GENERAL RULES AND PROCEDURES
Attached is the agenda which will determine the order of business conducted at today's Board
meeting:
CONSENT AGENDA- These items are considered routine and arê enacted by one motion. There
will be no separate discussion of these items unless a Commissioner so requests.
REGULAR AGENDA ITEMS- Proclamations, Presentations, Public Hearings, and Department
requests are items which the Commission will discuss individually usually in the order listed on
the agenda.
PUBLIC HEARINGS- These items are usually heard on the first and third Tuesdays at 7:00 P.M. or
as soon thereafter as possible. However, if a public hearing is scheduled for a meeting on a second
or fourth Tuesday, which begins at 9:00 AM., then public hearings will be heard at 9:00 AM. or
as soon thereafter as possible. These time designations are intended to indicate that an item will
not be addressed prior to the listed time. The Chairman will open each public hearing and asks
anyone wishing to speak to come forward, one at a time. Comments will be limited to five
minutes.
As a general rule, when issues are scheduled before the Commission under department request
or public hearing, the order of presentation is: (1) County staff presents the details of the Board
item (2) Commissioners comment (3) if a public hearing, the Chairman will ask for public
comment, (4) further discussion and action by the Board.
ADDRESSING THE COMMISSION- Please state your name and address, speaking clearly into the
microphone. If you have backup material, please have eight copies ready for distribution.
NON-AGENDA ITEMS- These items are presented by an individual Commissioner or staff as
necessary at the conclusion of the printed agenda.
PUBLIC COMMENT- Time is allotted at the beginning of each meeting for general public comment.
Please limit comments to five minutes.
DECORUM- Please be respectful of others opinion.
MEETINGS- All Board meetings are open to the public and are held on the first and third Tuesdays
of each month at 7:00 P.M. and on the second and fourth Tuesdays at 9:00 AM., unless otherwise
advertised. Meetings are held in the County Commission Chambers in the Roger Poitras
Administration Annex at 2300 Virginia Ave., Ft. Pierce, FL 34982. The Board schedules additional
workshops throughout the year necessary to accomplish their goals and commitments. Notice is
provided of these workshops. Anyone with a disability requiring accommodation to attend this
meeting should contact the St. Lucie County Community Services Manager at (561) 462-1777 or
TDD (561) 462-1428 at least forty-eight(48) hours prior to the meeting.

1. MINUTES (1-025)
It was moved by Com. Hutchinson, seconded by Com. Lewis, to approve the minutes of the
meeting held July 18, 2000; and, upon roll call, motion carried unanimously.
2. PROCLAMATION/PRESENTATIONS (1-027)
A. Tax Collector - Mrs. Dorothy Jo Conrad, Tax Collector presented the Recapitulation of
the 1999 Tax Roll. Bob Davis reviewed the Tax Roll Distribution Recap as well as the
Recapitulation.
B. Resolution No. 00-162- Proclaiming August 1,2000 as "National Night Out" in St. Lucie
County, Florida.
It was moved by Com. Lewis, seconded by Com. Coward, to approve Resolution No. 00-162;
and, upon roll call, motion carried unanimously.
Deputy Gonzales was present to accept the proclamation.
C. 2000 Chili Cook Off/Exchange Club Castle- The Board of County Commissioners
presented the plaques awarded to St. Lucie County Employees for their participation and
fund raising effort for the prevention of Child Abuse.
Mr. Paul Hiott, Veterans Services Manager, accepted the award on the Employees behalf.
3. GENERAL PUBLIC COMMENTS (1-600)
Mr. Alex Verde, Riverwoods resident, addressed the Board regarding the constant noise the flight

