GENERAL RULES AND PROCEDURES -Attached is the agenda, which will determine the order of business
conducted at today's Board meeting.
INVOCATION-PLEDGE - To bring order and decorum to its meeting, the Board begins its meetings with an
invocation followed by the Pledge of Allegiance. Participation is voluntary.
CONSENT AGENDA -These items are considered routine and are enacted by one motion. There will be no
separate discussion of these items unless a Commissioner so requests.
REGULAR AGENDA -Proclamations, Presentations, Public Hearings, and Department requests are items,
which the Commission will discuss individually, usually in the order listed on the agenda.
PUBLIC HEARINGS -These items may be heard on the first Tuesday at 6:00 P.M. or as soon thereafter as
possible and on a third Tuesday at 9:00 A.M. or as soon thereafter as possible, these time designations
are intended to indicate that an item will not be addressed prior to the listed time. The Chairman will open
each public hearing and asks anyone wishing to speak to come forward, one at a time. Comments will be
limited to five minutes.
As a general rule when issues are scheduled before the Commission under department request or public
hearing, the order of presentation is: (1) County staff presents the details of the Board item (2)
Commissioners comment (3) if a public hearing, the Chairman will ask for public comment, (4) further
discussion and action by the board.
ADDRESSING THE COMMISSION - Please state your name and address, speaking clearly into the
microphone. If you have backup material, please have eight copies for distribution.
NON-AGENDA ITEMS -These items are presented by an individual Commissioner or staff as necessary at
the conclusion of the printed agenda.
PUBLIC COMMENT -Time is allocated at the beginning of each meeting for the general public comment.
Please limit comments to five minutes.
DECORUM -Please be respectful of others' opinions.
MEETINGS -All Board meetings are open to the public and are held on the first and third Tuesdays of
each month; .the first Tuesday at 6:00 P.M. and the third Tuesday at 9:00 A.M., unless otherwise
advertised. Meetings are held in the County Commission Chambers in the Roger Poitras Administration
Annex at 2300 Virginia Ave., Ft. Pierce, FL 34982. The Board schedules additional workshops throughout
the year as necessary to accomplish their goals and commitments. Notice is provided of these workshops.

SUBJECT: Apprenticeship Program -Options and Discussion
Backqround:
On December 8, 2009, the Board adopted the Apprenticeship Program, which set forth the
program's requirements, which are summarized below:
• The eligibility criteria for the apprenticeship program includes a construction project valued
over $300,000 that is fully funded by the County (i.e. cannot be grant funded).
• For eligible projects, the Purchasing Division (with assistance of the consulting engineer if
necessary) identifies all trades that will be used on the project and ensures that the
apprenticeship program for the identified trade(s) is registered with St. Lucie County.
• As a bid requirement, 20% of all workers for each applicable trade must be apprentices.
• The apprenticeship requirement may be waived by the Board:
o If the contractor can demonstrate that the required apprentices are not available
despite a good faith effort on the contractor's part; or
If the Board determines it is in the best interests of the County to waive such
requirement based on potential savings of money and time.
Unless waived by the Board of County Commissioners, failure to demonstrate compliance
with the 20% requirement shall result in the bid being deemed non-responsive
Since the adoption of this program St. Lucie County has advertised 49 construction bids of which
only four have met the criteria that included the Apprenticeship Program. Those bids are as
follows:
- The first bid that included the apprenticeship program was for the Renovations of Floors 3
and 4 of the Old Clerk of Court Building; the awarded bidder was not successful in meeting
requirement of the apprenticeship program for this project.
- The second bid was for the South County Annex HVAC Equipment Renovations at a total
bid price of $487,786. The awarded bidder included the use of three (3) apprentices for this
project. The awarded contractor was successful in meeting their requirement and utilized

