LUCIE COUNTY LAND DEVEL MEN In reviewing this application for a variance from the St.Jeri Coand make the Land Development Code, the Board of Adjustment shall cons following determinations: 1. The variance requested arises from conditions that are unique and peculiar to the land, structures, and buildings involved; that the particular physical surroundings, the shape, or topographical condition of the specific property involved would result in unnecessary hardship for the owner, lessee, or occupant, as distinguished from a more inconvenience, if the Provisions of Chapter 7, are literally enforced; that they are conditions that are not ordinarily found in the same Zoning District, and the conditions are created by the regulations of Chapter 7, of this Code, and not by an action or actions of the property owner or the applicant. The subject 1.57 acre property is located south of Kitterman Road, on the east side of U.S. Federal Highway No. 1 and is zoned CG, Commercial General which is consistent with the COM, Commercial future land use designation. The petitioner (Rutherford/Strickland, LLC) is requesting relief from Section 7.09.04(A), of the St. Lucie County Land Development Code to reduce the required fifteen (15) foot landscape buffer between the street (east -west, private - entrance driveway) and off-street parking area to five (5) feet in depth. Background September 29, 2009 The applicant/property owner applied for a building permit with the St. Lucie County Code Compliance Division to construct a 15,719 square foot office building. November 6, 2009 The Growth Management Director approved GM Order No. 09-021 granting minor site plan approval for a 15,719 square foot office -building on 1.57 acres. The Growth Management Director also granted administrative relief to allow for a one (1) foot _____..-_.._..-__...reduction--of..parking..stallwidth-for--fifty-four_-(54), frty o-_...-.__. "a Ree afashed approved site plan. e March 5, 2010 Page 3 Petition: Port St. Lucie Social Security Building File No.: BA 220104038 February 2, 2010 The St. Lucie County Code Compliance Division issued a building permit to construct a 15,719 square foot office building. On February 3, 2010, the applicant was made aware by General Services Administration (a central management agency that is mandated by the federal government to assure that new construction complies with federal policy, including Department of Homeland Security requirements) that a minimum twenty (20) foot wide setback is required from the face of the building's exterior to any point where a vehicle can approach the building. The applicant has adjusted their previously approved site plan accordingly (see attached proposed site plan). The building was pushed to the rear of the property to allow for the federally required twenty (20) foot pedestrian zone located in the front of the building. The building remains in -line and directly abuts the twenty (20) foot wide access easement located along the north (side) property line. The requested variance represents 66.33% reduction in the required landscape buffer. The variance sought arises from conditions that are unique and peculiar to the land, structures, and buildings involved that would result in unnecessary hardship. The petitioner is mandated by the federal government to comply with requirements to protect the interest of public security/safety. 2. The granting of the variance will not impair or injure other property or Improvements in the neighborhood in which the subject property is located, nor impair an adequate supply of light or air to adjacent public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood. The variance requested is the minimum variance that will make possible the reasonable use of the land, building, or structures. As shown on the Proposed site plaR, buildieg pleeernent is coRs •ned to the - - north by a twenty (20) foot access easement. The applicant has informed staff that they are unable to acquire an additional ten (10) feet of property from the adjacent property owner to the south, nor reduce the size of the building. Therefore, if this variance is granted, the landscape buffer area (approximately March 5, 2010 Page 4 Petition: Port St. Lucie Social Security Building File No.: BA 220104038 2,000 square feet in size) that will be removed along the. private street will be placed (in similar size) along the west and south sides of the building. The applicant has met with the Environmental Resources Department and indications are that preliminary approval of the proposed landscape changes will be allowed pursuant to Section 7.09.04(0) of the LDC that requires an alternate landscape plan with plant material provided at a rate equal to 1.5 times the amount that was originally required. 4. The variance desired will not be opposed to the general spirit and intent of this Code or the St. Lucie County Comprehensive Plan. The requested variance will not conflict with the general spirit and intent of the St. Lucie County Land Development Code or the St. Lucie County Comprehensive Plan. Recommendation The variance is the minimum variance that will make possible the reasonable use of the land, structure or building and will not have adverse impacts to other property or improvements. in the neighborhood. Furthermore, staff has reviewed this petition and determined that it conforms to a strict interpretation of the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. The existing dock has been noted in existence since 1987. It is also included as an improvement on my property tax assessment. My interest in modifying the dock and replacing the seawall is simply three fold. 1. The elevation of the site will have to be raised approximate 2' because of the elevation required the septic tank system for the house. 2. The recommendations of the engineer suggested that with this additional fllldirt and that of a building foundation it would be prudent to replace the seawall which is not structurally sound. 3. If the seawall is replaced, it would be prudent and cost effective to modify the dock to what is ultimately desired, which is what was approved by the FDRP. The existing dock is in need of repair to make it structurally sound. The plan review comments I have received does not allow any flexibility or consideration to my situation. I ask you intercede and review the specifics of my permit application. I understand a dock is an "accessory" to the site but it already exists. K Please note also I had specified the "environmentally frlendly" ThruFlow decking material for the dock. I request that you will allow me to proceed with the permit as submitted and the reconfiguration of the existing dock. I am not in a financial position to start my house but can fund certain aspects in a logical sequence that are time consuming and cost f effective from a construction point of view of improvements that will be required regardless. Background On 07/28/2009 Mr. Smith applied for a build- ing permit for dock/sea wall & he was only allowed to replace the sea wall. On 8/25/09 Mr. Smith sent a letter to the Code Compli- allow him to proceed since the site elevation needs to be raised and seawall replaced per an engineer. The dock needs repair and was approved by the FDEP. On 9/02/09 the offi- cial responded to Mr. Smith that the dock is a nonconforming use & structure and cannot be reconstructed and expanded.
