Site Plan Extensions
At the request of the Board, staff has reviewed the Land Development Code rules and
County policy on site plan approval extension requests. The request stems from recent
action by the Board wherein a request by the developers of Indrio Crossing PUD for
another extension of their approved plan was initially denied. At a subsequent meeting,
the Board agreed to rehear the extension request. Prior to rehearing the request, staff
was asked to prepare information on the existing rules and policies as well as obtain
information on the extension policies of nearby jurisdictions. A number of the contacted
jurisdictions are either reviewing their extension policies or have already amended
them.
Attached please find the following documents:
· A summary of Land Development Code regulations governing extension
requests for a variety of applications;
· A list of requested and granted extensions 2005-2008;
· A table extension rules and policies for several nearby counties and cities;
Growth Management has recently received several requests for extensions. Developers
have identified a variety of reasons for requesting extensions. The common thread in
the requests reflect the soft economy and a lack of demand for the proposed projects _
particularly housing. That said, the County has not received any requests to amend the
current extension regulations.
The current County LDC and policy are relatively generous. Generally, the Board may
grant plan approvals based upon a written request made in advance of plan approval
expiration. Typically, an approved plan is allowed two, one-year extensions, with the
exception of minor site plans and preliminary PUDs, which are allowed only a single,

one-year extension. County policy has been to routinely grant the exceptions upon
written request.
While staff is seeking Board direction on whether to amend the current extension policy,
we do offer some preliminary recommendations:
· Consideration of further extending any approvals beyond the current policy
should focus on economic development activities - particularly plans that include
targeted industries. This is recommended regardless of current economic
conditions.
· Should further extensions be granted to other approvals, consideration should
be given to requiring new traffic studies and/or an updated concurrency analysis.
Board members have expressed concern that extensions may tie up trips on the
road network and make it more difficult for other projects to meet concurrency.
· The Board may also wish to give consideration to projects that have already paid
impact fees, made proportionate fair share contributions or made other
significant or beneficial contributions to the County in advance of going to
construction.