school planes are making over his development. He stated the planes are taking off at 2:00 a.m.
which causes sleepless nights for the residents and also the fact that the planes are only 400-500
feet above a house, this causes a main concern for safety.
Com. Barnes addressed Mr. Verde's comments and felt the county needed to do something to
make them comply with regulations.
The County Administrator stated he would work with the County Attorney and staff and come
back to the Board with recommendations.
Com. Coward commented on the hours of operation which were discussed at a previous meeting
and feels this is an issue which needs to be addressed. He concurred with a committee being
formed to receive input from the surrounding community.
Mr. Charles Grande, Hutchinson Island addressed the Board regarding the concept of televising
the BCC meetings. He also commended the Board on the work being done on the budget. He
suggested the Board consider at the state level regarding mobile homes paying their fair share of
property taxes.
Mr. Bob Bangert, Holiday Pines resident, addressed the Board on item C-8C and stated his
opposition to any consideration of a gambling boat being permitted to utilize the dock.
Com. Coward stated the RFP does not state "gambling boat" it is an open invitation and the
Board will address the RFP's and make a decision. Money will not be the factor, other things
will be taken into consideration such as community prosperity.
Mr. Robert Anderson, area resident, commended the Board on their actions with Florida
Recycling. He also thanked everyone for the information received regarding the dredge site.
He also questioned if grant monies could be utilized to repair the pavilion which was taken down
at Pepper Park the south end. He also addressed the Title Loan issues.
Com. Barnes addressed Mr. Anderson's questions regarding the Taylor Creek dredging project.
Com. Coward advised Mr. Anderson that the State Legislation passed an ordinance which is more
restrictive than the one the county approved and this is why the county's ordinance is being
repealed.
4. CONSENT AGENDA (1-1690)
Com. Hutchinson commented on item C-9 B where she felt that post - performance evaluations
should be done on the companies doing major projects for the county. She felt any problems
could be handled immediately as opposed to two or three years later.
Com. Bruhn suggested staff contact local firms and advise them what is required and what they
need to do in order to be placed on the lists.
Com. Coward suggested having a threshold in place for the major projects.
The County Administrator stated he felt this was an excellent suggestion and would come back to
the Board with recommendations including a threshold.
Com. Barnes commented on item C-3B. He stated he wanted to make sure that the Board of
County Commissioners would approve any change to the conservation easement.
Com. Coward complemented staff on item C-3A.
It was moved by Com. Lewis, seconded by Com. Barnes, to approve the Consent Agenda to
include A-I; and, upon roll call, motion carried unanimously.

1. WARRANT LIST
The Board approved Warrant List No. 43.
2. PUBLIC WORKS
A. Bid Waiver to approve a Repair Estimate from Quotation- The Board approved staff
recommendation, approving the request for bid waiver and authorized the repair of a 1992
Kenworth Dump Truck by Freightliner Trucks of South Florida in the amount $10,746.86.
B. Contract Award- The Board approved awarding the irrigation and sod contract for the
South County Regional Sports Stadium to East Coast Sod & Landscape, Inc., in the
amount of$133,690.96.
C. Building and ZoningÆquipment Purchase- The Board approved the purchase of laptop
computers instead of desktop computers. Desktop computers were approved in last
years budget but not purchased. The increase in price is covered by savings in vehicle
purchases.
D. Solid Waste/Contract Cancellation/Sole Source Bid Waiver- The Board approved
canceling the current contract with Consolidated Resource Recovery for the processing
and recycling of yard waste, effective September 30,2000 authorized a sole source bid to
BP Technologies and authorized the Chairman to sign the contract as prepared by the
County Attorney.
E. Contract Award- The Board approved awarding the lighting contract for the South
County Regional Sports Stadium to Florida Power and Light in the amount of$134,966.
3. COMMUNITY DEVELOPMENT
A. Grant Application- The Board.. approved authorizing the submission of a grant application
to the North American Wetland Conservation Act Grant Program administered through
the United States Fish and Wildlife Service to assist in the purchase ofland within the
North Fork of the St. Lucie River CARL boundary, and authorized the County
Administrator to sign the application form and other associated documents.
B. Tourism/R.J. Gibson Invoices- The Board approved the payment of the June invoices to
R.J. Gibson in the amount of $31,032.13.
C. Midway Industrial Park Phase II/Final Plat Review- The Board authorized the final
processing of this minor subdivision plat, but directed that specific recording of the plat be
withheld until the required conservation easements are completed and recorded and until
the right of way conveyances for West Midway Road are recorded and accepted by St.
Lucie County.
4. UTILITIES
Work Authorization Approval- The Board approved the work authorization with Camp,
Dresser, McKee for services at the South Hutchinson Island Wastewater Treatment Facility in an
amount not to exceed $29,800.
5. HUMAN RESOURCES
A. Budget Amendment No. 00-147- and Equipment Request No. 00-231- The Board
approved the budget amendment and equipment request to purchase a computer for the
Safety/OSHA position. The Board approved the computer in FY 00101 and Equipment

