Subject: Health Insurance
Chris, you asked me yesterday to give you an overview of health insurance from my perspective.
The health insurance committee meets once a quarter to review information and statistics about
the plan. The participation of the constitutional offices is limited to getting loss information but
they have not had a vote on the premium levels or decisions such as OPEB reserves. When the
county changed from a self insured program to Blue Cross, we read that in the newspapers.
There was no communication with constitutional offices or the health insurance committee.
The overall status of the plan was asked for a number of times but information was not
forthcoming. I finally went to audit reports and requested data from the Clerk of the Circuit
Court who pays the bills to try and get an overview of the program. My research determined that
charges for health insurance are and have been too high and have resulted in excess reserves.
Lowering the premium to a level that supports the program would save all of us money in our
budgets. On top of that excessive premium, there continues to be a 2.5% surcharge that is
unneeded, unexplained, and remains there as a holdover from shortages that were present years
ago.
GASB 45 gives a choice to the county of whether to be on a "pay as you go basis" or set up
reserves for past employment benefit based on actuarial calculations. The county (and by
inclusion the constitutionals) are doing both. The last reserve number I heard for OPEB was $17
million. Our concern with high premium levels and unnecessary reserves is the impact on our
budget. In the last ten years we have reduced staff from 89 people to 72 people through attrition
by automation and cross training. We need the staff we have and do not wish to lay off staff to
accommodate insurance premiums that are too high. Layoffs ripple through the economy of our
county in a highly negative way and our county will not be healthy again until we lower
unemployment. In general the county puts off decisions to lower premiums and discuss options
about OPEB reserves. You spoke of charging employees more for health insurance. In the face
of no pay raises in four years, the first avenue of action needs to be lower premiums before we
consider asking employees to pay more.

~ We had $9,061,338 as of 9/30/2010. In FY 2011, per Board direction, we refunded $4,654,000. This brought the
current balance to $4,407,338.
' This money was received from the insurance carriers for hurricane damage. The County may have to return a

Agreement, my files do not reflect that the Agreement has been modified or terminated. Based on this, I believe that

Greetings Dan,
Referencing Commissioner Dzadovsky email to you I believe there has been some confusion about the insurance
committee. I would like to clear some things up and these are my own thoughts and not of the other constitutional
officers, although they can comment if they wish.
First of all, there is no actual "committee", so it does not need to be abolished. What happens is, the constitutional
officers and other agencies are invited to a meeting from time to time to listen to what county insurance guys have
already done. There are question and answers but there is no input from the invitees that influence any decision
affecting health insurance.
Dan, if you opine that the 1993 Interlocal Agreement is still valid, then the Board can instruct the insurance department
to begin adhering to its provisions. Only then will there bean "insurance committee". Section 6 of the Interlocal states
that the Committee shall:
A. Review insurance plans.
B. Make recommendations to the Board regarding selection of a consultant.
C. Make recommendations to the Board regarding revisions of the plan
D. Make recommendations regarding plan provisions, claims administration, and reinsurance coverage.
E. Review loss experience
F. Develop and adopt by-laws and procedures.
None of the above is being done. The constitutional officers (except the Sheriff) believe they should be part of the
decision-making process because we have about one-third of the covered employees.
To address Commissioner Dzadovsky's concern about timeliness of the county's budget process, my input would be the
following (I'm on vacation out of state the next two weeks):
1. Reduce the insurance premiums the county charges each one of the pool's members by a minimum,,of
20-25 percent from last year. If the self-insurance fund experiences a loss, then fund that loss from the'' -~
insurance fund reserve.
2. Do not refund the pool members any of the over-funded insurance fund balance. Instead, use the
reserves to keep our premiums lower and to fund future losses, if any.
3. Re-establish the insurance committee in accordance with the 1993 Interlocal Agreement.
I would welcome #3 above and I believe the other constitutionals would too. Please contact me if anyone has any
questions.

Commissioner, the committee was formed pursuant to an Interlocal Agreement dated July 6, 1993 between the County
and constitutional officers. Abolishing the committee would require the consent of the parties to the Interlocal

What legal action would/could need to be taken to abolish the committee?
Could we simply place an item on the next BOCC meeting Tuesday to abolish the committee?
If that could occur in short order, the group would then be able to meet sooner than later.
I have deep concern that a delay until "sometime in September". I feel we need a result from the Constitutional's input
sooner than later. If there will be a revenue savings to each Constitutional Officers budgets and the BOCC budget we will
need that savings to continue to close the 2014 projected $21 million dollar gap.
Not knowing how result of this or these meetings about the restructuring of the health insurance costs will hamstring the
BOCC when setting the millage rate September 22.

