Dear Mr. Boll:
Enclosed, please find a copy of Resolution #88-198, which
denied your recent request for Conditional Use permit for the
operation of a Group Care Home in an AR -1 (Agricultural
Residential - 1 du/ac) zoning district. If you have any
questions on this Resolution, let my office know.
In regard to your recent request for a refund of the
application fee you filed with your request for a change in
zoning, after reviewing our application submission procedures,
Section 5.3.400(2), St. Lucie County Zoning Ordinance, I find
that I cannot authorize such a refund since this paragraph
clearly states that all application fees ar~ nonrefundable.
Further, I was not aware until very recently that at the time you
lequested withdrawal of this petition, all processing short of
actual appearance of the legal advertisement in the newspaper
had been completed. In ~ffect, consuming this processing fee.
I apologize for any inconvenience that this may cause.
However, the regulations in this matter are quite specific. If
you have any further questions, please let me know.

A RESOLUTION DENYING A PROPOSED
CONDITIONAL USE TO BE KNOWN AS
WILLIAM L. BOLL (GROUP CARE HOME)
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. A Group Care Home has' been proposed for location at
10979 Wetland Way, which pro3ect is to be known as William L.
Boil (Group Care Home).
2. On May 26, 1988, the St. Lucie County Planning and
Zoning Commission held a public hearing on the proposed
conditional use, .after publishing notice in the Fort Pierce News
Tribune and notifying by mail all owners of property within 500
feet of the project at least' 15 days prior to such hearing, and
recommended that the permit be denied.
3. On June 28, 1988, this Board held ~ public hearing on
the proposed conditional use, after publishing notice of such
hearing in the Fort Pierce News Tribune on June 8, 1988, and
after notifying by mail all owners of property within 500 feet of
the property, tabled any further review-~ntil July 5, 1988.
4. On Jul~ 5, 1988, this Board heard further discussion on
this petition and voted to deny this requested conditional, use.

William L. Boll - Request for Refund of Zoning
Application Fee
On March 24, 1988, Mr. William L. Boil, filed an application
for change in zoning from AR-1 to I, for the intended purpose of
operating a congregate living facility. A simultaneous
application for conditional use was filed for this congregate
living facility. On April 18, 1988, Mr. Boll requested that this
conditional use petition be changed to reflect his desire to
operate a Group Care Home instead of the Congregate Care Home,
thus eliminating the need for the change in zoning. Mr. Boll
requested withdrawal of his rezoning application.
In making this request for withdrawal, Mr. Boll requested a
refund of his rezoning application fee since none of the required
public~ hearings or advertising had yet taken place. Would you
please begin the necessary procedures to refund Mr. Boll's
rezoning application fee of $300.

This is to request that changes be made in my applications for the

Since it is my intent to operate a Group Home limited to no more than
twelve residents, I ask that my application for a zoning change from

ADMINISTRATIVE REGULATION
PROCEDURES OF GENERAL APPLICABILITY
Section 5.1.100 Notice
Notice of all public hearings which are required by a
of this Ordinance shall be given as follows, unless
stated' otherwise:

Content of Notice
Every required notice shall include' the date, time, and
place of the hearing; a description of the substance of
the subject matter that will be discussed at the hearing;
a legal description of the properties directly affected
including the street address when available; a statement
of the body conducting the hearing; a brief statement of
what action the body conducting the hearing is authorized
to take; and a statement that the hea~ing may be continued
from time to time as may be necessary.
Publication
Publication of the notice shall be as follows:

Amendments and Applications That Affect Less Than

Official Zoning Atlas that apply to less than five

Amendments That Affect Five (5) Percent or More of

Notice of the first public hearing on an amendment
to the Official Zoning Atlas that applies to five
(5) percent or more of the total land area in the
County's jurisdiction, an amendment to the text
of this Ordinance shall be properly advertised in a

Posting of Notice
ga) The petitioner shall erect and conspicuously place
upon the subject property at least one notice which
shall contain the following information:
(i) Present zoning and requested rezoning classifi-
cation; and
(ii) Dates of scheduled hearings.
The petitioner shall also provide an affidavit
signed by the petitioner and notarized stating that
the notice ~as posted at the initiation of the
· advertising per~od. Failure to maintain a conspic-
uous notice on the property shall not affect any
change or amendment of said Zoning Ordinance.
Section 5.1.200 Hearing Procedures

When the Development Coordinator determines that an appli-
cation for an amendment to the Official Zoning Atlas, an
application for an amendment to the text of this.. Or-
dinance, an application for a Planned Unit Development, an
application for conditional use approval, an aoplication
for a major adjustment to a conditional use, an
application requesting a Class A Bobile Home be defined as
a detached single-family dwelling unit, or an application
for a variance is completed, or that a petition for an
administrative appeal has been filed, he shall notify the
appropriate decision making body so a public hearing may
be set and notice given in accordance with the provisions
of this Ordinance.

EXamination and Co~g of Application and Other Documents
Any time after the provision of notice, as required by
this Ordinance in Section 5.1.100, any person, upon
reasonable request, may examine the application or
petition in question, and the material submitted in
support or opposition to the application or petitio~ in