Request No. 01-0l3 will be deleted from the FY 00/01 budget.
B. Group Health Insurance and TRICO Premiums for FY 00-01- The Board approved the
increase in the group health insurance premium of 10% and the acceptance of a premium
reduction in TRICO premium of 25%.
C. Budget Amendment No. 00-l48 and Equipment Request No. 00-232- The Board
approved the budget amendment and equipment request to purchase a filing system for the
Human Resources Department in the amount of $7,200.
6. INVESTMENT FOR THE FUTURE
Work Authorization No. 8- The Board approved the work authorization for the scope and
fee proposal submitted by Jenkins & Charland, Inc., for engineering services to provide requested
revisions to the construction documents for South 25th St., bridge over 10 mile creek in the
amount of $900. and authorized the Chairman to sign the work authorization.
7. MANAGEMENTIBUDGET
A. Budget Resolution No. 00-166 and Budget Resolution No. 00-167- The Board approved
Budget Resolution No. 00-166 for the $24,000 addition to the Airport Maintenance
Building grant from the Florida Department of Transportation and expend funds in the
amount of $25,000 from the Florida Department of Transportation Airfield Signage Grant.
B. Budget Resolution No. 00-160- The Board approved the budget resolution recognizing
50% reimbursement in the amount of $1,690,930.30 received from the Florida
Communities Trust for the Bluefield Ranch Project No. 98-071PSA.
C. Budget Resolution No. 00-168- The Board approved accepting the Bulletproof Vests
Grant Award from the US Department of Justice in the amount of $3,648.11 and
authorized the County Administrator to sign the electronic grant award documents and
approved the budget resolution to appropriate and expend the funds.
8. COUNTY ATTORNEY
A. Contract Assignment- The Board approved the Assignment of the April 2l, 1997 contract
between St. Lucie County and Dawn G. Kirk, P.A. and Stuart A. Webb, Esquire to 8t.
Lucie County and Dawn G. Kirk, PA., for legal representation ofindigents for dependency
cases and authorized the Chairman to sign the agreement upon obtaining all necessary
signatures.
B. Resolution No. 00-165- The Board approved adopting the proposed resolution approving
the Reapportionment Plan for the St. Lucie Metropolitan Planning Organization.
C. Permission to Advertise- The Board approved advertising a RFP for lease of the North
Dock on South Causeway Island.
D. Permission to Advertise- The Board approved advertising proposed Ordinance No. 00-08
Animal Licensing for a public hearing on August 15, 2000 at 7:00 p.m. or as soon
thereafter as possible.
9. PURCHASING
A. Bid No. 00-054 SHIP Housing Repair ProgramlHoskins House- The Board approved
awarding the bid to Jacobson Construction in the amount of$19,580 and authorized the
Chairman to sign the contract as prepared by the County Attorney.

B. RFP No. 00-033- Roadway and Intersection Design- The Board approved the following
short list:
1. Kimley-Horn & Associates
2. Inwood Consulting Engineer
3. American Consulting Engineers
4. Post, Buckely, Schuh & Jernigan

and also approved the request to enter into negotiations with all five firms and authorized the
Chairman to sign the contracts as prepared by the County Attorney.
10. CENTRAL SERVICES
Contract Extension- The Board approved the contract extension with Paragon Termite &
Pest Management through and including June 30,2001 and authorized the Chairman to sign the
first extension.
ADDITIONS-
A.l COMMUNITY DEVELOPMENT
Tourism/Contract Amendment- The Board approved the proposed First Amendment to
the Agreement with RJ. Gibson, Inc., and authorized the Chairman to sign the amendment upon
receipt of the signed originals from RJ. Gibson.
REGULAR AGENDA(I-1969)
5. Ordinance No. 00-21- Consider staff recommendation to adopt Ordinance No. 00-21
Repealing Ordinance No. 99-25 Regulating Motor Vehicle Title Loans.
It was moved by Com. Hutchinson, seconded by Com. Lewis, to approve Ordinance No. 00-21;
and; upon roll call, motion carried unanimously.
6. MANAGEMENT AND BUDGET-(1-2088)
Approval of Millage Rates- For consideration before the Board was staff recommendation
to approve the millage rates, approve the submission of the rates to the Property Appraiser and
set dates for the Public Hearings.
Com. Coward requested the time for the public hearing on September 141\ be changed due to a
conflict in his schedule.
It was the consensus ofthe Board to change the time to 6:00p.m.
It was moved by Com. Barnes, seconded by Com. Hutchinson to approve the outlined millage
rates, submission of the rates to the Property Appraiser and set the dates for the public hearings as
follows: September 7th at 5:05 p.m. and September 14th at 6:00 p.m. or as soon thereafter as
possible; and, to set the aggregate millage at the stated rate; upon roll call, motion carried
unanimously.

7. COMMUNITY DEVELOPMENT (1-2271)
Budget Resolution No. 00-159- For consideration before the Board was staff
recommendation to approve the revised Scope of Work approved by the Department of
Community Affairs for a Mobile Home Inventory, authorize the Chairman to execute the
Modification and approve the budget resolution to appropriate and expend the funds from the
grant award.
It was moved by Com. Coward, seconded by Com. Lewis, to approve staff recommendation; and,
upon roll call, motion carried unanimously.
8. LEISURE SERVICES (1-2331)
Construction of Batting Cages- For consideration before the Board was staff
recommendation to approve construction of four batting cages at Elks Park, approve the use of
Park A (Ft. Pierce) Impact Fees as the funding source for the County's share of the cost and
accept the offer of$5,000 from the Ft. Pierce American League and $5,00 from the Ft. Pierce
National League to be used toward the cost of the project.
It was moved by Com. Hutchinson, seconded by Com. Coward, to approve staff
recommendation; and, upon roll call, motion carried unanimously.
9 . ADMINISTRATION
Bi-Weekly Committee Reports- The Board gave updates on the various committees and
advisory boards that they serve on.
There being no further business to be brought before the Board, the meeting was adjourned at
10:15 a.m.