apprentices from the Florida Construction Apprenticeship Training Corp which has a training
facility with Indian River State College and is registered with St. Lucie County.
- The third bid with a total price of $2,399,500 was for the construction of the St. Lucie County
Recyclables Processing Facility. The County received only one submittal in response for
this project. The submittal included the use of 5°/u apprenticeship utilization although staff
worked with the sole bidder to achieve the 20% apprenticeship requirement on two of the
three trades included in the bid documents.
The contractor will be utilizing a total of three (3) apprentices. Of the 3 workers for the
pipefitting trade, one will be an apprentice. Of the four (4) workers for the HVAClsheet
metal trade, two (2) will be apprentices.
The. contractor will be utilizing one (1) apprentice from the Palm Beach Plumbing, AIC and
Pipefitting JAC and two (2) apprentices from the Palm Beach Sheet Metal JATC (Joint
Apprenticeship and Training Committee). Both organizations are partnered with the Green
Collar Task Farce and are registered with St. Lucie Ceunty.
The fourth bid was for the Re-use Troatment Additions to the North County Waste Water
Treatment Facility, There were four submittals received for this project but all bids were
rejected because the low bidder did not include the apprentice requirement in their submittal
and the other three submittals were over-budget -although the higher costs were not
attributable to the apprenticeship requirement but rather the project cost itself.
Aside from leaving the program as it currently exists, there are a few ideas that staff has identified o
for the Board to consider. In addition, there may be other ideas that the Board itself may want to 0
suggest of have staff explore. J

- Raise the project threshold to $1 million (or a higher threshold). "
For eligible projects, a higher threshold would result in larger projects that would require a
greater number of apprentices and increase the amount of time that apprentices would work on
a project, Projects fhat meet the current $300,000 threshold and are less than $t million tend to
be small and typically require fewer workers and fewer trades than a larger project.
- Require all eligible projects to disclose bid prices with and without apprenticeship
labor.
Since the Board has the discretion to waive the apprenticeship requirement, knowing the project
cost with and without apprenticeship labor will allow the Board to better evaluate the bid and
understand the impact of the apprenticeship requirement.

A RESOLUTION AMENDING THE ST. LUCIE COUNTY MANUAL OF
PURCHASING REGULATIONS AND PROCEDURES; AMENDING
SECTION 9 CONSTRUCTION PROJECTS TO CREATE SECTION 9.8
APPRENTICESHIP PROGRAM REQUIREMENTS; PROVIDING AN
EFFECTIVE DATE
WHEREAS, on October 7, 1985, the Board of County Commissioners for St. Lucie County,
(the "Board") adopted Resolution No. 65.212 which established the purchasing regulatiohs and
procedures for St. Lucie County, Florida, asset forth in the St. Lucie County Manual of Purchasing
Regulations and Procedures (the "Purchasing Manual"); and since that date the Purchasing
Manual has been amended from time to time.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of 5t. Lucie
County, Florida:
t. The St. Lucie County Manual of Purchasing Regulations and Procedures is hereby
amended as set out below:
9.8 APPRENTICESHIP PROGRAM REOUIREMENTS
Contractors shall be required to comply with the County's Apprenticeship Program, as
follows:
a. On County-funded construction projects which exceed $300.,000, twenty percent
(2050) of laborers wor)cing in specialties for which there are apprentice programs
registered with the County shall be apprentices. Such apprentices shall be
students in certified State of Florida Pre-Apprenticeship/Apprenticeship Programs
which are located in St. Lucie, Martin, Indian River or Okeechobee Counties and
which registered with the County.
b. ACounty-registered apprenticeship program is one which has registered with the
County and provided the required documentation, including but not limited to,
proof of certification as an apprenticeship program with the State of Florida and
proof ofhaving educational facilities physically [ocated in 5t. Lucie, Martin, Indian
River or Okeechobee Counties.
c, Unless the apprenticeship requirement is waived by the County, the failure of the
Contractor to demonstrate compliance with this requirement shall result in the
Contractor's bid being deemed nonresponsive,
d. The apprentice requirement may be waived or modified by the Director of
Management and Budget, with approval by the County AdmiMstratar, and appeal
to the Board of County Commissioners:

