WHEREAS, the Board of County Commissioners of St.
County, Florida, has made the following determinations:

1. Howard Beville presented a petition for a change in
zoning from AG (Agricultural) to IL (Industrial Light) for the
property described below.
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearing and 'notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board apprQve the
hereinafter described request for change in zoning classification
from AG (Agricultural) to IL (Industrial Light) for the property
described below.
3. On August 3, 1989, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on JUly 13, 1989, and notifying by mail
all owners of property within 500 feet of the subject property.
4. The proposed zoning change is consistent with the St.
Lucie County Growth Management Policy Plan and has satisfied the
standards of review set out in Section 5.3.300 of the St. Lucie

The purpose of this meeting is to hold public hearings for the

Zoning. Proof of Publication presented - July 13, 1989 and July
27, 1989. County Attorney McIntyre stated that this is the
Adoption Hearing and since the new Comprehensive Plan has not
been adopted at this time, the old rules still apply.

It was moved by Com. Fenn, seconded by Com. Minix, to adopt
Resolution No. 89-228, a resolution changi-ng the Zoning
Classification of certain property in St. Lucie County, Florida;
and, upon roll call, motion carried unanimously.

(Agricultural) to IL (Industrial Light).
On Thursday, August 3, 1989, you will be asked Co review a
petition on behalf of Howard BeVille, for a change in zoning from
AG to IL, for property located at 15150 Orange Avenue (1/4 mile
west of Shinn Road). The indicated intent.of this rezoning would
be to permit the operation of a general equipment sales and
service center.
County staff has reviewed this petition and determined it
not to be consistent with the Future Land Use Maps of the. SC.
Lucie County Growth Management Policy Plan ...... Staf~s~~'
recommendation for denial is based on the incompatibility.of the
proposed rezoning with the existing agricultural uses in the
area, and the continuation possible strip development of Orange
Avenue Extension. As referenced in our earlier comments, we do
not question th~ need for agriculturally related businesses in
this area Of the County, however, we must .question the
appropriateness of authorizing nonagriculturealy related uses
along the entire Orange Avenue corridor.
On Thursday, July 27, 1989, the St. Lucie County Planning
and Zoning Commission held a public hearing on this petition. At
this meeting the Planning and Zoning Commission voted to forward
this petition to the Board of County Commissioners with a
recommendation of approval.
Attached, you will find a copy of Draft Resolution #89-228,
our original staff report, and the minutes of the July 27, 1989,
Planning and Zoning Commission meeting. If you have any questions
on this matter, please let us know.
Consistent with Board Policy, attached you will find a copy
of Draft Resolution #89-228 which would grant approval to this
change in zoning. Staff recommends denial of Draft Resolution
#89-228.

any applicable portions of this Ordinance;

with the intent of the Industrial Light zoning
district.
Whether the proposed amendment is consistent with
all elements of the St. Lucie Growth Management
Policy Plan;
The proposed-amendment is not consistent with the
Industrial Development Policies of the St. Lucie
County GroWth Management Policy Plan. Specific
Policies in conflict are %45, %47, and %48.
Whether and the extent to which the...DropoSed

The proposed amendment is not consistent with the

COMMENTS
The petitioner, HowardR. Beville is proposing to change the
land use and zoning from AG tO-IL,, for the property located at
15150 Orange Avenue, so that a farm equipment maintenance and
display sales shop can be constructed at this site.
County staff has determined this petition to be..'inconsistent
with the Industrial Development Policies of the St. Lucie ~County
Growth Management Policy Plan and the future comprehensive land
use maps.
Although the specific requested use,_ the repair and sale of
farm equipment, appears not to be an unreasonable request for an
agricultural area such as where the property is located, it is
staff's opinion that if approved, the petition could provide the
initiative for the further linear development of Orange Avenue in
July 23, 1989 Petition:

non-agricultural or nonresidential activities. Though staff is
cognizant of the need, and in point of fact, the desirability of
the placement of agricultural service industries in the
agricultural areas of the County we are of the opinion that these
areas of nonagricultural/nonresidential development should be
concentrated around existing uses and not allowed to develop in a
scattered or haphazard fashion. Such an area is located less than
1 mile to the west of this sit~ with the identified eastward
extension of the cluster as being Godwin Road. Furthermore, it
should be noted that the indicated use of this property, the
sale and repair of agricultural equipment, is an authorized use
under the conditional use provisions of the AG district', the
district in which this property is presently located.
Consistent with our recommendation regarding the proposed
Land use designation change, Staff would again recommend that
this Board forward this request for zoning change to the Board of
County Commssioners with a recomemndation for denial.