Attached is a final copy of the Amended and Restated Interlocal Agreement between S1.
Lucie County and the City of F1. Pierce regarding the collection of Road Impact Fees.
This agreement is essentially the same agreement that was presented to you in draft
form on the 9th of Mayas part of the final adoption hearings for our revised impact fee
schedules. However, we have made a few minor amendments to this agreement since
the May 9th draft that makes this agreement consistent with the recently approved
agreements with Port S1. Lucie. These amendments are technical in nature and do not
effect any of the previously agreed to distribution formulas or overall performance
responsibilities for the signing parties.

SUBJECT Revised and Restated Interlocal Agreement Between the City of Ft. Pierce and St. Lucie

Attached is a final copy of the Amended and Restated Interlocal Agreement between St. Lucie County and
the City of Ft. Pierce regarding the collection of Road Impact Fees. This agreement is essentially the same

6 THIS AGREEMENT entered into this day of , 2000, by and
7 between ST. LUCIE COUNTY, a political subdivision of the State of Florida, hereinafter
8 referred to as "County", and the CITY OF FT. PIERCE, a Florida municipal corporation,
9 hereinafter referred to as "City" providing for the City's participation in the County's Roads
10 Impact Fee program.
11
12 WHEREAS, County originally adopted a roads impact fee ordinance effective February 1,
13 1986; and
14
15 WHEREAS, said fee is to be effected and collected both in the County and City; and
16
17 WHEREAS, County wishes to allow City to collect the fee as an agent of County;
18
19 WHEREAS, the parties originally entered into an Interlocal Agreement on the collection of
20 roads impact fees on February 4, 1986.
21
22 WHEREAS, On April 23, 1996, the parties agreed to amend and restate the original
23 Interlocal Agreement on the collection of roads impact fees for the purpose of establishing
24 specific areas within the City of Ft. Pierce where road impact fee collections could be
25 deferred based on the conclusions of the 2020 Metropolitan Planning Organizations (MPO)
26 Long Range Transportation Plan that certain portions of the City were essentially
27 developed and that the new development activity in those areas would be redevelopment
28 activity which would not be impacting the areas transportation network with new vehicle trip
29 impacts.

31 WHEREAS, the April 23, 1996, the amended interlocal agreement identified specific Traffic
32 Analysis Zones (T AZ's) that the collection of Road Impact Fees could be deferred until it
33 was demonstrated through the MPO Long Range Plan that additional traffic impacts were

1 being generated from these zones or that it was mutually agreed to amend this Interlocal
2 Agreement to add or delete one or more specific TAZ Zone.

4 WHEREAS, On August 26, 1997, the parties agreed to amend the amended and restated
5 Interlocal Agreement on the collection of roads impact fees for the purpose of deleting
6 T AZ #68 from Deferral Zone 3.
7
8 WHEREAS, County has amended, through Ordinance 00-004, the road impact fee
9 schedules to provide for a two year phase-in of the revised roads impact fees, effective
10 October 1,2000.

12 WHEREAS, the parties now desire to amend and restate the current Interlocal Agreement
13 on the collection of roads impact fees as set forth herein.

16 NOW, THEREFORE, IT IS AGREED as follows:

1.
This Amended and Restated Agreement is entered into pursuant to Section 163.01
Florida Statutes, Interlocal Cooperation Act.
2.
The County and the City agree that the County's road impact fee ordinance shall be
effective within the City's jurisdiction except as provided for in Section 5 of this
agreement, unless this agreement is terminated as hereinafter provided.
3.
The City agrees to:
a.
Collect the applicable impact fee as specified in County's ordinance prior to
issuing any building permit, mobile home permit, or electrical permit for a
recreational vehicle park within the City's jurisdiction.
b.
To maintain all records of the impact fee including the name, address,

amount paid and benefit district for each building permit, mobile home
permit, or electrical permit for a recreational vehicle park issued by the City.
c.
To remit to County all funds collected as impact fees, with the exception of
four percent (4%) of the funds collected which shall be kept by the City as a
fee for administration for collecting and transmitting the funds and with the
further exception of twenty percent (20%) of the funds which shall be kept by
the City for use by the City in acquiring rights of way or adding new roadway
capacity along any arterial or collector road identified in the City's
Comprehensive Plan, County's Comprehensive Plan or the Metropolitan
Planning Organization Long Range Transportation Plan. City shall remit the
collected funds monthly to the County, with payment being made to the
County by the 15th day of the following month.
d.
To expend the road impact funds retained by the City consistent with the
requirements of Section 1-17-31 (a) and (b), St. Lucie County Code and
Complied Laws.
e.
Contact the County Administrator or his designee when a building permit,
mobile home permit, or electrical permit for a recreational vehicle park is
applied for that is not specifically listed in the ordinance and to collect the fee
as determined for that use by the County Administrator or his designee.
f.
Notify County Administrator or his designee of any application for impact fee
refund received by the City. In the event of any request for refund, it is
hereby agreed that the City and the County shall, individually, only be
responsible to refund that portion of the Roads Impact Fee retained by the
City or the County, minus an administrative fee of three (3%) percent, or as

