Other Surface Water), 0.26 acres, FLUCCS 524. This is a roughly rectangular excavation circa early 1990’s or earlier. At high staging it drains westward via a swale into a south-draining ditch at the property line. See FLUCCS map and Topographic Survey. The state-jurisdictional boundaries of the Wetland and Other Surface Water feature are declared in attached correspondence from the South Florida Water Management District. VI. WILDLIFE, INCL. LISTED SPECIES The site’s open, mowed uplands, though altered vegetatively from the native condition, may nonetheless provide habitat for the needs of wildlife species. Obvious usage is by Wild Hog, detectable via extensive rooted areas, and Cottontail Rabbits, detected via droppings. Turtles and walking catfish reside in the pond, and other fish and reptiles are likely there but not verified. Otherwise, a small roster of rare, threatened, and endangered species as declared by the State or Federal governments also have potential to utilize this property. Reconnaissance for wildlife has been conducted anecdotally on several occasions in concert with other tasks, and systematically in May, 2019. Findings regarding listed species are as follows: Gopher Tortoise – Tortoise scat was observed on one occasion on the jeep track wending north to the trailer. No tortoise burrows have been found in ground surveys of this property, so it is likely that an individual resides in the promising habitat (dry flatwoods) to the east and forages this property on occasion. Sandhill Crane – A family of Sandhill Crane was once observed foraging on the uplands. They are believed to nest in wetlands off-site, as no nests are present on this property. Suitable wetlands for nesting are known to exist nearby within the Kitterman Woods complex, in the FP&L line corridor to the north, and in open marsh wetlands of the Savannas. Florida Pine Snake – A single adult Pine Snake was observed in Barnyard Grass rachis in wetland at the north boundary of this parcel. Typically, Pine Snakes dwell in underground burrows or near-surface debris cavities, of which this site has few. This individual most likely resides off-site. However, as with the Indigo Snake, land-clearing personnel should be instructed in recognition and back-away protocols to prevent harm to any Pine Snake encountered, however unlikely. Wading Birds – Wading birds including Woodstork and members of the Egret/Heron suite likely utilize the pond for foraging at times, though none have been observed. Note that the wetland, being highly colonized by dense grassy rachis and thatch, presently makes poor foraging for wading birds. As an additional note, the nearest documented nests of Bald Eagle are at 1.9 and 2.05 miles respectively. At these distances, no effect on Bald Eagles is likely from this project. VII. ECOLOGICAL SITE IMPACTS AND MITIGATION A. Impacts to Uplands = 8.87 acres±. Conversion of the uplands comprises the bulk of this project. The grassy-herbaceous vegetation community across the site is not a habitat protected for habitat’s sake by St. Lucie County or other authorities, subject to Page 37 of 105 occurrences of listed species addressed above. A final site-wide sweep for tortoise burrows or other features potentially hosting listed species should be conducted shortly before ground-breaking. B. Impacts to Open Water = 0.26 acres±. Elimination of any wildlife support provided by this small feature should be amply replaced by the proposed stormwater detention lake, at 0.51 acres±. C. Impacts to Wetlands = 0.13 acres±. Encroachment into the outer reaches (only) of the primary wetland is proposed. These encroachments will occur in low-quality Echinocloa-dominated regions at the periphery of the feature. Compensatory mitigation for these impacts is proposed via purchase of [herbaceous] mitigation credits at Bluefield Ranch Mitigation Bank. A quantification of the functional loss incurred, and of the mitigation credit required, will be calculated in coordination with SFWMD permitting. Wetland habitat loss will also be ameliorated by reduction of Echinocloa and eradication of exotic Torpedo Grass in the remaining preserved wetland. It is unclear at this time whether encroachment/elimination of the east-side wetland fragment is necessary, as it is never more than 6 – 8 feet onto this property. If impact proves necessary, appropriate compensatory mitigation will be negotiated with SFWMD if required. These areas are not required to be served with central utilities, however when at all practical, service connections should be provided. The RE designation is acknowledged as potentially suitable for limited residential and nonresidential development under the following criteria: • All residential and nonresidential development must be in accordance with applicable standards and restrictions as set forth in the Land Development Code; • All residential development proposals in excess of eight units must be approved through the Planned Development (PD) process as provided for in the Land Development Code; • Residential densities are set at a maximum of one (1) unit per one gross acre. D. Residential Suburban (RS) The Residential Suburban (RS) land use category is intended to act as a transitional area between the agricultural areas and the more intense residential areas in the eastern portion of the County. This category is found predominantly along the western edge of the urban form, but is also appropriate for areas of special environmental concern such as along the North Fork of the St. Lucie River and the Indian River Lagoon. The RS designation is intended for large lot, single-family detached residential dwellings, at a density of one (1) to two (2) units per gross acre. Residential Urban (RU) The Residential Urban (RU) classification is the predominant residential land use category in the County. This residential land use category provides for a maximum density of five (5) dwelling units per gross acre. The RU designation is generally found between the identified urban service areas and the transitional RS areas. These properties need to be serviced with central water and wastewater services. These services may be provided by either a public utility or through private on-site facilities, as would be permitted in accordance with all applicable regulations. New development in the RU areas can occur using traditional single-family or multifamily zoning designations or through the planned unit development process. Limited nonresidential uses may be appropriate, in accordance with applicable standards and restrictions as set forth in the Land Development Code. F. Residential Medium (RM) The Residential Medium (RM) land use category is to be applied to those areas that are within, or planned to be within, areas of central community services. A maximum residential density of nine (9) dwelling units per gross acre is permitted under this land use designation. If required, the actual density is subject to the satisfactory completion of the rezoning process, which would include complete review of the physical suitability of the property for development at the proposed intensity. The applicant is requesting amending the Official Zoning Atlas of St. Lucie County, requesting to rezone from RM-5 (Residential, Multiple Family-5), five (5) residential dwellings per one (1) acre, to RM-9 (Residential, Multiple Family-9), nine (9) residential dwellings per one (1) acre. This requested zoning amendment will result in a net increase of thirty-nine (39) residential dwellings. The approximately +/- 9.71 acre site is located on the north side of Kitterman Rd., approximately one-quarter mile east of U.S. 1, with a current street address of 322 Kitterman Rd. The site is under concurrent review for a major site plan to construct eight (8) two-story apartment buildings comprising eighty (80) units total, a clubhouse/pool facility, a playground, a covered mail gazebo, and a small two- story building containing a 1-unit apartment and storage area for a full-time, on-site manager.
