A RESOLUTION CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Clifford and Melissa Beckett, presented a petition for a
change in zoning from RM-5 (Residential, Multiple Family - 5
du/ac) to I (Institutional) for the property described below.
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at
leaSt fifteen (15) days prior to the hearing and notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board approve the
hereinafter described request for change in zoning classification
from RM-5 (Residential, Multiple Family - 5 du/ac to
(Institutional) for the property described below.
3. On November 15, 1988, this Board held a public hearing
on the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on October 21, 1988, and notifying by
mail. all owners of property within 500 feet of the subject
property.
4. The proposed zoning change is consistent with the St.
Lucie County Growth Management Policy Plan and has satisfied the
standards of review set out in Section 5.3.300 of the St. Lucie
County Zoning Ordinance.

WHEREAS, the Board of County Commissioners of St. Lucie

Petition of Clifford & Melissa Beckett for a Change in
Zoning from RM-5 (Residential, Multiple Family - 5
du/ac) to I (Institutional)
On Tuesday, November 15, 1988, you will be asked to review a
petition on behalf of Clifford and Melissa Beckett for a change
in zoning from RM-5 to I to permit the operation of a Pre-School
& Child Day Care facility, in an area designated I
(Institutional). This petitioned property is located at 9970
Lennard Road, in the southern portions of St. Lucie County.
On Thursday, September 22, 1988, the St. Lucie County
Planning and Zoning Commission voted unanimously to recommend
approval of this petition.
County staff has reviewed both the proposed petition and the
existing uses of land in the surrounding area. North and South of
the petitioned site, there are similar institutional type uses.
The proposed use of this property as a Child Care Facility, (see
File No.: CU-88-016), is consistent with these adjacent uses.
Staff has determined the requested use consistent with the
development policies of the St. Lucie County Growth Management
Policy Plan.
Attached, for your review is a copy of Draft Resolution #88-
331, which would grant approval to this requested change in
zoning. Staff recommends approval of Draft Resolution #88-331.
During the presentation of this matter to the Planning and
Zoning Commission, concern was expressed over the apparent
failure of this Department to notify all adjacent property owners
of this possible change in zoning. This concern was expressed
most eloquently by the residents of the Camelot Gardens
Condominimum, located east of the subject property. As pointed
out at the Planning Boards meeting, St. Lucie County Zoning

Regulations require that all property owners within a distance of
500 feet of the ~operty under petition be notified by mail of
the upcoming hearing. Under the direction of Section
5.1.100(4)(a), for proposed amendments effecting less than 5% of
the unincorporated County, staff uses the "latest ad valorem tax
rolls" to determine who is to receive such written notice. Based
upon the comments presented earlier, here appears to have been
several new land transactions within this area since the property
tax rolls closed and the County's Computer files last updated.
Ail adjacent property owners using the most current tax rolls are
properly notified as called for in Section 5.1.100(4)(a). When
of possible errors or omissions, staff takes whatever
action is required.

In reviewing this application for proposed amendment to the
Official Zoning Atlas, the Planning and Zoning Commission shall
consider and make the following determinations:
Whether the proposed amendment is in conflict with
any applicable portions of this Ordinance;
The proposed change in zoning is consistent with
the spirit and intent of the St. Lucie County
Ordinance, Institutional- zoning district
regulations.
Whether the proposed amendment is consistent with
all elements of the St. Lucie County Growth
Management Policy Plan;
The proposed change in zoning is generally
consistent with the St. Lucie County Growth
Management Policy Plan.

Whether and the extent to which the proposed
amendment is inconsistent with existing and
proposed land uses;

COMMENTS
The petitioners, Clif~ford and Melissa Beckett, are proposing
to amend the zoning on this property, to I (Institutional), for
the purpose of operating a pre-school and day care facility.
County staff has reviewed this petition and determined it
to be consistent with the residential character of the area, as
well as the general character of uses along this portion of the
Lennard Road corridor.
At this time, staff would recommend that you forward this
petition to the Board of County Commissioners with a
recommendation of approval. If you have any questions on this
matter, please contact the Current Planning Section of this