otherwise prescribed in Section 1-17-32 of the St. Lucie County Code and
Compiled Laws.
g.
Notify the County Administrator when a developer in the city, in lieu of paying
all or part of the road impact fee, offers to construct part of a arterial or major
collector road improvement project shown in the St. Lucie County
Comprehensive Plan, Metropolitan Planning Organization Long Range
Transportation Plan, City of Ft. Pierce Comprehensive Plan or appropriate
to the implementation thereof.
h.
To hold the County harmless should any suit or legal action be brought to
contest the City's expenditure of impact fee funds or the amount of the
administrative fee retained by the City. The City agrees to provide any legal
defense necessary at no cost to County. Should any Court order any refund
of any impact fee or the amount of the administrative fee retained by the City
or should any refund be agreed to by City, the refund shall be paid solely by
City.
i.
To provide the County on October 1 of each year, annual financial reports
and information pertaining to the collection and expenditure of road impact
fees retained by the City.

County agrees:
a.
To provide to City administrative procedures and administrative assistance
in setting up bookkeeping and other accounting procedures necessary for
City to collect the fee.

1 b. To maintain all records of the impact fee including the name, address,
2 amount paid and benefit district for each building permit, mobile home
3 permit, or electrical permit for a recreational vehicle park issued by any City
4 or County as furnished by the collecting agency.

6 c. To consult with City in regard to expenditure of any impact fee funds
7 collected by City and remitted to County and at the request of the City to
8 delay such proposed expenditure for a period of time reasonably sufficient
9 to allow for the City to advise the Board of County Commissioners of any
10 objections it may have to said expenditures.

12 d. In the case of redevelopment, determination of the appropriate previous use
13 shall be made by the City.

15 e. Except for any suit or action challenging the provisions of Section 5 of this
16 agreement, to hold City harmless should any suit or legal action be brought
17 to contest the validity of the impact fee ordinance or to contest the amount
18 of any impact fee imposed pursuant to the impact fee ordinance. The
19 County agrees to provide any legal defense necessary at no cost to City.
20 Should any Court order any refund of any impact fee or should any refund
21 be agreed to by County, said refund shall be paid solely by the County and
22 the City to the extent of percentage of fees retained by each respective
23 entity.

The city and county jointly agree:
a.
That portions of the City have essentially reached their maximum buildout
potential based upon current comprehensive land use plan and local zoning
designations.
b.
That any new development activity in the portions of the City described in
paragraph 5c, and as shown in the attached exhibit "A", will be
redevelopment of existing commercial residential uses and that the addition,
if any, of commercial and industrial square footage or residential
development above the levels currently found in these areas will have a
deminimis impact on the capital transportation needs of the areas described
as indicated by the 2020 Metropolitan Planning Organization's Long Range
Transportation Plan.
c.
To acknowledge the suspension of the collection of any impact fees in the
following TAZ (Traffic Analysis Zones):

22 10. This Amended and Restated Agreement shall be effective for a period of five (5)
23 years beginning October 1, 2000. Termination of this Amended and Restated
24 Agreement may only occur if; 1.) both parties agree to the termination, or, 2.)
25 imposition of the roads impact fee is not allowed by state law, or, 3.) upon breach
26 of the agreement by a party and failure to cure the breach within a reasonable time
27 period not to exceed forty-five (45) days. The termination of this Amended and
28 Restated Agreement shall not require the County to refund any monies collected by

revenue sources.
6.
The Board of County Commissioners shall have the final authority pursuant to
Section 1-17 -30(B) of the St. Lucie County Roads I mpact Fee Ordinance as to
whether to accept an offer by a developer to construct part of a road improvement
project in lieu of payment of all or part of the road impact fee.
7.
Nothing in this Amended and Restated Agreement is intended to deprive the County
of final authority and responsibility for the use and expenditure of impact fee monies
collected pursuant to the Road Impact Fee Ordinance.
8.
This Amended and Restated Agreement embodies the whole understanding of the
parties. There are no promises, terms, conditions or obligations other than those
contained herein; and this Amended and Restated Agreement shall supersede all
previous communications, representations, or agreements, either verbal or written,
between the parties hereto.
9.
This Amended and Restated Agreement may only be amended by a written
document signed by both parties and filed with the Clerk of the Circuit Court of St.
Lucie County, Florida.

