MAKING FINDINGS; PROVIDING FOR MAKING THE NECESSARY
CHANGES ON THE ST. LUCIE COUNTY ZONING ATLAS;
PROVIDING FOR CONFLICTING PROVISIONS AND SEVERABILITY;
PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE AND
DEPARTMENT OF COMMUNITY AFFAIRS AND FOR AN
EFFECTIVE DATE AND ADOPTION'.
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
I. Howard Beville, Jr., presented a petition to amend
the future land use classification set forth in the St. Lucie
County Growth Management Policy Plan from AG (Agricultural) to IL
(Industrial Light) for the property described below.
2. The St. Lucie County Local Planning Agency, after
holding a public hearing on January 26, 1989, of which dUe notice
was published at least seven (7) days prior to said hearing and
all owners of property within five hundred (500') feet were
notified by mail of said hearing, has recommended that the Board
amend the future land use classification set forth in the St.
Lucie County Growth Management Policy Plan froTM AG (Agricultural)
to IL (induS~rial Light) for the property described below.
3. The Board held a public hearing on August 3, 1989,
reference to the date of adoption of this ordinance.
D. CONFLICTING PROVISIONS.
Special acts of the Florida Legislature applicable only
to unincorporated areas of St. Lucie County, County Ordinances and
County Resolutions, or parts thereof, in conflict with this
Ordinance are hereby superseded by this ordinance to the extent of
such conflict.
E. SEVERABILITY.
If any portion of this ordinance is for any reason
held or declared to be unconstitutional, inoperative or void,
such holding shall not effect the remaining porti6ns of this
ordinance. If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property, or
circumstances, such holding shall not effect its applicability to
any other person, property or circumstances.

F. APPLICABILITY OF ORDINANCE.
This ordinance shall be applicable as stated in Paragraph
G. FILING WITH THE DEPARTMENT OF STATE.
The Clerk be and hereby is directed forthwith to send a
certified copy of this ordinance to the Bureau of Laws,

The purpose of this meeting is to hold public hearings for the
following petitions for a Change in Land Use and Change in
Zoning. Proof of Publication presented - July 13, 1989 and July
27, 1989. County Attorney McIntyre stated that this is the
Adoption Hearing and since the new Comprehensive Plan has not
been adopted at this time, the old rules still apply.

Change in Future Land Use
Reference was made to memorandum from Land Development Manager,
addressed to County Administrator/County Commission, dated August
1, 1989, re: "Petition of Howard Beville, Jr., by Agent: Gerald S.
James, Esquire, to amend the Future Land Use Maps of the St.
Lucie County Growth Management Plan from AG (Agricultural) to IL
(Industrial Light)."
Gerald S. James, Esq., was present to request approval of this
petition; Letter in opposition from L. W. Pearce, dated August 2,
1989, was submitted for the record, stating that their realtor
has indicated this change will have a definite negative effect on
the value of the property which is adjacent.
COm. Fenn referred to fetter received from DCA, dated June 12,
1989, stating that their review indicated that the amendments
petitioned by Indrio Grove, Heminway, Noelke, Beville, Russakis,
Maiucci~ and Brown, Beale and Russakis are consistent with the
statutory requirements which were in effect prior to October
1985.
After discussion, it was moved by Com. Trefelner, seconded by
Com. Minix, to adopt Ordinance No. 89-058, an ordinance amending
the St. Lucie County Growth Management Policy Plan, Ordinance No.
86-0i by changing the Land Use Designation of the property
located at 15150 Orange Avenue (more particularly described
herein), from AG (Agricultural) to IL (Industrial Light) making
findings; providing for making the necessary changes on the St.
Lucie County Zoning Atlas; providing for conflicting provisions
and severability; providing for filing with the Department of
State and Department of Community Affairs and for an Effective
Date and Adoption; and, upon roll call, motion carried
unanimously.
After lengthy discussion regarding where the arbitrary line will
ultimately be drawn~ it was the consensus of the Board to direct
staff that, upon receipt of this petition back to the Board for
adoption, the Board's concern be taken into account and the line
be moved accordingly.

