THE IL (INDUSTRIAL, LIGHT) ZONING DISTRICT
OF CERTAIN PROPERTY IN ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
the testimony and evidence including but not limited to the staff report has made the
following determinations:
Cassens Land Enterprises. Inc.. presented a petition for a change in
zoning from the AR-1 (Agricultural, Residential - 1 du/acre) Zoning
District to the IL (Industrial, Light) Zoning District for the property
described below.
On June 17, 1999, the St. Lucie County Planning and Zoning
Commission held a public headng on the petition, after publishing
notice at least 10 days prior to the hearing and notifying by mail all
owners of property within 500 feet of the subject property, and
recommended that the Board of County Commissioners approve the
hereafter described request for a change in zoning from the AR-1
(Agricultural, Residential - I du/acre) Zoning District to the IL
(Industrial, Light) Zoning District for the property described below.
On July 20, 1999, this Board held a public hearing on the petition,
after publishing notice at least 10 days prior to the headng and
notifying by mail all owners of property within 500 feet of the subject
property.
The proposed change in zoning is consistent with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan
and has satisfied the requirements of Section 11.06.03 of the St.
Lucie County Land Development Code.

The proposed rezoning of property located at 3180 N. Kings Highway from the AR-1
(Agricultural, Residential - 1 du/acre) Zoning District to the IL (Industrial, Light) Zoning District.
The stated purpose of the rezoning is to allow for the continued use of a storage/warehouse.
At the June 17, 1999, public hearing on this matter, the St. Lucie County Planning and Zoning
Commission, by a vote of 5 to 0 with four members absent (Ms. Wesloski, Mr. Lounds, Mr.
Mathis, and Mr. Moore), recommended approval of this petition as set forth in Draft Resolution
99-021.
This proposed rezoning meets the standards of review as set forth in Section 11.06.03 of the St.
Lucie County Land Development Code, and is not in conflict with the goals, objectives, and
policies of the St. Lucie County Comprehensive Plan.
Staff recommends the approval of this petition for a change in zoning from the AR-1 (Agricultural,

Ms. Snay stated that she was presenting the petition of Cassens Land Enterprises, Inc., for a Change
in Zoning f~om the AR-1 (Agricultural, Residential - 1 du/acre) Zoning District to the IL (Industrial,
Light) Zoning District for 2.48 acres of land located at 3180 Kings Highway. She stated that this
property is located in the MXD-AIRPORT Land Use, which under Pohcy 1.1.7.4 of the Future Land
Use Map of the County's Comprehensive Plan, limits the uses to those that are allowed in the
Commercial, Industrial, T/U, or P/F land use designations. She stated that the proposed change in
zoning is consistent with all elements of the St. Lucie County Comprehensive Plan.
Ms. Snay stated that the surrounding zoning to the subject property is AR-1 (Agricultural,
Residential - 1 du/acre) to the north, west, and east. CG (Commercial, General) is located to the
south.
Ms. Snay stated that staff has reviewed this petition and determined that it conforms with the
standards of review as set forth in the St. Lucie County Land Development Code and is not in
conflict with the St. Lucie County Comprehensive Plan. Staff is, therefore, recommending that you
forward this petition to the Board of County Commissioners with a recommendation of approval.
Chairman Wesloski asked if there were any questions for Ms. Snay.
Chairman Wesloski asked if the applicant was present. No applicant stepped forward.
Chairman Wesloski stated that normally the Board would table an application when the applicant
is not present.
Mr. Kelly stated that tabling for a month has been the practice in the past.
Chairman Wesloski asked if there was a motion.
Mr. Men'itt made a motion to continue this petition to the June 17, 1999, meeting.
Mr. Grande seconded the motion.
Upon roll call, the motion was approved, 7-0.

Chairman McCurdy explained the Planning and Zoning Commission hearing procedures.
Ms. Cyndi Snay presented staff comments.
Ms. Snay stated that she was presenting the petition of Cassens Land Enterprises, Inc. for a Change
in Zoning from the AR-1 (Agricultural, Residentiai - 1 du/aere) Zoning District to the IL (Industrial,
Light) Zoning District.
Ms. Snay stated that the purpose of the rezoning is to continue the existing warehouse/storage
operation for property located at 3180 North Kings Highway. The subject property is located within
the MXD-Airport land use designation.
Ms. Snay stated that according to Policy 1.1.7.4 of the St. Lucie County Comprehensive Plan the
subject property would be appropriate for either commercial or industrial development. The
applicant's request for a Change in Zoning would be compatible and would further the Goals,
Objectives, and Policies of the St. Lucie County Comprehensive Plan. The rezoning is not expected
to create additional demands on service delivery as the subject property is already being utilized as
a storage/warehouse facility in association with a grove.
Ms. Snay stated that staff has reviewed this petition and determined that it conforms with the
standards of review as set forth in the St. Lucie County Land Development Code and that the request
is consistent with the Goals, Objectives, and Policies of the St. Lucie County Comprehensive Plan.
Staff is, therefore, recommending that you forward this petition to the Board of County
Commissioners with a recommendation of approval.
Chairman McCurdy asked if there was any discussion of the Board.
At this time, Chairman McCurdy opened the public portion of the hearing.
Mr. Steve Cassens, 3180 North Kings Highway, Fort Pieme, addressed the Board. Mr. Cassens
stated that he would be happy to answer any questions that the Board may have.
Mr. Merritt asked Mr. Cassens if this parcel of land is currently in operation.
Mr. Cassens stated that currently there is an office, a warehouse, and a maintenance shop. He stated
that he is concerned about the warehouse which he stores agricultural products and repairs pallet bins
for packing houses. He said that he would like to use this warehouse for other reasons, such as for
paper goods.