you in draft form on the 9th of Mayas part of the final adoption hearings for our revised
impact fee schedules. However, we have made a few minor amendments to this
agreement since the May 9th draft that makes this agreement consistent with the
recently approved agreements with Port St. Lucie. These amendments are technical in
nature and do not effect any of the previously agreed to distribution formulas or overall
performance responsibilities for the signing parties.
Staff recommends approval of the Amended and Restated Interlocal Agreement
between St. Lucie County and the City of Ft. Pierce regarding the collection of Public

9 to whether to accept an offer by a developer to construct part of a public building

days prior to October 1 of each year of its intent to retain and use sixteen (16%)
percent of the fee in accordance with the terms of this paragraph. The effect of the
notification shall be for one (1) year from October 1 to September 30, unless
extended annually as set out in this paragraph.

Attached is a final copy of the Amended and Restated Interlocal Agreement between St.
Lucie County and the City of Ft. Pierce regarding the collection of Parks Impact Fees.
This agreement is essentially the same agreement that was presented to you in draft
form on the 9th of Mayas part of the final adoption hearings for our revised impact fee
schedules. However, we have made a few minor amendments to this agreement since
the May 9th draft that makes this agreement consistent with the recently approved
agreements with Port St. Lucie. These amendments are technical in nature and do not
effect any of the previously agreed to distribution formulas or overall performance
responsibilities for the signing parties.

6 THIS AMENDED AND RESTATED AGREEMENT entered into this day of
7 ,2000, by and between ST. LUCIE COUNTY, a political subdivision of the
8 State of Florida, hereinafter referred to as "County", and the CITY OF FORT PIERCE, a
9 Florida municipal corporation, hereinafter referred to as "City" providing for the City's
1 0 participation in the County's impact fee program.

12 WHEREAS, County originally adopted a parks impact fee ordinance effective January 1,
13 1996; and
14
15 WHEREAS, said fee is to be effected and collected both in the County and City; and
16
1 7 WHEREAS, County wishes to allow City to collect the fee as an agent of County;

19 WHEREAS, the parties originally entered into an Interlocal Agreement on April 23, 1996,
20 which the parties now desire to amend and restate as set forth herein.

22 NOW, THEREFORE, IT IS AGREED as follows:

This Amended and Restated Agreement is entered into pursuant to Section 163.01,
Florida Statutes, Interlocal Cooperation Act.

The County and the City agree that the County's parks impact fee ordinance shall
be effective within the City's jurisdiction unless this Agreement is terminated as
hereinafter provided.

Collect the applicable impact fee as specified in County's ordinance prior to
issuing any building permit, mobile home permit, or electrical permit for a
recreational vehicle park within the City's jurisdiction.
b.
To maintain all records of the impact fee including the name, address,
amount paid and benefit district for each building permit, mobile home
permit, or electrical permit for a recreational vehicle park issued by the City.
c.
To remit to County fifty percent (50%) of all funds collected as impact fees,
after the deduction of four (4%) percent of the funds collected which shall
be kept by City as a fee for administration for collecting and transmitting the
funds. City shall remit the collected funds monthly to County, with payment
being made to County by the 15th day of the following month.
d.
Contact the County Administrator or his designee when a building permit,
mobile home permit, or electrical permit for a recreational vehicle park is
applied for that is not specifically listed in the ordinance and to collect the fee
as determined for that use by the County Administrator or his designee.
e.
Notify the County Administrator or his designee of any application for impact
fee refund received by the City. In the event of any request for refund, it is
hereby agreed that the City and the County shall, individually, only be
responsible to refund that portion of the Parks Impact Fee retained by the
City or the County, minus an administrative fee of three (3%) percent, or as
otherwise prescribed in Section 1-15-44 of the St. Lucie County Code and
Compiled Laws.

Notify the County Administrator when a developer in the City, in lieu of
paying all or part of the parks impact fee, offers to construct part of a parks
improvement project shown in the City's or County's Comprehensive Plan or
appropriate to the implementation thereof.
g.
To expend the impact funds retained by the City to construct part or all of a
parks improvement project shown in the City's or County's comprehensive
plan or for park land acquisition for sites identified in the Comprehensive
Plans of the City and the County.
h.
To hold the County harmless should any suit or legal action be brought to
contest the City's expenditure of impact fee funds or the amount of the
administrative fee retained by the City. The City agrees to provide any legal
defense necessary at no cost to County. Should any Court order any refund
of any impact fee or the amount of the administrative fee retained by the City
or should any refund be agreed to by City, the refund shall be paid solely by
City.
i. To provide the County an annual report on October 1 of each year, annual
financial reports and information pertaining to the collection and expenditure
of park impact fees by the City.

a. To provide to City administrative procedures and administrative assistance
in setting up bookkeeping and other accounting procedures necessary for
City to collect the fee.