INVOCATION: The Invocation was given by Mrs. King.
Regarding the Minutes of August 25, 1988, Mrs. King made a_motion
that the subject minutes be approved, subject to changin~ refer-
ence to her as being a life-long Gator to the wife of a Gator.
Mrs. Allen seconded the motion, and upon roll call, the Board
voted unanimously in Ifavor of the motion with the exception of
Mr. Sciturro and Mr. Carman who were not present at the subject
meeting.
Mr. Murphy scheduled with the Board a workshop meeting on the St.
Lucie County Comprehensive Plan on October 19, 1988 at 7:00 P.M.
That workshop meeting will cover the following draft elements:
Infrastructure, Ingovernmental Coordination and Parks and
Recreation. ·
PUBLIC HEARING - CLIFFORD & MELISSA BECKETT - FILE NO. RZ-88-045:
Petition of Clifford and Melissa Beckett for a change in zoning
from RM-5 (Residential, Multiple Family - 5 du/ac) to I (Institu-
tional) for property located at 9970 Lennard Road.
Mrs. Melissa Beckett presented the petition. Regarding surround-
ing property uses, she stated that an orange grove is across the
street from the subject property, and a plant nursery is located
on Parcel 5 on the overview. Also nearby is a Cumberland Farms
Convenience Store under construction, an Elks Lodge, Garden
Apartments, a day care center, a truss plant, and warehouses.
Due to the growth in the area, she felt that a Christian pre-
school and extended day care center is needed. In support of the
petition, she offered letters from Mr. Harry Lentz (Parcels 1, 2,
and 3 on the overview), and Mrs. Gloria Seal (of 1831Lennard
Road) stating that they would welcome a day care center in'the
area. Chairman Terpening requested the Secretary to read those
letters into the record.
Mrs. Myra Lowery Brunner, owner of Parcel 6 on the overview,
spoke in favor of the petition stating that the growth in the
area warrants a day care center.
Mr. George Evans, a resident of Camelot Gardens and President of
the Camelot Gardens Homeowner's Association, Stated that a major-
ity of the 85 members of the association are opposed to the
petition. He also stated that several adjacent property owners
in Camelot Gardens had not received notification of the meeting.
He objected to the hodge-podge of zoning districts and land uses
that occur along Lennard Road. He felt there is a lack of co-
ordination between the County and the City of Port St. Lucie. In
closing, he felt that all current adjacent property owners should
be notified of the petition before continuing the hearing of that
petition.
Tn response to questioning by Chairman Terpening, Ms. Storey
indicated tha~ proper procedure has been followed regarding noti-
fication of this petition.
With a show of hands, Chairman Terpening determined there were 21
people in the audience in opposition to the petition.
Chairman Terpening made the following letters in opposition a
part of the record: Camelot Gardens Homeowners Association,
George J. and Mary Jane Evans, John and Irmgard Zalaznik, Roy E.
and Ruth H. Haberland, Patrick G. Anzalone, Herbert H. and
Elizabeth Huff, and William W. Johnson. A letter was also re-
ceived from Clifford L. and June B. Morse requesting postponement
of the petition until all current adjacent property owners have
been notified of the petition.
Regarding Staff comments Mr Murphy said Staff has determined
the petition to be generally consistent with the previous de
velopment approvals both in the City of Port St. Lucie and the
County along this section of Lennard Road. There are other
Institutional-type~.activities to the north and the south of the
subject site. The proposed use has been determined generally
compatible with those activities. Staff recommended approval of
the petition.
Mr. Murphy added two letters of opposition to the record which
were recently received. Those letters were from Martha York
Clements and Mr. and M_rs. Louis Leitkowski.
Chairman Terpening said he does not receive letters addressed to
him regarding petitions. These letters are received by Staff.
Mr. Murphy said those letters are read and reviewed before being
passed on to the Chairman to be made part of the record. Unfor-
tunately, time does not always permit written response to all
letters received. However, an attempt is made to address all
comments at the public hearing.
Mr. Joe Lowery, owner of Parcel 5 on the overview, reiterated the
various uses located on Lennard Road. He said there are only a
few of the condominiums in Camelot Gardens that actually face the
subject property, and are built within 30 to 40 ft. of the prop-
erty line. He said the subject property is presently zoned to
permit multiple housing.
In response to questioning by Mr. Flowers, Mrs. Beckett said the
preschool, day care center would be operated for-profit.
In response to questioning by Mrs. Ferrick, Mr. Murphy indicated
that the property zoned PUD to the south of the subject property
is within the City of Port St. Lucie.
In response to questioning by. Mr. Sciturro, Mr. Murphy indicated
that the .98 acres involved in the subject petition ends half-way
back on Parcel A on the overview, and the subject property does
not border Camelot Gardens.
In response to questioning by Mr. Skidmore, Mr. Murphy said there
is approximately 500+ ft. between the subject property and
Camelot Gardens.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
Mrs. Fawsett pointed out to those in opposition to the petition
that the property line of Camelot Gardens does not abut the
subject petitioned property.
In response to questioning by Mrs. Ferrick, Mr. Murphy said--tha't

made a motion that the Planning and Zoning Commission recommend
that the St. Lucie County Board of County Commissioners grant
approval to the petition of Clifford and Melissa Beckett for a
change in zoning from RM-5 (Residential, Multiple Family - 5
du/ac) to I (Institutional). Mrs. Ferrick seconded the motion,
and upon roll call, the Board voted unanimously mn favor of the
motion.
Chairman Terpening informed the petitioners that the petition
will be forwarded to the Board of County Commissioners with a
recommendation of approval.