Mr. Merritt asked Mr. Cassens what is located next to the warehouse.
Mr. Cassens stated that the piece of property that is located directly to the south of the warehouse
is a mower repair shop.
Chairman McCurdy asked if there were any other questions from the Board.
Chairman McCurdy asked if there was anyone else from the public that would like to speak on this
issue.
Hearing no arguments in favor or in opposition to Cassens Land Enterprises, Inc., Chairman
McCurdy closed the public portion of the hearing.
Chairman McCurdy asked what was the pleasure of the Board.
After considering the testimony presented during the public hearing, including staff comments, and
the standards of review as set forth in Section 11.06.03, St. Lucie County Land Development Code,
Mr. Merritt moved that the Planning and Zoning Commission recommend that the St. Lucie County
Board of County Commissioners grant approval to the application of Cassens Land Enterprises,
Inc., for a Change in Zoning from the AR-1 (Agricultural, Residential - 1 du/acre) Zoning District
to the IL (Industrial, Light) Zoning District.
Mr. Grande seconded the motion, and upon roll call the motion was approved 5-0.
Chairman McCurdy stated that the petition would be forwarded to the Board of County
Commissioners with a recommendation of approval.

north, west, and east. CG (Commercial, General) is located
to the south.
The existing uses in this area are agricultural, industrial and
commercial along North Kings Highway.
The Future Land Use Classification of the immediate
surrounding area is MXD-AIRPORT.
Station 4 (2850 Aviation Way), is located approximately 3
miles to the east.
Water and sewer services are to be provided on site.
The existing right-of-way for North Kings Highway is 60
feet.
North Kings Highway is tentatively scheduled for
resurfacing in FY 1998-99. Widening of this roadway is not
programmed as part of the County FDOT work program.

The applicant is requesting a change in zoning from the AR4 (Agricultural, Residential
1 du/acre) Zoning District to the IL (Industrial, Light) Zoning District. The area in which
the subject property is located is designated MXD-AIRPORT on the future land use map
of the County's Comprehensive Plan. Policy 1.1.7.4 states:
"Mixed Use activity areas shall be developed in the sub area Mixed Use
activity areas as depicted in Figure 1-10a thru 1-10j."
According to Figure 1-10D, the subject property is located in area designated as
Commercial/Industrial. This area is restricted to those uses that would be equivalent to the
Commercial, Industrial, T/U or P/F land use designations.
The proposed change in zoning is consistent with all elements of the St. Lucie County
Comprehensive Plan. The MXD-Airport Land Use and its sub area as shown on Figure
1-10D requires a CG (Commercial General), IL (Industrial, Light) or IH (Industrial, High)
Zoning District, or a PNRD (Planned Non-Residential District) consistent with these
districts.

The rezoning of the property is not expected to create significant additional demands on
any public facilities in this area. The subject property is currently operating as a
storage/warehouse. The proposed use will continue as a storage/warehouse facility. Prior
to the approval of any expansion to the existing facility, the applicant will need to provide
documentation verifying that sufficient facilities are in place to support the new
development.
Whether and the extent to which the proposed amendment would result in significant
adverse impacts on the natural environment;
The proposed amendment is not anticipated to create adverse impacts on the natural
environment. The applicant will be required to comply with all federal, state, and local
environmental regulations. The site does not contain any known unique or threatened
habitat.
Whether and the extent to which the proposed amendment would result in an orderly
and logical development pattern specifically identifying any negative affects of such
patterns;
An orderly and logical development pattern will occur with this change in zoning. The
surrounding parcels of property are designated for uses as required within the MXD-
Airport land uses. The Comprehensive Plan identifies the area under consideration with
a land use and further requires either a Commercial General, Industrial or PNRD (Planned
Non-Residential District) Zoning classification. In addition, the development patterns
along Kings Highway have taken on a more urbanized (commercial and industrial) pattern.
Whether the proposed amendment would be in conflict with the public interest, and
is in harmony with the purpose and intent of this Code;

