(LF EST) Case No. 84989 was heard first on the agenda: Case #84989, Location of violation, 208 Rouse Rd., Ft. Pierce, FL, Property Owners, John and Louise Cross. Mr. Cross the property owner was sworn in by the Board’s Secretary. Officer Williams addressed the Board and stated for the record she is re-submitting two (2) photos dated September 11, 2015, two (2) photos dated December 1, 2015, one (1) dated March 1, 2016, and submitting three (3) photos dated September 6, 2016. Officer Williams stated on August 11, 2015, the property was found in violation of Section 38 -26 for having outside storage of items and materials such as tires, pallets, and other miscellaneous items, Section 11.05.00 for not having a Zoning Compliance permit to use the property as a storage facility and Section 42-103 formally known as Section 1-12-17 for not having a Business Tax License for the storage facility. 3 Officer Williams stated this case has been continued numerous times due to the property owner trying to evict the person who caused the violations and abate the violation himself. She noted at the last hearing on June 1, 2016, the Board continued the case to today’s meeting. There was discussion among the Board, staff and Mr. Cross regarding the violations on the property. Mrs. Monahan made a motion in reference to Case No. 84989 that the Code Enforcement Board continues this case to the Code Enforcement Board hearing on December 7, 2016. Mr. Taylor seconded and the motion carried unanimously. Case #88176, Location of violation, 1050 Tilton Rd., Port St. Lucie, FL, Property Owner, Raymond N. Roddy. Mr. Roddy the property owner was sworn in by the Board’s Secretary. Officer Brubaker addressed the Board and stated for the record she is submitting the property appraiser card, the realtor card, and one (1) photo dated September 1, 2016. Officer Brubaker stated during her first inspection she found 1050 Tilton Rd. in violation of 11.05.01, for adding two bedrooms to the barn without the proper permits. She stated she issued a letter and gave a compliance date of June 20, 2016. She stated staff has had contact with the owner and discussed the ways to correct the violation. She noted as of September 7, 2016 the property remains in violation. There was discussion among the Board, staff and Mr. Roddy, regarding the violation on the property. Mr. Currie made a motion in reference to Case #88176 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by December 1, 2016, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be held if the violation is not abated by the given compliance date. Mr. Murdock seconded and the motion carried unanimously. Case #85335, Location of violation, 1050 Tilton Rd., Port St. Lucie, FL, Property Owner, Raymond N. Roddy. Mr. Roddy the property owner was sworn in by the Board’s Secretary. Officer Barrios addressed the Board and stated for the record, she is submitting seven (7) pictures dated September 1, 2016, one (1) picture of the aerial and one (1) google earth picture. Officer Brubaker stated on November 13, 2015 a Notice of Violation was sent to Raymond N. Roddy, the property owner at 1050 Tilton Rd., for the following sections of the St. Lucie County Land Development Code: Section 11.05.01, Building and Sign Permits: please obtain a demolition permit for the primary structure, Section 8.00.01, Accessory Uses and Structures: accessory structures are not allowed on the property without a primary structure, please remove the accessory structures from the property, Section 3.01.03, (E) Ar-1 Agricultural Residential District: please cease living in the accessory structures as this is not permitted with a correction date of December 4, 2015. She stated staff has had communication with the property owner and on July 15, 2016 a Notice to Appear was sent. She noted as of September 7, 2016 the property remains in violation. There was discussion among the Board, staff and Mr. Roddy regarding the violations on the property. Mr. Currie made a motion in reference to Case #85335 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations 4 of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by December 1, 2016, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Samuel Reynolds, representative for the property owner was sworn in by the Board’s Secretary. Officer Moise addressed the Board and stated for the record, she is submitting six (6) photos, one (1) dated June 29, 2016, one (1) dated August 26, 2016, one (1) dated August 29, 2016 and three (3) dated September 6, 2016. Officer Moise stated during her first inspection she found 2700 Sheraton Blvd. in violation of Section 13.09.00, Section 303.2, to repair the rotted wood and broken front window. She stated she issued a letter and gave a compliance date of July 13, 2016. She stated she has had no contact with the owner and as of September 6, 2016 the property remains in violation. There was discussion among the Board, staff and Mr. Reynolds regarding the violation on the property. Mr. Hofmann made a motion in reference to Case #88666 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by November 4, 2016, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for pros ecuting this case. Pierce Steven and Carolyn Prince 5 Mr. Taylor made a motion in reference to the cases read into the record that the Code Enforcement Board enter an Order of Finding against the violator finding the violator in default and if the violator does not appear to contest the violations against him/her that the Board adopt the recommendation of staff as set forth on the agenda. Mr. Campion seconded and the motion carried unanimously. IX. FINE HEARING: Case #86676, Location of violation, 5511 Sunset Blvd., Ft. Pierce, FL, Property Owner, Grover R. Fasnacht Jr. There was