Residential Contractor Ms. Ariyanayagam explained that Mr. Johnson had provided documentation and letters of recommendations from various commercial contractors, a building official, attorneys, engineer and neighbors attesting to his work ethic and moral character but had not taken the exam for a Residential Contractor license. He asked the Board to consider his request based on his previous experience and the fact that he holds licenses for Concrete Finishing, Masonry and Carpentry, and to be grandfathered in as a Residential Contractor license. He took the exam for Concrete Finishing in 1991, the Masonry exam in 1983 and was approved by the Board; the Carpentry license exam was waived in 1992 by the Board. Mr. Davis commented the Residential license was above a sub-contractor license, and asked if the Board had previously received these types of requests, and if so, how they were acted on. He thought this was asking for something that’s a greater standard than a subcontractor and asked why it would be considered. Ms. Ariyanayagam said these requests do not usually come before the Board when applicants don’t take the Exam, however if an applicant requests coming before the Board to state their case, then staff will do so, and it is up to the Board to make a decision. Staff has not approved any licenses of this type to be grandfathered in. Mr. Mitchell asked if staff was recommending approval. Ms. Ariyanayagam explained it was before the Board for their review for a decision on approval. Johnny Johnson, 4504 Livinia Ave., Fort Pierce, Fl., was sworn in by Ms. Goycochea. Mr. Johnson explained the history of his licenses, and about being grandfathered in. As a Black contractor whose education was interrupted by serving in the War, he worked in the construction business doing commercial and industrial work. When he was coming up there were no Black contractors in St. Lucie County. He said he was not grandfathered in as a subcontractor, each license was as a specialty contractor. He has been in business for over 20+ years, and has never had any problems recorded against him. He was asked years ago if he wanted to convert his licenses to be a residential contractor, he did not want to do that at that time, because he made more money doing what he was doing. He’s worked for many contractors throughout the State. Mr. Dunkelberger clarified the difference between the residential license and the three licenses Mr. Johnson holds and what he is allowed to do. Ms. Ariyanayagam explained a residential contractor can build a single family residence up to two stories and anything within that scope is allowed. Mr. Johnson holds is Specialty Trade Licenses only regulated in St. Lucie County, whereas a residential contractor license must be registered through the State. Mr. Davis advised the scope of the residential license and explained the exam for the license verifies the extent of knowledge and ability of the applicant to operate a business, business law and finance issues. The Board has the responsibility to assure that an applicant has these levels of understanding to operate a business. Mr. Davis commented on the broader scope of a residential license being registered and licensed through the State, requiring testing to verify their ability to pass the test standards. Mr. Mitchell assured Mr. Johnson that the Board was not questioning his integrity, experience or ability, and that there are minimum standards required by the State that the Board has to adhere to. He suggested that an Oral test versus a written test might be an option. He asked Ms. Lueke to address any previous grandfather clause for licensing in the County. Ms. Lueke knew of no records of any clause from meetings in the past for contractors being grandfathered in for licensing. She cautioned the Board on setting a precedent for others for granting a residential license without taking an exam, and advised that any consideration would have to articulate their reason for doing so, and articulate whatever special circumstances for the granting of a license would have to be included in their Page 3 of 9 CONTRACTOR EXAMINING BOARD October 21, 2009 recommendation because the Ordinance requires an exam. Mr. Davis confirmed there was no clause that accommodates that action. Mr. Johnson reiterated his past 25 years experience and said he had to cut his education in order to go to work, and serve in the military and thought he was being penalized for not having an education. That his experience on the job counted for his ability to be considered and recommended for approval. Mr. Johnson asked if he could have an attorney look into the grandfather clause. ? Motion was made by Mr. Mitchell to deny the applicant’s request for a Certificate of Competency for a Residential License