SUBJECT: Anim41 Registration and Spay/Neuter Programs
As directed by the Board of County Commissioners during its regular meeting of
Mnrch 10, 2009, the Board will consider revisions to the animal registration ordinance and
Spcay/Neuter Program during the Informal Meeting on March 24, 2009. Commissioner
Grande has nsked staff to prepare Q draft ordinance outlining the revisions discussed
during the March 10, 2009 meeting for the Board's review. A copy of draft Ordinnnce No.
09-014 is attached. The proposed ordinance would define a"pet seller" as anyone other
than a registered breeder, governmentnl entity or non-profit agency who offers for sale
one or more dogs or cats during a twelve (12) month period. A pet seller would be required
to obtain an annual license in the sume mnnner ns a breeder. A copy of Ordinance No. 07-
O10 which established the unimal registrntion requirements is also attached.
Current nnimal registration fees were adopted pursuant to Resolution No. 07-077.
Attached to this memorandum is a copy of proposed Resolution No. 09-103 which would
amend the fee schedule. Under the proposed amendments to the fee schedule, the annual
fee for a pet seller would be set at $100.00, equal to the annual breeder fee, and fees
would be wuived for sterilized dogs and cats owned by a household with an annunl income of
125% or below the poverty guidelines established by the United Stuted Depnrtment of
Henlth and Human Services (DHHS).
As the Board is aware, the revenue generated from animal registrations is used to
fund the Spay/Neuter Program. Under the current program, vouchers nre available for
free spray and neuter procedures offered by the Humane Society and participating local
veterinarians. With the exception of (ow income households, it has been suggested the
BoQrd consider approving a co-pay for participation in the Spuy/Neuter Program.
Attached to this memorandum is a copy of the revised program application which would
provide for a co-pay. The revised application incorporates the DHHS poverty guidelines
which would be used to determine eligibility for waiver of the co-pay.
Staff requests further direction from the Bourd on how it wishes to proceed
regarding to animal registration nnd the Spay/Neuter Program.

Commissioners to estubtish programs providing for the henlth, safety, and general welfnre
of the residents of St. Lucie County; and,
WHER~AS, Chnpter 1-4 (Animctls und Fowl) of the St. Lucie County Code of
Ordincances and Compiled Laws (the "Animal Control Ordinance") provides for the
regulation and control of animals in the unincorpornted nrens of St. Lucie County; and,
WHEREAS, on this 3rd dny of April, 2007, nt a duly advertised public hearing, the
Board determined thnt it~ is necessQry and in the public interest to nmend the Animal
Control Ordinance to establish n differential registration/identificntion tag program for
dogs and cats as an nppropriate mectns of (a) promoting public heQlth and safety, (b)
facilitating. the identification und return of strny and Inst dogs nnd cats, and (c)
encouraging spaying and neutering to reduce the pet overpopulation in St. Lucie County in
order to effectively enforce the provisions of Chapter 1-4.

Section 1-4-16 (Definitions) of Chapter 1-4 of the St. Lucie County Code of
Ordinances and Compiled Laws is hereby umended to add a definition of "breeder" as
follows:
Section 1-4-16. Definitions.
Breeder. Any person who owns, keeps, harbors, maintnins, or hns custody of anX
doq or cut which produce n totnl of two or more litters during n twelve (12) month period.
PART C. AMENDMENT OF CHAPTER 1-4 (ANIMALS AND FOWL) OF THE CODE
OF ORDINANCES AND COMPILED LAWS OF ST. LUCIE COUNTY, TO
CREATE ARTICLE III, (REGISTRATION).
Article III (Registration) of Chapter 1-4 of the St. Lucie County Code of
Ordinances and Compiled Luws is hereby created to read as follows:
ARTICLE III. REGISTRATION
Section 1-4-29. Registrntion required; effect on dogs or cnts in existence on the
effective dnte of the ordinnnce.
Except ns otherwise provided herein, it shall be unlawful for any pe"rson to own,
keep, harbor, mnintain, or have custody of an~dog or cat four (4) months or older, unless
such dog or cat hcis been currently reQistered in accordance with the provisions of this
ordinnnce. Any dog or cnt four (4) months or older on the effective dcate of this ordinance
and which has n current vnlid rabies vaccination as of the effective date shall be
reqistered in accordance with the ~rovisions of this ordinnnce.

