GENERAL RULES AND PROCEDURES - Attached is the agenda which will determine the order of business conducted at today's Board meeting: CONSENT AGENDA - These items are considered routine and are enacted by one motion. There will be no separate discussion of these items unless a Commissioner so requests. REGULAR AGENDA - Proclamations, Presentations, Public Hearings, and Department requests are items, which the Commission will discuss individually usually in the order listed on the agenda. PUBLIC HEARINGS - These items are usually heard on the first and third Tuesday at 6:00 P.M. or as soon thereafter as possible. However, if a public hearing is scheduled for a meeting on a second or fourth Tuesday, which begins at 9:00 A.M., then public hearings will be heard at 9:00 A.M. or as soon thereafter as possible. These time designations are intended to indicate that an item will not be addressed prior to the listed time. The Chairman will open each public hearing and aSRs anyone wishing to speaR to come forward, one at a time. Comments will be limited to five minutes. As a general rule, when issues are scheduled before the Commission under department request or public hearing, the order of presentation is: (1) County staff presents the details of the Board item (2) Commissioners comment (3) if a public hearing, the Chairman will aSR for public comment, (4) further discussion and action by the board. S:\RA Y\2006\AGENDA \2.3.06EMERGENCYDUNERESTORA TION.DOC COUNTY ADMINISTRATION MEMORANDUM 06-10 TO: Board of County Commissioners FROM: Ray Wazny, Assistant County Administrator DATE: February 2,2006 RE: Emergency Dune Restoration On January 23, 2006 the Department of Environmental Protection (DEP) issued a letter requiring the County to remove sand placed on South Hutchinson Island as a result of the Emergency Dune Restoration Project (copy attached). Staff proposes to resolve the issues outlined in the DEP letter through the following process: 1. County Staff is working with permitting agencies to have permits issued to allow the proposed work as outlined below. 2. Staff proposes to use the sand washed into the Blind Creek area by hurricanes as replacement material. Removal of this sand will potentially allow for the restoration of the mangroves wetland area westerly of the dune. Dickerson will remove vegetation from the Blind Creek sand and move it to the dune at no cost to the County. A map of the Blind Creek area and photographs are attached. 3. The DEP will stake the limits of the areas in the Emergency Dune Restoration Project where material is to be removed and replaced taking into consideration vegetation which is viable and location of the vegetation. 4. The removed sand material will be loaded by Dickerson and transported to the Bale Fill to be used as required cover material. See attached memorandum from Ron Roberts. The Bale Fill will pay transportation costs only for the material, which is estimated at $6.20 per cubic yard, to Dickerson. Shoreline protection integrity will be maintained by immediately replacing material as it is removed. 5. In addition, DEP has indicated that it may provide additional funds to vegetate the restored areas. Attached is a report from Richard Bouchard, Erosion District Manager, outlining the status of project funding. Box 10788 Tallahassee, Florida 32302 RE: SL-213 Dear Mr. Lewis: This is in reference to the violation of Chapter 161.053, Florida statutes, by st. Lucie County, for the placement of non-compatible fill material under the provisions of Department permit SL-213. On November 18, 2005, Department staff met with you and representatives of st. Lucie County, the U.S. Fish & Wildlife Service, Florida Fish and Wildlife Conservation Commission, NOAA National Marine Fisheries, the Environmental Protection Agency, Coastal Planning & Engineering, Inc., and Larry Dale of Dickerson Florida, Inc. During that meeting, several options were discussed to resolve this matter. On December 29, 2005, the Department received a remediation plan prepared by Dickerson Florida, Inc. The Department has reviewed the submitted plan and enclosed sand samples and finds that it is unacceptable to resolve the current outstanding violation. The proposed sand samples are not compatible beach quality sand and thus, do not meet the criteria of Rule 62B-33.0155(1) (h), Florida Administrative Code. The native existing beach sand in st. Lucie County is approximately a 7.5 YR to 10 YR with a value of 7 on the Munsell Color Chart. It is also mottled in color due to shell content. The submitted samples are not mottled in color, and are much darker than the existing beach. The submitted samples are approximately a 10 YR with a value of 5/2, or grayish brown, on the Munsell Color Chart. The submitted samples have no orange/yellow component as does the native existing beach. Also, it is not anticipated that the material will bleach because there is nothing in the samples to bleach. The shell content of the submitted samples is white to gray in color. The proposed remediation plan describes removal of non-compatible material up to either 2-feet or 5-feet seaward of existing or planted vegetation. However, the plan does not adequately address Department concerns that the remaining amount of non-compatible material will continue to pose potential impacts to marine turtle nesting. Therefore, the proposed amount of material to be removed is also unacceptable to the Department. During our meeting of November 18, 2005, the Department indicated that all corrective actions would need to be completed by March 1, 2006. Staff stressed the importance that the submittal of the two parallel path plans and timeline would need to be submitted as quickly as possible. Staff is concerned that after waiting until December 29, 2005, to receive the County's proposed remediation plan, that the plan would include sand samples that are clearly non-compatible with the existing native beach sand. In addition, there is no concurrent plan for the complete removal of the non-compatible material and timeline as requested in our meeting. Finally, the U. S. Fish & Wildlife Service has also reviewed the proposed plan and finds it to be unacceptable to resolve this matter. In order to resolve this matter to the satisfaction of the Department, all of the non-compatible material placed under the provisions of DEP permit SL-213 must be removed from the area seaward of the Coastal Construction Control Line by no later than March 1, 2006. The replacement of removed material with beach compatible sand acceptable to the Department shall be the responsibility of the County, but must be completed prior to marine turtle nesting season beginning on March 1, 2006. If removal has not been completed within the time period specified above, the Department will proceed with the issuance of a Final Order that will require complete removal of all non-compatible material from the area seaward of the Coastal Construction Control Line within the project limits of permit SL-213, restoration of all steve Lewis January 23, 2006 Page 3 affected areas with compatible sand fill reviewed and approved by the Department, and the assessment of an appropriate administrative fine, pursuant to Section 161.054, Florida Statutes, and Rule 62B-54, Florida Administrative Code. The construction of the cell will require approximately 50,000 cubic yards of dirt. The assumption has been that the material would be purchased and delivered to the Baling Facility for the construction of the new cell. The cost of material of this type, including delivery, has ranged from $6.45-$14.45 per cubic yard. After inspecting the material on Hutchinson Island we believe this material would be well suited for our needs. If we can purchase the material for under market oosts. I show that there is approximately $403,000 in State funds remaining. There is a good chance we can also get reimbursed for the turtle monitoring that the County paid ($62,099) for after construction. If so, the state grant funds remaining would be reduced to $340,944. Dickerson's construction contract with the County is for $4,450,000. I show after expenses that there would be $497,794.48 remaining on that Contract. Of the amount remaining, $402,994.67 would have been paid out of State funds and $94,799.81 would have been paid out of FEMA funds. We cannot justify any further construction expenses for FEMA funds.