On Thursday, August 3, 1989, you will be asked to review a
petition on behalf of Howard Beville, Jr., for a change in land
use from AG to IL, for property located at 15150 Orange Avenue.
The petitioners are seeking this change in land use in order ..to
permit a general equipment sales and leasing operation. .~ii'
-County staff has reviewed this petition and determined it
not to be consistent with the Land Development Policies of the
St~ Lucie County Growth Management Policy Plan.
As required under the provisions of Chapter 163, Florida
Statutes, this petition has been reviewed for general
consistency with state planning requirements and been determined
to be generally compliant with the provisions of law in effect at
the time of adoption of the Growth Management Policy Plan.
On Thursday, January 26, 1989, this petition was presented
at a public hearing held by the St. Lucie County Local Planning
Agency. At that hearing staff recommended that this petition be
denied on the grounds that this.proposed land use change would be
incompatible with surrounding agricultural uses. Following the
review of this petition the Local Planning Agency voted
unanimously to recommend approval of this petition.
Attached, you will find a copy of Draft Ordinance #89-058,

Pursuant to section 163.3184, Florida Statutes, the
Department of .Community Affairs has reviewed the .ten proposed map
amendments to the St. Lucie County Growth Management Policy Plan.
A summary of the proposed amendments is enclosed, as are the
comments by review agencies.
The review indicated that the amendments petitioned by ·' '.'~
Indrio Grove, Heminway, Noelke, Bevilte, Russakis; Maiucc~, ,and..-., .:..
Brown, Beale and Russakis are consistent with the statutory
requirements which were in effect prior to October, 1985.
Regarding the Heminway amendment, please note the enclosed
comments by the Florida Department of Transportation concerning
right-of-way acquisitions along St. Lucie Boulevard. Regarding
the Indrio'Grove amendment, the soils do not appear suitable for
septic systems. Therefore, prior to issuing a building permit or
development order approval, a soil survey should be conducted to
ensure that adequate facilities are available, consistent with
Policy 24 (page 29) "All '
, residential areas should be provided
with adequate levels of public services and facilities."
The amendment petitioned by. Pugliese is inconsistent with
Policy 4 (page 28) which states that, "continuous linear
development along major routes should be restricted." Please
no~e the comments by the Florida Department of Transportation
~oncerning right-of-way acquisition, and the potential traffic
impacts on Midway Road and U.S. 1, both of which are currently
operating at a level of service "F."

The amendment petitioned by Interstate Citrus Partners to
redesignate 141 acres to Interchange is premature. Currently,
there is no interchange, and the extension of St. Lucie Boulevard
to 1-95 is a long-range project which has not been budgeted.
The amendment petitioned by Raven Parc is inconsistent with
Policies 46 and 47 (page 32). Policy 46 states that, "industrial
development should be served by roads of sufficient capacity."
Please note the comments by the Florida Department of Transporta-
tion regarding the potential traffic impacts of the proposed '~ ~
amendment. Policy 47 states that, "New industrial development
should take place, whenever practicable, in planned industrial
parks." Additionally, industrial development is not compatible
with adjacent land uses.
Upon completion of the adoption process, fhe Department
requests a copy of the amended plan and adoption ordinance,
pursuant to section 163.3187(3), Florida Statutes. If you have

