Mr. Harris stated Agenda Item #II BA-620104072 Spanish Lakes #1 has been
withdrawn by the petitioner, but asked anyone that would like to speak about the
petition to do so now.
Patricia I. Stumbaugh, a Spanish Lakes resident, stated she found an error
where the application stated there was no homeowners association but there is
one. She stated she appreciates what the Wynnes are doing and they are good
builders. Ms. Stumbaugh stated she was representing the seniors on fixed
incomes and they cannot afford the $800 house payrnefit plus $500 for rent. She
stated that according to him their homes havereached the end of their
usefulness but so have their pocketbooks because" they do not make much in
Social Security and are expected to retire in those homes: ,tUls. Stumbaugh stated
she has been to the office at least five trtds to check the documents. She asked
why aren't they putting everything in at!'one time and then advertising the public

Background
The house on the subject property was constructed in 1956 and has a front setback of
25.4 feet without the front porch. The subject property is in the RS-3 (Residential, Single
Family — 3 du/ac) Zoning District, which requires a minimum setback of 25 feet from the
front property line and 7.5 feet from each side property line. The front porch was
constructed without obtaining a building permit and the applicant is attempting to remedy
this fact by obtaining an "after the fact" permit. The front porch and new roof encroaches
up to six feet into the front setback at one point and less than one foot into the west side
setback.

The property fronts on a private 50 foot access easement recorded in OR Book 212,
Page 869. The homes on the subject parcel and the adjacent parcels were developed
approximately around the same time period and have similar setbacks relative to the
access easement. The decreased setback with the addition of the front porch is not
substantially inconsistent with the existing setbacks on surrounding properties.
On May 27, 2010 the applicant was cited by Code Enforcement for building without a
permit. The applicant submitted a building permit to St. Lucie County on August 16, 2010
to construct a front porch and new roof for the single family residence. The plans were
reviewed by the Zoning Division on August 17, 2010 and the applicant was notified that
the front porch encroached into the front and side setbacks and that a variance would be
required before building permit approval.
Section 7.04.01(B) permits the encroachment of an unsupported roof overhang up to
thirty (30) inches within any required yard setback. If the applicant is not granted this
variance, the new roof would have to be cut back or rebuilt to meet this provision and the
columns and flooring of the front porch would need to be demolished.

STANDARDS OF REVIEW AS SET FORTH IN SECTION 10.01.02,
ST. LUCIE COUNTY LAND DEVELOPMENT CODE
In reviewing this application for a Variance to the St. Lucie County Land Development
Code, "The Board of Adjustment shall not grant a variance unless it shall, in each case,
make specific findings of fact based directly upon the particular evidence presented
supporting written conclusions that:"
1. The variance requested arises from conditions that are unique and peculiar
to the land, structures, and buildings involved; that the particular physical
surroundings, the shape, or topographical condition of the specific property
involved would result in unnecessary hardship for the owner, lessee, or
occupant, as distinguished from a mere inconvenience, if the provisions of
the Code are literally enforced; that it is a condition that is not ordinarily
found In the same zoning district, and the condition is created by the
regulations of this Code, and not by an action or actions of the property
owner or the applicant.
The variance sought arises from conditions that are not unique and peculiar to the
land, structures, and buildings involved; nor the particular physical surroundings,
shape, or topographical condition of the property that would result in unnecessary
hardship.
The conditions that require the variance were not created by the regulations of the
Land Development Code, but by the placement of the house too close to the front
property line to allow for any further additions to the front of the house without
encroachment. The need for the requested variance is to allow the continued use
of a new roof and front porch and to approve the application for building permit.
2. The granting of the variance will not impair or injure other property or
improvements in the neighborhood in which the subject property is located,
nor impair an adequate supply of light or air to adjacent property,
substantially increase the congestion in the public streets, increase the
danger of fire, create a hazard to air navigation, endanger the public safety,
or substantially diminish or impair property values within the neighborhood.
The granting of the requested variance is not expected to impair or injure other
property or improvements in the neighborhood. The property will continue to
provide adequate light and/or air to the public streets. Attached are letters from
Donald Burford and John Fagarass, adjacent property owners, supporting the
variance. The 50 foot access easement which provides frontage to the subject
property is property owned by Mr. Fagarass.

3. The variance granted is the minimum variance that will make possible the
reasonable use of the land, building, or structures.
The requested variance is the minimum needed to allow for the continued use of
the front porch and new roof for the single family residence and to allow the
applicant to apply for a building permit without altering the already constructed
porch.
4. The variance desired will not be opposed to the general spirit and intent of
this Code or the St. Lucie County Comprehensive Plan.
The requested variance is consistent with the intent of the St. Lucie County Land
Development Code but not the specific provisions of this section. The applicant is
requesting the variance from the requirements of the front and side setback in
order to support an already constructed covered porch which will provide
protection from inclement weather when entering the residence. The requested
variance is not in conflict with the Goals, Policies, and Objectives of the
Comprehensive Plan.
Recommendation
Staff has reviewed this petition and determined that it may not necessarily be in conflict
with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan.
However, the requested variance does not conform to a strict interpretation of the
standards of review as set forth in Section 10.01.02, St. Lucie County Land Development
Code. Staff is, therefore, recommending denial of the requested variance.
