The Beau Rivage area in St. Lucie County is comprised of several residential subdivisions including Beau Rivage Heights, Beau Rivage Estates, Eventide, Bay Colony and The Plantations. A number of residents in the area have signed a petition (attached) requesting that St. Lucie and Martin Counties consider a reconfiguration of county boundaries to include the area in Martin County. Any reconfiguration of county boundaries requires legislative action along with support by both county commission boards. This Town Hall meeting is an opportunity for residents to discuss the proposal with the St. Lucie Board of County Commissioners. This is only an informative Town Hall meeting, no voting will take place. The following information and memo attachments are provided to assist in the discussion: • The area is all single family residential and consists of 129 acres with approximately 554 people living in 228 homes (2.43 persons per household from BEBR data). The area is substantially built -out and only a handful of single-family lots remain undeveloped. • Physically, the area is not directly connected to the rest of St. Lucie County by a County - owned or maintained right-of-way. Access is via Britt Road from US 1 in Martin County. • Taxes - Data from the 2010 assessment shows the total taxes received from the area for all assessing districts is about $1,286,300. The 11 BOCC assessments in the area net about 43% (8.9776 mills) of the overall millage (20.7842 mills) which amounts to approximately $555,609 coming to the BOCC's various funds. • Public Works — Most, but not all, of the roads in the area are publicly owned and maintained rights -of -way. Over the past three years, Public Works has spent approximately $120,000 in the area providing right-of-way and drainage maintenance service. • Utilities - St. Lucie County Utilities (SLCU) Service Area but there is no infrastructure nearby. Board of County Commissioners Beau Rivage Area April 19, 2011 Page 2 • Beau Rivage area properties in SLC are on well and septic. • SLC has offered Port St. Lucie Utilities (PSLU) the option to serve this area, however PSLU was not interested. • Martin County Utilities has infrastructure nearby as they serve Beau Rivage East. If Beau Rivage stayed in the County and wanted utility service, SLCU would be the provider and approach Martin County for bulk utility service. • Previous discussions with area property owners regarding the provision of County utility service through an MSBU have been unsuccessful. • Emergency Response — Data has been pulled from 911 Emergency Services for numbers of calls for service and the response time for the calls. In the past year and from the data provided, 911 has recorded approximately 100 calls for service and logged 360 "closed patrols" (regular patrols of the area). From the data on calls for specific calls for service to 911, the average response time was about 20-25 minutes. o Sheriff's Office — The Sheriff's Office stated that there was no simple way to calculate savings if they no longer had to provide service in the area. The Beau Rivage area is a small part of a much larger zone that is covered by one deputy. Regardless of the status of Beau Rivage, the deputy working the zone would still be present and there would be no direct cost savings to the Sheriff's Office or the county. o SLC Fire District — Discussion with the Fire District indicated that they are aware of the issue and had been collecting data on response times. The Fire District indicated that there is a mutual aid agreement in place with Martin County and that in certain circumstances, Martin County Fire/Rescue may provide transport but generally wait for SLC to arrive and handle. The Fire District indicates an average response time of 12 minutes. School District — The Martin County School District has an agreement with the St. Lucie County School District to serve the Beau Rivage area. The St. Lucie School Board recently notified Beau Rivage residents that students from kindergarten to grade 8 will be required to attend St. Lucie County schools and students currently in grade 9-11 will be "grandfathered" and may continue to attend their current school. It is the School Board's position that there are students in proximity to all three neighboring counties and special exception for this neighborhood is not supported. As of December 2010, 56 students in the Beau Rivage area attend Martin County Schools. Approximately forty residents of the Beau Rivage area presented their petition to the Martin County Board of County Commissioners on February 22, 2011. A presentation was given by Martin County staff and 15 residents spoke on the record in favor of the county boundary realignment. All of the Martin County Commissioners spoke in favor of the proposed realignment while acknowledging that ultimately it was St. Lucie County's support that is most important. Attached is Resolution 11-2.39 adopted by the Martin County Board of County Commissioners supporting the proposed realignment. We are an enclave community at the end of Britt Road in St. Lucie County. Since our communities were developed 50 years ago we have always been isolated from St. Lucie County. When Ballantrae was developed we were permanently cut off from the rest of the County. The only access to our enclave is a three-mile drive through Martin County. Earlier this month we delivered approximately 400 petitions (copy attached) each signed by the residents in our communities to the County Attorneys for St. Lucie and Martin Counties. The petition requests that St. Lucie and Martin Counties enter into discussions to facilitate the annexation of our enclave community from St. Lucie into Martin County. We recognize that changing county boundaries requires an act of the legislature. We know that signed petitions and county commission resolutions are not required under law. Nevertheless our petitions -- signed by over 90% of the residents -- and action by the respective county commissions — approving annexations -- would give our legislators the impetus to sponsor the needed legislation. We ask for the respective County Commissions to pass a resolution directing that discussions commence between the two counties to reach a fair agreement which would allow us to move from St. Lucie to Martin County. As the petition states, we have had difficulties with fire, sheriff and emergency response. This is not to say that the emergency service agencies have neglected us, it is a matter of logistics and costs. There have been several incidents of 911 calls that were misdirected due to confusion of where we are located. We live in Beau Rivage, Beau Rivage Estates, The Plantations, Eventide, Bay Colony and Beau Rivage Heights i adjoining neighborhoods. We respectfully petition the St. Lucie and the Martin County Commissions to allow our enclave community to be removed from St. Lucie County and to be annexed into Martin County. The following are several of the reasons that we request this action. Risk to Life and Property. The City of Port St. Lucie Fire Department that services our community is about five miles away on Port St. Lucie Boulevard, while Martin County has a fire station less than a quarter mile from our entrance. Recently Martin County fire rescue responded to a medical emergency promptly, but could not transport the resident. Thirty minutes after Martin County was on the scene the emergency vehicle from St. Lucie County appeared. Emergency Services. The delay and distance for emergency county services is of utmost importance. Our police/sheriff, ambulance and fire rescue come from St Lucie County. If St. Lucie emergency vehicles were at the border of the two counties on US1, they would have to travel four miles through Martin County before they could reach our community. We have experienced several recent incidents of unacceptable response from St. Lucie County to medical emergencies in our community. Typical response time is between 30 to 40 minutes. Sheriff Services. The nearest St. Lucie County Sheriff's office is 14.9 miles from our community. Martin County has a substation at the Treasure Coast Mall (less than a mile). The Martin County Sheriff's main facility is 6.8 miles away. The Martin County Sheriff has regular patrols that are in nearby Martin County neighborhoods. Isolation from St. Lucie County and Social Connections with Martin County. When St. Lucie County permitted the development of what is now Ballantrae Country Club, it isolated our neighborhoods thus creating an isolated enclave or outparcel of St. Lucie County. There is no direct access to St. Lucie County and its accompanying parks, libraries or other infrastructure. Consequently, most of our community identity is with Martin County. Our network of friends, contacts, business dealings and our children's playmates are in Martin County. Infrastructure Support. We receive few St. Lucie County infrastructure services. The County performs regular maintenance of our swales; however the roads have not been well maintained. They have "sink holes" caused by poorly maintained drains. Schools. Children in our community have always gone to Martin County schools. Many of us bought homes in this community because of the proximity of the schools. The St. Lucie County School Board has indicated that they will require our children to attend the distant St. Lucie schools in the near future. The only way we can avoid that eventuality is to be annexed into Martin County.
