Discoloration or damage caused by water,salts,chemicals and/or abuse,misuse,negligence,alteration,accident,vandalism,or acts of God void this warranty.* TERMS/CONDITIONS_ 1.Materials Guaranteed to be specified herein or equal. 2.Workmanship:To be completed in a workmanlike manner in accordance with the standards in the industry. 3.Fence Location:To be responsibility of owner/purchaser.STUART FENCE CORP.(herein after referred to as SFC)is not responsible for and owner/purchaser agrees to hold harmless and indemnify any and all suits or claims for damage(s)resulting from fence location or damage to underground pipe,electrical, telephone,gas,water,cable TV service,sprinkler or irrigation systems,swimming pool filter lines,or any other damage to personal or real property unless owner/purchaser furnishes SFC prior to installation with(1)accurate survey,(2)accurate diagram indicating location of owner/purchaser property lines,AND (3)location of any and all underground pipes,electrical,telephone,gas,water,cable TV service,sprinkler or irrigation systems,swimming pool filter lines,or any other personal property obstructions overhead or underground as outlined herein and above. 4.Changes to Contract work:Shall be considered a change in the original scope for which the parties contracted for and said changes will be add-ons to the contract price or deducted from the contract price accordingly as determined solely by SFC.In the event changes for lesser amounts of work are ordered, owner/purchaser will be responsible for costs of material purchased and labor expended up to the point of the change. 5.Title In goods:Owner/purchaser agrees that title to the goods herein described shall not pass to the owner/purchser until all payments due SFC are paid in full according to the terms of the contract.Owner/purchaser agrees to grant SFC free access to the property to remove fence materials in the event OWNER/PURCHASER FAILS TO PAY SFC according to the terms of this contract. 6.Unpaid Balance:Owner/purchaser agrees to pay SFC 1.5%interest per month(18%annual)for any and all unpaid monies due according to the terms of this contract commencing the day the fence installation is completed,together with the costs of collection,including a reasonable attorney's fee's. 7.Ground Site Conditions:Contract price is based on normal ground conditions.In the event construction debris is found during Installation.SFC will notify owner/purchaser immediately,and SFC shall be entitled to a cost increase as determined by SFC not to exceed 10%of the contract price as agreed. S.Delays:SFC shall not be liable for delays caused by acts of God,strikes,unavailability of materials or other events that are beyond our control. 9.Cancellation:Deposit monies will be forfeited by owner/purchaser in the event owner/purchaser cancels this contract unless expressly agreed to by SFC prior to commencement of work.Materials or other items purchased prior to cancellation together with a preparation fee of 20%of the total job cost will be paid for by owner/purchaser and deducted from the deposit monies.In the event the owner/purchaser fails to cooperate with SFC on any requirements to the completion of this contract,SFC shall cancel this contract and refund deposit less expenses incurred. 10.SFC shall not be responsible for rules and/or restrictions set forth by Homeowner/Condo Associations.Any changes will be in addition to the dollar value of this contract. 11.if owner/purchaser agrees to clear fence line of obstruction(trees,shrubs,branches;debris,etc.)and fails to do so prior to commencement.SFC installers will do this and charge the owner/purchaser an additional$45.00 per hour,per man,for this work.All obstructions removed will be left on job site.