Approval by Review. ** Mr. Difrancisco seconded and the motion. *** Ms. Ariyanayagam commented that exams for licenses for particular categories of Specialty Trades have previously been waived by the Board and only granted for those Specialty Trades which are regulated by St. Lucie County. She agreed with the County Attorney’s advice that we need to be very careful with setting a precedent with Licenses regulated by the State. ** A voice vote was taken on the motion: Mr. Dunkelberger-yes; Mr. Davis-yes; Mr. James-yes; Mr. Curtis- yes: Mr. Mitchell-yes; Mr. Difrancisco-yes; Mr. Hudspeth-yes; The motion carried unanimously. F. CITATION APPEALS Against: Hugo A. Broatch, 143 N. Naranja, St. Lucie County Tenant at above address Complaint Filed by: Investigator, Carl Brome Violation: Engage in a business or act in the capacity of a contractor without being duly registered or certified. Recommendation: $500.00 fine to be paid within 30 days of the date of this Board’s meeting. Letter – Attachment #1 - from Home owner. Mr. Brome reviewed the citation which was issued on 8/18/09, following a complaint that Mr. Broatch was doing work on the property. There was no permit for the work being performed and Mr. Broatch is not a licensed contractor, which is violation of SLC 2-5-5. A Stop Work Order was issued with a citation in the amount of $500.00. Mr. Broatch was advised that a permit and a licensed contractor was required for the work being done to the property. Mr. Brome spoke with the homeowner, Ms. Sawsan Moussa, who was present with Mr. Broatch to explain. On 8/26/09 a letter was received from Ms. Moussa requesting the citation be waived. A letter was sent on 9/8/09 requesting that Mr. Broatch appear at today’s meeting. Staff’s position is the citation was issued correctly since Mr. Broatch does not hold a Certificate of Competency in St. Lucie County. Ms. Ariyanayagam who was present with Mr. Brome when the citation was issued, confirmed there were new walls being built, there was evidence of demolition, and work started on the renovation. In addition, after the Stop Work Order was posted, work continued on the property without a permit. She concurred that the citation was issued correctly. ***Photos of the work done on the interior and exterior of the residential property were displayed. st Ms. Sawsan Moussa, 14500 SW 71 Street, Miami, Fl, 33183, was sworn in by Ms. Goycochea. She said they bought the property in foreclosure, it was abandoned, the real estate agent said they could go ahead and repair it, she was unaware they needed a permit to do that. The house was not livable and they tried to fix it to protect it. Ms. Moussa discussed her problem with pulling a permit. Mr. Davis said throughout the State there are unlicensed contractors repairing homes without a permit, and the explanation of not knowing what was required prior to renovation, is the same in St. Lucie County and throughout the State of Florida. Construction can not begin without a licensed contractor and a permit. Mr. Hugo Broatch, 143 N. Naranja, was sworn in by Ms. Goycochea. Mr. Broatch had difficulty with English and Ms. Barrios volunteered to translate. He was staying with the Moussas, he cleaned up and fixed it up in appreciation for allowing him to stay there. Page 4 of 9 CONTRACTOR EXAMINING BOARD October 21, 2009 Mr. Davis requested that comments be directed to the issue of the citation, which is operating without a license and without a permit. That his actions went beyond cleaning, a demolition needs a permit, and they need to go through channels for renovating the home. Ms. Ariyanayagam said Ms. Moussa was told they required a permit and that the tenant was cited because he could not act as a contractor without having a license, and work continues on the property. Mr. Davis commented they could be cited again, that the Board is trying to guard against this type of activity. ? Mr. Difrancisco made a motion to deny the request based on the facts and findings, and the citation stands. ** Mr. Mitchell seconded and the motion carried unanimously. Mr. Davis advised Ms. Moussa if they are continuing to work they need to stop, the property will be monitored for activity, and it could come back before this Board. They need to go through the proper channels and have a licensed contractor doing the work, with proper permitting. Ms. Moussa was advised to speak with staff concerning payment of the citation. Against: Gary W. Holloway 6251 N. US Highway #1 Complaint Filed by: Investigator, Carl Brome Violation: Engage in a business or act in the capacity of a contractor without being duly registered or certified. Recommendation: $500.00 fine to be paid within 30 days of the date of this Board’s meeting. Letter – Attachment #2 Companion Case: Against: Roger