Section 1-4-30. Issuance of nnimnl registration/identification tngs.
~ All owners or custodi4ns of dogs nnd c4ts in the unincorporated areas of St.
Lucie County shall obtain a St. Lucie County reqistration/identificntion tng for each dog
and cat by the nge of four (4) months that they own, keep, harbor, maintain, or have in
custody as follows:
~ Within thirty (30) doys of acquirinq the doq or cat; or
(2) Within thirty (30) days nfter the owner or custodian takes residence
in the unincorporated nreas of St. Lucie County, whichever occurs later.
~ Except as provided herein, registration/identification tags should be
securely fastened about the animnl's neck b~a collar or other device so as to be clearly
visible at all times. Dogs and cats not so registered/identified may be considered stray
and in violution of Section 1-4-22 and may be impounded as therein provided. A vaccination
certificate and if applicable, n sterilization certificnte, issued by a veterinarian must
accompany al) applications for a St. Lucie County registration/identificution taq,
The reqistration/identificntion taq shnll be vnlid for one (1) year from the
date of issuance or date of the rabies vaccination, whichever is earlier for unsterilized
anim4ls and for the lifespnn of sterilized animals.
~ Animnl owners or custodians shal) purchnse a reqistration/identification taq
directl~y from (1) any participatinq veterinurians' office displaying the St. Lucie County
Animal Control ~Division Seal, and (2) the Humane SocietY of St. Lucie County, Inc., 100
Savannnh Rond, Fort Pierce, Floridn 34982. Such request shall include proof of current
vaccin4tion nffidavit ns set forth above in Section 1-4-30(b) and n sterilization certificate
du~licate copy, if a~pliccable. Pnrticiputinq veterinarians shall provide the Humane Society
of St. Lucie County, Inc., with a(ist of 411 licenses issued which shall maint4in Q dntabase
of such informntion. The fees for registrntion/identification taqs shal) be established by
resolution of the Board. The County shnll pay pnrticipating veterinarinns nnd the Humane
Society of St. Lucie County, Inc., re~ectively, the sums to be determined by resolution of
the Board fo~ each regisfration/identif ication tag sold.

another nor from one owner to another. Upon transfer of a previously registered nnimal

within which to com~lv with the requirements of this ordinance.
~ Net proceeds accruinq to the County from the sale of cnt or doq
registration/identification tags shall be turned over to the Clerk of the Circuit Court to
be plnced in a fund designate as the "Animal Registration Fund." The proceeds shall be
used for spay/neuter programs in St. Lucie County operated by the St. Lucie County
Humane Societv.

~ Any owner or custodinn who is Q nonresident or temporary resident,
as defined herein~provided that the owner's animu) has been vnccinated for
rabies, which vaccincation remains vQlid under the Inws of St. Lucie Countv
for the durntion of the anticipated stay within the unincorpornted arens of
the County. A"temporary resident" as used herein shall be defined to mean
a person who intends to reside in the unincorporated arens of the County for
ca total ~eriod of less than six months during any twelve-month period. All
other requirements including but not limited to restraint obligntions shnll

~ The ownership, care, custody or maintenance, in the ordinary course
of business, of any animal by n research or veterinary medical facility,
qovernment operated or uuthorized animal shelter, humnne society facilitX,
boarding facilitY, or commercia) pet shop, provided th4t said shelter,
facility, or shop is operatinq in accordance with all applicctble occupationn)
licensing and zoningordinnnces;
(3) Dogs and cuts kept on property zoned AG-1, AG-2.5, AG-5, or PUD
where livestock is permitted; or,
~ Service and/or therapy dogs and cats, includinq but not limited to
guide dogs forpersons with visual impairment.
Section 1-4-31. Breeder registration required
It shall be unlawful for nny_person to oper4te as a cat or dog breeder unless such
person hns been currently registered as a breeder in accordnnce with the provisions of
this ordinance. Any breeder shall be registered in accordnnce with the provisions of this
ordinance.

