LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Clifford and Melissa Beckett, presented a petition for a change in zoning from RM-5 (Residential, Multiple Family - 5 du/ac) to I (Institutional) for the property described below. 2. The St. Lucie County Planning and Zoning Commission, held a public hearing on the petition, after publishing notice at leaSt fifteen (15) days prior to the hearing and notifying by mail owners of property within five hundred feet (500') of the subject property, and has recommended that the Board approve the hereinafter described request for change in zoning classification from RM-5 (Residential, Multiple Family - 5 du/ac to (Institutional) for the property described below. 3. COMMISSION REVIEW: NOVEMBER 15, 1988 RESOLUTION NO.: 88-331 FILE NO.: RZ-88-045 AGENDA ITEM: - A MEMORANDUM TO: FROM: DATE: SUBJECT: County Administrator County Commission Planning Administrator November 7, 1988 Petition of Clifford & Melissa Beckett for a Change in Zoning from RM-5 (Residential, Multiple Family - 5 du/ac) to I (Institutional) On Tuesday, November 15, 1988, you will be asked to review a petition on behalf of Clifford and Melissa Beckett for a change in zoning from RM-5 to I to permit the operation of a Pre-School & Child Day Care facility, in an area designated I (Institutional). This petitioned property is located at 9970 Lennard Road, in the southern portions of St. Lucie County. On Thursday, September 22, 1988, the St. Lucie County Planning and Zoning Commission voted unanimously to recommend approval of this petition. County staff has reviewed both the proposed petition and the existing uses of land in the surrounding area. North and South of the petitioned site, there are similar institutional type uses. The proposed use of this property as a Child Care Facility, (see File No.: CU-88-016), is consistent with these adjacent uses. Staff has determined the requested use consistent with the development policies of the St. Lucie County Growth Management Policy Plan. Attached, for your review is a copy of Draft Resolution #88- 331, which would grant approval to this requested change in zoning. Staff recommends approval of Draft Resolution #88-331. During the presentation of this matter to the Planning and Zoning Commission, concern was expressed over the apparent failure of this Department to notify all adjacent property owners of this possible change in zoning. This concern was expressed most eloquently by the residents of the Camelot Gardens Condominimum, located east of the subject property. As pointed out at the Planning Boards meeting, St. Lucie County Zoning November 7, 1988 Page 2 Subject: Beckett - Rezoning File No.: RZ-88-045 Regulations require that all property owners within a distance of 500 feet of the ~operty under petition be notified by mail of the upcoming hearing. Under the direction of Section 5.1.100(4)(a), for proposed amendments effecting less than 5% of the unincorporated County, staff uses the "latest ad valorem tax rolls" to determine who is to receive such written notice. Based upon the comments presented earlier, here appears to have been several new land transactions within this area since the property tax rolls closed and the County's Computer files last updated. Ail adjacent property owners using the most current tax rolls are properly notified as called for in Section 5.1.100(4)(a). Regarding the Minutes of August 25, 1988, Mrs. King made a_motion that the subject minutes be approved, subject to changin~ refer- ence to her as being a life-long Gator to the wife of a Gator. Mrs. Allen seconded the motion, and upon roll call, the Board voted unanimously in Ifavor of the motion with the exception of Mr. Sciturro and Mr. Carman who were not present at the subject meeting. Mr. Murphy scheduled with the Board a workshop meeting on the St. Lucie County Comprehensive Plan on October 19, 1988 at 7:00 P.M. That workshop meeting will cover the following draft elements: Infrastructure, Ingovernmental Coordination and Parks and Recreation. · PUBLIC HEARING - CLIFFORD & MELISSA BECKETT - FILE NO. RZ-88-045: Petition of Clifford and Melissa Beckett for a change in zoning from RM-5 (Residential, Multiple Family - 5 du/ac) to I (Institu- tional) for property located at 9970 Lennard Road. Mrs. Melissa Beckett presented the petition. Regarding surround- ing property uses, she stated that an orange grove is across the street from the subject property, and a plant nursery is located on Parcel 5 on the overview. Also nearby is a Cumberland Farms Convenience Store under construction, an Elks Lodge, Garden Apartments, a day care