c. To expend the County's portion of the impact fee funds to construct part or
all of a parks improvement project shown in the St. Lucie County
Comprehensive Plan or appropriate to the implementation thereof.
d. Except as provided in Section 3h, to hold City harmless should any suit or
legal action be brought to contest the validity of any impact fee ordinance or
to contest the amount of any impact fee imposed pursuant to the impact fee
ordinance. The County agrees to provide any legal defense necessary at no
cost to City. Should any Court order any refund of any impact fee or should
any refund be agreed to by County, said refund shall be paid solely by
County and the City to the extent of percentage of fees retained by each
respective entity.
e. To provide the City, on October 1 of each year, annual, financial reports and
information showing the amount of impact fees collected and expended
within each park benefit district.
The Board of County Commissioners shall have the final authority pursuant to
Section 1-15-37 of the St. Lucie County Parks Impact Fee Ordinance as to whether
to accept an offer by a developer to construct part of a park improvement project in
lieu of payment of all or part of the park impact fee.

1 6. Nothing in this Amended and Restated Agreement is intended to deprive the County
2 of final authority and responsibility for the use and expenditure of impact fee monies
3 collected pursuant to the Park Impact Fee Ordinance.

5 7. This Amended and Restated Agreement embodies the whole understanding of the
6 parties. There are no promises, terms, conditions or obligations other than those
7 contained herein; and this Amended and Restated Agreement shall supersede all
8 previous communications, representations, or agreements, either verbal or written,
9 between the parties hereto.

11 8. The Amended and Restated Agreement may only be amended by a written
12 document signed by both parties and filed with the Clerk of the Circuit Court of 8t.
13 Lucie County, Florida.

15 9. This Amended and Restated Agreement shall be effective for a period of five (5)
16 years beginning October 1, 2000. Termination of this Amended and Restated
17 Agreement may only occur if; 1.) both parties agree to the termination, or, 2.)
18 imposition of the parks impact fee is not allowed by state law, or, 3.) upon breach
19 of the agreement by a party and failure to cure the breach within a reasonable time
20 period not to exceed forty-five (45) days. The termination of this Amended and
21 Restated Agreement shall not require the County to refund any monies collected by
22 the City and remitted to the County pursuant to this Amended and Restated
23 Agreement. The Amended and Restated Agreement may be extended upon mutual
24 agreement of both parties.

The City of Port St. Lucie has requested one minor amendment to this Interlocal Agreement, which we can
honor. Specifically, the City has requested that paragraph 4f (page 4) be amended to provide that the County
will, each October 15t, provide the City with a report outlining the collection and expenditures of impact fees for
the previous year. There is no problem in meeting this request.
Staff recommends approval of the Amended and Restated Interlocal Agreement between St. Lucie County
and the City of Port St. Lucie regarding the collection of Library Impact Fees.

BACKGROUND: As part of the improvements being made at the Savannas Recreation
Area, a "john boat" was purchased. Staff was originally told that it would be
considered Equipment under $750 and would not need Board approval. However, when
freight charges are added, the price exceeded $750, so Board approval becomes
necessary. The attached budget amendment and equipment request have been
prepared for approval so that we can take possession of the boat.

We had ordered a "john boat" for the Savannas Recreation Area and had planned to pay for it with a
County credit card, which I was originally told I could do. However, the credit card was declined and
the reason given was that because of the added freight charge, this boat would now be considered a
piece of capital equipment.
In order to pay for this boat, we need an equipment request form and budget amendment which will
be submitted for Board approval. Funds are currently available in 316.7240.551200.7650. The
amount of the purchase is $909.00.
I appreciate your assistance with the matter. Please let me know what else I might need to do.

consider the following meeting schedule/adjustments for the month of November 2000:
· Cancel the regularly scheduled Board meeting of Tuesday, November ih and
reschedule that meeting for Wednesday, November 8'- This meeting will begin
at 7: 00 PM.
· The Boards meeting of Tuesday, November 14th, will be held at its regular time
of 9:00 AM. The agenda for this meeting will be as abbreviated as possible in
order to allow those attending the Association of County's meeting in
Tallahassee an opportunity leave on schedule.
· Move the starting time of the Boards regular meeting of Tuesday, November

reorganization meeting.