Section 1-4-32. Issunnce of breeder registrntion certificate.
~a) All breeders of cats nnd/or dogs in the unincorpornted ureus of St. Lucie

~ The breeder registrution number shall be included in all ndvertisements for
sale of nny animals offered for sale or breeding bx the breeder.
~ Breeders shall obtctin ct reqistration certificate directly from (1) anx
participatinq veterinariuns' office displaying the St. Lucie County Animal Control Division
Seal, and (2) the Humane Society of St. Lucie County, Inc., 100 Savnnnah Road, Fort

set forth above in Section 1-4-30(b) and u sterilization certificnte duplicate copy, if
applicable. Participating veterinarinns shall provide the Humane Society of St. Lucie
County, Inc., with Q list of al) licenses issued which shall maintain a database of such
information. The fees for breeder reqistration shnll be established by resolution of the
Bonrd. The County shall pny pnrticipatinq veterinarians and the Humane Society of St.
Lucie County, Inc., respectively, the sums to be determined by resolution of the Bonrd for
ench registrntion certif icute issued.
~ The breeder registration certificate shall be non-transferable.

Specinl acts of the Florida legislature applicnble only to unincorporated areas of St.
Lucie County, and ndopted prior to January 1, 1969, St. Lucie County ordinnnces and St.
Lucie County resolutions, or parts thereof, in conflict with this ordinance are hereby

superseded by this ordinance to the extent of such conflict.
PART D. SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or declared to be
unconstitutional, inoperative, or void, such holding shall not affect the remaining portions
of this ordinance. If this ordinance or nny provision thereof shall be held. to be
inapplicable to any person, property, or circumstance, such holding shnll not affect its
npplicnbility to any person, property, or circumstance.
PART FILING WITH THE DEPARTMENT OF STATE.
The Clerk is hereby directed forthwith to send a certified copy of this ordinnnce
to the BureQU of Administrcitive Code and Laws, Department of State, The Capitol,
TQllahassee, Florida 32304.
PART F. EFFECTIVE DATE.
This ordinance shal) take effect October 1, 2007.

A RESOLUTION ESTABLISHING A FEE
SCHEDULE FOR ANIMAL AND BREEDER
REGISTRATION AN~ PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has
made the following determinations:
1. On April 3, 2007, the Board adopted Ordinance No. 07-010 which amended
Chapter 1-2 "Animuls and Fowl" of the Code of Ordinances of St. Lucie County, Florida by
creating Article III, "Registration" to require registration of dogs nnd cats and breeders
in the unincorporated areas of the County.
2. Subsection 1-4-30(d) of the Code of Ordinances provides for the Board to
establish by resolution a fee schedule for the issuance of registration/identification tags
and registration of breeders pursuant to Ordinance No. 07-010.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St. Lucie County, Florida:
1. The following fee schedule shall apply for issuance of animal
registration/identification tags pursunnt to Chapter 1-4, St. Lucie County
Code of Ordinunces:
A. Sterilized cat or dog -
(1) $10.00 annual fee per animal
~ (2) $25.00 lifetime fee per animal
B. Multiple sterilized pets/one owner -
(1) First sterilized cat or dog -$10.00 unnual fee, $25.00 lifetime
fee
(2) Second sterilized c4t or dog -$8.00 annual fee, $20.00
lifetime fee
(3) Third sterilized cnt or dog -$6.00 annual fee, $15.00 lifetime
fee
C, Sterilized cat or dog with Senior Exemption -$7.50 annual fee per
animal (proof of owner's current ndditionnl homestead exemption for
persons 65 and older pursuant to Section 1-19.3-86, St. Lucie County
Code of Ordinances, required at time of issuance)
D. Non-sterilized cat or dog -$75.00 ctnnual fee per animal
E. Non-sterilized cat or dog with veterinnrian certificate indicating
animal's health or age prevents sterilization -$10.00 annual fee per
animal
F. Breeder's registration -$100.00 annual f ee

2. All fees hereunder shall be paid directly to the collecting entity which shall
in turn remit the funds collected, minus npproved ndministrative expenses,
to the County on a monthly basis.
3. Annual fees shall be due on or before October lst.
4. This resolution shall take effect on October 1, 2007.