Petition of Howard Beville, Jr., by Agent: Gerald S. James,
Esquire, for a change in zoning from AG (Agricultural) to IL

Gerald S. James, Esquire, presented the petition. He explained
that Mr. Beville is the owner and operator of Beville Citrus and
Harvesting Company. This business has operated for many years as
a citrus picking and hauling company in St. Lucie County. There
are over 100 units of equipment involved in this business which
involves an area from Lake County to West Palm Beach, and over to
the west coast. The subject property involves 13.5 acres on the
northshinn Road. side of Orange Avenue and is approximately 1/4 mile west of
Mr. James noted that to the west of the sub3ect property there is
a continuity of industrial uses. The next property lying to the
west of Mr. Beville's property is the ABC Citrus Trucking
facility. This business is of the same type as Mr. Beville's and
involved light industrial use of the land. Continuing west on
the north side of Orange Avenue there is OrangeCo., Inc. which is
also in the business of citrus picking and hauling using heavy
equipment. West of OrangeCo., Inc. is the BBC Citrus facility,
and then the Orange Avenue Industrial Park (Ace Hardware,
Johnson Irrigation). On the south side of Orange Avenue is the
Carter Store.
Mr. James also noted that a land plan amendment to Industrial,
Light was presented to this Board in January 1989, at which time
this Board unanimously recommended approval of that amendment to
the Board of County Commissioners.
Mr. James stated that Staff feels the sub3ect property Should
remain residentially classified. However, in light of the fact
that there is a labor camp located on the back side of this
property and due to the intensity of the industrial uses and high
speed truck traffic in this area, the petitioner does not feel
the property is conducive to residential uses.
Regarding Staff comments, Mr. Murphy said Staff's recommendation
regarding the land use plan amendment was for den/al. Staff's
recommendation for the change in zoning is consistent with the
recommendation for the land use plan amendment. Staff feels that
there is already one developed general industrial area along
Orange Avenue, located to the west of the sub3ect proDerty
between 1/8 mile and 1/4 mile. The line of demarcation that has
been chosen to be included in the draft Comprehensive Plan is the
1/ne for Section 7. Staff's concern is where the line should be
drawn for nonresidential development along Orange Avenue. It is
not desirable to encourage linear development of our ma3or
traffic ways unless it is completely unavoidable. Staff feels
that the use of the properties in this corridor for industrial
activities related to agriculture is appropriate because it is
consistent, with the area. There is nothing to prohibit Mr.
Beville from continuing his operation. He could establish an
operation similar to his present operation consistent with the
Conditional Use provisions in the Agricultural zoning district.
However, Industrial, Light uses opens up an entirely different
type of development option that Staff feels is inappropriate for
subjectthis area. petition. For these reasons, Staff recommended denial of the

that if approved, the petition could provide t~e initiative for
the further linear development of Orange Avenue in non-
agricultural or nonresidential activities.', Mr. Carman said he
did not feel residential uses in this area are appropriate
because of other industrial type uses in the area.
Mr. James said beginning with Section 7 and moving easterly for
1/2 mile to Shinn Road, there exists only one residential unit on
the north side of Orange Avenue. This unit is owned by Mr. West,
who has no objection to the subject petition. Considering this,
Mr. James said there would be no adverse impacts to existing
residential uses. The petitioner feels that the line should be
extended easterly to include his property.
Mr. James said Mr. Beville is in the equipment business and needs
the viability to sell equipment. Numerous units of heavy
equipment are constantly being bought, rehabilitated and sold.
Mr. James said if any further development were to be desired, he
assumed other procedures to safeguard the public would be
required.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including Staff comments and the Standards of Review as
set in Section 5.3.300, St. Lucie County Zoning Ordinance, Mr.
Carman made a motion that the St. Lucie County Planning and
Zoning Commission recommend that the Board of County
Commissioners grant approval to the Petition of Howard Beville,
Jr. for a change in zoning from AG (Agricultural) to IL
(Industrial, Light). Mrs. King seconded the motion, and upon
roll call, the Board unanimously voted in favor of the motion.
Chairman Terpening informed the petitioner's agent that the
petition will be forwarded to the Board of County Commissioners
with a recommendation of approval.

