The-petition.was heard at three separate meetings of the Planning & Zoning~C°~issi°n' on Feb. 22,-Apr. 26th and May 24~, to give .time ~for~evelopers to work out design plans for egress and ingress from U. S. 91.- At the meeting of May 24th, during which time developer~ agreed to participate up to $5[000 for Iconstruction of a parallel service road, the Planning & Zoning Con~u~ssioD ~%animously recommended approval of the pet_uzon. Atty. john'Pruitt was present representing Gary Scott and.Jezfre} Price~ He said the property had 250' frontage on U. S. 91 and was approximatel~ 670' deep.. .There was some discussion about the parallel access road. Since the shopping center would'der-one-roof and not subject to a site development plan the County could not insikt on a service~road~althoughlit was likely the DOT would concern-itself with-it at the time they were asked to approve the curb cut. Mr. Pruitt advised there was 60' between the pavement and R/W line, adequate for such a road,-and that his clients would contribute up to $5;000 for construction of such a road~ based on a range of from $20. %o $40. per ft. and that Wendy's is now negotiating with DOT for such a road based on $40. sq. ft. Atty. Adams advised that the $5,000 cannot be made a cohdition of zoning. Admn. Lewis asked Mr~ Pruitt if he would make the offer of $5~000 to DOT, and Mr. Pruitt said he would- Moved by Com~ McCain to approve the petit.ion.(as ~er Resolution No. 79-61) which was seconded by Com. Chairman MEMORANDUM TO: FROM: Planning and Zoning Commission County Development Coordinator DATE: May 23, 197§ SUBJECT: May 24, 1979, Rezoning Public Hearings (1) SCHACHT _(A-1 to B-3) Existing Land Use: Vacant Future Land Use: General Commercial/Medium Density Residential COMMENTS: The proposed rezoning is slightly nerth of the Port St. Lucie Medical Center. Planning justification for additional commer- cial zoning in this area at the present time appears weak, especially in view of the absence of county policy governing access controls to U. S. 1. In conversations with representatives Of the petitioner, access. controls have been discussed. Only one (1) two-way driveway should be pemitted from U, S. I. In addition, space for an access/service road should be provided parallel to U. S. l, e. g., no improvements within fifty (50) feet of U. S. 1 right of way. The petitioner's representatives appear willing to cooperate with the county in this matter. PLA I III G7_OI tNG COMMISSION MAY 1979 PUBLIC HEARING: Petition of Roy A. and Margaret Schacht, by their agents, Gary B. Scott and Jeffrey W. Price, for a change in zoning c!ass~f~cation from A-1 (agriculture) to B-3 (arterial business) for the property located on the West side of U. S. #is adjacent to Spanish Lakes Riverfront. Speaking for the petitioners was John Pruitt~ Attorney. ~e stated that the problem has been the access entrance from U. S. #t caused by the traffic flow, and that they had been working with DOT on a possible service road as the solution to the problem. DOT wit1 require 60' from the pavement to the property line for location of a service road and there is adequate allowance without moving the building on the property. Because of the time limitations on the contract, they cannot wait for the rezoning to become final~ but there is adequate r/w for the road. They will have to proceed with the building, and would be willing to earmark $5,000.00 for the building of the road. The cost has not been determined, and estimates range from $20 to $40 per foot. There will be only one entrance from U. S. Mr. Scott asked Mr. Ament if there was enough property for the access road, to which Mr. Apment replied that apparently there was. He further stated that Allen Green Enterprises, the developer of Wendy's has also nego- tiated with DOT for a service road, at a cost of $40 per foot assuming there is minimal drainage. There was no opposition to the petition. Motion by Mr. Tiernan and second by Mr. McIver to approve the petition. The Board was polled and the mOL on passed unanimously. The Planning and Zoning Commission will recommend to the Board of County Commissioners approval of the petition. PLANNING AND ZONING COMMISSION APRIL 26~ 1979 PUBLIC HEARING: Petition of Roy A. and Margaret Schacht, tabled from February 22, 1979. John Pruitt, Attorney, appeared and requested an additional 30 day extension, stating that there were some problems with the design plan for ingress and egress to U. S. #!. Motion by Mr. Gorham and second by Mr. Tiernan for continuance to the May 24th hearing. Motion passed by unanimous voice vote. Representing the petitioners was John Bruitt~ an attorney from Stuart. He staged they ~equested the change in zoning to B-3 because they want to use it as a small shopping site and tha~ the area is developing along business lines and this would be compatible with the area. He stated that South of this is a Village Square Shopping Center and a Holiday Inn across the road. Chairman Scott asked if th-ere was anyone present opposed to the petition'; there was not. Chairman Scott then read into the record a letter from Mr. Joel F. Wynne, President of Spanish Lakes in which they requested a denial w%th prejudice of the petition. The Secretary then read the comments of Gary Ament into the record. Mr. Bruitt stated they had no objection to a buffer and they would like time to try to resolve it with the Engineering Department~ or the proper department involved and asked the petition be tabled until this was resolved. Mr. ~cIver moved the petition be tabled and the motion was seconded by Mr. Tiernan. Petition tabled until the 2nd meeting. The Board. was-~ polled-and the.motion passed unanimously. We try to be responsible and reasonable in 'offering our opinions regarding the various zoning applications ad- jacent to Spanish Lakes. The grewth of Spanish Lakes is a very major reason for the commercial development along U. S. 1. This growth has or~y occurred because of the attractive lifestyle which is being offered. If zoning is granted without properly buffering the adjacent residential areas, it will threaten the quality of life our residents expect. With regard to this application, we feel that it is a very u~reaso~ble request. Ex~ending the B-3 from the normal250' in depth to some 700' would infringe very drastigally in the residential area. No buffer has been provided, and the uses permitted in B-3 would present an extremely serious threat to our residents. We theMefore respectfully request a denial with prejudice of this application.
