A. CALL TO ORDER
The meeting was called to order at 8:31 a.m. by Vice Chairman, Fred Rohrbough.

Motion was made by Mr. Langel to approve the Minutes of the May 21, 2008 Contractor’s Licensing
Examining Board Meeting.

Mr. Rohrbough noted the applicant did not have a recommendation letter from a contractor certified or registered
by the State of Florida. He has provided all other documents in compliance with St. Lucie Code of Ordinances
and Compiled Laws.
The applicant was not present. Mr. DiFrancesco asked if the letter of recommendation was a requirement and if
he was licensed previously. Ms. Ariyanayagam said it’s required by the Ordinance, and Mr. Insabella held a
license with St. Lucie County, from the City of Port St. Lucie Reciprocity, and also Martin County. He turned in all
of his licenses and reapplied. He has met all the requirements except for this one.

Mr. DiFrancesco made a motion to approve Harry Insabella for his application for a license as Marine
Construction Contractor.

Ms. Ariyanayagam reviewed the citation and Ms. Lifland read the information into the record. Ms. Hicken had ten days
to either appear or pay the fine.
No one was present to represent Ms. Hicken.
Ms. Lifland read the violation into the record (stated above).

G. CITATION APPEALS:
Against: Mark Wayne Wellborn, 1403 Seaway Drive, Fort Pierce, Fl 34949
Violation: Working without a Certificate of Competency In St. Lucie County,
Civil Penalty $500.00 and working without a Permit, Civil Penalty $250.00

Investigator: Swendy Ariyanayagam
No one was present to represent Mr. Wellborn
Ms. Ariyanayagam provided two photos dated May 9, 2008. On May 9, 2008 she issued a citation for Mr. Mark
Wayne Wellborn for rebuilding a dock without a Certificate of Competency and not having a building permit at
13129 S. Indian River Drive, St. Lucie County. Mr. Wellborn said he was working for the sub, and hired at times to
do jobs. Ms. Ariyanayagam explained he needed a Marine Contractor or General Contractor license and a
building permit was required for the rebuilding project. A Stop Order was issued. A citation was issued for $250
for not having a permit; and for $500 for not holding a Certificate of Competency, totaling $750.00. Mr. Wellborn
wrote a letter dated 5/22/08 requesting a hearing before the Contractor Licensing Board. Ms. Ariyanayagam
stood by the citation being issued correctly at the time of the investigation.

Mr. Mitchell made a motion to support staff’s recommendation that Mark Wayne Wellborn was issued a
correct citation for not holding a Certificate of Competency $500.00, and not having a building permit
$250.00, totaling $750.00.

Violation: Section 2-5-5. Working without a Certificate of Competency; Civil Penalty $500.00

Investigator: Swendy Ariyanayagam
Ms. Ariyanayagam provided two photos dated 6/12/08. On 6/12/08 she issued a citation to Mr. Gandee d/b/a
Handee Gandee Handy Man Services for doing business without a Certificate of Competency in St. Lucie County.
Mr. Gandee came in and explained he was in the process of applying for a license. He now has a license and
staff recommended the citation fine be waived. A letter was provided by Mr. Gandee in support of his applying for
a license at the time of the citation.

Mr. Langel made a motion in reference to Jan Douglas Gandee that the citation fine be waived.

Against: Charles Maloy, d/b/a Charles Maloy, Inc., 221 S.W. Christmas Terrace, Port St.
Lucie, Fl. 34983
Violation: Section: 2-5-5. Working without a Certificate of Competency; Civil Penalty $500.00
Complaint Filed by: Staff
Investigator: Monica Barrios
Ms. Barrios provided two photos. On 5/14/08 at 10701 S. Ocean Drive, Fort Pierce she found Mr. Maloy doing
siding, and after checking she found that Mr. Maloy does not hold a Certificate of Competency in St. Lucie
County. A citation in the amount of $500.00 was issued. Mr. Maloy requested an administrative hearing to appeal
the citation.
Staff’s Recommendation:
Staff’s decision is that the citation was issued correctly.
Charles Maloy, 221 S.W. Christmas Terrace, Port St. Lucie, Fl., was sworn in by Ms. Lifland. Mr. Maloy said he
was working with a State Certified Contractor, and he was working with a licensed person who has workmen’s
comp and insurance. He was taking down some siding on a mobile home, and not doing any other work.
Ms. Ariyanayagam said if he’s an employee of a Certified Contractor, he needed to provide proof of being
employed.
Mr. Maloy said he was on the payroll, and just started at the time of the citation. Ms. Ariyanayagam said at the
time the citation was issued correctly, but since then Mr. Maloy has taken steps to correct that. Discussion
ensued. Mr. Maloy displayed proof of employment.

