II. Minutes

Review the minutes from the June 18, 2009 regular meeting, for

approval.

Mrs. Hammer motioned to approve the minutes with minor corrections.

Chairman Mundt introduced to the Commission St. Lucie County’s new Assistant

County Administrator Christopher Steers.

III. Public Hearings

A. Ordinance No. 09-019
19
An ordinance establishing regulations setting forth the procedure for Zoning in
20
Progress and Planning in Progress and application of same; providing for
21
application of exemption for same; providing for a procedure to assert property
22
owner rights; providing for durations; and providing for an effective date.

Ms. Young, Assistant County Attorney stated that the purpose for this ordinance is to
25
provide for a temporary suspension of various development permit applications when
26
the county is considering proposed changes to the Land Development Code,
27
Comprehensive Plan, Zoning Atlas and Planning Analyses to establish a procedure so
28
the county can have a “status quo” in place while the above items are being reviewed if
29
it appears that what is being proposed would change the conditions of the development
30
applications.

Ms. Young stated that this is a two (2) step process. The first is Zoning in Progress
33
(ZIP) or Planning in Progress (PIP) which is when an issue may be identified with the
34
Board initiating the process. The County Administrator, Planning and Zoning
35
Commission, Growth Management Director or the County Attorney can bring the issue
36
to a Board to request a ZIP or PIP resolution be adopted.

Ms. Young gave details of the time table of this process to the Commission stating that
39
a Temporary Suspension Order (TSO) would go through the standard ordinance
40
adoption procedure. If the TSO was adopted it would suspend most pending
41
applications while the Board is considering whether the proposed amendments would
42
be adopted.

Mr. Satterlee, Growth Management Director stated this would be a useful tool not

something that would be used a lot and this option is a better alternative than declaring
2
a moratorium which creates uncertainty among all involved.

Chairman Mundt opened the public hearing.

Johnathan Ferguson, Attorney and resident of St. Lucie County opposed this ordinance.
6
He stated that this was one of the lousiest ordinances the county has come up with,
7
sending a horrible message to anyone thinking of developing in St. Lucie County.

Chairman Mundt closed the public hearing.

Staff and the Commission had a lengthy discussion regarding the pros and cons of this
12
proposed ordinance.

Ms. Morgan motioned to return this document back to staff for further refinement
15
and to continue this item to September 17, 2009 at 6:00 p.m. or as soon thereafter
16
as possible.

IV. Other Business

Mr. Satterlee updated the Commission on Senate Bill 360. He also informed the
24
Commission that Chapters 10, 11 and 12 of the St. Lucie County Land Development
25
Code is temporarily being put on hold in order for Mr. Steers to become familiar with the
26
process.

Chairman Mundt asked if Mr. O’Neill responded to this month’s quorum call and
29
questioned his number of absences.

Ms. Milone believed he did not.

Mr. Mundt will speak to Commissioner Dzadovsky regarding this matter.