AN EFFECTIVE DATE
WHEREAS, the Board of County Commissioners of St. Lucie County, Floridu (the
"Board"), has made the following determinations:
1. On September 29, 1987, the Bourd cidopted Resolution No. 87-184 which
establislied penalties for violations of Article II (Animal Control) of Chapter 1-4 of the St.
Lucie County Code of Ordinances and Compiled Laws.
2. On September 27, 1994, the Bourd adopted Resolution No. 94-210 which
established penalties for violations of provisions added fio Article II (Animal Control) of
Chapter,l-4 pursuant to Ordinnnce No. 94-05.
3. On July 23, 2002, the Board adopted Resolution No. 02-86 which increased
penalties for violations of Article II (Animal Control) of Chapter 1-4 of the St. Lucie
County Code of Ordinances and Compiled Laws to reflect the increased costs of providing
animal control services.
4. On April 3, 2007, the Board udopted Ordin4nce No. 07-010 which
established a registration requirement for dogs and cats in the unincorporated areas of
the County pursunnt to Section 1-4-29 effective October 1, 2007. ~
5. It is appropriate and necessary to establish a penalty for failure to register
an animal as required under Section 1-4-29.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St. Lucie County, Florida, Resolution No. 87-184, as amended, is hereby further umended

COUNTY, a political subdivision of the State of Florida, hereinafter referred to as the "County",
whose address is 2300 Virginia Avenue, Fort Pierce, FL 34982.

A. Provide the Seller with a current and adequate supply of St. Lucie County Animal
Registration Tags and Registration Forms.
B. Provide the Seller with Return Envelopes for mailing the Registration forms and
fees to the County on the first business day of the new month.
D. Reimburse the Seller of Registration Tags for the cost of Postage in a timely
manner when Registration forms and fees for the current month are mailed to the
St. Lucie County Public Safety Department on the first business day of the new
month.
2. Resuonsibilities of the Selier•
A. Sell St. Lucie County Animal Registration Tags provided by the County.
B. Provide the St. Lucie County Public Safety Department with all pertinent
information for each Registration Tag soid using the Registration Forms provided
by the County. The Seiler may retain up to $2.00 for each tag sold to cover its
administrative costs.
B. Provide the St. Lucie County Public Safety Department with a receipt or
documentation for postage fees when mailing the Registration forms and fees to
the County on the first business day of the new month.
C. Ensure all documentation and fees are mailed to the St. Lucie County Pubiic Safety
Department on the first business day of each new month.
Either party may terminate this Agreement upon thirty (30) days prior written notice to the other
party. The Seller shall return aii unsold tags and final documentation to the County within thirty
30) days of the effective date of termination.

will be contacted directly by St. Lucie County Animal Control. ~

14-16 (DEFINITIONS) TO ADD A DEFINITION FOR
"PET SELLER"; AMENDING SECTION 1-4-31 (BREEDER
REGISTRATION REQVIRED) TO REQUIRE PET SELLER
REGISTRATION; AMENDING SECTION 1-4-32
(ISSUANCE OF BREEDER REGISTRATION CERTIFICATE)
TO PROVIDE FOR ISSUANCE OF PET SELLER
REGISTRATION CERTIFICATES; PROVIDING FOR
CONFLICTING PROVISIONS; PROVIDING SEVERABILITY
AND APPLICABILITY; PROVIDING FILING WITH THE
~EPARTMENT OF STATE; PROVIDING AN EFFECTIVE
~ATE; PROVIDING ADOPTION; AND PROVIDING
CODIFICATION.
WHEREAS, Section 125.01, Florida Statutes, Quthorized the Bourd of County
Commissioners to establish programs providing for the heQlth, sufety, and general welfare
of the residents of St. Lucie County; and,
WHEREAS, Chapter 1-4 (Anim4ls nnd Fowl) of the St. Lucie County Code of
Ordinances and Compiled Laws (the "Animal Control Ordinance") provides for the
regulation und control of animals in the unincorporated areas of St. Lucie County; and,
WHEREAS, on April 3, 2007, the Board adopted Ordinance No. 07-010 which
estublished a differential unimal registration/identificntion tag program for dogs and cats
in the unincorporated areas of the County as an appropriQte means of (a) promoting public

