ATTEST BOARD OF COUNTY COMMISSIONERS ST~ LUCIE COUNTY, FLORIDA lrman BOARD OF COUNTY COMMISSIONERS SEPTEMBER 2S, 1979 ZONING - FARM BUREAU - PUBLIC HEARING CONTINUED Petition of St. Lucie County Farm Bureau for a change in zoning from R-lC (residence, single family) to B-3 (arterial business) for property located directly behind 3327 Orange Ave. This petition was heard Aug. 28th and continued until today to determine if Farm Bureay could accept a lesser zoning catagory. Mr- John Weathers and others from the Farm Bureau, including Jim RUssak~, A1 Brown, & Bill Stark., appeared to request B-3 for the piece of propertY they wished to purchase to the south of their present location so they can expand facilities and build an office building. Also they sell pro- duce to theist members from time to time. Atty. Rupert Smith was pres'en't representing Mr. Miles Barry who is objecting to any change of the 'R-t classification on the basis that it would change the character of the neighborhood. It was stated that Mr. Barry bought the property because it was zoned residential and has spent a lot of money on improvements.. There was considerable-discussion discussion as to how to resolve the problem of allowing the Farm Bureau to expand as it wished without Permitting ~ B-3 catagory in a residential area. Com. McCain moved to approve the rezoning to B-1 but the motion died for a lack of a second, and besides Zoning Director Thomas advised that a B-1 classificati_on ~'ould not cover an office building. Atty. Adams stated that in his opinion a P-1 catagory would satisfy the needs of the Farm Bureau for its office facilities and that they could use their other section of B-3 for retailing farm products. Com. Park moved to table the petition until after the public hearing with %he Planning & Zoning Commission who are now working on upgrading~the Zoning Resolution in which case the correct catagory may be established, but motion died for a lack of a second. Jim Russakis expressed fear of losing the property if purchase was furthe~ delayed and said the Farm Bureau would request permission to amend their petition to P-1 which they felt would be satisfactory. by Res. 79- Com. Enns moved to amend the petition to P-1 and approve it, which was seconded by Com. Price. Com. McCain spoke against this saying that the limited depth of B-3 along Orange Ave. was unrealistic Cas-200~ of 5usiness is unrealistic on U.S. 91) and that eventually there would be B--3 expansion in this area S. of Orange Ave Com. Pa~k also spoke against the motion saying he didn't think the County should be put in a position of negotiating between the petitioner and neighbor hood residents, but Com. Enns said that although he agreed there would be business in this ar~ eventually, this zoning shouldn't come all at once, but evolve slowly as property owners sell and move away. John Weathers, President, Farm Bureau stated they plan to purchase thei rea~ adjoining lot, if rezoned, to enable them to ad, to' their present building!and increase their parking and were told that B-3 was necessary. Mrs. L. Jones, owner of property on 36 ~ St. feared this would increase the traffic on .36th St. which is used by John Carroll High School to get to Orange Ave., ~and was also concerned as to what types of enterp.rises ~could go into a B-3 classification should the Farm Bureau s~ll t~eir property once' it was rezoned. Com. Park asked why B-3 was needed for an office building and Mr. Thomas explained that according to his interpretation of the zoning regulation, that because this lot was not 40,000 sq. ft. or had 250' of road frontage, the zloni~ had to be contiguous to the front lot. However, Com. Park expressed concern about projecting a finger of B-3 zoning i~to a residential area. Com.. Green suggested reducing the zoning to B-1 or B-2 but Mr. Weathers said he was not sure the Farm Bureau would pay the high. price requested for the property if it had to be limited for parking purposes. M~. Miles Barry said h%a~ived in area for 30 years and didn't want to see B-3 in the neighborhood which would permit bars an~ other objectionable o'ccupations. He also noted that no one knew for sure the plans for the Far~ Bureau. Mr. Thomas suggested a P-1 classification which would accommodate an office building and prohibit the objectionable occuaptions permitted in B-3. Mr. Weathers apologized for not bringing the~%~%ut said he could not say if the Farm Bureau would accept a lesser zoning category but could ask the~ Com. Park moved to continue the Hearing until Sept. 25th which was seconde. by Com. Price, and upon roll call, unanimously carried.
