Motion to: Half Cent Sales Tax - Mark Satterlee, Deputy County Administrator A presentation of the half-cent sales tax that will be on the ballot on Tuesday, November 6, 2018 was given by Deputy County Administrator Satterlee. The half-cent local government surtax is to fund projects to: improve local roads, reduce traffic congestion, add sidewalks, improve local water quality, including the Lagoon, reduce neighborhood flooding and similar uses under Florida law and seek matching funds for these purposes. Shall St. Lucie County levy half-cent sales tax, for ten years, with expenditures reviewed by an independent citizens committee ensuring dollars are spent fairly throughout Port St. Lucie, Ft. True Stone Masonry Concrete Product Manufacturing (Small-scale) - Conditional Use Permit Kori Benton, Senior Planner stated the applicant, True Stone Masonry, is requesting a conditional use permit to allow for specialty concrete product manufacturing with an existing 6,000 sq. ft. light-industrial facility situated on a 0.69-acre property located at 7324 Commercial Circle, Ft. Pierce. The site is located within the Kings Highway Industrial Park, zoned industrial light and has a future land use designation of Towns Villages and Countryside (TVC). True Stone has identified this site to serve as their business headquarters, for operations specializing in custom stone and architectural concrete products encompassing design, fabrication and off-site installation. The proposal seeks to repurpose an existing facility to provide for storage of manufacturing ingredients, manufacturing space for production of concrete and stone products, racks for curing and staging of finished products and support offices. The conditional use plan includes improvements to the property include fencing, landscaping, restriping of the parking lot, exterior & interior building repairs. COUNTY ATTORNEY 1. Amending Section 8.02.02 of Land Development Code, Paragraph J - Particular Temporary Uses Permitted Assistant county attorney Katherine Barberi stated on April 7, 1998 the St. Lucie County Board of County Commissioners (BOCC) adopted Ordinance No. 1998-002 which provided for the creation of paragraph (J) authorizing special vehicle and boat sales events on sites not approved for permanent display. Since the adoption of the code, County staff has received complaints regarding this temporary use. The complaints are in regards to garbage, salespeople sleeping on site, and banners. There were complaints on the usage of more parking spaces than allowed per permit. The offsite temporary vehicle and boat sales uses an extraordinary amount of parking spaces as a space is required for the item being sold and a space for the customer. Additionally, if the customer trades in a vehicle, a parking space is required for the trade in. The complaints in regard to temporary special vehicles and boat sales raise public health and safety concerns. To protect the health, safety and welfare of the citizens of the County, an amendment is needed to assure orderly use of property and to protect the safety of motor vehicles, bicycles, pedestrians and the vendors at temporary special vehicle and boat sale events. Staff recommends the Planning & Zoning Commission forward the draft ordinance to the Board of County Commissioners with a recommendation of approval. Whether the proposed amendment is consistent with all elements of the St. Lucie County Comprehensive Plan; The proposed change in zoning from I (Institutional) to CG (Commercial General) is consistent with the St. Lucie County Comprehensive Plan policies. The Future Land Use Element’s Land Use Compatibility Chart allows CG Zoning within the subject property’s COM (Commercial) Future Land Use Designation. The proposed amendment is consistent with the Comprehensive Plan’s Future Land Use Elements Goals, Objectives and Policies for properties located inside the Urban Service Area.  Objective 1.1.1: Maintain the Future Land Use Map land with the following use designations to portray the future development patterns of St. Lucie County. The COM (Commercial) land use category allows for a maximum height of 60 feet with 40-50% maximum lot coverage by structure. The subject parcels are currently undeveloped and consist of 1.85 acres.  Table 1-3 Land Use Designation/Zoning Compatibility Matrix The CG (Commercial General) zoning district is compatible with the COM (Commercial) future land use. 3. Whether and the extent to which the proposed zoning is inconsistent with the existing and proposed land uses; The proposed CG (Commercial General) Zoning District is consistent with the existing uses surrounding the parcels. The proposed zoning maintains the viability of continued commercial uses on adjacent lands. As per LDC Section 7.09.04(E), side and rear yard perimeter buffer areas between non-residential or residential structure(s) housing three (3) or more dwelling units and single family or two family residential uses shall be landscaped with a masonry wall or opaque wood fence of at least eight (8) feet in height that forms a continuous screen between the uses. All masonry walls or opaque wood fences shall be landscaped with a continuous hedge along both the inside and outside base of the wall or fence. One (1) tree shall be planted along the wall or fence for each thirty (30) linear feet or major fraction thereof of the length of the wall or fence. The applicant has signed the required Concurrency Deferral Affidavit recognizing this provision. Water and Wastewater  The subject property is serviced by FPUA (Fort Pierce Utilities Authority). Transportation System  The petition site has frontage on Clematis Avenue, S 39th Street, and Olive Avenue. Clematis Avenue and S 39th Street are both a 50-foot County Right-of-Way. The County’s minimum Right-of-Way width is 70-feet for local roadways with open drainage systems.  A Right-of-Way dedication of 10 feet will be required for the property frontage along Clematis Avenue and S 39th Street. Olive Avenue is a 50-foot County Right-of-Way. A Right-of-Way dedication of 5-feet will be required for the property frontage on either side of Olive Avenue. As per LDC Section 7.05.03(I)(5), any right-of-way required in conjunction with the Site Plan approval shall be conveyed to St. Lucie County within ninety (90) days of the site plan approval or prior to the issuance of the first building permit, whichever comes first. 6. Rezoning RZ-520185314 Background The Environmental Resources Department (ERD) is in receipt of the September 12, 2018 date-stamped resubmittal from the Planning and Development Services Department. The applicant is requesting approval to rezone four (4) parcels currently zoned Institutional (I) to Commercial General (CG). The parcels total 1.85-acres and are located at 2305 S 40th St. in Ft. Pierce, south of Virginia Avenue. All four (4) parcels have a Future Land Use Map Designation of Commercial (COM) and are located within the Urban Services Boundary. Findings The rezoning from Institutional (I) to Commercial General (CG) is not anticipated to result in any adverse environmental impacts. The parcels are surrounded to the north, east, and west by CG zoned parcels. The change in zoning will enable the applicant to submit plans to process a commercial development application. Environmental impacts, as well as buffering from the residential uses to the south will be reviewed at the time of site plan or building permit submittal.
