GENERAL RULES AND PROCEDURES - Attached is the agenda which will determine the order of business conducted
at today's Board meeting:
CONSENT AGENDA - These items are considered routine and are enacted by one motion. There will be no separate
discussion of these items unless a Commissioner so requests.
REGULAR AGENDA - Proclamations, Presentations, Public Hearings, and Department requests are items, which the
Commission will discuss individually usually in the order listed on the agenda.
PUBLIC HEARINGS - These items are usually heard on the first and third Tuesday at 6:00 P.M. or as soon thereafter as
possible. However, if a public hearing is scheduled for a meeting on a second or fourth Tuesday, which begins at 9:00
A.M., then public hearings will be heard at 9:00 A.M. or as soon thereafter as possible. These time designations are
intended to indicate that an item will not be addressed prior to the listed time. The Chairman will open each public hearing
and asks anyone wishing to speak to come forward, one at a time. Comments will be limited to five minutes.
As a general rule, when issues are scheduled before the Commission under department request or public hearing, the
order of presentation is: (1) County staff presents the details of the Board item (2) Commissioners comment (3) if a public
hearing, the Chairman will ask for public comment, (4) further discussion and action by the board.
ADDRESSING THE COMMISSION - Please state your name and address, speaking clearly into the microphone. If you
have backup material, please have eight copies for distribution.
NON-AGENDA ITEMS - These items are presented by an individual Commissioner or staff as necessary at the
conclusion of the printed agenda.
PUBLIC COMMENT - Time is allotted at the beginning of each meeting of general public comment. Please limit
comments to five minutes.

Board schedules additional workshops throughout the year necessary to accomplish their goals and commitments. Notice

This public hearing is the first of two public hearings to consider the approval of a 56.62 acre area
located at 2525 Center Road, Fort Pierce, FL as a designated Brownfield site. This public hearing is to
provide an opportunity for public input on the size of the areas, the objectives for rehabilitation, job
opportunities and economic developments anticipated, neighborhood resident's considerations, other
relevant local concern and approval of Resolution No. 06-035 to designate the site as a Brownfield site
- Consider staff recommendation to approve Resolution No. 06-035 designating this area as a
Brownfield area.

ANNOUNCEMENTS
MAY 22, 2006
1. The Florida Department of Environmental Protection, Division of Recreation and Parks will
conduct a public workshop for Fort Pierce Inlet State Park on Wednesday, May 24, 2006, at
7:00 p.m. The purpose of this workshop is to present the draft land management plan for this
park to the public. A DEP Advisory Group meeting is scheduled for Thursday, May 25, 2006,
at 9:00 a.m. The purpose of the meeting is to discuss the proposed land management plan for
this park with the Advisory Group members.
2. The Board of County Commissioners will hold a Space Needs Study Workshop on Wednesday, May
24, 2006 from 2:00 p.m. to 4:00 p.m. in the County Commission Chambers.
3. St. Lucie County will hold the second Public Visioning Meeting to discuss the River Park Community
Center on Thursday, May 25, 2006 at 6:00 PM. at the Oxbow Eco Center located at 5400 NE St.
James Drive, pt. St. Lucie, FL 34983.
4. On Tuesday, May 30, 2006 at 6:00 p.m. in the County Commission Chambers the Board of County
Commissioners will hold 2nd Public Hearing to include:

_2nd Reading of TDR Ordinance
5. The Board of County Commissioners will hold a Hurricane Preparedness Workshop on Friday, June 9,
2006 from 9:00 a.m. to Noon in the County Commission Chambers.
6. The Special Olympics, St. Lucie County Golf Tournament will be on Saturday, June 10, 2006 at Club
Med at 8:30 a.m. (Shotgun Start).
7. The Board of County Commissioners will hold an Infrastructure Workshop on Monday, June 19, 2006
from 9:00 a.m. to Noon in the County Commission Chambers.
8. The Port St. Lucie City Council will host a Joint Meeting with the Board of County Commissioners and
the City of Fort Pierce Commission on Thursday, July 13, 2006 from 2:00 p.m. to 5:00 p.m. at the Port
St. Lucie Community Center.
9. The Board of County Commissioners will hold a TVC Infrastructure Workshop on Monday, July 17,
2006 from 2:00 p.m. to 5:00 p.m. in the County Commission Chambers.

site must be designated a Brownfield area by the local government. A
Brownfield site may not be contaminated but may be an economically
deprived area. In this case an individual will be redeveloping the area.
Once the County has designated the area as a Brownfield site then many
opportunities become available for streamlining the cleanup process and
tapping into State incentives, such as tax credits, $2500 per job bonus
refund, low interest loans, sales tax credit on building materials and more.
The second public hearing will be scheduled for June 6,2006.
This meeting today will provide neighbors and nearby residents the
opportunity to provide comments and suggestions, in accordance with
Section 376.80 of Florida Statute.
The Board of County Commissioners will consider the following issues with
respect to the subject area:
1. Whether the Brownfield area warrants economic development and
has a reasonable potential for such activities;
2. Whether the proposed area to be designated represents a
reasonable focused approach and is not overly large in geographic
coverage;