To amend the Future Land Use Maps of the St. Lucie County Growth
Management Policy Plan from AG (Agricultural) to IL (Industrial,
Light) .for prQperty located along the north side of Orange
Avenue, approximately 1/4 mile west of Shinn Road. County
staff, s recommendation for this petition is denial; however,
consistent with County Policy, staff recommended that the Board
forward to the Florida Department of Community Affairs this
petition requesting a change in a Land Use from AG to IL,
26,including 1989. all comments presented at the LPA Hearing on January
County Staff's recommendation for denial is based on citing
inconsistencies with both the existing and p~oposed Future Land
Use Maps of the Growth Management Policy Plan. Staff pointed out
in their memorandum to the Local Planning Agency, dated January
18, 1989, that in reviewing this proposed change in Land Use,
they have looked at the long-term uses in the area as they relate
to what can reasonably be expected to serve as a non-residential
area for the Western reaches of St. Lucie County, and that area,
while located close to this property, is approximately still 1/2
mile further to the west. Concern of staff is thaE if we
con%znue to haphazardly change the classifications of properties
up and down the Orange Avenue Corridor, we may simply want to
look at the reclassification of the entire corridor; and instead
of dozng one parcel at a time, do the whole thing.
Com. Fenn asked for clarification of exact l~cation of this
property because zoning has been changed on the north side of
Orange Avenue in that area, near Carter's Grocery and Trowbridge
Road. Staff advised that that was the exact problem that they
faced in review of this petition as to "where do you draw the
Line" and recommended that the Line for non-residential
activities that are centered around Carter's store stop at Godwin
Road, which is close but beyond that line that staff ms
recommending at this time; and, based upon that, staff
recommendation is denial.
Attorney Gerald S. James, representing the petitioner, stated he
wanted the record to clearly show their objections to the denial
and the inconsistent position taken by staff on their petition
vs. a petition for three times the amount of land that they are
recommending in favor of across the street to the south and
approximately 400 feet west of his client's parcel. His client,
Mr. Beville, a long-time citrus man in the County, presently
operates on approximately 14 acres of land (subject of the
petition) and he operates as mos.t fruit harvesting contractors
do, and that is with the agricultural exception to their
business, because they' re citrus-agricultural related activities,
they' re operating on agricultural lands; but then we ask our
question, what are they doing--and in my mind, they' re doing
clearly light-industrial pursuits, so it is actually a misnomer
at the present time as far as a land utilization to say that this
gentleman is growing crops and therefore agricultural lands.
At this point Mr. James reiterated what was said at the LPA
Hearing and after lengthy detail, stated that as far~ as the
findings of staff, we want the record to show: 1) The policies to
which they refer are inconsistent (45, 47, and 48) we feel that
it is hard to justify inconsistencies under those policings Wh'en~
they' re recommending 40 acres across the street'~ ~fo'~ .!ight~
industrial use. Staff in the Russakis parcel says there is a
grea~ demand for light industrial use of land in that area; we
agree with that; we do not agree with staff that in Item 4 of
their review comm~ents they state that the proposed change in land
use may create unnecessary demands on the limited public services
in this area. Well, if our 14 acres could, then I would submit
that there is no unusual demand by the 40 acres across the
street. It's a very inconsistent position, untenable, and I
don't think it can be justified. Our position is that we feel
that this should be transmitted and we want the record to show
that there is a use that is not new to this area; .. I want .the
record further to show that as to Parcel 3, our neighbor Mr.
West, we have agreed to have a buffer zone, and make allowances
for a buffer zone with our neighbors so that he is not opposing
our re-zoning petition. Other than our neighbor, Parcel No. 1,
behind us, I think, is the Orange Co Labor Camp; our land, in my
view, is not and should not be reserved for some mythical
reszdentia! area; this land is not and, in my mind, foreseeab!y
will not be subject matter of protecting a residential
ne!ghborhood; that is not the presenE land use and trend in that
area; so we feel that if staff is fighting to create an imaginary
line, T would submit, looking at the proposed Land Use
Comprehensive Change Map that I have seen, I think they show
Shinn Road which is approximately 1/4 mile east of this property
as being a six-lane road in the future and maybe it should be
1/4 mile east of our property and let Shinn Road with the
dynamics of its movement of traffic be the road; I don't think
considering the uses of our land and the neighboring lands around
it we should try to force a line to be drawn there and say this
property should be prOtected for residential purposes; I think
that's forcing conclusion and creating a rule without a reason.
It was moved by Com. Minix, seconded by Com. Fenn, that this
petition be transmitted to the Florida Department of Community
Affairs for comments; and, upon roll call, motion carried
unanimously.
Discussion concerning this item was as .follows:
Com. Fenn asked again for the proper location of this property
since the memorandum indicated that it was 1./4 mile west of Shinn
Road; and Mr. James stated that it was east of Shinn Ro,ad. Staff
replied that the Property is located 1/4 mile west of Shinn Road.
Mr. James agreed With staff and said that it was located west of
Shinn Road.
Com. Fenn referred to the next petition coming before the Board
which is located in the same general area. On one petition staff
is calling for denial and on the petition coming before the BOard
next, the property is much larger and staff is recommending
appro~a!. Upon questioning, staff replied that the specific
petition referred to is the next one on the agenda. The
properties are close to each other and the next petitioner's
property is larger than this one; but it is not a matter of how
big the property is; it's where the property is located and what
is'around that property in terms of today and what we're looking
at- conceptually on the Future Land Use Map. Staff is proposin~
to draw the line at Godwin Road, approximately 65'0 ft'~' west of
the petition before you today. That's essentially what Staff's
basis is: they're looking to establish a commercial node
centered off the Carter Store Complex and they need to draw the
line somewhere, and that-essentially is the difference of opinion
as to where that line is to be drawn. The issue that has yet to
be resolved is whether to accept staff's recommendation, or some
other point, following public comment.
Mr. James was questioned by the Board about his indication that
his property was about 400 feet east of the next petition's
property; staff memorandum shows 600 feet (which is'-~o-ff the tax
maps). Staff replied, upon questioning about how far away from
Godwin Road this parcel is, and the other parcel to the West of
Godwin, that properties on the map go just a little bit beyond
that and you have the approximate location of Canal No. 56, North
St. Lucie Canal, and, along the banks of that canal there is a
roadway identified by the Tax Map as Godwin Road; if you take the
southwest corner of the petitioned property before you to the
northeast corner of the next petition ther~ is approximately 700
ft; (that is approximately 600 ft. for Parcel 5 and about 100 ft.
of canal right-of-way). That's about the distance that we're
speaking of. Godwin is not a major road, but a local street;
Godwin Road is the eastern boundary line; and Chairman Cuipepper
pointed out that it's the eastern boundary line to the other
parcel that would be considered which is Mr. James' bone of
con~en~ion; then there is ]/4 of a mile to Shinn Road which would
be another 1400 feet and then the question becomes where do you.
want ko draw the line and what is to be done with the entire
Orange Avenue Corridor, because, if you set up essentially a 3/4.
mile long stretch of non-res identi al/non-agri cul tur~l
designation, you are going to be requested to hold the res5 of it
at least between this point and Ft. Pierce into a similar
classification; but if it is the direction of the Board for
staff to consider in the preparation of the Land Use Maps, we can
go that way; but our initial draft is that we not do it that way;
staff is seeking direction from the Board where the arbitrary
comingline should eastward, be drawn as to where this Land Use Category will stop
Com. Fenn pointed out that staff should have given Godwin Road to
the Board as a recommendation that Godwin Road be the Road to'
have the industrial development east or west and that this Board
should make the decision whether or not that's going to be; and
at this point a denial would not be the proper decision.~, to be
made; but in the absence of the decision by this Board, having to
say that this is going to be the roadway for the division, I
think t-hat staff was a little premature in denying this
petition.
Chairman Culpepper requested that this' portion of the discussion
be transcribed in recognition of the fact that there' is some
concern on the part of the Board as to where this' arbitrary. !~ng
will ultimately be drawn; so that the DCA will understand that
there may be confusion and concern by the Boa~d'a§ to'~h~'~e- this'
arbitrary line is drawn and that policy may or may not change.

