Upon the request of any party to the proceedings, individuals testifying during a hearing will be sworn in, Any party fo the proceedings will be granted the opportunity to cross-examine any individual testifying during a hearing upon request Anyone with a disability requiring accommodation to attend this meeting should contact the St. Lucie County Community Services Manager at (772) 462-1777 or TDD (772) 462-1428 at least forty-eight (48) hours prior to the meeting. 7/28/2011 ..: ~ - Development Review Fee Discussion Board Of County Commissioners August 4, 2011 ~~. ac c c~ During the Strategic Planning and Budget sessions, staff presented a number of ideas for raising revenue. • Increase Building Permit fees to help cover the cost of adding staff to improve plan review time frames. • Adopt new fees for complex and detailed development review processes not being assessed. • Consider increasing current fees that are insufficient to cover staff time. • There are a number of reviews that not only involve Planning but also Public Works and ERD. • With a few exceptions, current fees are collected in Planning & Development Services and distributed to department budgets by Finance. 1 7/28/2011 _ -- r ._ '~ ~ ~~~Building Perming~Fees • Permits such as electrical, plumbing and signs and "over- the-counter" permits for fencing, driveway replacement, etc. involve substantially less staff time for review. However, the time and responsibility of the Building Inspector is increased to make sure these permits meet Building Code. • For simpler permits, a $25 to $100 increase is recommended, bringing the cost of these permits to $100 to $400. • This increase will not result in SLC permit fees being substantially higher than the cities or adjacent counties. • The fees will remain in the Building Enterprise Fund and will generate approximately $ 70,000 per year, sufficient to hire at least 1 Certified Building Plans Reviewer. ~~.._ - - ~~~ .~ ~.-w-BFt~ _ ___~on>~ng Fees' v~~~ ., • Commercial construction greater than 6,000 SF must first be reviewed and approved as a site plan by the Planning Division. • Following site plan approval (if required), permits for SF home and commercial construction are reviewed by staff in Zoning, Building, State Licensed Plans Examiner and inspected by State Certified Building Inspectors or 10-50 man-hours. • Permit fees for SF home and commercial construction are based on the value of construction (per $1,000) multiplied by .65. Staff is proposing an increase to .70 as a multiplier. • This results in permit fees for SF home and commercial construction being increased by $50 per $100,000 value of construction. • Occasionally, ERD and/or Public Works are required to review these permits. Each spend an average of 8 man-hours per project including site visits. Each is proposing a charge of $200 if their review is required. • The total fee would be collected by Building and distributed to ERD and Public Works (if applicable) by Finance. 2 7/28/2011 ~~~~ ~___---Propose~l~w-fees-- • Fees are not currently charged for the following development review functions. These functions require significant staff time and generally involve multiple departments due to the technical expertise required. Function Est. Determination 20-100 ,. ~-=--- - Development gre~ements • A Development Agreement (DVA) facilitates phasing of improvements related to• proposed development • Departments involved in the preparation and review of a DVA include PDS, Public Works, ERD and County Attorney. • The County Attorney's office is responsible for drafting, finalizing, obtaining BOCC approval and recording DVAs. • DVA annual reports are coordinated by Planning and are also reviewed by the County Attorney, Public Works and ERD. Amendments are handled in similar manner. • Recommended fee for processing the initial DVA is $2,000 with an additional $300 for ERD review. • Recommended fee for review of the annual report is $500. • Recommended fee for processing amendments is $1,000. 3 7/28/2011 ~~~~, _.- rte--- _. _ .::: Mining M~_ ~ ~ - _~-f ~• • This process is separate from the Conditional Use that is processed by PDS for which there is a charge of $1,500. The focus of the CU is the impact on adjacent properties. • The mining permit application is processed parallel with the CU (if needed). There is a small fee of $350 charged by Public Works. • The mining permit involves review and approval of all of the technical aspects of the mining process and methodology as well as impacts to the environment, land, water use, tree mitigation, wetlands, etc. The review also includes the plan and methodology for closing the mine and requirements for restoration of the site. • The permit is active for 20 years and includes multiple construction inspections, permit compliance monitoring and closure and restoration construction and inspections. • The Public Works fee is proposed to be increased to $5,000 + $1 per acre per year the mine is active. The ERD fee is proposed for $1,000. ~- ~W~~-~--~_ _-R-i-aht of Way Permits 1 _._ .. ~- & License A reemen _ W_ g is • Right-of-Way (ROW) permits are typically provided for utilities or construction of improvements in SLC-owned right-of-way. • License Agreements are revocable agreements for private use of SLC property. May include monitoring wells, subdivision signs, fencing, etc. • These permits and agreements typically involve Public Works (Engineering and Road & Bridge) and County Attorney's Acquisitions. • There is currently no fee for ROW permits or License Agreements. / Recommended Fee for License Agreements - $250 / Initial fee for 2 reviews of ROW Permit o Residential - $275 o .Commercial - $450 o Utility - $150 o Development - $450 / Each additional review $125 for residential and commercial applications. / Each additional review $100 for utility and development order applications. 4 ~; ., ~~~..~ Tr Agreement • For construction of public improvements by a developer. The review and inspection process is iterative and may include multiple reviews and inspections. • Involves Public Works (Engineering) and County Attorney's Office. No fee is charged. • Recommended fees: /Sidewalks & Turn Lanes - $125 (2 reviews) /Other Activities (roadways, etc.) - $2,150 (2 reviews) /Each additional review - $500 ---- ~;~.~__ ,- 1~ ..~ ___.._.. ~____ x~ a -- ---- = , - o ~.....:.- . ~;~ , r ~,;-. • Appeals of Administrative Decisions are processed through the Board of Adjustment and can involve many types of administrative determinations from PDS Director, Public Works Director and County Engineer. Appeals of the ERD Director's administrative determinations are made to the BOCC as the Environmental Control Board. • It is difficult to determine the number of man-hours required to process appeals due to the wide variety of issues that can be involved. One recent example involved 100+ man-hours; simple appeals could take 20 man-hours to process. • There is currently no fee to appeal any administrative decision. • Recommended Fee - $1,000 • This fee would be remitted to the Department responsible for the administrative decision and for responding to the appeal. 7/28/2011 5 7/28/2011 ~,~s~. `~Y,_~- __-~ , . Review _. _~eases • TVC fees /Adopted in 2007 /Not justified based on staff review time required. /Propose to decrease planned developments fees consistent with other PUD fees and remove minimum and per acre fees for site plans. • Class A Mobile Home fee /Current fee based on BOCC review and approval. /Per Board. direction, staff is proposing ordinance to amend process for administrative approval. and proposing to decrease fee accordingly. f _ __._.__..._ ~. -- -~.~ Cross Training The question regarding cross-training of staff was raised at, the Strategic Planning Session as a possible means of addressing the lack of staff to review and inspect Building Permits. Staff has confirmed that: • State Law requires Plans Examiners and Building Inspectors to provide 5 years of documented experience in each specific area of expertise in order to qualify to take and pass the test for that certification. • The same criteria applies to additional certification in each specialized field. 6