WHEREAS, the Board of County Commissioners of St. Lucie

2. The St. Lucie County Planning and Zoning Commission,

Re: File No. RZ-8@-045
This letter is in response to the Planning and Zoning an-
nouncement of a proposed zoning change at 9970 Lennard Road
at the request of Clifford and Melissa Beckett. The pro-
perty in question is currently zoned RM 5 and the change is
requested to be I (Institutional).
We are opposed to the requested zoning change. This is the
second zoning change requested in that immediate vicinity
w~thin the past several years. The previous change was t~
Agricultural. With this requested change to Institutional,
we believe that the residential nature of the area is being
destroyed and this has an adverse effect on life style and
property values. Our purchase in this area was at ].east
partly because of its unique rural nature yet still within
the city.
There appears to be no master plan for the use of Lennard
Road and coordination between the city and county zoning
boards ~eems t~ be non-existent. There are at least five
different categories of zoning on that road: residential,
agricultumal, institutional, commercial and industrial.
Further, the road is rapidly becoming overloaded due to its
use as an alternative to US 1. These zoning changes which
will require more automobile traffic further exacerbate the
situation.
For these reasons, we believe that this zoning change should
be denied.

an objection to the proposed zonin§ change on the property
located at 9970 Lennard Road from RM 5 to I (Institutional).
While the petitioners, Clifford and Melissa Beckett, are pro-
posing a Christian preschool and extended day child care program,
it does not limit them to the proposal.
At present we have a conglomeration of commercial, industrial and
agricultural zoning. We do not need institutional zoning added
to'the present confusion. At present we have a day care center,
an elementary school and a Lutheran .Church. Also, a convenience
store and a Cumberland.Farms Store are presently under construc-
tion. Lennard Road is rivaling Route ~1 for daily traffic.
The Beckett property borders on an open pond which, with other
hazards, would make the safety of such young children almost an
impossibility.
We sincerely hope that some one from the Board of County Commis-
sioners will inspect this location before the September 22nd
hearing.

We bought our townhouse at Camelot Gardens on Blossom
Road in Port St. Lucie, with the knowledge that all
abutting properties, with the exception of the Lowry
Nursery on Lennard Road, was and will be RM5 zoning.
We fear that a zoning change for the Beckett propriety
could lead to the same change in the adjoining open
land. Lennard Road already has Commercial,Inaustrial=
and Agricultural zoning,we surely do not need Institutional
zoning on this block to add to the traffic problems.
The private lake on the Becke%t lot could be an added
hazard for a pre-school.
We have one child care center already on Lennard Road.
The Elementary School, two new convienence stores,plus
the new High School under construction,will definitely
overload Lennard Road.
We strongly oppose the proposed zoning change from RM5
to I Institutional for the Beckett property.

use as an alternative to US 1. These zoning changes which
will require more automobile traffic further exacerbate the
situation.
For these reasons, we believe that this zoning change should
be denied.

1. Notification of all interested parties is complete. I have
been provided a copy of the mailing list to which the notice has
been sent and note a number of homeowners missing. I specifically
refer to those people living on SE Round Table Drive. These pro-
perties are the most proximate to the land in question. None of
these homeowners are included in the mailing list. It appears that
your mailing list is incomplete and lags recorded ownership by
about a year.
2. Coordination has been effected between the zoning boards
for the city and county regarding a master plan for the properties
on Lennard Road and that area's future. In sighting the county
maps, the only responsibility that the county has on the east side
of Lennard Road is from Blossom Road south to the property in
question, a distance of some several thousand feet. At present,
there are a minimum of five different zoning designations on
Lennard Road: Agricultural, Residential, Commercial, Institutional
and Industrial. This hodgepodge of categories is the result of
the lack of coordination between the city and county and adversely
affects other properties in the immediate area.
It is believed that this matter cannot be resolved until all
interested parties have had an opportunity to voice an opinion and
the spot zoning practices of the city and county are changed.