K. Johnson 6251 N. US Highway #1 Complaint Filed by: Investigator, Carl Brome Violation: Engage in a business or act in the capacity of a contractor without being duly registered or certified. Recommendation: $500.00 fine to be paid within 30 days of the date of this Board’s meeting. Letter – Attachment #2 Mr. Brome advised of the two companion cases listed above at the same location. On 8/3/09 Mr. Brome responded to a complaint at the property at 6251 N. US Highway #1 and he observed the two men working on the property. Mr. Johnson was engaged in drywall work, requiring a Drywall license and Mr. Holloway was running telephone lines which requires a Communication and Sound license. Both men were working for Mr. Bob Beringhaus, of A Beautiful Home & Pool, Inc. A permit is required for interior work including plumbing and electrical work. Neither Mr. Johnson nor Mr. Holloway are licensed contractors, which is in violation of SLC 2-5-5. A Stop Work Order and a citation for $500.00 was issued for each Mr. Holloway and Mr. Johnson for working without a Certificate of Competency in St. Lucie County, as well as performing work without the required permit. This was also explained to Mr. Beringhaus. On 8/29/09 a letter was received from Mr. Beringhaus requesting an administrative hearing. It is staff’s position that the citations were issued correctly, as neither Mr. Johnson nor Mr. Holloway hold a Certificate of Competency in St. Lucie County. Photos were displayed of the commercial property on US #1. The interior work was discussed. Bob Beringhaus, A Beautiful Home & Pool, Inc., 1719 Sunset Isles, Fort Pierce, Fl., was sworn in by Ms. Goycochea. Mr. Beringhaus said he rented the property as seen in the photos, the interior walls were up when he rented it, and they were attempting to open up a construction company. The men sanded the drywalls already there, and didn’t know they needed a permit for sanding. He wasn’t aware the telephone lines needed a permit. Since the stop work order, they haven’t done any work, are attempting to fix all the problems and follow all the rules and regulations at this time. Mr. Davis said from the photos he saw substantial work left to complete the remodeling and it all needed to be permitted. Mr. Beringhaus explained an issue in applying for a permit: they were attempting to open up a company that held a GC’s license, with that license he spoke with subcontractors for plumbing and electric, but there was no Page 5 of 9 CONTRACTOR EXAMINING BOARD October 21, 2009 company open yet to apply for the permit. Since then, they have opened the company and attempted to apply for the permits, and they were denied. They have applied for a business license. It was not their intention to do anything wrong. Mr. Mitchell asked if the two men were being directed and supervised by Mr. Beringhaus at the site, and if he was paying them. Mr. Beringhaus said he wasn’t paying them, they were helping him out. Mr. Mitchell asked if the fine should be on Mr. Beringhaus, rather than the two men helping him. Mr. Davis said Mr. Beringhaus wasn’t on site when the two individuals were working. Discussion ensued. Ms. Lueke advised that the two individuals had to be his employees and that wasn’t the case because Mr. Beringhaus does not provide Workmen’s Comp, they aren’t on his payroll, and in order to qualify for a Supervisory exception under the Statute certain other circumstances have to exist, which didn’t occur here. Mr. Beringhaus said he rented the building from an individual who said previous work was done by someone who came before him in 2006, who ran out of money. There was no previous permits applied for, and when he spoke with Carl, Carl said it looked like the drywall was up for quite a while. He didn’t know a permit was required for sanding walls. Discussion ensued on cables being pulled, low voltage, and a license required for communication and sound, and the difference between commercial and residential. Mr. Brome advised Beautiful Home & Pool had a State license since 1979, and he explained what was on site when the property was cited. Discussion ensued on what work was completed and what materials remained from the previous tenant prior to the rental. Ms. Ariyanayagam said there is an open case for the previous property owner. Mr. Davis heard there was no material on site, and he asked if there was actual construction going on, there is an appearance of plumbing work, but the two men indicate they were just sanding, and he was concerned about work that could have been done previously and pursuing the citation was difficult. Ms. Lueke asked if the Board needed to separate the two citations, one for drywall and one for wiring. Mr. Davis said that sanding drywall did not require a license, pulling wire required a