center, a truss plant, and warehouses. Due to the growth in the area, she felt that a Christian pre- school and extended day care center is needed. In support of the petition, she offered letters from Mr. Harry Lentz (Parcels 1, 2, and 3 on the overview), and Mrs. Gloria Seal (of 1831Lennard Road) stating that they would welcome a day care center in'the area. Chairman Terpening requested the Secretary to read those letters into the record. Mrs. Myra Lowery Brunner, owner of Parcel 6 on the overview, spoke in favor of the petition stating that the growth in the area warrants a day care center. Mr. George Evans, a resident of Camelot Gardens and President of the Camelot Gardens Homeowner's Association, Stated that a major- ity of the 85 members of the association are opposed to the petition. He also stated that several adjacent property owners in Camelot Gardens had not received notification of the meeting. He objected to the hodge-podge of zoning districts and land uses that occur along Lennard Road. He felt there is a lack of co- ordination between the County and the City of Port St. Lucie. In closing, he felt that all current adjacent property owners should be notified of the petition before continuing the hearing of that petition. Tn response to questioning by Chairman Terpening, Ms. Storey indicated tha~ proper procedure has been followed regarding noti- fication of this petition. With a show of hands, Chairman Terpening determined there were 21 people in the audience in opposition to the petition. Chairman Terpening made the following letters in opposition a part of the record: Camelot Gardens Homeowners Association, George J. and Mary Jane Evans, John and Irmgard Zalaznik, Roy E. and Ruth H. Haberland, Patrick G. Anzalone, Herbert H. and Elizabeth Huff, and William W. Johnson. A letter was also re- ceived from Clifford L. and June B. Morse requesting postponement of the petition until all current adjacent property owners have been notified of the petition. Regarding Staff comments Mr Murphy said Staff has determined the petition to be generally consistent with the previous de velopment approvals both in the City of Port St. Lucie and the County along this section of Lennard Road. There are other Institutional-type~.activities to the north and the south of the subject site. The proposed use has been determined generally compatible with those activities. Staff recommended approval of the petition. Mr. Murphy added two letters of opposition to the record which were recently received. Those letters were from Martha York Clements and Mr. and M_rs. Louis Leitkowski. Chairman Terpening said he does not receive letters addressed to him regarding petitions. These letters are received by Staff. Mr. Murphy said those letters are read and reviewed before being passed on to the Chairman to be made part of the record. Unfor- tunately, time does not always permit written response to all letters received. However, an attempt is made to address all comments at the public hearing. Mr. Joe Lowery, owner of Parcel 5 on the overview, reiterated the various uses located on Lennard Road. He said there are only a few of the condominiums in Camelot Gardens that actually face the subject property, and are built within 30 to 40 ft. of the prop- erty line. He said the subject property is presently zoned to permit multiple housing. In response to questioning by Mr. Flowers, Mrs. Beckett said the preschool, day care center would be operated for-profit. In response to questioning by Mrs. Ferrick, Mr. Murphy indicated that the property zoned PUD to the south of the subject property is within the City of Port St. Lucie. In response to questioning by. Mr. Sciturro, Mr. Murphy indicated that the .98 acres involved in the subject petition ends half-way back on Parcel A on the overview, and the subject property does not border Camelot Gardens. In response to questioning by Mr. Skidmore, Mr. Murphy said there is approximately 500+ ft. between the subject property and Camelot Gardens. Hearing no further public comment in favor of or in opposition to the petition, Chairman Terpening closed the public portion of the hearing. Mrs. Fawsett pointed out to those in opposition to the petition that the property line of Camelot Gardens does not abut the subject petitioned property. This was only partially done before zoning. After zoning approval cleaning up stopped. This we feel Will happen again if the Beckett's get approval as they are all one family. The Beckett's now have sheds that are less than 25' from our fence a zoning violation, also their dog is allowed to run free and roams our neighborhood.