Subject: Brownfield Designation
Per your request, here is an outline of the County's process to designate a brownfield site. This
information is based on Sections 376.77-376.84, Florida Statutes. As I state in more detail
below, there would need to be two public hearings: one to determine the area to be designated
and one to designate the area.
Larry Daum stated that the area is outside of a community redevelopment area, enterprise zone,
empowerment zone, closed military base, or designated brown field pilot project area. The local
government, therefore, must conduct at least one public hearing in the area to be designated, in
accordance with section 376.80(2)(a). According to Roger Register at DEP, the hearing must be
held in, or as close to, the area to be designated as is feasible. The hearing is to provide an
opportunity for public input on the size of the area, the objectives for rehabilitation, job
opportunities and economic developments anticipated, neighborhood residents' considerations,
and other relevant local concerns. Notice of the public hearing must be made in a newspaper of
general circulation in the area and the notice must be at least 16 square inches in size, must be in
ethnic newspapers or local community bulletins, must be posted in the affected area, and must be
announced at a scheduled meeting of the local governing body before the actual public hearing.
In determining the areas to be designated, the local government must consider:
1. Whether the brownfield area warrants economic development and has a reasonable potential
for such activities;
2. Whether the proposed area to be designated represents a reasonably focused approach and is
not overly large in geographic coverage;
3. Whether the area has potential to interest the private sector in participating in rehabilitation;
and
4. Whether the area contains sites or parts of sites suitable for limited recreational open space,
cultural, or historical preservation purposes.
After this initial public hearing to determine the area to be designated, the local government shall
hold a second public hearing to consider a resolution designating the brownfield area. For
counties, the local governing body shall adopt the resolution in accordance with the procedures
outlined in section 125.66, except notice for the public hearings on the proposed resolution shall
be in the fonn established in section 125.66(4)(b)2. According to Roger Register, the county
need only hold one public hearing on the resolution to designate. The local government may
designate a brownfield area under the provisions of the act provided that:
I. A person who owns or controls a potential brownfield site is requesting the designation and
has agreed to rehabilitate and redevelop the brownfield site;
2. The rehabilitation and redevelopment of the proposed brownfield site will result in economic
productivity of the area along with the creation of at least ten (10) new pennanent jobs at the
brownfield site, which are not associated with implementation, demolition, or construction of the
brownfield site;
3. The redevelopment of the proposed brownfield site is consistent with the local comprehensive
plan and is a permittable use under the applicable local land development regulations;
4. Notice of the proposed rehabilitation of the brownfield area has been provided to neighbors
and nearby residents of the proposed area to the designated, and the person proposing the area for
designation has afforded to those receiving notice the opportunity for comments and suggestions
about rehabilitation; and
5. The person proposing the area for designation has provided reasonable assurance that he or
she has sufficient financial resources to implement and complete the rehabilitation agreement and
redevelopment plan.
A local government with jurisdiction over the brownfield area must notify the Department of
Environmental Protection of its decision to designate a brownfield area for rehabilitation for the
purposes of sections 376.77-376.85. This notification must include a resolution to which is
attached a map adequate to clearly delineate which parcels are to be included in the brownfield
area or a less-detailed map and a detailed legal description. See Hillsborough County's
Resolution, attached.
If a property owner within the area proposed for designation requests in writing to have his or her
property removed from the proposed designation, the local government shall grant the request.
The local government notifies the DEP of the identity of the person responsible for brownfield
site rehabilitation. The designation of the brownfield area and the identification of the person
responsible for brownfield site rehabilitation entitles the identified person to negotiate a
brownfield site rehabilitation agreement with the DEP.

COUNTY. FLORIDA. MAKING FINDINGS; DETERMINING THE AREA TO BE
DESIGNATED AS A BROWNFIELD AREA WITHIN UNINCORPORATED ST. LUCIE
COUNTY, FOR THE PURPOSE OF ENVIRONMENTAL REHABIUTATION AND
ECONOMIC DEVELOPMENT, AS 31 3440 W 795.1 FT OF S 1167.5 FT OF. N 1217.5
FT OF SW 1/4 OF NE 1/4 AND SE 1/4 OF NW 1/4-LESS RDS AND CANALS-
(56.62 AC.:) (OR 2526-487), LOCATED AT 2525 CENTER ROAD, FORT PIERCE,
FLORIDA 34946.
WHEREAS. the State of Florida has provided, in Chapter 97-277, Laws of Florida,
codified at Sections 376.77-376.84, Florida Statutes, for the designation by resolution,
at the request of the property owner, of one or more parcels as a "Brownfield Area," and
for the corresponding provision of environmental remediation and economic development;
and
WHEREAS, the property owner, BPSC Ind., LLC, has requested designation as a
Brownfield Area the parcel (313440 W 795.1 FT OF S 1167.5 FT OF N 1217.5 FT OF SW
1/4 OF NE 1/4 AND SE 1/4 OF NW 1/4-LESS RDS AND CANALS- (56.62 AC:!:) (OR
2526-487), located at 2525 Center Road, Fort Pierce, Florida, 34946) depicted on Exhibit
A attached hereto and incorporated by reference; and
WHEREAS, on May 22,2006, the Board of County Commissioners held a public meeting
near the area to be designated to provide an opportunity for neighbors and nearby
residents to provide comments and suggestions, in accordance with Section 376.80 (2)(a);
and
WHEREAS. St. Lucie County has considered the following issues with respect to the
subject parcel, as specified in Section 376.80(2)(a), Florida Statutes:
1. Whether the brownfield area warrants economic development and has a
reasonable potential for such activities;
2. Whether the proposed area to be designated represents a reasonably
focused approach and is not overly large in geographic coverage;
3. Whether the area contains sites or parts of sites suitable for limited
recreational open space, cultural, or historical preservation purposes.
NOW THEREFORE BE IT RESOLVED that the area depicted on Exhibit A, 31 3440 W
795.1 FT OF S 1167.5 FT OF N 1217.5 FT OF SW 1/4 OF NE 1/4 AND SE 1/4 OF NW
1/4-LESS RDS AND CANALS- (56.62 AC:!) (OR 2526-487), located at 2525 Center Road,
Fort Pierce, Florida, 34946), is determined to be considered for designation as a