no one present to represent the property owner. Officer Brubaker addressed the Board and stated this case was brought to the June 1, 2016 Code Board and found in violation of 11.05.01, a structure built without a permit and was given until August 5, 2016 to come into compliance. She stated for the record she is re-submitting two (2) photos, one (1) dated May 23 2016 and one (1) dated May 31, 2016. She stated on August 16, 2016 a permit for the structure was applied for. She noted as of September 6, the permit is still pending and the property remains in violation. There was discussion among the Board, and staff regarding the violation on the property. Mr. Murdock made a motion in reference to Case No. 86676 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting November 2, 2016 with a maximum fine not to exceed $5,000.00. Mr. Hofmann seconded and the motion carried. Case #84525, Location of violation, 8229 S US Hwy. 1, Port St. Lucie, FL, Property Owner, Christian Dickert. Christian Dickert was sworn in by the Board’s Secretary. Officer Brubaker addressed the Board and stated this case was found in violation at the February 2016 Code Board for Section 3.01.03 (S), the cargo containers are not permitted in a Commercial General zoning and Section 7.10.02, outdoor displays in a Commercial General zoning. She stated they were given until September 1, 2016 to come into compliance. She stated for the record she is re-submitting nine (9) photos and submitting five (5) photos, three (3) dated June 10, 2015, two (2) dated November 17, 2015, four (4) dated February 2, 2016 and five (5) dated September 6, 2016. She stated she is also submitting the site plan and two warehouses orders. She stated she has had contact with the owner and Mr. Dickert is here to ask for more time to comply. She stated staff supports the extension. She noted Mr. Dickert has removed fifteen (15) of the twenty-two (22) cargo containers on the property and has removed many tires. She noted as of September 6, 2016 the property remains in violation. There was discussion among the Board, staff and Mr. Dickert regarding the violations on the property. Mrs. Monahan made a motion in reference to Case No. 84525 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violations and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation s exist starting January 31, 2017 with a maximum fine not to exceed $10,000.00. Mr. Hofmann seconded and the motion carried. Case #84516, Location of violation, 8229 S US Hwy. 1, Port St. Lucie, FL, Tenant/Violator, The Tire Stop Inc. Christian Dickert, the property owner was sworn in by the Board’s Secretary. 6 Officer Brubaker addressed the Board and stated this case was found in violation at the February 2016 Code Board for Section 3.01.03 (S), the cargo containers are not permitted in a Commercial General zoning and Section 7.10.02, outdoor displays in a Commercial General zoning. Mr. Taylor seconded and the motion carried. Case #86269, Location of violation, 7508 Hibiscus Rd., Ft. Pierce, FL, Property Owner, Mary W. Lewis. Mary W. Lewis was sworn in by the Board’s Secretary. Officer Swartzel addressed the Board and stated for the record, she is re-submitting four (4) photos, one (1) dated December 7, 2015, one (1) dated February 22, 2016, one (1) dated March 29, 2016, one (1) dated April 4, 2016 and she is submitting one (1) dated September 6, 2016. She stated 7508 Hibiscus Rd. was brought to the April 6, 2016 Code Board and found in violation of Section 11.05.0 1, Building and Sign Permits, to obtain a permit for changing out the windows. She stated the Board gave a compliance date of August 5, 2016. She stated she has had contact with the owner since the Board and the owner has been working with the plans examiners in regards to the permit. She noted as of S eptember 6, 2016 the property remains in violation and the property owner is here to ask for more time. There was discussion among the Board, staff, and Mary Lewis regarding the violation on the property. Mr. Murdock made a motion in reference to Case No. 86269 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting January 30, 2017 with a maximum fine not to exceed $5,000.00. Mrs. Monahan seconded and the motion carried unanimously. Case #87075, Location of violation, 7804 Pacific Ave., Ft. Pierce, FL, Property Owner, Oriol Pierre. Ronald Gilbert, representative for the property owner was sworn in by the Board’s Secretary. Officer Swartzel addressed the Board and stated for the record, she is re-submitting five (5) photos, four (4) dated March 3, 2016, and one (1) dated May 27, 2016. She stated she is also re-submitting the MLS sheet. She stated 7804 Pacific Ave. was brought to the June Code Board and found in violation of Section 11.05.01 , Building and Sign Permits, to obtain a permit for the renovations done to the house and section 13.08.01 , Adopting Standard Building Code, Section 604.3, Electrical System Hazards, the electrical outlets are sparking, exposed and unsafe. She stated the Board found the property in violation and gave a compliance date of August 5, 2016. She stated she has had contact with the representative for the property and the 7 contractor. She noted as of September 6, 2016 the property remains in violation and no permits have been applied for. There was discussion among the Board, staff and Mr. Gilbert regarding the violations on the property. Mr. Murdock made a motion in reference to Case No. 87075 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by th e violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation s exist starting January 15, 2017 with a maximum fine not to exceed $5,000.00. Mr. Taylor seconded and the motion carried unanimously. Case #85919, Location of violation, 3033 Pioneer