Clippinger Certificate of Competency # 25430 State License # CGC050816 Investigator: Carl Brome Staff Recommendation: The permitting privileges to be suspended in St. Lucie County until the expired permit receive a final inspection. It is further recommended that a copy of the findings of facts in this case be sent to the State Department of Business and Professional Regulations. Type of Contractor: General Contractor Licensed in St. Lucie County since: 9/15/2008 Type of Permits: Building Permit (Renovation to SFR) Total Number of Permits Expired: 1 First Notification to the Company: 1/30/2007 Follow-ups: Letters, Phone calls. Last call was on 5/6/2009. Violation: SLC CCL 2-5-20 Revocation or Suspension of Certificate of Competency Sub section (3) Willfully disregards and violates an applicable state or local building code, regulation or law. *SLC Land Development Code: 11.05.01 (2) a. Building Permits shall expire and become null and void if work authorized by such Building Permit is not commenced, having called for and received a satisfactory inspection, within six (6) months from the date of issuance of the permit, or if the work is not completed within eighteen (18) months from the date of issuance of the Building Permit, except that the time may be extended by the building official. (8) Abandons a construction project in which the contractor is engaged or under contract as a contractor. A project shall be considered abandoned ninety (90) days after the contractor terminates the project without just cause or without proper notification to the owner, including the reason for termination, or fails to perform work under the contract for ninety (90) consecutive days. (11) Proceeds on any construction job without first obtaining and posting the required county building permits and scheduling required inspections. CLIPPINGER A SESWALL INSPECTION SERVICE, INC 25430 CGC050816 THIS ACTION AGAINST LAWERENCE S CLIPPINGER WITH HOMES DOCKS & MORE CONSTRUCTION INC WHO HOLDS A LICENSE AS GENERAL CONTRACTOR IS THE RESULT OF AN INVESTIGATION BASED UPON A COMPLAINT FILED BY THE SLC STAFF AND RESIDENT: DELILA MCKENNA AT 6311 OLEANDER AVE. AN INVESTIGATION REVEALED THE FOLLOWING VIOLATIONS: Sec. 2-5-20: Revocation or suspension of certificates of competency. (3) Willfully disregards and violates an applicable state or local building code, regulation or law. (8) Abandons a construction project in which the contractor is engaged or under contract as a contractor. THE REVISED CONTRACT WITH HOMES DOCKS & MORE INC AND THE HOMEOWNER WAS SIGNED ON TH FEBRUARY 5 2007 FOR RENOVATIONS TO THE SINGLE FAMILY RESIDENCE. THE HOMEOWNER TO DATE HAS PAID $40,500 OF THE $45,859 AGREED AMOUNT TO THE CONTRACTOR. APPROXIMATELY 25 PERCENT OF THE WORK STILL NEEDS TO BE DONE. THE OWNER HAS BEEN HAVING A DIFFCULT TIME HAVING THE CONTRACTOR TO FINISH THE WORK & RETURN HER CALLS. MS MCKENNA WANTS THE JOB COMPLETED AS CONTRACTED. STAFF HAS BEEN COORDINATING WITH THE CONTRACTOR AND THE HOME OWNER BUT THE PERMIT STILL REQUIRES BEING REACTIVATED AND FINALED. IF MR CLIPPINGER IS FOUND IN VIOLATION OF THE ABOVE CHARGES IT IS THE RECOMMENDATION OF THE CODE COMPLIANCE DIVISION THAT THE PERMITTING PRIVILEDGES BE REVOKED IN ST LUCIE COUNTY UNTIL THE PERMIT IS RENEWED AND HAVE RECEIVED A FINAL INSPECTION. THE TERM OF INSPECTION IS NOT TO EXCEED ONE YEAR. IT IS FURTHER RECOMMENDED THAT A COPY OF THE FINDINGS OF FACTS IN THIS CASE BE SENT TO THE STATE DEPARTMENT OF BUSINESS AND . Complaint(s) filed by: Staff Investigator: Monica Vargas Barrios Staff Recommendation: To revoke the certificate of competency in St. Lucie County. Qualifier: George M. WHITE DBA CONFIDENT CLEANERS INC DBA OASIS ALUMINUM AND SCREEN 24341 FOR THE RECORD I AM SUBMITTING THE LIST OF 1 EXPIRED PERMIT. ON OCTOBER 13, 2008 STAFF NOTIFY VIA MAIL TO MR. WHITE WITH CONFIDENT CLEANERS INC DBA OASIS ALUMINUM AND SCREEN ABOUT THE EXPIRED PERMIT HE HAS IN THE COUNTY. THE PERMIT NEEDED TO BE RENEWED AND RECEIVE FINAL INSPECTION. ON FEBRUARY 10, 2009 STAFF NOTIFIED MR. WHITE VIA MAIL AGAIN THAT THE PERMIT IS STILL EXPIRED. ON APRIL 7, 2009 STAFF SENT THE NOTICE TO APPEAR BEFORE THE LICENSING BOARD. STAFF HAS HAD NO COMMUNICATION WITH MR. WHITE. THE PERMIT REMAINS EXPIRED. THIS IS IN VIOLATON OF SECTION 2-5-20: Revocation or suspension of certificates of competency. (3)Willfully disregards and violates an applicable state or local building code, regulation or law. IN THAT HE HAD VIOLATED SLC LDC 11.05.01 2A Time Limitations of Building Permits: IF MR.