Section 1-4-16 (Definitions) of Chapter 1-4 of the St. Lucie County Code of
Ordinances and Compiled Laws is hereby amended to add a definition of "breeder" as
follows:
Section 1-4-16. ~efinitions.
Breeder. Any person other than a pet seller registered pursunnt to Section 1-4-31,
as provided herein, qovernmental entity, or non-profit corporation which has been granted
501.C(3) status by the Internal Revenue Service, who owns, keeps, harbors, maintains, or
has custody of 4ny dog or cat which produce a total of two or more litters during a twelve
(12) month period.
Pet Sel%% Any person or entity, other than a registered breeder pursu4nt to
Section 1-4-31, governmental entity, or non-profit corporation which h4s been granted

Ordinances and Compiled Laws is hereby amended by amending Section 1-4-31 to read as

seller shall be registered in accordance with the provisions of this ordinnnce. A breeder
who is reqistered pursuant to this ordinance shall not also be required to reqister as a pet
seller.
Section 1-4-32. Issuance of breeder nnd/or pet seller registration certificnte.
(a) All breeders e#~e#~-e+~e~-deg~ and pet sellers in the unincorpornted nreas
of St. Lucie County shall obtain an annual St. Lucie County breeder or pet seller, as
appropriate, registrntion certificate on or before October lst of each yenr.
(b) The registration number shnll be included in all
advertisements for sale of any animals offered for snle or breeding by the breeder or et
seller.
~ Breeders and pet sellers shall obtain a registration certificate directly from
(1) any participuting veterinarians' office displnying the St. Lucie County Animal Control
Division Seal, e~ (2) the Humane Society of St. Lucie County, Inc., ,
re~~-R+e~E°, ~"O~~ or (3) the St. Lucie County Animal Control Division. Such
request shall include proof of current vaccinution affidavit as set forth above in Section 1-
4-30(b) and a sterilization certificate duplicate copy, if applicable. Participating
veterinarinns shall provide the . , St. Lucie Countv
Animal Control Division with a list of all ~e~ reqistration certificates issued which
shnll mcaintain a database of such information. The fees for breeder and pet seller
registration sh411 be estublished by resolution of the Board. The County shal) pay
participating veterinarians and the Humane Society of St. Lucie County, Inc., respectively,
the sums to be determined by resolution of the Board for each registration certificate
issued.
(d) The ~edet~ registration certificate shull be non-transferable.
~ Net proceeds accruing to the County from the sQle of breeder and pet seller
registration certificates shall be turned over to the Clerk of the Circuit Court to be
placed in a fund designate as the "Animnl Registration Fund." The proceeds shall be used
for spay/neuter progrnms in St. Lucie County operated by the St. Lucie County Humane
Society.

PART C. CONFLICTING PROVISIONS.
Special acts of the Florida legislature applicnble only to unincorporuted areas of St.
Lucie County, nnd adopted prior to JnnuQry 1, 1969, St. Lucie County ordinances and St.
Lucie County resolutions, or pnrts thereof, in conflict with this ordinance nre hereby
superseded by this ordinance to the extent of such conflict.
PART D. SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any re4son held or declnred to be
unconstitutional, inoperative, or void, such holding shall not affect the remaining portions
of this ordin4nce. If this ordinance or any provision thereof shull be held to be
inapplicable to any person, property, or circumstance, such holding shall not affect its
applicability to nny person, property, or circumstance.

WHEREAS, the Board of County Commissioners of St. Lucie County, Floridu,
has made the following determinutions:
1. On April 3, 2007, the Board adopted Ordinance No. 07-010 which
amended Chapter 1-2 "Animals and Fowl" of the Code of Ordinunces of St. Lucie
County, Florida by creating Article III, "Registration" to require registration of
dogs and cats and breeders in the unincorporated areas of the County.
2. Subsection 1-4-30(d) of the Code of Ordinances provides for the
Board to establish by resolution a fee schedule for the issuance of
registration/identification tags and registrntion of breeders pursuant to
Ordinance No. 07-010.
3. On April 3, 2007, the Board ndopted Resolution No. 07-077 which
established a fee schedule for registration pursuant to Section 1-4-30(d) of the
Code of Ordinances.
4. On XX XX, 2009, the Board adopted Ordinnnce No. 09-014 which
umended Article III, Chapter 1-2 of the Code of Ordinances to establish
registrntion requirements for pet sellers.
5. It is necessary to nmend the fee schedule set forth in Resolution No.
07-077 to establish a fee for pet sellers.
6. The Board has determined it is appropriate to further amend
Resolution No. 07-077 to provide for a reduced dog and cat registration fee for
low income persons.

