I was saddened to learn of Harold Phillip's departure for New Zealand, and have been asked to fill in for him on Gopher tortoise issues through the Audubon Society. I have also advised staff that hand written minutes will be taken when recording devices fail or are not available. The Board of County Commissioners recognizes that public input is valuable and important. They formed the Environmental Advisory Committee (EAC) to facilitate public input well in advance of any issue being presented to the Planning and Zoning Board and the Board of County Commissioners. We encourage your participation in the public meeting process. Please let me know if you have difficulty in the future in obtaining minutes of meetings. LUCIE COUNTY ENVIRONMENTAL ADVISORY COMMITTEE TO: Board of County Commissioners FROM: Environmental Advisory Committee Members ~~. -"YI"-' .?'--' e~ _)oo.--c::-~/ SUBJECT: Comprehensive Plan Text Amendments Regarding Wetlands DATE: May 8, 2007 On April 19, 2007 Bobby Klein, speaking as part of the development team for the proposed ProvenceslWillow Lakes DRI, presented proposed text amendments to the Environmental Advisory Committee. Mr. Klein claims that these text amendments are being proposed because the St. Lucie County Comprehensive Plan, as it is currently written, may be inconsistent with state law. The proposed amendment language would be in conflict with the existing Comprehensive Plan Policy, in that the proposal appears to abolish County regulation of wetlands and cede County wetland regulation to the State. The proposed amendment also appears to weaken or abolish the ability of the County to require avoidance and minimization of wetland impacts, before mitigation is considered. The state regulations have caused the abolishment of 87,000 acres of much needed wetlands. This amendment comes at a time when much of Florida, including St. Lucie County, is within a Severe Water Shortage period with mandatory water use restrictions. According to SFWMD, "We're at a point where every drop of water makes a difference, and water conservation needs to be part of everyone's daily routine," said Carol Ann Wehle, executive director of the SFWMD. "Despite recent rain events, we have entered what may be the worst drought in recordable South Florida history, and even this latest action from our Governing Board may not be enough to see us through the current dry season without the need for further restrictions." (https://mv.sfwmd.Qov/portal/paQe Accessed April 27, 2007). This also appears to diminish or negate the County's role in planning for protection of fish, wildlife, and habitat. The Environmental Advisory Committee advises the Board of County Commissioners that we do not agree to the Comprehensive Plan text amendments proposed by Mr. Klein regarding wetland regulations. Should the St. Lucie County ,.', ... Comprehensive Plan, as it is currently written, be found inconsistent with state law, as Mr. Klein advised, then the Environmental Advisory Committee recommends that 1) the Board of County Commissioners not transmit the text amendments proposed by Mr. Klein to the Department of Community Affairs and 2) the Board of County Commissioners direct the Environmental Resources Department to be responsible for revising the St. Lucie County Comprehensive Plan so that it is compliance with state law and so that the revised Comprehensive Plan requires avoidance and minimization before mitigation is considered.