Amendments to the St. Lucie County Comprehensive Plan
Introduction
Pursuant to the provisions of the Local Government Comprehensive
Planning and Land Development Regulation Act, Chapter 163,
Florida Statutes, the Council must be provided an opportunity to
review and comment on comprehensive plan amendments prior to
their adoption. St. Lucie County has submitted proposed
amendments 'to the State Department of Community Affairs which in
turn is seeking COuncil,s comments. '
Council's review of the information forwarded by the Department
of Community Affairs is in the context of the relationship of the
proposed amendments to the regional policy plan developed
pursuant to Section 186.507, Florida Statutes. If a conflict
with adopted plans or policies is identified, the regional
planning agency is to specify any objections and may make
recommendations for modifications~ Council also provides
informal comments to the local government through a spirit of
cooperation, and technical assistance on matters related to the
proposed amendments. These advisory comments are aimed at
providing coordination between the local and regional
comprehensive plans.

The County analysis suggests that there is a need for
additional land for light industrial uses related to
agriculture in this area, and is proposing designating
an area in the vicinity of these proposed amendments
as appropriate for such use in the future land use
plan.
Although there may be a need for some amount 'of
agriculture related industrial land in the general
area of these proposed amendments, these amendments
should not be aDDroved until the following points can
be addressed:
It should be demonstrated that undevelo ed land
Ss not available to serve this need. These
conversions would displace existinq citrus groves
which would be more difficult to re-establish on
undeveloped land than would the proposed
industrial uses, thus resulting in a negative and
potentially unnecessary impact on citrus
production in St. Lucie County and the Region.
Establishment of new groves is becoming
increasingly burdensome on native lands given the
need to protect wetlands and other sensitive
environments, while at the same time providing
for efficient grove and irrigation system
layouts. This is less a problem for ~industrial
uses since buildings can be clustered and
arranged~to avoid such impacts much more easily.

~evels of service. Given these properties,
location, services may be difficult to provide at
reasonable cost. The development of these sites
may place an undue burden on regional roads since
housing is not available in proximity.to these
sites and workers would have -to drive some
distance to and from work. Development will
effect level of service on Orange Avenue and
could impact Kings Highway as the connection to
the Turnpike and Okeechobee Road (all regional
roadways). Further, provision of water and sewer
service could be a problem given location and
depending on the intensity of proposed
development.