BACKGRGIJNU:
The Economic Development Ad Valorem Tax Exemption Program was first approved by
the Board of County Commissioners in October of 1992 (Ordinance No. 92-24) in an effort
to stimulate job growth in St. Lucie County. In November 2002, after the voters of the
County approved the continuation of the program. the BOCC approved the continuation of
the program (Resolution No. 02-196). The program was revised in October 2003
(Resolution No. 03-258j. The program is structured to provide a tax exemption to
qualifying businesses to expand or relocate to St. Lucie County.
The revisions requested at this time include the following: change in rnanagement from
Economic Devefopment Division to Grants and Disaster Recovery Department. and the
addition of a bonus incentive for hiring local residents or local contractors.
FUNDS AVAILABLE:
No funds required at this time.
PREVIOUS ACTION:
The Economic Development Ad Valorem Tax Exemption was last revised in October
2003.
RECOMMENDATION: Staff recommends that the Board approve the revised Economic Development Ad
Valorem Tax Exemption Program as provided in the attached backup and request the
County Attorney to redraft the basic grant agreement.

I. Proaram fntent
The St. Lucie Baard of County Commission, in Florida be(ieves that local government should support
economic growth by providing an incentive for County employment opportunities that will lead to the
improvement in the quality of life for County residents, positive expansion of the economy in terms of
new jobs and improvements to real and personal property, and creating jobs in such a way so as not
to disadvantage existing businesses while recognizing that productive competition fosters economic
growth.
The Economic Development Ad Valorem Tax Exemption is a local option tax incentive for new or
expanding businesses, which may be granted at the sole discretion of the Board of County
Commissioners. Incentives could be provided to businesses of diverse industries that would have a
positive impact on the County's economy.
Any exemption granted may apply up to one hundred percent (100%) of the assessed value per
Section 9 and Section 12 of Article VII, of the Florida State Constitution, of all improvements to real
~roper"ty mad~ ~y or ror the use of a new business and of alf tangibie personal property or sucn new
business, or up to one hundred (100%) of the assessed vaiue of all added improvements to real
property made to facilitate the expansion of an existing business and of the net increase in all tangible
personal property acquired to facilitate such expansion of an existing business, provided that the
improvements to real property are made or the tangible personal property is added or increased after
the date of the preliminary application or one year prior to the filing of the final application. Property
acquired to repface existing property may not be considered to facilitate a business expansion. The
exemptions may not appiy to improvements to real property made by or for the use of new or
expanding businesses when such improvements have been included on the tax rolis prior to the
preliminary application or one year prior to the fifing of the final application.
The ability to receive an exemption for the period granted is conditioned upon the app(icant's ability to
maintain the new business or the expansion of an existing business as defined in Section III.E. and H.
throughout the entire exemption period. The applicant will be required to submit a report on an
annual basis to the County evidencing satisfaction of this condition. The annual report shall be
submitted on the attached form. In addition, any business granted an exemption will furnish to the
County or its designee such information as the County or its designee may reasonabfy require for the
purpose of determining continued performance by the business of the conditions stated in the
exemption orciinance and the representations made in the appfication.
II. Enactment Authoritv
Article VII, Section 3 of the Constitution of the State of Florida and Section 196.1995 Florida Statutes,
empower the County to grant Economic Development Ad Valorem Tax Exemptions after the electors
of the County, voting on the question in a referendum, authorize such exemptions. In a referendum
held on this issue on November 5, 2002, the voters of St. Lucie County authorized the County to
grant Economic Development Ad Valorem Tax Exemptions. This exemption program is applicable in
all areas of St. Lucie County where the County is the taxing authority.
The exemption applies .only to taxes levied by St. Lucie County, where the County is the taxing
authority. The exemption does not apply to taxes levied by the school district or water management
district, fire district or to taxes levied by the voters for the payment of bonds or other special taxes
authorized by a vote of the electors pursuant to Section 9 and Section 12. Articie VII, of the Florida
State Constitution.
The Ordinance (Ordinance No. 92-24) that impiements the tax abatement program is entitled
"Economic Development Ad Valorem Tax Exemption Ordinance of St. Lucie County, Florida".