license. Ms. Ariyanayagam said the Drywall license blends it all together and sanding is finishing and within the license. The wiring needs a licensed contractor to do it. Mr. Beringhaus asked the Board to look at the dates he rented the place, and the dates of the citation issued that it would have been physically impossible to do all the work that was done inside the building. He said a week after he got the citation he had a company qualified by a GC and he could pull permits, and he would not do anything that would jeopardize his ability to do that, they were trying to move forward to get the permits required. He provided Carl with cards he set up for Workmen’s Comp, and W4’s on the guys in anticipation of going to work. Ms. Ariyanayagam referred to the citations being given for complaints against the two unlicensed contractors and she stood by staff’s issuance of the citations as correct for the regulated trades. Further discussion ensued. Mr. Dunkelberger commented on two separate motions, for Mr. Johnson for Drywall and Mr. Holloway for Wiring for Communications and Sound. ? Mr. Dunkelberger made a motion to deny the appeal and uphold the citation for Gary W. Holloway. ** Mr. Mitchell seconded the motion. Ms. Lueke advised the Board that if Gary Holloway wanted to speak on his behalf his right to due process would allow him to do that. Mr. Holloway indicated by nodding his head that he did not wish to speak before the Board. ? A voice vote of the seconded motion was taken: Mr. Dunkelberger-yes; Mr. Davis-yes; Mr. James-yes; Mr. Curtis- yes; Mr. Difrancisco-yes; Mr. Hudspeth-yes; Mr. Mitchell-yes. The motion carried unanimously. * Mr. Dunkelberger made a motion to accept or approve the appeal and deny the citation for Roger Johnson. ** Mr. Mitchell seconded the motion. Mr. Johnson did not wish to speak. The motion carried 5-2. Mr. DiFrancisco and Mr. Hudspeth opposed. Mr. Davis advised that they go through the permitting and licensing process. Ms. Ariyanayagam reminded the Board that citation fines are asked to be paid within thirty days of the Board meeting and read into the record. ? An amendment to the motion F.2 made by Mr. Dunkelberger is for the fine for the citation to Mr. Gary Holloway be paid within thirty days of this Board meeting, per Ms. Ariyanayagam’s advice, was agreed to by Mr. Dunkelberger. ** Mr. Mitchell seconded the amendment to the motion and it carried unanimously. G. DISCIPLINARY CASES: Against: Arroyo Enterprises Inc. Ruben F. Arroyo, County #18827 Building Contractor, Licensed in SLC since 2004 State License # CBC 058507 Violation: Sec. 11.05.01: Building and Sign Permits. 1.a, The erection, alteration or reconstruction of any building or structure shall not be commenced without obtaining a Building Permit from the Public Works Director. Investigator: Carl Brome Mr. Brome reviewed the case which was investigated through a complaint and followed through by staff. During June, 2008 staff received complaints that sun rooms were being built without the required permit. Staff cited the homeowner who supplied copies of the contracts that Arroyo Enterprises completed the work. Staff cited Mr. Ruben F. Arroyo for the violations. Of the four properties, three have been permitted, completed and received a final inspection, one still requires a permit and is not yet done. The remaining property is located at 6602 Eden Road, had a contract for a total cost of $27,800.00. A permit is required for the structure itself and the A/C unit and electricity. Staff has had several contacts with Mr. Arroyo and his employees to correct the violation. As of today the property remains in violation and there is no permit for the sun room. Mr. Arroyo should cease construction progress until the permit for the constructed sun room is applied for and issued. Staff Recommendation: If Mr. Arroyo is found in violation of the above charges it is the recommendation of the Code Compliance staff that the permitting privileges be suspended in St. Lucie County. It is further recommended that a copy of the findings of facts in this case be sent to the State Department of Business and Professional Regulations. Mr. Davis asked for the term of suspension. Ms. Ariyanayagam said permitting privileges are usually suspended for one year. Mr. Brome said the remaining property had a permit applied for and issues were not being taken care of, and as of today there is no valid permit. Mr. Davis confirmed the issue was working without a valid permit for the property. Ruben Arroyo, 6704 S. US #1, Port St. Lucie, Fl., was sworn in by Ms. Goycochea. Mr. Arroyo thought the suspension of his license was harsh, since he had been trying to comply with all the requirements to get a permit. He applied Dec. 2, 2008, and they have been back and forth with