Given the lack of public facilities (sewers, road
improvements, drainage considerations, etc.), this
proposed change appears premature, at best. In the
application materials, the owner suggests that no
plans have been formulated to develop the property.
The proposed amendments may be inconsistent with the
Regional COmprehensive Policy Plan if not adequately
addressed in the evolving County comprehensive plan.
Furthermore, environmental assessments should be
required when long-term agricultural lands are
converted to other uses. The proposed amendments
would be deemed inconsistent if not dealt with in the
County,s new comprehensive plan.
PA-88-019: This proposed change to industrial land
use appears compatible with surrounding uses.
However, on-site facilities are proposed to serve the
development. Industrial development on this
relatively small parcel (4.5 acres) should not be
permitted until a full range of services is available,
especially central sewer and water.
PA-88-020: This proposed amendment involves a land
use change from low density residential to light
industrial along Lennard Road in an unincorporated
enclave in the City of Port St. Lucie. The parcel is
9.3 acres in size. The Port St. Lucie and County
staffs have determined this proposed land use to be
incompatible with surrounding uses which include
residential structures, child care facilities, and a
fraternal lodge. However, the parcel does adjoin
another industrial parcel whose recent redesignation
was also opposed by County and City staff.
There appears to be no established need for an
industrial land use at this location. The Regional
Plan indicates that land use changes are to be based
on need. The Regional Plan further seeks a compatible
mix of land uses, appropriately lOcated. It does not
appear that an industrial use is compatible in this
neighborhood~ despite the adjacent use. A full range
of urban services, also required by the Regional Plan,
is not available. Impacts to the intersection of Port
St. Lucie Boulevard would need to be addressed. Also,
if developed, much of the native pine flatwoods which
exist on site should be preserved, at least the 25
percent called for in the Regional Plan.

PA-88-024: This proposed amendment involves a land
use change from light industrial to commercial general
adjacent to St. Lucie County's airport. The proposed
use is compatible with surrounding land uses and the
site is within the planned future service area of the
Ft. Pierce Utilities Authority. A full range of urban
services should be available concurrent with
development. A traffic study should address impacts
on St. Lucie Boulevard, U.S. 1, and the intersection
of these two regional roadways.
PA-88-025- This proposed amendment is to allow a
change from semi-urban to low density residential. If
the property is developed at a than
two dwelling' units per acre, a fUll range of urban
services should be available concurrent with
development.
PA-88-026:- This proposed amendment involves a land
use change frOm low density
general. A commercial office land use lies to the
west and a shopping center lies to the east of this
parcel. Development on this parcel potential
to have a negative effect on U.S. 1

Based on the information provided, proposed amendments 016, 019,
024, 025, and 026 do not appear to be in conflict or
inconsistent with the policies contained in the Regional
Comprehensive Policy .Plan. Proposed amendments 017, 018, 020,
021, and 023 appear to be in conflict or inconsistent with the
policies contained in the Regional Comprehensive Policy Plano

I thank the members of this council for the opportunity to address
you and bring to you the concerns of the residents and homeowners
of Golden Ponds. We at Golden' Ponds have joined with the residents
of Angle Road and those of the Meadowood Communit-f in- opposinq a
request, before y. ou, for a change in a land-use and zoning within
our area.