Grant Application to Florida Seaport Transportation and Economic Development (FSTED) Council for
the Taylor CreeklC25 Dredging and Restoration Project.
BACKGROUND:
Currently, BCI Engineers and Scientists, Inc., is preparing an application to FSTED requesting grant
funding in the amount of $700,000 for the Taylor CreeklC25 Dredging and Restoration Project. This
amount would represent approximately 50% ofthe anticipated cost to complete the Taylor Creek Project.
FSTED has indicated that a revised Port Master Plan document consistent with the Port Charette
recommendation and consistent with the City of Ft. Pierce Comprehensive Plan Element must be
completed before the grant funding application could receive final approval from FSTED.
At this point in time, funding for the Taylor Creek Project is proposed to be established through the
following agencies in the listed amounts:

DESCRIPTION IN DETAIL:
The Taylor Creek Restoration Dredging Project area coòsists of the western right-of-way of the Intracoastal
Waterway (ICW) from the east to the west of the Soutb Florida Water Management District (SFWMD) Canal No.C-25
Spillway and the Fort Pierce Farms Water Control District Canal No.1 (F-l Spillway). (See Figure 1). The upland
Port area is directly to the south of Taylor Creek.
Taylor Creek was dredged about 37 years ago according to historic USACOE information. Recently, St. Lucie County
completed a survey and sediment characterization and sediment removal feasibility studies that have shown an
average of six feet of sedimentation resulting in an estimated total of 210,000 cubic yards of sediments for removal.
The need for removal is necessitated by the recent obsen'ations by the Florida Department of Environmental
Protection (Exhibit A) in the reduction of seagrass tj'pes and coverage in tbe area abutting this project and the port
directl~' to the south. This project is thus an emen!enn' project required not only to protect the marine resources of
the Indian River Lagoon, the most diverse estuary in North America, but preclude siltation in recently dredged federal
waterways (turning basin) and the directly connecting Intracoastal waterways. This project is supported, through
funding, by the South Florida Water Management District, St. Johns River Water Management District (Indian River
Lagoon National Estuary Program) and the Florida Inland Navigation District.
This project is aJso consistent with Chapter 311.07 Florida Seaport Transportation and Economic Development
Funding; (3)(a) 50-SO matching, (3)(b2) The dredging or deepening or channels, turning basins or barbors, and
(3)(b7). Enyironmental projects. In addition, a 1996 Charrette will be utilized to amend tbe 1989 Port of Ft. Pierce
Master Plan through joint cooperation of the St. Lucie County (port) and City of Ft. Pierce and will be included in the
Local Government Comprehensive Plan in the near future.

As indkated in the project description (Form B) this is an emergency project which will benefit
both thefederal navigation channels (JCW and turning basin) and the environmental resources
abutting Taylor Creek (Figures 2 & 3.)

Comprehensive Plan (LGCP)? If not yet incorporated, when do you e""pect it to be adopted into
the LGCP?
A Port of Fort Pierœ Master Plan was completed in 1989, but was not implemented, except for
a North entry to the port (now in engineering design phase - See Exhibit B). However, a
Charrette in 1996 (See Exhibit CJ has resulted building a public concensus, whkh is expected
to he incorporated into the LGCP and amend the existing Port Master Plan (1989).
C. If applicable, give the comprehensive plan amendment nwnber wlùch includes this port project.

Exhibit D is being submÏJJed as documentation of progress towards amending the Port Master
Plan (1989). Both St. Lucie County ad City of Ft. Pierce are working towards the d/..>velopment
of the Port of Fort Pierce. Selection of consultant(s) to assist 'with this development will be
interviewed on August 2, 2000.

This is all emergency project (See Project Description in Form B). It will serve as preventive
maintenance for the Federal Navigation Channels and protect the impacted marine resources
abutting the projeä area.

BACKGROUND:

Program in order to pave Sapp Road for economic development purposes. The
County Commission committed to allocating $250,000 to improve Sapp Road should
the state funding not be secured. The State has committed to reserve funds
from the Transportation Trust Fund for this project. Staff requests to
reallocate $111,000 of the county funds previously designated for road
improvements to the installation of water and sewer infrastructure. The funds
would only be accessed if we do not receive a Community Development Block Grant
(CDBG)for the installation of water and sewer lines.

PREVIOUS ACTION:
On June 6, 2000, the Board committed $250,000 to the paving of
Sapp Road.
RECOMMENDATION:
Staff recommends that $111,000 of the funds previously

SUBJECT: Smithsonian Institution - Extension of Letter ofIntent for "Exploring
Marine Ecosystems" Exhibit
BACKGROUND:
On April 25, 2000, the Board of County Commissioners approved a Letter ofIntent with the
Smithsonian Institution for the relocation of a portion of the Smithsonian's "Exploring Marine
Ecosystems" Exhibit to St. Lucie County. The Letter of Intent did not constitute a binding
agreement between the parties but provided for the parties to continue negotiations on the final
agreement during the next ninety (90) days. The Smithsonian's initial draft agreement was
forwarded to the County Attorney during the week of July 1Th. As it appears that the agreement will
not be finalized prior to the expiration of the initial ninety (90) day period, the Smithsonian has
requested that the negotiations period by extended for an additional thirty (30) days as set forth in
the attached letter.
CONCLUSIONIRECOMMENDA TION:
Staff recommends that the Board of County Commissioners approve an extension of the
Letter of Intent with the Smithsonian Institution for an additional thirty (30) days to August 31,
2000, and authorize the Chairman to sign the extension.