I. Upon request of the Contractor, if the Contractor demonstrates that the
required apprentices are not available despite a good faith effort on the
contractor's part; or
ii. Upon request of the Contractor, if the Contractor demonstrates that the
available apprentices are not sufficient to meet the required 20% and the
Cantractor commits to utilizing a specific percentage of apprentices who
are available; or
iii, if the County determines it is in the best interests of the County to waive
such requirement based on potential savings of money and time or grant
requirements.
e, The agreed upon percentage and type of apprentices will be included as a
requirement of the construction contract. Failure to meet the forms of the
apprenticesliiprequiremenf may result in the contractor being found in breach of
the contract and subject to possible monetary sanctions,

The Heathcote Protect Is a pa~tnershlp' Involving Several Ageacles, Including: Florida Communlttes Trust,
florlda Department of Environmental Protection, South Florida Water Management t)Istrlct, Clty of Fort
Pleree and St, Lucie County.
Management of the :Protect design and constructlon Is being done by the City and the County. The
Project goals have changed slgnlflcantly since the original concept was started In 2004. The primary
goals now are as follows:
1. Stormwater Improvements for the Indian River Lagopn
,2, ParkemenitiesandPublicuse
The P~oJecf funding has been provided by Slate grants In the amount of $4:2 million. Some of tNe grants
are specifically for stprmwater components and cannot be used for park Improvements. The laty Is
administering all of LMe grant funds, iaclutling the FCYgrant,
The Protect has required a tremendousamount of coordlnatton between ttie Clty and County due to the
complexity.
There are slg (Ii) contract agreements that gpvern the protect design parameters and permit conditions.
Some of the design components are requirements of the grant contracts, such as an alum treatment
system:and floating vegetative mats,. Llkewlse,the permits require wetland restoration as mitigation for
Impacts,
The Clty of Fprt Pierce has agreed to design & construct the stprmwater components of the Project. The
City will magage inspection and certification of the Stormwater components, and will own and operate
the system after constructlon. The City will reielve credits towards their State requirements for
pollution load reduction goals (TMDCs) as a result of the neWconstructlon.
The Stormwater Improvements plan (copyattached) Includes: expansion ofthe existinglake to Increase
storage volume, elimination of tte bypass canal, construcklon of a blo Swale system, constructlon of an
AIUmTreatment Plant and constructlon of a pedestrJan walking trail around the lake perimeter, The
lake outfall structure will be modified to Increase overall detention time.

The Clty Is awarding the constructlon contract in January, 2014, and Is anticipating the start date In
March. The estimated cost of constructlon for the Stormwaterlmprovementsis$2,5 million,
The County Is responsible for the FCT Grant condltlons and for'the FCT Management Plan. The County
will design and construct the Park amenities that Ore required by the FCi Management Plan. The
County will manage Inspection and certification of the Park components and will amend the FCT
Management Plan as necessary. eased upon previous discussions with FC7 Staff, the County can amend
the FCT Management Plan provided thebaslccomponents remain Intact.
The FCT Park Improvement plan (copy attached) Includes:. nature trails, canoe launch, gazebos,
observation deck, several pedestrian bridges and public parking areas. The FCT Grant can be used to
fund constructlon of the park improvements. The estimated cast of constructlon Is $250,000. The
County will coordinate the timing of the construction of the park components so as not to Interfere with
the stormwater project. Some of the park components cannot be lnstalletl pntil after the stormwater
project is completed.
The. HeathCOte Project Is a work In progress and several outstanding issues remain to be resolVetl In the
future. Once we have defined the. magnitude and scope of the planned Improvements, an oppprtunlty
exists to modify or downsize the required mitigation improvements, Thls exercise will require
modification of the Army Corps permit and the surface water (SFWMD) permit. Reddctlon of the
required mltlgatlon should reduce the overall protect cost
A Consultant contract will need to be estatillshed for the mltlgatlon monitoring condltlons that are
spedfled In the permits. Monitoring Is generally required for 5 years after constructlon Is completed.
Finally, the exlstinginterlocal Agreement will needto be amended to reflect new responsibilities for the
City and the County.