To approve any land use change or to rezone to a so called Non-
Residential Developmen~ District would allow an industrial park
to be placed right in- the center of a to~ally residential area.
Our intentions are.. no't~ to hinder the industrial_growth of St.
Lucie County, to the contrary, we oppose such a change for the
health hazard that we. will be subjected to.
The reasons for our objections are as follows:
1. A severe increase in vehicular traffic will pose a hazardous
condition to children in the area and to the senior adults
who must use Angle Road for access to t~heir homes.
2. Excessive noise pollution from the trucks and other traffic
coming and going from this proposed industrial park.
3. Vehicular exhaust pollution will 9ose a serious heal-ch problem
Commissioner Wacha moved to add a cohdition (Condition
17) concerning buses stopping at the mall; alternative
transportation to be considered. The motion was seconded
by Councilmember Davis. Upon being put to a vote, the
motion carried unanimously.
Mayor Dannahower moved staff recommendations as amended
by Council. The motion was seconded by Councilmember
Jochem and carried unanimously.
DOWNTOWN UPTOWN DEVELOPMENT ORDER
Staff reported that at the January 1989 meeting, Council
reviewed ~nd>a~opted the Downtown Uptown Development of
Regional mpact~'report and recommendations recommending
approval Of the project subject to conditions. Staff
indicated that Coun6il now had the responsibility to
review the Development Order to determine whether it
adequately addressed regional concerns identified in the
report and. recommendations. If it does not. adequately
address these concerns, Council ~ay file an appeal with
the Florida Land and Water Adjudicatory Committee; on the
other hand, if it does adequately address these concerns,
an appeal should not be taken. Staff reminded Council
that only Phase I of a much larger project is being
reviewed, which begins the initial step of an intensive
effort to rebuild the City of West~-Palm Beach downtown
area. Staff indicated that the Development Order, for
the most -part, is consistent with Council policy.
However· Development Order Condition 30 does represent a
concern which S~aff outlined. Staff added that language
has been worked o~t that is agreeable to both the City
and Council staffs and indicated--that if the Development
Order is amended prior to Council's review period
terminating, staff would recommend that the appeal not be
taken._ On.~the other hand,, if it is not amended prior to
Council,s review period, termination date, .then staff
would recommend that Council authorize the Executive
Director and Council Attorney to appeal.

ST. LUCIE COUNTY COMPREHENSIVE PLAN ELFMENT AMENDMENTS
Chairman Eggert asked St. Lucie County if the amendments
have been reviewed by the Board of County Commissioners.
Commissioner Minix indicated that St. Lucie County's
policy has been to send the proposals to the Department
of Community Affairs, then have the public-hearing when
they come back to the County--this occurs after Council's

property is industrial, it should be- approved with a
stipulation that development of the piece occur
concurrent with services. Staff 'indicated that the new
St. Lucie County.C°mprehensive Plan which would be coming
up for review in August should take all this into
account, as well as what the costs are going to be.
Commissioner Davis commented that the proposed change
will allow agriculturally based industry to develop at
that location. He reminded. Council that in western Palm
Beach County the sugar mills are in the middle of sugar
plantations becauseof:~the service they provide. He felt
a disservice would be done to agriculture if the
development of packings, and processing plants were moved
out of the grove~.area. ~
Commissioner Fenn.informed Council that police and fire
protection, as Well as waste removal can be prOvided this
area.
Councilman Helm stated that there- is a danger in
converting agricul' acreage to something else since a
heavy residue of and other pesticides may exist in
the soil.
Staff suggested amending the recommendation to state that
the proposed amendments may be ,inconsistent with the
Regional Comprehensive Policy Plan if not ~dequately
addressed in the evolving County. Comprehensive Plan.
Commissioner Minix indicated his agreement.
Mr. Jim G. Russakis, St. Lucie County resident and owner
and operator of Russakis Hedging. and Topping, indicated
that he has been an active citrus grower since 1965; and
added that he was the previous owner of the land being
discussed as Amendment PA-88-017, and is the current part
owner of PA-88-023. Ms. Russakis informed Council that
the first grove (PA-88-017) is approximately 40 to 50
years old and is no longer economical as a grove. He
indicated that light industrial uses are across the
street from the site, and added that this piece of
property will serve three different operations, one of
which is Russakis Hedging and Topping. In reference to
the comments made about timeliness of the development,
Mr. Russakis pointed~ out that his operation, which is
currently located on Glades Cut-off Road, needs to be
moved to alleviate traffic by moving closer to the area
he services. In reference to fire protection, Mr.
Russakis pointed out that there is a fire station on
Shinn Road, which is near the site; in reference to
police protection, law enforcement is up the street at
the correctional institution;- and, in reference to
disposal of waste, one of the major waste haulers is a
neighbor of the site. In regard to Councilman Helm's
concern, Mro Russakis indicated that a test would be made

Duld, Chairman of the GQ~ernmental Relations Committee of
the Golden Ponds Adult community Homeowners' Association,
indicated that in the near .future it is expected that the
owner of the parcel in .Amendment PA-88-021 would be
submitting a rezoning .application. He passed out a
Statement dated-April 21, 1989, protesting the land use
change.
Commissioner Roberts moved to make the Statement part of
the record. The motion was seconded by Commissioner Helm
and carried unanimously (copy attached).
Mr. Duld also passed out a petition containing in excess
of 320 signatures of homeowners of th~ 'G~lden Ponds
community, and another petition from the private owners
along Angle Road and residents of Meadows community,
asking that the proposal to change the zoning be denied.
Motion was made by Commissioner-Roberts and seconded by
Councilmemher Foley to add these petitions along with the
statement to the comments transmitted to the Department
of Community Affairs'. Upon being put to a vote, the
motion carried unanimously.--~
Mr. Daryl C~umm, speaking for the land owners of Johnston
Road, raise~ some concerns about possible right-of-way
purchasing Droblems. Chairman Eggert asked Mr. Ci~mm to
appear before the County Commission.