The petitioner, Cassens Land Enterprises, Inc., has requested this change in zoning from the
AR-I (Agricultural, Residential - 1 du/acre) Zoning District to the IL (Industrial Light) Zoning
District in order to cominue the existing storage/warehouse use of the subject property under a
new tenant on the subject property. Cassens current operation is a permitted use in the AG-1
(Agricultural 1 du/acre) zoning district. The existing storage/warehouse facility is designated as
an accessory use to the agricultural use (grove). The rezoning is necessary in order for the
storage/warehouse facility to be utilized as a use that is not a part of the overall operation of the
grove. The subject property is in an area designated within the Comprehensive Plan for more
intensive Commercial or Industrial Uses.
Staff has reviewed this petition and determined that it conforms with the standardf of review as
set forth in the St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan. Staff recommends that you
forward this petition to the Board of County Commissioners with a recommendation of approval.

The exist'rog uses in this area are agricultural, industrial and
commercial along North Kings Highway.
The Furore Land Use Classification of the immediate
surrounding area is MXD-AIRPORT.
Station 4 (2850 Aviation Way), is located approximately 3
miles to the east.
Water and sewer services are to be provided on site.
The existing right-of-way for North Kings Highway is 60
feet.
North Kings Highway is tentatively scheduled for
resurfacing in FY 1998-99. Widening of this roadway is not
programmed as part of the County FDOT work program.

In reviewing this application for proposed rezoning, the Planning and Zoning Commission shall

Lucie County Land Development Code;
The applicant is requesting a change in zoning from the AR-1 (Agricultural, Residential
1 du/acre) Zoning District to the IL (Industrial, Light) Zoning District. The proposed
rezoning is consistent with the St. Lucie County Land Developmem Code.

Whether the proposed amendment is consistent with all elements of the St. Lucie
County Comprehensive Plan;
The applicant is requesting a change in zoning from the AR-1 (Agricultural, Residential
1 alu/acre) Zoning District to the IL (Industrial, Light) Zoning District. The area in which
the subject property is located is designated MXD-AIRPORT on the future land use map
of the County's Comprehensive Plan. Policy 1.1.7.4 states:
"Mixed Use activity areas shall be developed in the sub area Mixed Use
activity areas as depicted in Figure 1-10a thru 1-10j."
According to Figure 1-10D, the subject property is located in area designated as
Coinmercial/Industrial. This area is restricted to those uses that would be equivalent to the
Commercial, Industrial, T/U or P/F land use designations.
The proposed change in zoning is consistent with all elements of the St. Lucie County
Comprehensive Plan. The MXD-Airport Land Use and its sub area as shown on Figure
1-10D requires a CG (Commercial General), IL (Industrial, Light) or IH (Industrial, High)
Zoning District, or a PNRD (Planned Non-Residential District) consistent with these
districts.
Whether and the extent to which the proposed zoning is inconsistent with the existing
and proposed land uses;
The proposed zoning is consistent with existing and proposed land uses in the area. The
general use of the immediate surrounding area of the subject property is as follows:

on public facilities, and whether or to the extent to which the proposed amendment

waste, mass transit, and emergency medical facilities;
The rezoning of the property is not expected to create significant additional demands on
any public facilities in this area. The subject property is currently operating as a
storage/warehouse. The proposed use will continue as a storage/warehouse facility. Prior
to the approval of any expansion to the existing facility, the applicant will need to provide
documentation verifying that sufficient facilities are in place to support the new
development.
Whether and the extent to which the proposed amendment would result in significant
adverse impacts on the natural environment;
The proposed amendment is not anticipated to create adverse impacts on the natural
environment. The applicant will be required to comply with all federal, state, and local
environmental regulations. The site does not contain any known unique or threatened
habitat.
Whether and the extent to which the proposed amendment would result in an orderly
and logical development pattern specifically identifying any negative affects of such
patterns;
An orderly and logical development pattern will occur with this change in zoning. The
surrounding parcels of property are designated for uses as required within the MXD-
Airport land uses. The Comprehensive Plan identifies the area under consideration with
a land use and further requires either a Commercial General, Industrial or PNRD (Planned
Non-Residential District) Zoning classification. In addition, the development patterns
along Kings Highway have taken on a more urbanized (commercial and industrial) pattern.
Whether the proposed amendment would be in conflict with the public interest, and
is in harmony with the purpose and intent of this Code;
The proposed amendment would not be in conflict with the public interest and is in
harmony with the purpose and intent of the St. Lucie County Land Development Code.