il(. Definition of Terms
The following words, phrases, and terms shall have the same meanings attributed to them in current
Florida Statutes and the Florida Administrative Code, except where the context clearly indicates
otherwise:
A. Applicant - Any person, firm, partnership, or corporation that files an application with the
St. Lucie Baard of County Commissioners seeking an economic deveiopment ad
valorem tax exemption.
B. Bonus exemption for empfovment of St Lucie Countv residents and St. Lucie Countv
contractors.
1. If a business can verifv after the first vear of exemption that sixtv percent (60%}
of its full-time empioyees have been St Lucie County residents for at least six (6)
months prior to empiovment then the business shall be entitled to one additional
year from the standard exemption as set forth on Attachment 1.
2. If a business can verifv after the first vear of exemption that eiqhtv percent (8Q%)
of its full-time emplovees have been St Lucie Countv residents Tor at least six (6)
months prior to emploVment then the business shall be entitled to two additional

3. If a business can verify that it used a licensed qeneral contractor whose arincipal
place of business is focated in St Lucie County to construct the improvements
then the business shall be entitfed to one additional vear from the standard
exemption as set forth on Attachment 1.
~C. Business - Any activity engaged in by any person, firm, partnership, corporation, or
other Business organization or entity, with the object of private or public gain, benefit, or
advantage, either direct or indirect.
~D. County - St. Lucie County.
~E. Department - The Fiorida Department of Revenue.
€F. Exqansion of an Existinq Business:
1. As defined in Section 196.012(16). Fforida Statutes. an Expansion of an Existing
Business means:
(a) A business establisning ten (10j or more jobs to empioy ten (10j or more
ful!-time employees in this State, which manuractures, processes,
compounds, fabricates, or produces for sale items of tangibfe personal
property at a fixed location and which comprises an industrial or
manufacturing pfant;
(b ~ tiny business estabfishing twent~~-five (25j or more jobs to employ twenty-
five (25) or more ful{-time empioyees in this State. whos~ Saies ractor. as
defined by Section 22Q.15;5;. ~lori~~ Statutes ro~ tn~ r'acifitv witn respecT
to which it requests an economic devefopment ad valorem tax exemption
is fess than 0.~0 for each year the exemption is claimed; or
(c) Any business located in an Enterprise Zone that increases operations on a
site collocated with a commercial or industrial operation owned by the
same business.
2. ~ny expansion of an existing business must increase operations on a site
collocated with a commercial or industrial operation owned by the same
business, resulting in a net increase in employment of not fess than ten percent
(10%) or an increase in productive output of not less than ten percent (10%).
The ten percent (10%) requirement does not appfy to Enterprise Zones.
€G. Extraordinarv as determined bv St. Lucie Board of Countv Commissioners.
~H. Improvements - Physical changes made to raw land, and structures placed on or under
the iand surface.
~ I. New Business - As defined in Section 196.012(15), Fiorida Statutes, a new business
means:
1. A Business estabiishing ten (10) or more jobs to employ ten (10) or more full-time
employees in this State, which manufactures, processes, compounds, fabricates,
or produces for safe items of tangibie personal property at a fixed locaiion and
which comprises an industrial or manufacturing plant; or
2. Any business estabfishing twenty-five (25) or more jobs to employ twenty-five
(25) or more ful!-time empfoyees in this State, whose Sales Factor, as defined by
Section 220.15(5), Fiorida Statutes. for the facility with respect to which it
requests an economic development ad vaiorem tax exemption is less than 0.50
for each year the exemption is claimed; or
3. An office space in this State owned and used by a corporation newly domiciled in
this State; provided such office space houses fifty (50) or more full-time
empfoyees of such corporation; or
4. A business located in an Enterprise Zone (pursuant to Section 290.0065, Fiorida
Statutesl.

other commercial or industrial operation owned by the same Busin~ss.