planning documents:
Ten proposed amendments to the Future Land Use Element,
St. Lucie County
Council staff will review the documents in accordance with
the requirements of the Local Government Comprehensive
Planning and Land Development Regulation Act, Chapter 163,
Florida Statutes. It is anticipated that the report and
recommended comments will be presented to Council at its
meeting on April 21, 1989.
Prior to the Council meeting, the meeting agenda, report,

invited to attend the meeting and will be afforded an

Regarding the Minutes of December 7, 1988, Mr. McCain made a
motion to approve the subject Minutes. Mr. Skidmore seconded the
motion, and upon roll call, the Board voted unanimously in favor
of the motion with the exception of Mrs. Allen who was not
present at the subject meeting.
DECEMBER 8, 1988 LOCAL PLANNING AGENCY SPECIAL MEETING REGARDING
CALLAWAY LAND & CATTLE COMPANY (THE RESERVE) DEVELOPMENT OF
REGIONAL IMPACT - MINUTES APPROVAL:
Regarding the Minutes of December 8, 1988, Mr. Pruitt made a
motion to approve the subject Minutes. Mm. Skidmore seconded the
motion, and upon roll call, the Board voted unanimously in favor
of the motion.
PUBLIC HEARING - HOWARD BEVILLE, JR. - FILE NO. PA-88-017:
Petition of Howard Beville, Jr., by Agent: Gerald S. James,
Esquire, to amend the Future Land Use Maps of the St. Lucie
County Growth Management Policy Plan from AG (Agricultural) to IL
(Industrial, Light) for property located at 15150 Orange Avenue,
approximately I/4 mile west of Shinn Road.
Attorney Gerald S. James presented the petition. He explained
that Mr. Beville owns the sub3ect 13.63 acres and operates a
citrus enterprise on the sub3ect parcel at the present time. In
addition to citrus harvesting activities, Mr. Beville also stores
equipment. Mr. Beville currently maintains approximately 100
fruit trailers and 15+ tractors. Being in the equipment business
in harvesting requires a broad span of equipment that is
constantly being repaired and overhauled. There are times that
he has equipment that he has repaired or overhauled that he would
like to sell. He would also like to become a dealer for new
equipment mostly related %o agricultural enterprises. However,
items such as lightening loaders, hedging and topping equipment
that are agriculturally related are not permitted to be sold by a
dealer in the present AG land use. In the case of a freeze
effecting his citrus harvesting business, Mr. Beville would like
to cover his contengincies by permitting the sub3ect property to
utilize a dealership for maintenance sales and service of new
and used equipment. '
Referring to Parcel 5 on the overview, Mr. James said this prop-
erty is owned by ABC Fruit Company which is in the fruit harvest-
ing and equipment sales business. Orange Co of Fla. is located
to the west of Parcel 5. This business is also similar to that
of Mr. Beville. Carboy Industrial Park is located to the west of
Orange Co of Fla. That industrial park involves Agricutural
Chemical Company and Johnson Irrigation. Carter's Store is lo-
cated near the industrial park, and there are discussions that a
truck fueling facility may be developed at that location. There-
fore, there are industrial uses and/or agricultural uses that are
industrial in nature that are contiguous all the way from the
industrially zoned land to the west, moving continously to abut
Mr. Beville's property.
Mr. James questioned why the sub3ect petition was recommended for
denial by Staff and a similar request for a nearby (and larger)
parcel in Agenda Item No. 6 was recommended for approval. Mr.
James said the sub3ect proposed land use does not infringe upon a
residential community and the subject area is not appropriate for
residential use. He did not feel it appropriate to arbitrarily
draw a line as to where industrial uses may be permitted.
Regarding Staff comments, Mr. Murphy said County Staff has re-
viewed this proposed amendment and has found it not to be within
any defined area of Critical State Concern, that the property