In connection with your email dated August 10, 2011, entitled Upcoming BOCC Insurance Discussion, the Tax Collector,
Property Appraiser, Supervisor of Elections, and Clerk of the Circuit Court welcome the opportunity to present
recommendations to the Board in regard to health insurance; however, we wish to do the presentation outside the
purview of the Interlocal Agreement For Coordination of Insurance Services, dated July 6, 1993, and we wish to postpone
our discussion to sometime in September.
The Interlocal Agreement, as far as we know, has lain dormant for over ten years. As you know, the constitutional
officers (except the Sheriff) have been asking for it to be resurrected for over a year. To suddenly have a public meeting
using a single provision of the Agreement (paragraph 6C) may be contrary to Florida's Sunshine law because the other
provisions of the Agreement have not been adhered to. The "committee" as it now stands is not an advisory group but
simply a group that is informed from time to time of the decisions the county has already made. The Interlocal
Agreement, in our opinion, needs to be rewritten, approved by the county attorney and the constitutionals before final
implementation.
Also, as you may know, the constitutional officers have asked the Gehring Group, which is an agent of record similar to
EMI, to make a cursory study of the current health insurance claims history and premiums to see if there could be a
significant downward adjustment to the health insurance premiums. Gehring Group has finished its study and will
present its findings to the constitutional officers later this month. We want to listen to their findings before we make
any recommendations to the Board.

Please be advised that the Insurance Fund will be discussed at the Board's next budget workshop which will be held
next Thursday, August 18th The Board is planning to hear a presentation on the Insurance Fund and to have a joint
discussion with the Constitutional Officers on the Fund, use of the reserves, the role of the Insurance Advisory
Committee and any other matters relating to the Insurance Program. If at all possible, the Board would like for each of
you to be at the workshop to participate directly in the discussion. (Feel free to also have the appropriate staff to attend

Last night, I read the Insurance Services Interlocal Agreement. I made the Board aware of the Agreement and the

NOW, THEREFORE, in consideration of the premises and of the

terms, conditions and covenants herein contained, it is agreed by ~
and between the parties hereto, as follows: N
1. This Agreement is entered into pursuant to Section
163.01, Florida Statutes, Interlocal Cooperation Act.
2. The County shall provide or contract with a third party
or participate in a self--insurance program as provided in Section
163.01(3)(h), Flor~.da Statutes, to provide .insurance related
services'as set out in Exhibz,t "A".
3. The part;.es acknowledge that the St. Lucie Welfare
Association, Inc., c/b/a Abbiejean Russell Care Center, hereinafter
referred to as the "Association", is a non--profit corporation
organized under the laws of the State of Florida which receives the
majority of its funding from federal, state and local governmental
sources. The parties agree that the County shall enter into an

5. To the extent authorized by law, the Officers agree to ~

fully indemnify and hold harmless the County, its officers, N
employees, and agents of and from all liabilities, damages, claims, (,~
~
recoveries, costs, and expense in any way arising out of or in
connection with the performance of this Agreement.
6. The parties agree to form an insurance Committee which
shall perform the following duties: -
A. Review current insurance plan which provide coverage
for 311 the parties.
B. Make recommendations to the Hoard of County
Commissioners regarding the selection of a
cons~.xltant to assist in the review and bidding of
the insurance plan which may require a third party
administrator or a direct contract with the County.
C. Make recommendations to the Board of County
Commissioners with regard to the selection or
proposed revision of the insurance plan. In the
even, the Board does not accept the Committee's
reco~unendation, the matter will be referxed back to
the Committee for additional review and
reco.-tTmendation to the Board. The Board's decision
on the Committee's second recommendation shall be
final.
D. Make recommendations to the parties with regard to
insurance plan provisions, claims administration
and reinsurance coverage. The County agrees to
notify the Committee prior to the adoption of any
revision to the insurance plan following approval
of t.ze plan as set forth in Paragraph 6.C.
E. ~ Review loss experience of the insurance plan and
' performance of claims administrator.
F. Develop and adopt such by-laws and procedures as it
deems necessary.
The Insurance Cammi~tee shall be composed of the Officers and-the
Chairman of the Board of County Commissioners. Each member of the

year first written above until ,terminated by the County or any of
the Officers, as to the terminating Officers} only, party upon no

parties prior to January 1 for life and/ar health insurance and
October 1 for all oi:her coverage.
8. The Agreement may only be amended by a written document
signed by all parties and filed with the Clerk of the Circuit Court
of St. Lucie County,. Florida,
9. All notices, requests, consents, and other comrnunicatians
required or permitted under this Agreement shall be in writing
(including telex and telegraphic communication) and shall be (as
elected by the pe_son giving such notice) hand delivered by
messenger or courier service, telecammunicated, or mailed (airmail
if international) by .registered or certified mail {postage
prepaid}, return receipt requested, and addressed to:

delivery, (b} on the date telecommunicated if by telegraph, {c} an

assigns of the parties hereto.
11. This Agreement embodies the whole understanding of the
parties. There are na promises, terms, conditions, ar obligations
other than those contained herein, and this Agreement shall
supersede all previous communications, representations or
agreements, either verbal or written, between the parties hereto.
12. This Agreement shall be recorded with the Clerk~of the
Circuit Court, St. Lucie County, Florida, prior to becoming
effective.
IN WITNESS WHEREOF, the parties hereto have accepted, made,
and executed this Agreement upon the terms and conditions above
stated on the day and year below written.