Mr. Siscio in the Building Dept. to comply with requirements, and revisions that were done through the permitting process. A problem has been with the death of the homeowner, Mr. Politica (sp.) that Mrs. Politica would not update the survey, and they had to spend over $1,000.00 of their money to get all the paperwork required to get this permit. He was told the permit was ready to be issued but the electrical contractor and A/C contractor had gotten After the Fact permits (this work was not done by him), one of the contractors was Roberts Air, and if they did not comply Mr. Arroyo would be brought up to the Board. There was a problem with his production manager, his work was not checked, the permits were to be gotten for the four jobs, and this job was done outside of his control. The other contractors couldn’t be found and Arroyo’s permit was put on hold and voided. Page 7 of 9 CONTRACTOR EXAMINING BOARD October 21, 2009 Ms. Ariyanayagam said the projects were completed before a building permit was issued. She discussed Mr. Arroyo’s previous history before the Board. Mr. Davis understood they had to look at what was before them and not at cases from 2006. Mr. Arroyo said those cases were not related and that the Politica’s pulled their own permits. He explained the past history of other jobs and that his project manager did not do his job. He acknowledged his responsibility to check on every job to see if the permits were pulled. Ms. Ariyanayagam reiterated that Mr. Arroyo went ahead and built the project without a permit. He confirmed he started the project without a permit. Mr. Arroyo said his part was to pull the permit for what he did, the sun room, but the A/C and electrical had already been done on the property. Discussion ensued. ? Mr. Mitchell said I hereby make a motion in reference to the complaint against Arroyo Enterprises Inc., that the Board of Examiners make the following determination: After hearing the facts in this case, the testimony and recommendation of staff regarding the existence of a violation we determine that the violation in fact did occur and the alleged violator committed the violation and an Order of Enforcement is warranted. Ruben Arroyo, Arroyo Enterprises Inc. shall have his permitting privileges suspended in St. Lucie County for a period of one year and a copy of the fact and findings shall be sent to the Department of Business and Professional Regulations. ** Mr. Curtis seconded the motion. Mr. Dunkelberger understood there was one outstanding permit. Ms. Ariyanayagam confirmed and said the Mr.Mitchell was asked if that provision allows for any outstanding permits to take care of work to be completed. permit issue is resolved to prior to a year, if the suspension would be lifted at that time, and if so, would it be included in the motion . Mr. Davis clarified the suspension holds as long as the permit is outstanding and the work is not completed or finaled. ? Mr. Mitchell agreed to the question raised by Mr. Dunkelberger that if the permit issue is resolved prior to a year, the suspension would be lifted at that time, and to amend the motion accordingly. Mr. Davis understood the reason for the amendment and explained that he is concerned when construction begins without permits pulled, but he frowned upon the circumstances that would allow it to occur. This Board is incumbent in verifying that permits are in place, and the issue becomes muddy and he would like it more clear cut to determine his vote. ** Mr. Hudspeth seconded the motion as amended. A voice vote was taken. Mr. Dunkelberger-yes; Mr. Davis-no; Mr. James-yes; Mr. Curtis-yes; Mr. DiFrancisco-yes; Mr. Hudspeth-yes; Mr. Mitchell-yes. The motion carried 6-1. Mr. Davis opposed and explained his reason above. H. OLD BUSINESS: None I. NEW BUSINESS: Ms. Ariyanayagam noted the Board and staff would not be meeting until the next meeting January, 2010. She thanked the Board on behalf of the staff for their hard work and all the time they dedicate. Four current Board members were approved by the BCC to continue: Craig Dunkelberger, Fred Rohrbough, Douglas Davis and John Langel. Staff was also thanked and applauded for their work. The Board was wished a Happy Holiday and staff will see them in January, 2010. Mr. Davis thanked staff and said even though their questions may be intense and directed to staff, the Board appreciates the work they do and they understand with the extreme, dire, economic times there will be more unlicensed activity out there, under the table type of things, and he applauded their bringing it to the Board’s attention. The Board’s questions are only to try to get to the heart of the matter in order to make determinations on which to make decisions. He sent Best Wishes to the Board and staff for a Happy Holiday.