The petitioner, Cassens Land Enterprises, Inc., has requested this change in zoning from the
AR-1 (Agricultural, Residential - 1 du/acre) Zoning District to the IL (Industrial Light) Zoning
District in order to continue the existing storage/warehouse use of the subject property under a
new tenant on the subject property. Cassens current operation is a permitted use in the AG-1
(Agricultural 1 du/acre) zoning district. The existing storage/warehouse facility is designated as
an accessory use to the agricultural use (grove). The rezoning is necessary in order for the
storage/warehouse facility to be utilized as a use that is not a part of the overall operation of the
grove. The subject property is in an area designated within the Comprehensive Plan for more
intensive Commercial or Industrial Uses.
Staff has reviewed this petition and determined that it conforms with the standards of review as
set forth in the St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan. Staff recommends that you
forward this petition to the Board of County Commissioners with a recommendation of approval.

The existing use in this area are agricultural, limited
industrial and commercial along North Kings Highway.
The Future Land Use Classification of the immediate
surrounding area is MXD-AIRPORT.
Station 4 (2850 Aviation Way), is located approximately 3
miles to the east.
Water and sewer services are to be provided on site.
The existing right-of-way for North Kings Highway is 60
feet.
North Kings Highway is tentatively scheduled for
resurfacing in FY 1998-99. Widening of this roadway is not
programmed as part of the County FDOT work program.

In reviewing this application for proposed rezoning, the Planning and Zoning Commission shall

Whether the proposed amendment is consistent with all elements of the St. Lucie
County Comprehensive Plan;
The applicant is requesting a change in zoning from the AR-1 (Agricultural, Residential
1 du/acre) Zoning District to the IL (Industrial, Ligh0 Zoning District. The area in which
the subject property is located is designated MXD-AIRPORT on the future land use map
of the County's Comprehensive Plan. Policy 1.1.7.4 states:
"Mixed Use activity areas shall be developed in the sub area Mixed Use
activity areas as depicted in Figure 1-10a thru 1-10j."
According to Figure 1-10D, the subject property is located in area designated as
Commercial/Industrial. This area is restricted to those uses that would be equivalent to the
Commercial, Industrial, T/U or P/F land use designations.
The proposed change in zoning is consistent with all elements of the St. Lucie County
Comprehensive Plan. The MXD-Airport Land Use requires either a CG (Commercial
General), IL (Industrial, Light) or IH (Industrial, High) Zoning District.
Whether and the extent to which the proposed zoning is inconsistent with the existing
and proposed land uses;
The proposed zoning is consistent with existing and proposed land uses in the area. The
general use of the immediate surrounding area of the subject property is as follows:

4. Whether there have been changed conditions that require an amendment;
The land conditions of the area have not changed so as to require an amendment.
Whether and the extent to which the proposed amendment would result in demands
on public facilities, and whether or to the extent to which the proposed amendment
would exceed the capacity of such public facilities, including but not limited to
transportation facilities, sewage fac'dities, water supply, parks, drainage, schools, solid
waste, mass transit, and emergency medical facilities;
The rezoning of the property is not expected to create significant additional demands on
any public facilities in this area. The subject property is currently operating as a
storage/warehouse. The proposed use will continue as a storage/warehouse facility. Prior
to the approval of any expansion to the exist'rog facility, the applicant will need to provide
documentation verifying that sufficient facilities are in place to support the new
development.
Whether and the extent to which the proposed amendment would result in significant
adverse impacts on the natural environment;
The proposed amendment is not anticipated to create adverse impacts on the natural
environment. The applicant will be required to comply with all federal, state, and local
environmental regulations. The site does not contain any known unique or threatened
habitat.

Whether and the extent to which the proposed amendment would result in an orderly
and logical development pattern specifically identifying any negative affects of such
patterns;
An orderly and logical development pattern will occur with this change in zoning. The
surrounding parcels of property are designated for uses as required within the MXD-
Airport land uses. The Comprehensive Plan identifies the area under consideration with
a land use and further requires either a Commercial General or Industrial Zoning
classification. In order for the subject property to be consistent with the Comprehensive
Plan, the rezoning would have to take place. In addition, the development patterns along
Kings Highway have taken on a more urbanized (commercial and industrial) pattern.
Whether the proposed amendment would be in conflict with the public interest, and
is in harmony with the purpose and intent of this Code;
The proposed amendment would not be in conflict with the public interest and is in
harmony with the purpose and intent of the St. Lucie County Land Development Code.

The petitioner, Cassens Land Enterprises, Inc., has requested this change in zoning from the

District in order to continue the existing storage/warehouse use of the subject property under a
new tenant on the subject property. Cassens current operation is a permitted use in the AG-1
(Agricultural 1 du/acre) zoning district. The subject property is in an area designated within the
Comprehensive Plan for more intensive Commercial or Industrial Uses.
Staff has reviewed this petition and determined that it conforms with the standards of review as
set forth in the St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan. Staff recommends that you
forward this petition to the Board of County Commissioners with a recommendation of approval.