Mr. DiFrancesco made a motion in reference to the complaint against Charles Maloy, that the Board make
the following determination: that we accept staff’s recommendation that Charles Maloy has taken steps to
correct the violation and the fine be reduced to $250.00.

H. DISCIPLINARY CASES:
Against: Apple Restoration, Inc.
Complaints Filed by: Staff
Investigator: Monica Barrios
This case was removed; no action was taken.
Against: Prosperity Ventures, Inc, d/b/a Tropical Screen, Jude Kleila Qualifier
Violation: Section: 2-5-19 Prohibited Activities Sub-Sections (9) and (12)
Section 2-5-20 Revocation or suspension of certificates of Competency
Subsection (11)

Investigator: Monica Barrios
Ms. Barrios provided two photos. On 3/3/08 Mr. Jude Kleila was found installing a pool enclosure without a permit.
She has not had any communication with the contractor. As of 7/15/08 the pool was enclosed without a permit.

Staff’s Recommendation:
If Mr. Kleila is found in violation it is the recommendation of staff that his certificate of
competency be revoked in St. Lucie County.
No one was present to represent Mr. Kleila.

Mr. Mitchell made a motion in reference to Mr. Jude Kleila, d/b/a/ Prosperity Ventures, Inc., that the Board
makes the following determination: after hearing the facts in the case, the reports and testimony of staff
in regard to the existence of a violation, we determine the violation in fact did occur and the alleged
violator committed the violation. Mr. Jude Kleila shall have his/her Certificate of Competency revoked in
St. Lucie County.

Violation: Section 2-5-20 Revocation or suspension of Certificates of Competency
And Subsection (3)
Complaint Filed by: Staff
Investigator: Carl Brome
Mr. Brome provided a list of one expired permit. On 4/30/08 staff notified Mr. Morales of Stanislaus Enterprise,
Inc. that the permit needed to be renewed. As of 7/15/08 the permit is still expired.
Staff Recommendation:
If Mr. John S. Morales is found in violation it is the recommendation of staff that the
permitting privileges be suspended until all expired permits are renewed and receive a final inspection. Term of
suspension is not to exceed one year. It is further recommended that this case along with the copy of the Board’s
Order be prepared and sent to the Florida Construction Industry Licensing Board.
No one was present to represent Mr. Morales.

Mr. Langel made a motion in reference to the complaint against John S. Morales that the Board of
Examiners make the following determination: after hearing the facts in the case, the testimony and
recommendation of staff in regard to the existence of a violation, we determine the violation did occur
and the alleged violator committed the violation. John S. Morales shall have his Certificate of
Competency suspended for a period of one year and the Department of Professional Regulation be
notified.
** Mr. Mitchell seconded and the motion carried unanimously.
I. OLD BUSINESS: None
J. NEW BUSINESS:
Ms. Ariyanayagam advised that the Contractor Examining Licensing Board will begin to hold their meetings every
other month starting October, and no meeting will be held in October; a meeting will be held in November, and no
meeting in December. She explained reasons for the change and said that the public must first be notified of this
change in schedule, that staff has made progress catching up with expired permits, and with the reduction of staff,
that preparation for the Code Enforcement Board meetings requires staff to play catch up to prepare the cases for
the Boards. Staff made the recommendation to administration to hold the meetings every other month because of
staff cuts and the reasons stated.

Mr. Mitchell made a motion and recommended with no changes in the economy, should the need arise,
that this Board go back to review meeting every month.
Ms. Ariyanayagam agreed that if staff sees a back-up with contractors they would definitely review the meeting
schedule.

Mr. Dunkelberger clarified the meetings would be held in August, September, and November, 2008. No meetings
are scheduled for October and December, 2008.

Ms. Ariyanayagam again welcomed Mr. Hudspeth to the Board on behalf of staff.
L. ADJOURNMENT:
There was no further business and the meeting was adjourned at 9:30 a.m.