does not qualify as a small area or emergency plan amendment
under Chapter 163.3187, Florida Statutes, and is not proposed for
adoption under a Joint Planning Agreement pursuant to Chapter
163.3171, Florida Statutes. In response to comments and ques-
tions raised by the petitioner's representative, Mr. Murphy re-
ported that some time ago the Board of County Commissioners
established the beginnings of an Agri-Industrial area in the
immediate area of Carter's Store, approximately 3/4 mile west of
the petitioned property. As in any land use matter, a line must
be drawn somewhere. In reviewing the overall area, Staff recom-
mends that the nonresidential-nonagricultural uses in this area
be stopped at Canal 56 (Godwin Road) which is approximately 600
ft. west of the western property line of the sub3ect property.
The property across the street from the subject site is currently
classified for residential, low intensity use. In Staff's
opinion, it does not appear that a logical expansion of indus-
trial use could take place off the Beville tract~to the surround-
ing areas. Therefore, Staff recommended that the Local Planning
Agency forward to the Board of County Commissioners a recommenda-
tion for transmittal to the Department of Community Affairs for
further review, and also forward a recommendation of denial of
the petition.
Mr. James said he had a problem with arbitrary lines that do not
have a rationale. He said a rule has to have a reason, otherwise
it is arbitrary. Considering the surrounding uses stated above,
Mr. James did not see reason to draw the line at Mr. Beville s
property. ,
In response to questioning by Mr. Carman, Mr. James said Carter's
Grocery Store is located approximately 1/8 mile west of the
sub3ect property and on the south side of the road. Regarding
Agenda Item No. 6, Staff comments, Paragraph 4, Staff said "In
recognition of this demand, County Staff has preliminarily desig-
nated a 1./4 mile radius around what is locally known as "Carters
Store" for mixed use development activities on our new future
land use maps. This designation is intended to provide for a
community service cluster to meet the needs of the residents of
the area." Mr. Carman questioned if the sub3ect property is
within 1./4 mile. Mr. Murphy replied that based on tax map
information the sub3ect property appears to be approximately 1/2
mile to the east of Carters Store. Mr. Terpening said the 40
acres on the south side separates Carters Store from the west
line of Lot 5, which is a ( section, or 1300 ft. on Orange
Avenue. Mr. Murphy said the map indicates approximately 440 ft.
of frontage on the sub3ect property, and from Mr. Beville's west
property line to what appears to be a canal is approximately 660
ft. The distance from Canal 56 (Godwin Road) to Trowbridge Road
is 1260 ft. The sub3ect property is approximately 1/2+ mile
away.
Referring to the third paragraph of Staff Comments in Agenda Item

No. 6, Mro Carman said Staff stated, "The Trowbridge Road/Orange
Avenue area .... This area represents a central Port for which
agricultural support industries can be found. However, what
lands that were available for these activities has essentially
been consumed yet there remains additional demands." Mr. Carman
felt that the proposed land use would be helpful in meeting those
additional demands. Mr. Murphy said this is acknowledged in
Staff Comments for Mr. Beville's petition; however, the bottom
line is that a line must be drawn somewhere. Staff recommends
that the nonagricultural-nonresidential uses be contained in a
reasonably compact form, in this case being the section line
between Sections 12 and 7. It is conceivable that the line could
be pulled farther to the east, but in doing so, the door would be
open for similar petitions to occur in that surrounding area.
The question then becomes, "Where do you stop?"
Mr. Carman felt if there is a demand for these activities, the
line should not be drawn that close. He supported the reasoning
behind drawing a line, but felt that when it is this close and
there is a demand, he is in support of satisfying the demand.
Mr. Skidmore felt that Mr. Beville will not be changing his
activities, but is only trying to comply with regulations. He
stated his support of the petition.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public hear-
ing, including Staff Comments, and the Standards of Review as set
in Section 5.3.300, St. Lucie County Zoning Ordinance, Mr.
Skidmore made a motion that the St. Lucie County Local Planning
Agency recommend to the Board of County Commissioners, that the
petition of Howard Beville, Jr. for a change in land use from AG
(Agricultural) to IL (Light Industrial Development), be trans-
mitted to the Florida Department of Community Affairs for further
review and evaluation under the requirements of Chapter 163,
Florida Statutes. Mrs. King seconded the motion, and upon roll
call, the Board unanimously voted in favor of the motion.
Chairman Terpening informed the petitioner and his agent that the
petition will be forwarded to the Board of County Commissioners
with a recommendation of transmittal to the Department of
Community Affairs.