Cir., Ft. Pierce, FL, Property Owner, Nick Priest (EST), Samuel D. Steele (EST), and Dan Williams. There was no one present to represent the property owner. Officer Goycochea addressed the Board and stated for the record, she is submitting seven (7) photos, six (6) photos dated October 29, 2015 and one (1) dated November 2, 2015. She stated this case was brought before the June 1, 2016 Code Board for being in violation of Section 13.09.00, Exterior Property Maintenance, for the mold and mildew, Section 13.08.01, Standard Housing Code, Plumbing Systems and Fixtures, and Section 13.08.01, Standard Building Code, Electrical System Hazards. She stated the Board gave a compliance date of August 2, 2016. She stated staff has not had any contact with Mr. Williams and as of September 6, 2016, the property is still in violation. Mr. Currie made a motion in reference to Case No. 85919 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting August 6, 2016 with a maximum fine not to exceed $5,000.00. Mr. Taylor seconded and the motion carried unanimously. Case #86549, Location of violation, 3402 Avenue F., Ft. Pierce, FL, Property Owner, Willie J. and Melissa Lee. There was no one present to represent the property owner. Officer Williams addressed the Board and stated for the record, she is re-submitting twenty-one (21) photos dated January 11, 2016. She stated on January 11, 2016, the property was found in violation of S ection 13.08.01, Article 304 for having a roof in disrepair, Section 13.08.01, Article 309.1, for having infestation of bugs, Section 13.08.01, Article 305, to repair the ceiling. Section 13.08.01, Article 504, to repair the plumbing and install proper plumbing fixtures, Section 13.08.01, Article 305, to repair the holes in the wall, Section 13.08.1, Article 604.3, to repair the electrical system, Section 13.08.01, Article 304.12, to repair the windows, Section 13.08.01, Article 304.6, to repair the hole in the walls on the back of the property, Section 13.08.01, Article 304.13, to repair the windows and doors to make them weather tight, Section 13.08.01, Article 505.3, to supply the structure with water and Section 13.09.01, Article 504.3, to cover the system tank. Officer Williams stated at the April 6, 2016 meeting, the property owners were present and the Board found the property in violation and gave a compliance date of September 4, 2016. She stated since the Board meeting, she has not had any contact with the property owners. She further stated since the property owners have not shown her that the violations have been corrected, as of today’s date, the property is still in violation. There was discussion among the Board, and staff regarding the violations on the property. Mr. Murdock made a motion in reference to Case No. 86549 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the 8 violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting September 5, 2016 with a maximum fine not to exceed $10,000.00. Mrs. Monahan seconded and the motion carried unanimously. 2nd Motion Mr. Murdock made a motion in reference to Case No. 86549 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the condition caused the violation presents a serious threat to the public health, safety, and welfare and Staff is directed to notify the St. Lucie County Board of County Commissioners of the conditions. Mrs. Monahan seconded and the motion carried unanimously. X. REPEAT VIOLATION: Case #89234, Location of violation, 7701 Lakeland Blvd., Ft. Pierce, FL, Property Owner, Nathanial E. and Billie Jo Anderson. Nathanial E. Anderson was sworn in by the Board’s Secretary. Officer Swartzel addressed the Board and stated for the record she is submitting three (3) photos, one (1) dated August 17, 2016, one (1) dated August 19, 2016, and one (1) dated August 29, 2016. She stated 7701 Lakeland Blvd. was originally brought to the May 4, 2016 Code Board and found in violation of Section 8.00.03 (F), Particular Permitted Accessory Structures, a maximum of two (2) pieces of recreation equipment may be stored on the property and only one (1) may be stored in the front yard. She issued a Repeat Violation letter to appear to the September Code Board. Officer Swartzel stated on August 17, 2016 she inspected the property and found it to be in violation again of Section 8.00.03(F), Particular Permitted Accessory Structures, a maximum of two (2) pieces of recreation equipment may be stored on the property and only one (1) may be stored in the front yard. She stated she issued a Repeat Violation letter for the September Code Board. She stated she has had contact with the property owner and on August 29, 2016 the property was brought into compliance. She stated the property was in violation for eleven (11) days. There was discussion among the Board, staff, and Nathanial Anderson regarding the repeat violation on the property. Mrs. Monahan made a motion in reference to Case No. 89234 that the Code Enforcement Board makes the following determination: After hearing testimony, the facts in the case, and the report of staff that the violation previously committed has been repeated, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $50.00 shall be imposed for the violation if paid within thirty (30) days. A prosecution cost was not imposed. Mr. Hofmann and the motion carried unanimously. XI. REFERRAL TO THE BOARD OF COUNTY COMMISSIONERS: None. XII. FINE REDUCTION HEARING Case No. 82469, Location of violation, 8280 Business Park Dr., Port St. Lucie, FL, Property Owners, Good Samaritan Ministries. Fine Reduction requested by Pastor Vito Bitetto, Good Samaritan Ministries. This reduced fine must be paid within thirty (30) days of this hearing or the fine will revert back to the original fine of $5,000.00 and prosecution cost of $200.00.
