ITEM N0.2 _ _ _ Planning and Development Services Department • MEMORANDUM TO: Commissioner Lewis THROUGH: Mark Satterlee, AICP, Planning and Development Services Director FROM: Kara Wood, Planning Manager, Planning Division DATE: June 22, 2010 SUBJECT: River Park Community Overlay Zone Revisions Background: Residents from the River Park Homeowners Association have approached the County numerous times over the last few years to request changes to the River Park Community Overlay Zone to allow more conversions of residential properties to commercial uses. For your reference, a map of the Overlay Zone from the Land Development Code is provided at the end of this memorandum. The purpose of the Overlay is "to recognize changing conditions along Prima Vista Boulevard, in the River Park Subdivision, between South US #1 (SR 5) and Airoso Boulevard and to establish supplemental performance standards of review by which to evaluate all applications for change in zoning to nonresidential use which may be filed for parcels in the River Park subdivision area." The Overlay is further "intended to provide for a logical and orderly transition from residential to nonresidential zoning where appropriate, and to protect those parcels which remain residential from the impacts of the nonresidential development." This intent is implemented in the standards of the Overlay by allowing changes in zoning from residential to non-residential as outlined in Table 4-8 from the Code: RIVER PARK COMMUNITY OVERLAY ZONE REZONING OPTIONS INTERSECTION ZONES " MID-BLOCK ZONES PUD 8~ PNRD (CO ~ CN uses only, except as specified in 4.02.05) Comprehensive Plan Amendment to Commercial PMUD (residential and CO and CN (COM) required for any change to a nonresidential use only, except as specified in zoning category, including PNRD 4.02.05) * Note: Intersection Zones include locations at Prima Vista Boulevard and South US #1, Floresta Drive and Airoso Drive The residents who have requested changes to the Overlay are concerned about the condition of properties along Prima Vista Boulevard that have no appeal for residential use given the character and intensity of the roadway they front. As staff understands, these residents wish to either remove the Overlay entirely, leaving no specific standards for review of changes to non-residential zoning, or revise the Overlay to be more permissive for rezonings. Without these limiting standards of the River Park Community Overlay Zone Revisions June 22, 2010 Page 2 Overlay, any property along Prima Vista Boulevard could rezone to CN (Commercial Neighborhood) or CO (Commercial Office) without a Future Land Use Amendment and still be consistent with their existing RU (Residential Urban) Land Use Designation. The River Park Homeowner's Association is now requesting that the County waive the fee charged for a text amendment to the Land Development Code ($2,550 for the base review plus $150 supplemental ERD review fee) for revisions to the Overlay. Staff has no authority to grant this wavier, which can only be given by the Board of County Commissioners; this is the reason for scheduling this discussion with the Board at the June 22nd Informal Meeting. Staff is aware of only one previous request for a fee waiver to look to as a precedent for how the County has considered this type of petition. In 2005 a resident requested that the fee for a Future Land Use Amendment be waived; staff recommended denial of the request and the Board agreed with staffs recommendation. Among staffs concerns is that there remains disagreement among area residents about the appropriate direction of the future of the River Park area. While the Homeowner's Association has taken the position that the Overlay should be revised, some other residents are concerned that lifting these restrictive standards of the Overlay would negate the expressed intent of the Code "to protect those parcels which remain residential from the impacts of the nonresidential development." Attached are two letters from River Park residents that have been published in the local newspaper this year that demonstrate the difference of opinion that exists on the issue. While staff does not disagree that homes along the busy stretch of Prima Vista Boulevard now hold little appeal for residential use, the wholesale reconsideration of the use of those properties warrants careful consideration. Land Development Code amendments require complete analysis of the possible effects of the change, which, if the review fee is waived, is the burden of the County to accomplish. And since the Overlay continues to be a disputed issue among area residents, staff is also concerned about appearing to take a side on the issue by subsidizing a Land Development Code amendment through a fee waiver. An alternate suggestion is for the County to sponsor a limited scope neighborhood charrette to bring the residents together, assess the issue in its entirety and see if there is some compromise to be reached between the two viewpoints for the future of Prima Vista Boulevard. Recommendation: Staff recommends that the Board consider whether it wants to support any of the following options: 1. Waive the $2,700 fee for the Land Development Code amendment. 2. Reduce the fee. 3. Sponsor a limited scope neighborhood charrette.
