First Bethel Missionary Baptist Church, Inc. presented a
petition for a change in zoning from I (Institutional) to RS-4
(Residential, Single Family, 4 du/ac) for the property
described in Section A below.
On June 25,1993, the St. Lucie County Planning and Zoning
Commission held a public hearing on the petition after
publishing notice of such hearing in the Port St. Lucie News
and notifying by mail all owners of property within 500 feet
of the subject property at least 15 days prior to the hearing.
At that public hearing, the Planning and zoning Commission
recommended that the Board approve the requested change in
zoning from I to RS-4.
On July 27, 1993, this Board held a public hearing on the
petition, after publishing notice of such hearing in the Port
St. Lucie News and notifying by mail all owners of property
within 500 feet of the subject property at least 15 days prior
to the hearing.
The proposed zoning change is consistent with the St. Lucie
County Comprehensive Plan and has satisfied the requirements
of Section 11.06.03 of the St. Lucie County Land Development
Code.
THEREFORE, BE IT RESOLVED by the Board of County Commissioners

Mr. David Kelly presented staff comments. He stated that the
petitioner is requesting a change in zoning of approximately nine
acres on the northeast corner of Juanita Avenue and North 41st
Street, from I (Institutional) to RS-4 (Residential, Single Family,
4 du/ac) in order to construct. 26 homes in a single family home
subdivision. He stated that the surrounding zoning is compatible
with the RS-4 zoning. Water servic~ will be provided by Fort
Pierce Utilities. T~ere will be individual septi~ tanks for sewer
service.

area, some are subsidized by the Federal Government under Section
Eight or other programs. ~
Mr. Middleton stated that these homes will be affordable houses
individually owned by people with low incomes. These will not be
rental properties.
Alecia Dale, Representative for St. Lucie Dream Builders, appeared
before the Commission. She clarified for the Commission that they
will not be low income housing. She stated that these homes will
be sold under an~income cap of $30,000.00~ She stated that they do
not intend to build a "slnm area" and they will be forming a
homeoWners association. She stated that it will be quite~ an
impressive, project...

Mr. Walker stated that builders do not build houses to make slums.
However, people do make slums. He asked what the price of the
houses would be.

maximum income for a family to buy one of these homes is $30,000.00
a year.

concern regarding the utilities in the area.- She stated that if
the utilities stops at 41st Street, what wouldhappen to the rest
of the Harmony Heights Subdivision. ~.
Chairman Klein stated that staff had reported that the developer
would be required to bring city water to the property.
Mr. Charles Henetey, an interested person, appeared before the
Commission. He stated that he was concerned with the t~e of homes
.being constructed. He' stated that he is. in fagot, of affordable

Ms. Bertha' McDonald, an interested person, appeared before the
Commission. She stated that the background of the people buying
the homes would be thoroughly screened, and that she approves of
the petition, and could not understand why the neighbors were
complaining.

opposed to a petition. He told her that he did appreciatet her
opinion on the matter.

respected Ms. McDonald's opinion, but Ms. Hall does not live in the
neighborhood.
Ms. Delores Terry, an adjacent property owner, appeared before the
Commission to speak in opposition to the petition. She stated that
she is concerned with the possibility of added crime to the
neighborhood. She presented the Commission with., a petition
containing 97 signatures from surrounding neighbors in opposition
to the petition.

Chairman Klein then restated Ms. Hall's petition of opposition. He
then explained to her that the property is currently zoned
Institutional, which would allOw community .residential homes,
family day care homes, HRS facilities, institutional residences,
homes, etc. Should the proposed zoning be approved, the petitioner
would have the ability to build just four homes to an acre. He
asked Ms. Hall'if the people that had signed her petition had
understood that the present zoning of Institutional would'allow the
uses he had just mentioned.

Ms. Hall stated that she and her neighbors had not understood the
present zoning. They were concerned with the low income houses.
Chairman Klein stated that he just wanted to make sure those
residents that had signed the petition had understood.the uses that
could be allowed in the present zoning.
Ms. Elisia Dale reappeared before the Commission. She stated that
there seemed to be confusion among the adjacent property'owners on
the quality of the homes they will be building. She stated that
the homeowners buying their homes will be thoroughly screened by
Barnett Bank.
Mr. Bigge asked whether or not there could_be deed restrictions
placed on these-homes that would satisfy..the surrounding neighbors.

To Whom It May Concern:
We the Home and Property Owner(s) on North 41st Street and
Juanita Ave. and adjacent neighborhood, do strongly object to the
.planning of the construction of the low income housing on our
street. We are greatly concerned about the additional traffic
and the increase in crime that this housing development would
create, which is a proven fact, not to mention the decrease in
the value of our property, another proven fact.
It is our understanding that there will be A public hearing on
June 24, 1993. We will be attending said hearing and we will be
strong in our attempt to protest this plan.
We further understand that everyone deserves adequate housing and
that not everyone can afford to own their own home. However, we
also feel that those of us that have purchased homes should not
be penalized and should have the right to protect our property
purchased in good faith.
We implore you. to change your plans in regards to this matter.

We, the undersigned, residents of the area of Juanita Avenue and North 41st Street, Fort Pierce, do
hereby petition the Planning & Zoning Commission to oppose the proposed Zoning change in our
neighborhood from I to RS-4. We sincerely believe that the introduction of twenty-sLx.(26) additional
low-income housing units would undermine our property values and introduce a much higher crime
rate to our neighborhood. Please do not change this zoning due to adverse affects on those who live
here.