PUBLIC HEARING - JIM G. RUSSAKIS - FILE NO. RZ-88-064:
Petition of Jim G. Russakis, by Agent: Edward W. Becht, for a
change in zoning from AR-1 (Agricultural, Residential - 1 du/ac)
to IH (Industrial, Heavy) for property located at the southeast
corner of the intersection of Rock Road and Colbourne Road,
opposite the St. Lucie County Correctional Facility.
Edward Becht, Esquire, presented the petition. He noted that
this Board heard the accompanying land use plan amendment for the
subject property in January 1989. The property presently
contains approximately 40 acres of citrus groves.
Mr. Becht noted that the petitioner did not object when the
County wished to locate the St. Lucie County Correctional
Facility opposite the subject property. The petitioner feels
areathat. Industrial, Heavy uses are consistent with the surrounding
Regarding Staff comments, Mr. Murphy noted this petition
accompanies a large area plan amendment scheduled for review by
the Board of County Commissioners on August 3, 1989. Staff finds
the Petition consistent with the general character of activities
in the subject area. Staff recommended approval of the petition;
however, Staff wished to note an issue that will need to be
addressed as the subject site develops. That issue involves
intersection geometry in the corner of Rock Road and Orange
Avenue. This intersection is presently used by the Sheriff's
Department vehicles. When larger commercial trucks are
introduced to this intersection, it may be necessary to provide
turn lanes and site distance improvements. Although these issues
do not necessarily need to be addressed at this time, Staff
wished to make the Petitioner aware of these issues so that when
site development plans are submitted, this is a critical area to
be maintained.
Referencing a letter received from the McArthur Foundation, Mr.
Murphy said the comments were not necessarily in opposition to or
in support of the petition, but they were concerned about impacts
on adjacent properties. They request that there be a condition
of approval in the zoning change that would ensure the
maintenance of a 100 ft. landscape buffer between their property
(Parcel 1 on the overview) and any industrial activity. In
discussions with the McArthur Foundation, Mr. Murphy informed
this party that this County does not have the ability to
condition a zoning petition in this manner. However, when site
development or construction plans are submitted, Staff can look
to see %hat %o the greatest extent possible County requirements
are met.
Chairman Terpening made the letter from the McArthur Foundation a
part of the record.

Mr. Carman questioned if the petitioner would be expected to
participate in the cost factor of site distance and lane geometry
improvements? Mr. Murphy said these issues are addressed in
greater detail when the actual development plans are submitted.
If, as a result of the petitioner's project, the need is made
apparent, they would be expected to participate.
Mr. Becht said that the McArthur Foundation does not question the
appropriateness of the proposed use. Their concerns are directed
toward buffering between their commercial uses and any heavy
industrial use. He pointed out that any subsequent sale of this
property would more than likely be to someone that will build a
facility larger than 6,000 square feet. This would mean site
plan review which would addressing buffering concerns.
Mr. Terpening noted that the more offensive industrial uses are
required to have a Conditional Use Permit.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public

The petitioner, Howard R. Beville is proposing to change the
land use and zoning from AG to IL, for the property located at
15150 Orange Avenue, so that a farm equipment maintenance and
display sales shop can be constructed at this site. ~
County staff has determined this petition to be inconsistent
with the Industrial Development Policies of the St. Lucie County
Growth Management Policy Plan and the future comprehensive land
use maps.
Although the specific requested use, the repair and sale of
farm equipment, appears not to be an unreasonable request for an
agricultural area such as where the property is located, it is
staff's opinion that if approved, the petition could provide the
initiative for the further linear development of Orange Avenue in

non-agricultural or nonresidential activities. Though staff is
cognizant of the need, and in point of fact, the desirability of
the placement of agricultural service industries in the
agricultural areas of the County we are of the opinion that these
areas of nonagricultural/nonresidential development should be
concentrated around existing uses and not allowed to develop in a
scattered or haphazard fashion. Such an area is located less than
1 mile to the west of this site with the identified eastward
extension of the cluster as being Godwin Road. Furthermore, it
should be noted that the indicated use of this property, the
sale and repair of agricultural equipment, is an authorized use
under the conditional use provisions of the AG district, the
district in which this property is presently located.
Consistent with our recommendation regarding the proposed
Land Use designation change, Staff would again recommend that
this Board forward this request for zoning change to the Board of
County Commssioners with a recomemndation for denial.
